Abstract

This research tries to discuss modern law and its character which is elaborated through a review of Law No. 7 of 2017 on Elections. Through conceptual and statutory approaches, this research tries to examine the concept of modern law based on the benchmarks of ideas put forward by Max Webber, Marc Galenter and Charles Sampford.. The results of this study show that it is quite difficult to categorize the law in Indonesia as a modern law. Nevertheless, this research successfully shows that one of indonesia's legal products, Namely Law No. 7 of 2017 on Elections, has fulfilled elements of modern law. This research is expected to help academics and legal practitioners to be able to dig deeper into the concept of modern law so that it can be applied in law in Indonesia with some adaptation and adjustment.

Abstract

This research aims to analyse corruption law in Indonesia, especially in the form of offense formulation of corruption in the law on the eradication of corruption. This study used mixed legal method, namely descriptive qualitative method and normative juridical method. This research found that corruption in Indonesia still doing as bussiness as usual. Moreover, in the offense formulation of corruption eradication, there are quite several ambiguous and multi-interpretative norms, that can be interpreted widely by the judge. This condition is very horrible and terrible. In connection with the above conclusions, then there are some things that can be suggested by the authors and are expected to be used as material for consideration for parties related to this research, the government should provide clear and certain offense formulation of corruption and the judges may not interpret the formulation of corruption offenses with the aim of reducing or alleviating the punishment of corruptors.

Abstract

The issue of human rights in Indonesia towards the 21st century has shifted from violations committed by the government during the new order to the issue of human rights violations by multinational companies (corporate crime), because of natural resources exploitation is directly proportional to the increase in human rights violations. Many cases of human rights violations by business actors that occur in the form of annexation and seizure of indigenous peoples land that occurs every year. One of the causes of the many cases of human rights violations against indigenous peoples is due to the loosening of permits given by the government to companies wishing to exploit natural resources. Strengthening the Permits principle can be used as a strategic step in reducing the number of violations of poverty that occur to indigenous peoples. Permits used as a means of controlling human behavior which results in rights and obligations born of licenses.

Abstract

Masuknya Komisi Pemberantasan Korupsi (KPK) ke dalam rumpun lembaga eksekutif menyebabkan ambivalensi kelembagaan negara. Independensi dari Komisi Pemberantas Korupsi harus dibenturkan dengan tanggung jawab secara vertikal kepada lembaga eksekutif (Presiden dan Wakil Presiden). Semenjak disahkannya Undang-Undang No.19 Tahun 2019, KPK resmi menjadi bagian dari lembaga eksekutif. Korupsi merupakan tindak pidana yang termasuk ke dalam (extraordinary crime) sehingga sangat dibutuhkan penanganan yang sangat optimal baik secara preventif maupun penanggulangan korupsi secara tepat. Komisi Pemberantasan Korupsi hadir untuk memberantas korupsi, melakukan tindakan-tindakan pencegahan korupsi, dan memonitoring terhadap penyelenggaran aparatur/lembaga di pemerintahan. Dengan demikian, independensi dari KPK sangat dibutuhkan mengingat ruang gerak KPK yang harus flexible dalam fungsi pengawasan penyelenggaran negara. Masuknya KPK ke dalam ranah eksekutif selayaknya akan memperkuat kekuasaan eksekutif dan memudahkan kepentingan politik oligarki pemegang kekuasaan

Abstract

Crimes committed by juveniles today continue to grow, as well as various law enforcement approaches. Juveniles as legal subjects have special attention not only in matters of children’s rights but also in the punishment of children. Various crimes committed by juveniles occur a lot and lead to no longer what is called juvenile delinquency, but a serious crime. The Child Protection Act and the Child Criminal Justice System Law explicitly regulate the protection of children’s rights in the context of human rights. Fostering sanctions for juveniles are one of the ways that are encouraged compared to providing severe criminal sanctions, while here another criminal law is a double-edged sword and ultimum remedium. This paper examines efforts to guide children as an alternative sanction in juvenile criminal law. Studies in this paper include studies of Child Criminal Law, Criminal Law, Human Rights, and the Law on Child Protection.

Abstract

Judicial corruption practices in Indonesia have been going on for long time. Even, according to the Transparency International survey (2007), the judiciary in Indonesia ranks the highest for corruption perception index. Not only that, the mode used by the judicial mafia is also increasingly modern and occurs almost in all aspects of judiciary. This research has two aims, namely: (1) to know and analyze the mode of corruption in the judicial process in Indonesia, and (2) to know and analyze the model of litigation cost control in the judicial process in Indonesia. This research is a juricial-normative research which is using the statute approach and conceptual approach. From this research, it can be seen that, typically, corrupt practices have been initiated since the registration of the case, the establishment of the judges panel, summoning witnesses and experts, negotiating decisions and costs of copy of the decisions. Ironically, many parties are involved in the judicial corruption practices ranging from clerks, officials and employers in the judiciary and the judges themselves. However, the more modern technology can be used as an alternative solution in combating the practices of judicial corruption. One of them, by applying litigation cost control that can be integrated through a whistleblowing system. In this way, the public can monitor in real-time the trial process starting from registration litigation fees, the process of litigation until post-verification, officials and employers in the judiciary and the judges themselves.

Abstract

Penelitian ini mencoba membahas tentang praktik privatisasi di Indonesia dan korelasinya dengan teori negara kesejahteraan. Melalui pendekatan konseptual, penelitian ini mencoba mengkaji secara preskriptif, problematika dalam gejala privatisasi di Indonesia yang seringkali menciptakan pro dan kontra, terutama jika disandingkan dengan teori negara kesejahteraan. Penelitian ini menjadikan gagasan tentang negara kesejahteraan sebagai sebuah tolok ukur dan pisau analisis. Hasil dari penelitian ini menunjukkan bahwa berdasarkan hasil pembahasan, dapat disimpulkan bahwa gejala privatisasi yang terjadi di Indonesia, tidak selaras dan sejalan dengan semangat untuk menciptakan negara kesejahteraan. Masyarakat justru merana, ter-PHK dan terbuang akibat efek privatisasi. Oleh karenanya, privatisasi bukanlah merupakan tuntunan, melainkan tuntutan dari segelintir elit bangsa yang ingin sejahtera, baik secara individu maupun secara kelompok dan golongannya sendiri.

Abstract

Corruption is one of the biggest problems faced by developing countries, including Indonesia. A research conducted by Transparency International in 2016 shows that Indonesia is ranked 90th out of 176 countries in the world. This condition has caused many sectors to be disturbed. The Indonesian Corruption Eradication Commission (better known as KPK), an anti-corruption body officially established by the government, has recently been intervened by many parties. KPK has implemented various ways to eradicate corruption. One of them is through the channel of education by releasing Anti-Corruption Clearing House (ACCH) with the aim to provide anti-corruption education in schools. Unfortunately, ACCH gets less positive response from the public. Hence, this paper will discuss about the introduction of anti-corruption education from an early age through darus with the aim of preparing anti-corruption generation in Indonesia.
