Abstract

A high level of criminality has caused several issues in upholding the criminal code. The issues include things that are related to the effective ways to tackle criminality, criminal cases accumulation, and over-capacity issue. These issues need a proper handle immediately. One of the resolution mechanisms of criminal cases is by using the restorative justice approach, namely penal mediation. This research is to analyze the penal mediation construction in Indonesia and its role as an attempt of criminal case policy as the update of Indonesian criminal law This research conducted a normative juridical analysis of a variety of legislation and crime prevention theories. Penal mediation is an alternative dispute resolution  (ADR) outside the court which commonly applies to civil cases. Unlike the juvenile criminal justice system, the positive criminal law in Indonesia cannot resolve the criminal cases outside the court; nevertheless, certain cases make it possible to have it settled outside the court. Apart from that, as a discrete, Indonesian law enforcement also settles some criminal cases outside the court. For civil cases, the mediation usually in the case relate to finance issue, as for criminal case, it is more on freedom and life of an individual. Mediation for civil cases is usually directly among parties of the dispute, or the second party of interest. As for criminal cases, the parties are more complexs which include the actors, victims, but also the prosecutor and public.

Abstract

Many populations in Indonesia have made various problems that arise one of the problems of unemployment that occur in Indonesia. Many unemployment certainly makes the Indonesian economy decline, of course it becomes the duty of the government in overcoming the decline in the Indonesian economy and the issue of unemployment which is surged annually especially in the year 2020. Indonesian President Joko Widodo has created a pre-work card program which is expected to suppress the unemployment rate in Indonesia. With community pre-work cards can increase productivity and competitiveness of work and improve work competence. The community who participated in the pre-employment card program will be provided with training and incentives during the pre-work card training. But the government itself does not guarantee after joining the pre-employment program, people will get a job or not. Of course again this is a government task to be able to open extensive jobs for the people of Indonesia but this also needs to get support and participation from the people of Indonesia to make this pre-work card a successful program and can suppress the unemployment rate in Indonesia.  Keywords: Pre Work Cards; Unemployment; Effectiveness.

Abstract

Coronavirus Disease 2019 (COVID-19), a virus found in China, has spread worldwide as it has become pandemic. As a result, significant and detrimental impacts are undeniable to global citizens, including those in Indonesia. With the government's suggestions like introducing physical distancing and large-scale social restriction, they slow down economic growth. Also, they impact religious practices, particularly those performed by Muslims in Indonesia. This paper will discuss the impact of the COVID-19 pandemic through the lens of Islamic law. There are two main issues to analyze. First, what is the impact of COVID-19 on community activities in the view of Islamic law? Second, what is the impact of COVID-19 on religious communities in carrying out worship? This paper finds that the COVID-19 pandemic has adversely impacted religious worship activities in public places by considering this virus's rapid transmission. It is followed by the closure of worship places to encourage citizens to practice their religious activities at home. Thus, the whole community was urged, and some were prohibited following the mapping zone experienced by each region. Given Islamic law is believed and trusted by Muslims, in the end, the government has issued a new normal policy by opening places of worship with health protocols. Abstract

Introduction to The Problem: The rapid flow of globalization has brought indigenous peoples to prolonged horizontal and vertical conflicts. The majority of conflicts triggered by who has the right to own the land and functionalize it. The land that belongs to indigenous peoples and it inherited from generation to generation, suddenly taken by investors and it even supported by the government. The indigenous people are often victimized and forced out from their customary lands. They who try to claim the rights sometimes experience obstacles because of the stronger and dominant government position in the court. One of these conflicts occurred in the Dayak community in Central Borneo Province.Purpose/Objective Study: This study aims to determine the problems experienced by indigenous peoples in Central Borneo Province, as well as to find out the mechanism for establishing a legal protection system in order to provide recognition and strengthening ownership of customary land in the Central Borneo Province.Design/Methodology/Approach: This study uses normative research methods, with statute approaches and conceptual approaches.Findings: there are serious problems experienced by indigenous people in Central Borneo Province, related to customary land in their territory. However, there are legal safeguards that can be carried out through formal and administrative land recognition.

Abstract

This research aims to discuss ASEAN counter-terrorism policy and its impact on human rights protection. The terrorism act of Abu Sayyaf in the Philippines, the spread of terrorism in Indonesia by JAT and JAD, and the rebellion movement in Pattani-Thailand are the most heard of terrorism cases in Southeast Asian countries. The research focused on the regulatory through comparative approaches. The result found that ASEAN has an agreement known as ASEAN Convention on Counter-Terrorism (ACCT) for combating terrorism. ACCT implementation in national legal regulations of ASEAN members in the midst of the spread of terrorism plays a crucial role in combating terrorism and its impact on human rights protection. However, the effort of eradicating terrorism in Southeast Asian countries is not in line with the principles of peace and regional integrity. The practice of authoritarianism and militarism has instead become most prominent as a result of perpetuating militarism-based legal regulations in resolving terrorism. Efforts for combating terrorism in Southeast Asia, therefore, leave a serious problem regarding the protection of human rights, the issue of impunity, attacks on civil society, and the involvement of the military which threatens territorial integrity. Those are at cross purposes with ACCT policies as well as national sovereignty, integrity, and security of ASEAN members. (Penelitian ini bertujuan membahas kebijakan anti-terorisme ASEAN dan dampaknya terhadap perlindungan hak asasi manusia. Aksi terorisme Abu Sayyaf di Filipina, penyebaran terorisme di Indonesia oleh JAT dan JAD, serta pemberontakan di Pattani-Thailand adalah kasus-kasus terorisme terpopuler yang terjadi di Asia Tenggara. Penelitian ini fokus pada peraturan perundang-undangan dengan pendekatan komparatif. Hasilnya menunjukkan bahwa ASEAN memiliki kesepakatan yang disebut Konvensi ASEAN tentang Kontra-Terorisme (ACCT) untuk memerangi terorisme. Penerapan ACCT dalam peraturan hukum nasional negara anggota ASEAN di tengah maraknya aksi terorisme sangat penting dalam upaya pemberantasan terorisme dan dampaknya terhadap perlindungan hak asasi manusia di ASEAN. Akan tetapi dalam praktiknya, pemberantasan terorisme di ASEAN masih belum sejalan dengan prinsip perdamaian dan keutuhan kawasan. Praktik otoritarianisme dan militerisme justru menjadi praktik paling menonjol yang dilakukan oleh negara-negara di ASEAN seiring dengan langgengnya regulasi hukum berbasis praktik militerisme dalam menyelesaikan kejahatan terorisme. Pemberantasan terorisme di Asia Tenggara menyisakan masalah serius terkait perlindungan hak asasi manusia, isu impunitas, serangan terhadap masyarakat sipil, dan keterlibatan militer yang mengancam integritas teritorial. Isu-isu tersebut bertentangan dengan Kebijakan ACCT serta kedaulatan, integritas nasional, dan keamanan anggota ASEAN.)

Abstract

This study attempted to discuss the interpretation of open legal policy by constitutional judges in terms of reviewing legislation related to the legal norms of parliamentary thresholds. Through conceptual and statutory approaches, this study tries to examine the ways or models of interpretation conducted by constitutional judges. This research uses Aharon Barak's thinking on the concept of legal interpretation a benchmark and an analytical tool. The results of this study show that the interpretation conducted by the constitutional judge relating to a norm that is considered an open legal policy is appropriate. This research is expected to help academics and legal practitioners, especially with regard to election law to be able to dig deeper into models of legal interpretation, not only based on the idea of Aharon Barak but also by other thinkers or experts.

Abstract

Since the Coronavirus Disease 2019 (Covid-19) pandemic in Indonesia, which continues to grow and has an impact, not a few companies have gone bankrupt. Whether it's a small company, a medium-sized company or even a large corporation are affected by the Coronavirus Disease 2019 (Covid-19). This paper aims to find legal issues on labor right during Covid-19 pandemic in Indonesia. Using the normative legal research, this paper analyzess some of regulation and legal government act to protect labor right who terminated (Pemutusan Hubungan Kerja/PHK) during Covid-19 pandemic. In the end, this paper finds that the government issued two program to solve PHK and protect labor rights, namely Pre-Works Card and Cash Incentive Program (Bantuan Langsung Tunai/BLT). It actively helps employee to create a new job and continue their daily life.

Abstract

Two large digital platform companies, Gojek and Tokopedia, officially merged to form a holding company called the GoTo Group that is considered to have anti-competitive behavior and potentially data monopoly. This article aimed to analyze the adequate response to potential violations of the Prohibition of Monopolistic Practices and Unfair Business Competition Regulation and legal issues related to consumer data monopoly issues. This article uses normative legal research with the conceptual research and statute approach. The result shows that it is necessary to define “relevant markets” and the “substituted products” to determine the existence of unfair business competition in the Gojek-Tokopedia merger. It requires analyzing the consumer behavior in other marketplaces other than Tokopedia; when consumers do not "run" to Gojek, it means they are not in the same market. To prevent privacy protection failures in post-merger data integration, companies need to assess data sharing that may be carried out as part of a risk assessment. Artikel ini bertujuan untuk menganalisis respon yang memadai terhadap potensi pelanggaran Peraturan Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat serta masalah hukum terkait masalah monopoli data konsumen. Artikel ini menggunakan penelitian hukum normatif dengan pendekatan penelitian konseptual dan undang-undang. Hasil penelitian menunjukkan perlunya mendefinisikan “pasar relevan” dan “produk substitusi” untuk mengetahui adanya persaingan usaha tidak sehat dalam merger Gojek-Tokopedia. Hal ini membutuhkan analisis perilaku konsumen di pasar lain selain Tokopedia; ketika konsumen tidak “lari” ke Gojek, berarti mereka tidak berada di pasar yang sama. Untuk mencegah kegagalan perlindungan privasi dalam integrasi data pasca-merger, perusahaan perlu menilai pembagian data yang mungkin dilakukan sebagai bagian dari penilaian risiko. Данная статья направлена на анализ адекватного реагирования на возможные нарушения Положения о запрещении монополистической практики и недобросовестной конкуренции, а также на правовые вопросы, связанные с проблемой монополии на данные потребителей. В данной статье используется нормативно-правовое исследование с концептуальным и правовым исследовательским подходом. Результаты исследования указывают на необходимость определить «соответствующие рынки» и «продукты-заменители», чтобы определить наличие недобросовестной деловой конкуренции в слиянии Gojek-Tokopedia. Это требует анализа поведения потребителей на рынках, отличных от Tokopedia; когда потребители не «бегут» в Gojek, это означает, что они не находятся на одинаковом рынке. Чтобы предотвратить сбои в защите конфиденциальности при интеграции данных после слияния, компаниям необходимо оценить возможное совместное использование данных в рамках оценки рисков. Abstract

The existence of indigenous peoples that are guaranteed directly in the constitution of the State of Indonesia. This research aims to analyze the value of culture and local wisdom, by the traditional and indigenous people, namely Tengger tribe. The type of legal research conducted is juridical empirical. The research will examine between the rule of law and the environment in which the law applies. This research found that Cultural values and local wisdom are one of the foundations of the existence of indigenous peoples. Because, through these values, indigenous peoples do all forms of law that they believe in and the system of life that has been agreed together to realize a regularity in the lives of indigenous peoples, especially indigenous peoples Tengger tribe.

Abstract

This research tries to discuss the characteristics of modern law contained in Law No. 7 of 2017 on Elections. Through conceptual and legal approaches, this research tries to examine the concept of the relationship between the character of modern law and one of the legal products in Indonesia, namely Law No. 7 of 2017 on Elections. This research made Marc Galanter's thinking on the concept of modern law a benchmark and an analytical knife. The results of this study suggest that theoretically the product of regulation regarding election law in Law No. 7 of 2017 on Elections can be referred to as modern law. This research is expected to help academics and practitioners of election law to be able to dig deeper into the characteristics of modern law, not only based on the ideas of Marc Galanter but also by other thinkers or experts.Keywords: Character; Law, Modern; Election
