Abstract

Covid-19 atau Coronavirus Disease 2019 merupakan penyakit yang mudah menular dengan cepat dan luas. Penyebaran Covid-19 menimbulkan banyak dampak dari berbagai aspek kehidupan. Seperti aspek kesehatan, ekonomi, pendidikan dan sosial. Setiap negara memiliki peran yang sangat penting dalam penanganan pandemi global ini sehingga negara memiliki kewajiban pemenuhan hak asasi untuk warga negaranya dalam beragam aspek kehidupan. Penelitian ini bertujuan untuk mengkaji aspek tanggungjawab negara terhadap perlindungan dan jaminan HAM selama pandemi Covid-19. Penelitian ini akan memberikan pedoman bagi para stakeholders untuk memenuhi hak asasi warga negara selama pandemi Covid-19. Metode penelitian yuridis normatif digunakan dalam penelitian ini dengan melakukan telaah bersumber pada studi kepustakaan. Hasil yang ditemukan dalam penelitian ini menunjukkan bahwa Pemerintah telah berupaya menjamin terpenuhinya hak-hak dasar warga selama pandemi Covid-19, terutama dalam sektor kesehatan, ekonomi dan pendidikan. Namun, Pemerintah perlu untuk memenuhi hak-hak dasar yang lain, misalnya dalam sektor spiritual, sosial maupun budaya.

Abstract

Globalization has had a very significant impact on the pattern of human interaction. Migration from the citizen into the netizen era, slowly but surely will happen soon. Changes in this pattern of interaction is actually followed by changes in terms and systems that apply, for example in concern with the cyber law. Legal problems that did not happen in the real world, could happen in the virtual world. One form of problems that arise includes related disputes to domain ownership, concept of domain name law and the relationship between the concept of the trademark with the domain name. Legal products made by the government have not been thoroughly in providing legal protection for such domain name cases. So the authors feel the need to convey some legal analysis related to the connection between the concepts of trademark law with the law of domain names in Indonesia.

Abstract

It is argued that Indonesia has three main institutional functions, inter alia, executive, legislative, and judiciary. They are interlinked as constitutional organs due to their respective positions and functions. In this context, the inter-state institutions have a supervisory body that controls other institutions due to checks balances. As a result, it can lead to disputes among them, usually related to constitutional authority discourse. This paper analyzed the differences in implementing the existing laws governing an institutional power and function that encouraged disputes by taking the Newmont divestment case as an example. This paper's method was juridical research, with statutory, case, and conceptual approaches. The paper showed that state institutions inter alia, the President, the House of Representatives, and the Financial Audit Agency, shared the same authority to resolve the Newmont divestment case. The complexity of this case involved many parties, which dealt with the contention of the purchase of 7% shares of Newmont Nusa Tenggara Company. Consequently, this case was resolved and decided in the Constitutional Court with disputes over state institutions' authorities. This paper recommended a further elaboration on the limits and meanings of state institutions. KEYWORDS: Constitutional Disputes, State Institutions, Newmont Divestment.

Abstract

The article aims at discussing the application of parliamentary threshold legal norms in an integrative legal perspective. Through historical, conceptual and statutory approaches, this study tries to examine holistically and prescriptively the dynamics of applying parliamentary thresholds in legislative elections. This article makes the thinking of leaders on integrative law a benchmark and an analytical knife. The results of this study demostrates that the application of parliamentary thresholds in elections based on an integrative legal perspective is not appropriate because it has not been able to guarantee the fulfillment of a sense of justice for all Indonesians because integrative law views a legal event as a comprehensive state of pros and cons. This research is expected to help academics and legal practitioners, especially with regard to election law to be able to dig out deeper into integrative law, not only from one or two experts, but from several other experts.

Abstract

ABSTRAKIndonesia telah menyelenggarakan 11 kali pemilihan umum (pemilu) sejak tahun 1955. Hingga saat ini, rezim hukum pemilu telah melahirkan banyak regulasi dan ketentuan baru, seperti aturan tentang threshold atau ambang batas. Putusan Mahkamah Konstitusi Nomor 52/PUU-X/2012 menyatakan bahwa Pasal 208 Undang-Undang Nomor 8 Tahun 2012 tentang Pemilu Legislatif terkait dengan ambang batas parlemen (parliamentary threshold) sebesar 3,5% tidak berlaku secara nasional. Melengkapi putusan tersebut, Mahkamah Konstitusi melalui Putusan Nomor 14/PUU-XI/2013 menyebutkan bahwa pemilu tahun 2019 berlaku secara serentak, yang secara yuridis berdampak pada pola penerapan threshold. Rumusan masalah yang akan diurai dalam penelitian ini adalah bagaimana akibat hukum regulasi tentang threshold dalam pemilihan umum legislatif dan pemilihan presiden pasca Putusan Mahkamah Konstitusi Nomor 52/PUU-X/2012 dan Nomor 14/PUU-XI/2013. Metode yang digunakan dalam penelitian ini adalah metode penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa dalam konteks negara demokrasi, ambang batas atau threshold diterapkan sebagai batas untuk menyaring kandidat anggota legislatif ataupun presiden yang bersifat open legal policy dan diserahkan kepada pembuat undang-undang.Kata kunci: pemilihan umum legislatif, pemilihan presiden, ambang batas. ABSTRACTIndonesia has held 11 general elections since 1955. Up to now, the regime of general electoral law has given birth to many new regulations and provisions, such as regulations on threshold. The Constitutional Court Decision Number 52/PUU-X/2012 states that Article 208 of Law Number 8 of 2012 concerning the Legislative Election with a parliamentary threshold of 3.5% does not apply on a national scale. Complementing the ruling, the Constitutional Court through Decision Number 14/PUU-XI/2013 states the 2019 general election applies simultaneously that it may bring juridical effect on the pattern of threshold application. The formulation of the problem to be explained in this analysis is how the legal impact of the regulation on threshold in legislative and presidential elections after the issuance of Constitutional Court Decision Number 52/PUU-X/2012 and Number 14/PUU-XI/2013. This analysis uses a normative juridical research method. The results of the study show that in the context of a democratic country, the threshold is applied as a limit to filter out presidential candidates or legislative members, which is open legal policy and submitted to lawmakers. Keywords: legislative election, presidential election, threshold.

Abstract

Masuknya Komisi Pemberantasan Korupsi (KPK) ke dalam rumpun lembaga eksekutif menyebabkan ambivalensi kelembagaan negara. Independensi dari Komisi Pemberantas Korupsi harus dibenturkan dengan tanggung jawab secara vertikal kepada lembaga eksekutif (Presiden dan Wakil Presiden). Semenjak disahkannya Undang-Undang No.19 Tahun 2019, KPK resmi menjadi bagian dari lembaga eksekutif. Korupsi merupakan tindak pidana yang termasuk ke dalam (extraordinary crime) sehingga sangat dibutuhkan penanganan yang sangat optimal baik secara preventif maupun penanggulangan korupsi secara tepat. Komisi Pemberantasan Korupsi hadir untuk memberantas korupsi, melakukan tindakan-tindakan pencegahan korupsi, dan memonitoring terhadap penyelenggaran aparatur/lembaga di pemerintahan. Dengan demikian, independensi dari KPK sangat dibutuhkan mengingat ruang gerak KPK yang harus flexible dalam fungsi pengawasan penyelenggaran negara. Masuknya KPK ke dalam ranah eksekutif selayaknya akan memperkuat kekuasaan eksekutif dan memudahkan kepentingan politik oligarki pemegang kekuasaan

Abstract

Penelitian ini mencoba membahas tentang praktik privatisasi di Indonesia dan korelasinya dengan teori negara kesejahteraan. Melalui pendekatan konseptual, penelitian ini mencoba mengkaji secara preskriptif, problematika dalam gejala privatisasi di Indonesia yang seringkali menciptakan pro dan kontra, terutama jika disandingkan dengan teori negara kesejahteraan. Penelitian ini menjadikan gagasan tentang negara kesejahteraan sebagai sebuah tolok ukur dan pisau analisis. Hasil dari penelitian ini menunjukkan bahwa berdasarkan hasil pembahasan, dapat disimpulkan bahwa gejala privatisasi yang terjadi di Indonesia, tidak selaras dan sejalan dengan semangat untuk menciptakan negara kesejahteraan. Masyarakat justru merana, ter-PHK dan terbuang akibat efek privatisasi. Oleh karenanya, privatisasi bukanlah merupakan tuntunan, melainkan tuntutan dari segelintir elit bangsa yang ingin sejahtera, baik secara individu maupun secara kelompok dan golongannya sendiri.

Abstract

This research tries to discuss the relationship of economic factors in the establishment of a legal norm. Through conceptual and statutory approaches, this study tries to examine the concept of the relationship between economics and the law initiated by Richard A. Posner. This research makes the establishment of the norm on the size of the parliamentary threshold in the implementation of legislative elections as a benchmark for the relationship between the economy and the law. The results of this study show that changes in the size of the parliamentary threshold can be understood as an open legal policy agreed upon by lawmakers. The existence of rules on open legal policy makes economic and legal relations in determining the norms of parliamentary threshold size become real. This research is expected to help academics and legal practitioners to dig deeper into the relationship between economics and law, so as to understand the advantages and disadvantages that may result from such relationships.

Abstract

Coronavirus Disease of 2019 (COVID-19) with the official name of SARS-CoV-2 has been a serious emerging alert for countries around the world, which makes it a global outbreak of respiratory illness caused by a novel (new) coronavirus. Some countries did a remarkable job on flatten their COVID-19 case rate curve, the finest world reputation in handling this pandemic is given to the Republic of Korea or more known as South Korea which has amazed other world leaders wondering how Moon Jae-in, current President of South Korea, has successfully implied effective and accurate strategies in handling this world outbreak in South Korea. Asides from South Korea succeed, there are some countries who are fall way behind such as the Republic of Indonesia who is currently concerning not only in the medical sector, but the emerging economic sector is severely impacted which leaves us a solicitous feeling towards the future of our nation. In this case, a comparative study is needed to reflect on what has not yet done right. This paper discusses what sort of precise policy reconstructions should be adapted by the Indonesian government from the South Korean government’s effective strategy accuracy in handling COVID-19.

Abstract

In a juridical-formal, firmly determined, that each agreement requires the agreement of the parties. However, the implementation of normative tools is not as easy as the textual sounds. Through a juridical approach, writing with the theme "Agree to the Agreement and its Relevance as a Prevention of Default", raised two interesting problems. First, how is the relevance of the agreement in the agreement as an effort to prevent default; Second, what is the ideal format for agreement in an agreement. The findings in this study confirm, that: First, the agreement is the key word in ensuring the implementation and fulfillment of the promises of the parties to the agreement. Therefore, in agreement in general, the agreement has relevance to prevent defaults. Second, ideally, in every agreement it is necessary to ensure that the parties truly understand what has been agreed both formally and materially (substantially).
