Abstract

The legal system or commonly referred to as the legal tradition, has a wealth of scientific treasures that can be examined in more depth through a holistic and comprehensive comparative process. Exactly, the comparison of the legal system must accommodate at least three legal systems that are widely used by countries in the world today. The three legal systems are the Continental European legal system, Anglo American and Islamic Law. The comparative study of the three types of legal systems found that the history of the Continental European legal system is divided into 6 phases, while Anglo American legal history began in the feudalistic era of England until it developed into America and continues to be studied until now. Meanwhile, the history of Islamic law is divided into 5 phases, starting from the Phase of the Prophet Muhammad to the Resurrection Phase (19th century until nowadays). In addition to history, the authors find that the Continental European legal system has the characteristic of anti-formalism thinking, while the Anglo American legal thinking characteristic tends to be formalism and is based on a relatively primitive mindset. While the thinking character of Islamic Law is much influenced by the thought of the fuqoha (fiqh experts) in determining the law to solve a problem, so relatively dynamic and moderate.

Abstract

Post-reform of the role of judicial institution is run by two institutions namely the Supreme Court and the Constitutional Court. The duties and authorities of the two institutions are regulated in the Constitution of the Republic of Indonesia 1945 and the act that addresses the three institutions more specifically. Several powers possessed by the Supreme Court and the Constitutional Court, one of them is the authority to judicial review. The Constitutional Court is authorized to review the act on the Constitution of the Republic of Indonesia 1945, while the Supreme Court is authorized to review under the Act on the above legislation.The unfairness of the regulatory testing function is feared to trigger bureaucratic inefficiency. Based on data released by the Supreme Court Clerk, it was recorded during 2016 that the Supreme Court received 18,514 cases, including the Hak Uji Materi (HUM) subject to legislation under the Act. While the number of cases of judicial review of the Constitutional Court in 2016-2017 amounted to only 332 cases. Therefore, it is necessary to conduct a bureaucratic reform and provide new ideas related to the model of one court of judicial review in Indonesia. So that in this paper will be discussed deeply about problematic of judicial review in Indonesia and the authority of the Constitutional Court to review the act under one roof with SIJURI mechanism.

Abstract

Terrorism is a form of extraordinary crime that not only leads to lives and material losses, but also creates a continuing fear in society. Backed by the many cases of terrorism with suicide bombing mode, especially in the case of Bali Bombing 1 and 2, then born special datachment 88 (Densus 88) which has the obligation to combat terrorism. Unfortunately, in cracking down on the perpetrators of terror, even those still suspected as terrorist suspects, Densus 88 often uses violence and even shoots off on the spot. The late Siyono was one of the victims of repressive measures carried out by Densus 88. In other cases, Densus 88 is also often proven to mis-arrest after the suspect has lost his life. This condition is certainly contrary to the spirit of democracy and efforts to guarantee human rights protection in Indonesia. This paper discusses: (1) the Standard Operational Procedure of terrorist suspected arrest process by Densus 88 and its comparison with anti terrorism agency in other country; and (2) Guarantees and legal protection in the fulfillment of the rights of suspected terrorists.

Abstract

Criminal is a tool used in tackling criminal acts. The judge as the part who passes the sentence has a very important role in determining the effectiveness of the punishment that will be imposed on the perpetrator of the criminal act . So in this case the judge should be precise in determining which type of crime is appropriate for the perpetrator, considering that the imposition of a sentence against someone who has committed a criminal act is a very important part of realizing the expected criminal justice system. The application of imprisonment for the short term has many weaknesses. The process of prisonisation becomes a means of crime school for prisoners who have the opportunity to increase the number of existing receivers. Thus an alternative punishment is needed that can be a solution to the weaknesses of imprisonment. Conditional punishment is an alternative punishment that can be imposed by a judge against the perpetrator of a criminal act. The limitation in this research is focused on the use of conditional punishment which is expected to be able to fulfill the desired sentencing objectives and become an effort in criminal policy to tackle crime. This study uses a normative juridical research method that will examine conditional criminality in relation to the theory of the purpose of punishment as well as examine crime as an effort to tackle crime based on the theory of criminal policy.

Abstract

In effort to prevent and eradicate corrupt behavior, the community also has rights and obligations, in the sense that the community seeks to prevent and eradicate criminal acts of corruption. One form of community participation in preventing and eradicating corruption is through community organizations (Ormas). Ormas are considered as a forum for people who are engaged in social affairs and those who are neutral and do not have a practical political orientation. This research is a type of legal research using primary data, secondary data and tertiary data. Corrupt mentality of course comes from the motivation to rule on the basis of excessive ambition and precisely indirectly facilitated by the existing political system conditions, I think it is quite simple when someone who wants to get a higher position, the "job mafia" has provided easy access through Such paths of corruption are open and have become common knowledge for the public, therefore the important role of the Regional Leadership of Muhammadiyah City of Batu in the prevention and eradication of criminal acts of corruption is the formation of Muhammadiyah cadres themselves.

Abstract

Produk halal saat ini telah menjadi gaya hidup bagi seluruh masyarakat di dunia, tak terkecuali di Indonesia. Sebagai bagian dari tren dan gaya hidup tersebut, ebberapa UMKM dan home industry mencoba merespon dengan tekun mempelajari regulasi terkait jaminan produk halal. Tak hanya itu saja, para pelaku usaha juga mulai rajin mempelajari alur pengajuan sertifikasi halal oleh LPPOM MUI. Pengabdian ini berusaha menjembatani kebutuhan tersebut. Melalui model pengabdian langsung dengan mode blended learning, tim pengabdi dari Fakultas Hukum Universitas Muhammadiyah Malang memberikan edukasi dan ilmu raktis kepada Mitra, yaitu CV. Caraka Abadi, produsen minuman herbal Cangloh. CV. Caraka Abadi berdomisili di Kota Malang dengan membawahi beberapa merek produk herbal, terutama minuman herbal. Hasil pengabdian menghasilkan dokumen pengajuan sertifikasi halal LPPOM MUI yang sudah disetujui dan tingal menunggu penerbitan serta pemahaman karyawan CV. Caraka Abadi tentang regulasi jaminan produk halal.

Abstract

Parliamentary threshold atau ambang batas parlemen pertama kali diterapkan di Indonesia pada pemilu tahun 2009 sebesar 2,5%. Pada pemilu tahun 2014, ambang batas parlemen berubah menjadi 3,5% serta tidak berlaku secara nasional. Sesuai dengan amanat yang tertuang dalam Putusan MK Nomor 52/PUU-X/2012 maka ambang batas parlemen hanya berlaku untuk menghitung perolehan suara sah parpol di tingkat DPR. Dengan demikian, di tingkat DPRD Provinsi dan DPRD Kabupaten/Kota tidak berlaku ketentuan ambang batas parlemen. Keadaan ini menyebabkan banyaknya parpol yang masuk ke parlemen, sehingga dapat menimbulkan ketidakefektifan kinerja pemerintahan daerah. Oleh karenanya menurut penulis perlu dilakukan reformulasi parliamentary threshold atau ambang batas parlemen yang berkeadilan untuk diterapkan dalam pemilu anggota DPRD Provinsi dan DPRD Kabupaten/Kota. Reformulasi parliamentary threshold yang berkeadilan diterapkan dalam rangka mewujudkan sistem multipartai sederhana dan menciptakan kinerja pemerintahan yang efektif.Kata Kunci: Reformulasi, Parliamentary Threshold, Pemilihan Umum Anggota DPRD Provinsi dan DPRD Kabupaten/Kota, Sistem Multipartai Sederhana

Abstract

Consuming halal and safe food products is a constitutional right of citizens. This right is realized through guarantee of halal products, the institution authorized to issue fatwa halla on a product is LPPOM MUI. The results showed that LPPOM MUI issued a halal certificate for a product after previously going through a trial process at the MUI Fatwa Commission. Although judicially the position of MUI is not a state institution, the presence of the MUI, especially LPPOM MUI, can answer the needs of the community. Halal certificates from LPPOM MUI can at least provide legal certainty for the community. Abroad, halal certification institutions are government or private institutions that have their own statutory regulations and standards.

Abstract

A high level of criminality has caused several issues in upholding the criminal code. The issues include things that are related to the effective ways to tackle criminality, criminal cases accumulation, and over-capacity issue. These issues need a proper handle immediately. One of the resolution mechanisms of criminal cases is by using the restorative justice approach, namely penal mediation. This research is to analyze the penal mediation construction in Indonesia and its role as an attempt of criminal case policy as the update of Indonesian criminal law This research conducted a normative juridical analysis of a variety of legislation and crime prevention theories. Penal mediation is an alternative dispute resolution  (ADR) outside the court which commonly applies to civil cases. Unlike the juvenile criminal justice system, the positive criminal law in Indonesia cannot resolve the criminal cases outside the court; nevertheless, certain cases make it possible to have it settled outside the court. Apart from that, as a discrete, Indonesian law enforcement also settles some criminal cases outside the court. For civil cases, the mediation usually in the case relate to finance issue, as for criminal case, it is more on freedom and life of an individual. Mediation for civil cases is usually directly among parties of the dispute, or the second party of interest. As for criminal cases, the parties are more complexs which include the actors, victims, but also the prosecutor and public.

Abstract

Many populations in Indonesia have made various problems that arise one of the problems of unemployment that occur in Indonesia. Many unemployment certainly makes the Indonesian economy decline, of course it becomes the duty of the government in overcoming the decline in the Indonesian economy and the issue of unemployment which is surged annually especially in the year 2020. Indonesian President Joko Widodo has created a pre-work card program which is expected to suppress the unemployment rate in Indonesia. With community pre-work cards can increase productivity and competitiveness of work and improve work competence. The community who participated in the pre-employment card program will be provided with training and incentives during the pre-work card training. But the government itself does not guarantee after joining the pre-employment program, people will get a job or not. Of course again this is a government task to be able to open extensive jobs for the people of Indonesia but this also needs to get support and participation from the people of Indonesia to make this pre-work card a successful program and can suppress the unemployment rate in Indonesia.  Keywords: Pre Work Cards; Unemployment; Effectiveness.
