Abstract

The Kerinci indigenous people apply a system of land tenure of alternate rice fields that are inherited matrilineally. However, this system faces obstacles in legal certainty, especially related to the transfer of rights and land registration. This study aims to analyze the pattern of control, legal certainty, and dispute resolution mechanism in the system. The method used is empirical juridical with an analytical descriptive approach. The results show that although the rotational rice field system is still in effect, the absence of ownership certificates hinders legal certainty, while dispute resolution still relies on customary institutions. Harmonization of customary law and agrarian law is needed to improve legal protection for the Kerinci indigenous people.

Abstract

Women in Minangkabau culture are the heirs of traditional land, but in its arrangement and management, women are not significantly involved. At the level of implementing land registration, privately owned land has run smoothly, but problems often arise in managing customary land, both community customary land and Nagari customary land. This research aims to analyze women's involvement in managing Nagari traditional land. The research was conducted in Nagari Sungai Kamuyang, Limapuluh Kota Regency, using a qualitative approach. The analytical tool used is Anthony Ginddens' structural theory. The research results show that women's involvement in managing communal land is greater during consensus deliberation events. Women were more involved at the beginning of the activity, but men mostly carried out the implementation. In discussing the agreement to make Nagari Sungai Kamuyang a pilot project, women were invited to occupy the bundo kanduang position there as nagari officials. Women are no longer involved in determining boundaries in the field, and there is polarization in the division of labor between men and women. At the same time, discussions in forums ranged from socialization activities to building an agreement to make Nagari Sungai Kamuyang one of the pilot project locations for customary land management. The women present met and joined in the conversation. When a field assistance team was formed to determine land boundaries and land measurements by BPN, BPN was involved for a longer time.

Abstract

Reducing Emissions from Deforestation and Forest Degradation (REDD+) is a strategy to reduce greenhouse gas emissions from deforestation and forest degradation. Through this scheme, Indonesia is vital in implementing ratified commitments through national legislation. The methodology used in the research employed normative juridical techniques characterized by descriptive research parameters and underwent analysis through comprehensive literature exploration. The results found that Indonesia has supported sustainable development by issuing REDD+ arrangements to realize climate change mitigation. Through the REDD+ scheme, Indonesia is expected to provide answers to global warming problems that occur throughout the world by providing protection, preventing degradation, and providing an increase in the quality of forest cover and carbon stocks.

Abstract

This research discusses the challenges of implementing Free, Prior, and Informed Consent (FPIC) for indigenous peoples in national legal arrangements in Indonesia. FPIC is a principle that gives indigenous peoples the right to give consent to policies that affect their territories and resources freely, prior to full information, and without pressure. Although the FPIC rights of indigenous peoples are implicitly described and regulated in various national regulations, such as the 1945 Constitution, Forestry Law, Village Law, and environmental regulations slot zeus, these arrangements do not necessarily guarantee the protection of indigenous peoples' rights over their customary territories. Explicit legal arrangements are needed to guarantee indigenous peoples' FPIC rights over their customary territories. This is because in its implementation, the application of FPIC rights still faces various challenges such as conflicts of interest with the State's Right to Control (HMN), low understanding in the field, and gender injustice being the main obstacles. This study uses a normative juridical approach to identify differences between international and national legal arrangements, and offers recommendations to improve the protection and implementation of FPIC in Indonesia. The research emphasizes the importance of explicit legal arrangements to achieve justice, prosperity and harmony between indigenous peoples and the government.

Abstract

Land rights are rights giving authority to the right holder to use the and get the benefit from it.the rights holders is limited by the regulation. Those who may obtain property citizens only and legal entities indonesia based on government reg­ulation. Ownership of the land is hereditary right, strongest and fullest that can be held above the land. But often the ownership of the land has created problems in the communities. One of them is due to the occurrence of a inter-marriage would have an impact on the property over the land for inheritance in marriage a mixture. The law which occurs because the inheritance which causes the transfer of ownership of land did not require nationality, but the provisions of land restrict the ownership of property for land gave it to transfer a land rights over land inherited by foreigners. Then problem identification discussed in research is as follows: (a) how the process of intermarriages according to marriage law? ( b ) how the transition of ownership of the land because the inheritance in intermarriages? ( c ) how strong of property rights of the land because the inheritance in intermarriages? Research methodol­ogy used juridical approach is empirical research. Juridical empirical method, the research use approach to the problem, connected with the facts and law happens on the field. The research results show that the process was done based on marriage mingling law from the marriage was done. To ownership rights due to intermediate of the inheritance in marriage a mixture is the same with the transfer ownership rights as the other land inheritance. Along heir who performs marriage intervening who make a break to property by having them land rights.To the heirs who in mar­riage a mixture still heritage having land rights. If the heirs was for foreigners, they should release at most the due in a year time

Abstract

This research aims to analyze gender justice in the customary provisions of the division of joint property towards wives carrying the double burden in the Muslim community of Suku Anak Dalam (SAD) Batin Sembilan, Jambi, based on the principle of al-musāwah. The customary provisions of this community regulate the division formulation of joint property. Both husband and wife get half a share in the event of divorce or death of one of the parties. However, in reality, wives face the double burden today. In addition to being responsible for household affairs, wives are forced to work to earn a living due to their husbands neglecting their obligations. This research uses an empirical juridical approach. Data were collected through in-depth interviews and documentation. The informants in this research were the customary elders and some residents of SAD Batin Sembilan, while additional information was obtained from the Village Head. The data obtained were analyzed from the gender justice perspective using the principle of al-musāwah. The results showed that based on the principle of al-musāwah emphasizing equality and proportionality (tawāzun), the customary provisions on the joint property division for wives carrying the double burden have not fully promoted the values of gender equality and justice in Islam. On that basis, the joint property division should be added to the contribution/role of the husband and wife in producing marital assets. Thus, based on gender justice considerations, wives carrying the double burden are entitled to a more significant share of the joint property than husbands.

Abstract

Tanah diartikan sebagai suatu kehormatan bagi pemilik tanah. Dewasa ini tanah ulayat kaum khusunya di Nagari Kasang telah banyak dilakukan penerbitan sertipikat baik secara sporadik maupun sistematis, sehingga tanah yang telah bersertipikat tersebut banyak di lakukan pembagian kepada anggota kaumnya dengan menggunakan Akta Pembagian Hak Bersama, sehingga tanah ulayat kaum di Nagari Kasang tersebut keberadaannya mulai tergeser eksistensinya. Permasalahan yang diteliti dalam tesis ini adalah: pertama, Bagaimana proses terjadinya peralihan hak ulayat kaum menjadi hak milik individu di Nagari Kasang. Kedua, Bagaimana akibat dari pembagian hak bersama setelah menjadi hak milik individu. Tujuan dari penelitian ini taitu: pertama, untuk mengetahui proses terjadinya peralihan hak ulayat kaum menjadi hak milik iindividu di Nagari Kasang. Kedua, untuk mengetahui akibat dari pembagian hak bersama setelah menjadi hak milik individu. Penelitian dilakukan dengan menggunakan metode yuridis empiris. Berdasarkan hasil penelitian, maka penulis menyimpulkan: Pertama, Proses pembagian hak bersama pada tanah ulayat kaum yang terjadi di Nagari Kasang yaitu tanah ulayat kaum suku Jambak dimana tanah tersebut dilakukan pembagian hak bersama melalui Pejabat Pembuat Akta Tanah (PPAT) dengan menggunakan Akta Pembagian Hak Bersama. Dilakukan pembagian hak bersama melalui Pejabat Pembuat Akta Tanah (PPAT) dengan syarat adanya ranji kaum, dan surat kesepakatan yang di tandatangani oleh MKW dan seluruh anggota kaum serta diketahui oleh Wali Nagari Kasang kemudian dibuatkan Akta Pembagian Hak Bersama oleh PPAT kemudian diberikan ke Kantor BPN Padang Pariaman untuk dilakukan proses peralihan hak. Kedua, Akibat dari Pembagian Hak Bersama setelah menjadi hak milik individu yang dimana hak tanah ulayat kaum yang sifatnya komunal menjadi hak individu sehingga pihak yang telah mendapatkan bagian dari tanah ulayat melalui pembagian hak bersama bebas memperalihkan tanah tersebut tanpa harus meminta persetujuan anggota kaum lain karena tanah tersebut telah menjadi milik pribadi.

Abstract

Based on Presidential Instruction No.9/2025 the President ordered each village to form a Merah Putih Village Cooperative. Therefore, the Government of Nagari Kudu Gantiang in collaboration with the Department of State Administration Law, Faculty of Law, Andalas University conducted community service related to the establishment of the Merah Putih Nagari Cooperative. This activity aims to assist and socialize the formation of the Nagari Merah Putih Cooperative in Nagari Kudu Gantiang as an effort to strengthen the community-based economy. The method used is in the form of socialization and assistance in the formation of the Nagari Merah Putih Cooperative in Nagari Kudu Gantiang. The result of this service is that the Nagari Merah Putih Cooperative of Nagari Kudu Gantiang has been established as a revitalization of the Kudu Gantiang Village Unit Cooperative (KUD) which has not carried out its business activities for a long time.

Abstract

The problem of land registration in the Kampung Tua area of Batam City reflects the complex dynamics between the historical recognition of local communities and the formal agrarian legal system that applies in Indonesia. Until now, most of the land in Kampung Tua does not have a land rights certificate, even though it has been controlled by the community for generations. The dualism of authority between the Batam City Government and the Batam Business Agency (BP), as well as the insynchronization of regulations and spatial data, are the main obstacles in the process of legalizing people's rights. This research aims to analyze the land registration process in Kampung Tua, identify the types of rights granted to the community, and uncover obstacles and formulate strategic solutions in the context of local land policies. The method used is juridical-empirical, with a descriptive qualitative approach through document studies and in-depth interviews with relevant agencies, such as BPN, BP Batam, City Government, and community leaders. The results of the study show that the clarity of the legal status of land in Kampung Tua is very urgent to provide protection of community rights and encourage agrarian justice. It is necessary to strengthen single authority, prepare contextual technical regulations, and socialize legal procedures to the public in a more participatory manner.
