Abstract

This research is qualitative research with a descriptive approach, namely describing a number of things that are closely related to confiscation of assets in criminal law, criminal acts of corruption, and other things. The data used in this research is secondary data in the form of the Criminal Code, Civil Code, statutory regulations, the official website of the House of Representatives, other credible websites, and so on. The researchers analyzed the data using grammatical and systematic legal analysis techniques, namely interpreting every word in the legislation and connecting it with other secondary data or other related legislation. The result in this article show there are three major urgencies for the presence of the Law on Asset Confiscation in Indonesia, namely to provide instruments that are stricter than the current regulations because in the Criminal Code, asset confiscation is only an additional crime and not the main crime, providing a deterrent effect for corruptors and potential corruptors, and of course minimizing corruption cases in Indonesia. Under existing legal structures, state losses resulting from criminal acts of corruption cannot be recovered. Recovering state losses takes years and may not even be returned at all. What is meant to provide a deterrent effect in this research is to impoverish corruptors, change the nomenclature of words whose nature is emphasized from facultative to imperative, and change its status not only to become an additional crime, but also to become a principal crime. On this basis, researchers are of the opinion that the presence of asset confiscation laws in Indonesia can be effective in minimizing the occurrence of corruption in Indonesia.

Abstract

Technological advances provide a number of benefits in various sectors, one of which is the financial sector. Technological advances in the financial sector or commonly known as financial digitalization have made data bookkeeping more effective, easily accessible, transparent, and made it easier for employees to carry out financial reports. Based on this, this research aims to analyze the role of financial digitalization in preventing corruption in Indonesia. This research is qualitative research with a descriptive approach, namely describing the meaning of technology, technological developments, the benefits of technology, its relationship with finance, and the benefits of digitalization of technology in preventing corruption in Indonesia. The data used by researchers in this article is secondary data, namely in the form of legislation, scientific articles, books, websites and other things that are usually used in every research. The researchers analyzed these data using the stages of data collection analysis, data reduction, data analysis, and drawing Conclusion. The result in this research show that the presence of financial digitalization at least has benefits in preventing corruption because of its transparency. With the digitalization of financial tenders, financial reporting, and other things that are transparent and do not endanger privacy, they can be accessed easily by all stake holders, supervisors, partner companies, internal company parties, and so on to find out the tender winner, continuity of the tender, until completion of the tender. Apart from that, if suspicious potential for corruption is found, it can be tracked easily. Because of this, anyone who has the intention to commit corruption will be discouraged.

Abstract

Penelitian ini menyelidiki implementasi undang-undang lingkungan hidup dalam penegakan hukum terhadap pencemaran sungai di Bandung, Indonesia, dengan menggunakan pendekatan analisis kuantitatif. Penilaian kualitas air, evaluasi kerangka hukum, dan analisis penegakan hukum dilakukan untuk memahami secara komprehensif tantangan dan peluang dalam tata kelola lingkungan. Hasilnya menunjukkan adanya variasi polusi yang signifikan di berbagai lokasi sungai, yang menekankan perlunya intervensi yang ditargetkan. Kerangka hukum, meskipun komprehensif, mengungkapkan tantangan dalam hal kejelasan dan penegakan hukum, menggarisbawahi perlunya penyempurnaan peraturan. Efektivitas penegakan hukum berkorelasi positif dengan peningkatan kualitas air, yang menekankan peran penting dari intervensi peraturan. Temuan-temuan yang terintegrasi menawarkan pemahaman yang bernuansa tentang lanskap lingkungan di Bandung, yang memberikan landasan bagi rekomendasi kebijakan dan strategi tata kelola yang berkelanjutan.

Abstract

This research investigates the influence of legal, political, and social factors on religious freedom in Indonesia through a quantitative analysis. A sample of 150 participants was surveyed, and a structural equation model was employed to examine the relationships between these factors and their impact on perceptions of religious freedom. The results reveal significant positive associations between legal awareness, political dynamics, social attitudes, and religious freedom. The study contributes valuable insights for policymakers, legal practitioners, and advocacy groups seeking to enhance religious freedom in Indonesia

Abstract

Penelitian ini meneliti kesejahteraan ekonomi dan sikap sosial terhadap perlindungan hak asasi manusia di antara migran dan pengungsi di Indonesia melalui analisis kuantitatif. Studi ini menggunakan metode statistik deskriptif dan inferensial untuk mengeksplorasi tingkat pendapatan, status kerja, akses ke pendidikan dan perawatan kesehatan, serta persepsi perlindungan hak asasi manusia dan penerimaan masyarakat. Analisis inferensial memeriksa pengaruh kebangsaan, jenis kelamin, usia, dan durasi tinggal pada kesejahteraan ekonomi dan sikap sosial. Temuan ini mengungkapkan perbedaan regional yang signifikan dalam tingkat pendapatan, variasi berdasarkan gender dan usia dalam status kerja, dan korelasi positif antara durasi tinggal dan peningkatan sikap sosial. Implikasi terhadap kebijakan dan praktik dibahas, menekankan kebutuhan untuk kebijakan ekonomi yang disesuaikan, intervensi pekerjaan yang sensitif terhadap gender, dan inisiatif yang mempromosikan integrasi sosial. Studi ini berakhir dengan refleksi tentang keterbatasan dan saran untuk penelitian masa depan, yang bertujuan untuk berkontribusi pada strategi berbasis bukti untuk kesejahteraan dan integrasi migran dan pengungsi di Indonesia.

Abstract

Itsbat nikah adalah penetapan atas perkawinan yang telah memenuhi syarat dan dilaksanakan sebelum adanya UU No. 1 Tahun 1974. Keluarnya Surat Edaran Mahkamah Agung Nomor 3 Tahun 2018 menolak hak anak pada permohonan itsbat nikah. Penentuan batas umur untuk melangsungkan perkawinan sangatlah penting, yaitu untuk menciptakan kemaslahatan keluarga dan rumah tangga. Pembatasan usia dalam perkawinan oleh pembuat undang-undang dimaksudkan agar rumah keluarga yang dibentuk dapat mencapai tujuan perkawinan. Pemberian dispensasi umur pernikahan tidak semerta-merta tanpa adanya alasan. Banyak faktor-faktor yang melatar belakangi ditetapkannya dispensasi umur pernikahan. Baik factor dari pemohon maupun dari pertimbangan hakim selaku pemberi dispensasi umur perkawina. Dari putusan-putusan yang telah ada banyak pertimbangan yang dikemukakan, seperti untuk menghindari terjadinya hal-hal yang bisa menjeremuskan pada perzinahan, karena kedua calon mempelai merasa sudah siap untuk melakukan perkawinan.

Abstract

The concept behind meeting current sustainable development aims to meet needs without endangering the capacity of future generations to meet their own. In this sense, ensuring the achievement of sustainable development goals depends heavily on legislation. The application of sustainable development and its encouragement are greatly aided by the law. Through appropriate regulations, effective law enforcement, and the application of principles of justice, law can be a main pillar in achieving development objectives that prioritize not just economic advancement but also environmental preservation and social welfare for future generations. Overall, the role of law in sustainable development is crucial. Law not only regulates but also protects the rights of the community and the environment, and ensures that development is carried out in a sustainable and responsible manner. With a strong legal framework, Indonesia can achieve sustainable development goals that balance economic, social, and environmental needs.

The research explores the legal frameworks governing online content in Indonesia, analyzing how these regulations align with constitutional guarantees of freedom of speech. The findings reveal significant tensions between state interests in maintaining public order and individual rights to free expression, highlighting the potential for regulatory overreach and the chilling effect on public discourse. The study underscores the need for a more balanced approach to content regulation, advocating for clearer legal guidelines and independent oversight to ensure that regulations do not undermine democratic principles. This research contributes to the ongoing debate on the legal and ethical dimensions of content regulation in the digital age, offering insights for policymakers, legal practitioners, and digital platform operators.

Abstract

This research is a qualitative research with a descriptive normative approach, namely explaining the Position of Debt in Online Loans in the Indonesian legal system in descriptive form and accompanied by legal arguments. The data used are secondary data that researchers obtain from credible sources, namely websites, books, scientific journals, and others that are commonly used in every study. The data are analyzed by stages of data collection, data sampling, data reduction, and drawing conclusions. The result in this article show that the borrower is still obliged to return the loan that has been borrowed without being burdened with anything outside of the debt that could burden the borrower.

Abstract

The concept of a marriage dowry from various time formalities considers the sale and purchase transaction, that is, the sale and purchase between the future husband who is the buyer and the father or brother on the basis that the future wife is their material right. At first the guardian i.e. father or grandfather and close relatives who cared for the woman considered the dowry to be their right in exchange for the obligation to care for and nurture the woman. This understanding makes for a sociological reality in Muslim society that exposes women to discrimination, exploitation and violence. Ironically, almost all such destructive treatment is justified by religion. Women are not recognized as fully human like men, so they have no right to represent themselves. Women have always been regarded as objects of law in all laws and regulations, especially those relating to family law. In contemporary fiqh, dowry is defined as the obligatory gift of a man to a woman in the presence of a marriage contract, it is a good protection of Islam and its respect for women is that Islam gives her the right of ownership. The obligation of dowry in the Qur'an in sura an-Nisa verse 4 The imposition of only one subject results in the reading of the text in a patriakhis manner that is not in harmony with Islamic principles. In Islam a text is not specific to gender as the command of prayer, zakat, fasting of course although the editors of mukhatab are men but also target women. Contemporary fiqh does not apply the size of the dowry, meaning that the dowry can be expensive or cheap depending on the situation and the place that occurs. The understanding that requires a dowry on the part of the husband (man) alone is not in harmony with the principle of mubadalah. The reason is because according to mubadalah every sacred text whose mukhotob is male then it can certainly be applied to women. Likewise, with the obligation to give a dowry by men, it can also be from the side of the woman who gives the dowry
