Abstract

The concept of a marriage dowry from various time formalities considers the sale and purchase transaction, that is, the sale and purchase between the future husband who is the buyer and the father or brother on the basis that the future wife is their material right. At first the guardian i.e. father or grandfather and close relatives who cared for the woman considered the dowry to be their right in exchange for the obligation to care for and nurture the woman. This understanding makes for a sociological reality in Muslim society that exposes women to discrimination, exploitation and violence. Ironically, almost all such destructive treatment is justified by religion. Women are not recognized as fully human like men, so they have no right to represent themselves. Women have always been regarded as objects of law in all laws and regulations, especially those relating to family law. In contemporary fiqh, dowry is defined as the obligatory gift of a man to a woman in the presence of a marriage contract, it is a good protection of Islam and its respect for women is that Islam gives her the right of ownership. The obligation of dowry in the Qur'an in sura an-Nisa verse 4 The imposition of only one subject results in the reading of the text in a patriakhis manner that is not in harmony with Islamic principles. In Islam a text is not specific to gender as the command of prayer, zakat, fasting of course although the editors of mukhatab are men but also target women. Contemporary fiqh does not apply the size of the dowry, meaning that the dowry can be expensive or cheap depending on the situation and the place that occurs. The understanding that requires a dowry on the part of the husband (man) alone is not in harmony with the principle of mubadalah. The reason is because according to mubadalah every sacred text whose mukhotob is male then it can certainly be applied to women. Likewise, with the obligation to give a dowry by men, it can also be from the side of the woman who gives the dowry

Abstract

This study aims to analyze the influence of anti-corruption behavior on food self-sufficiency and its impact on community welfare in the Frontier, Outermost, and Disadvantaged (3T) regions. Corruption in the distribution of food aid and agricultural subsidies is often a major obstacle to the development of remote areas. Using a qualitative approach and in-depth literature review, this study explores how the integrity of local governance can ensure the effectiveness of food security programs. The analysis shows that anti-corruption behavior, manifested through budget transparency and public accountability, contributes significantly to sustainable food availability. The resulting food self-sufficiency ultimately becomes a key determinant in improving the welfare standards of communities in the 3T regions. This study recommends strengthening community-based supervision and digitizing the bureaucracy to minimize rent-seeking practices in the food sector in disadvantaged areas.

Abstract

The Free Nutritious Meals (MBG) program is a strategic government policy to improve the quality of human resources, but its implementation faces serious technical risks in including mass poisoning incidents. This study aims to comprehensively analyze the phenomenon of mass poisoning in the MBG program through four main perspectives: law, health, human rights (HAM), and social. Using a normative-empirical research method with a case study approach, this study explores systemic failures in the food supply chain. The results of the study indicate that mass poisoning is not merely a medical problem, but rather a representation of weak enforcement of food safety regulations, violations of the basic right to safe food, and triggers social distrust in state institutions. This study recommends strengthening food safety protocols, standardizing food supply units, and establishing clear legal accountability mechanisms to protect citizens as rights holders.

Abstract

The discourse on gender-neutral toilets has sparked a multidimensional debate in Indonesia, a Muslim-majority country that upholds religious values and Eastern norms. This study aims to analyze the existence of gender-neutral toilets through a dual lens: the perspective of Islamic law (Maqasid al-Shari'ah) and international human rights instruments. Using normative legal research methods with a conceptual and comparative approach, this article explores the tension between the inclusiveness of public spaces for gender minorities and the principles of privacy ( khalwah ) and gender segregation in Islamic tradition. The results show that while the human rights perspective emphasizes non-discriminatory accessibility and human dignity according to the Yogyakarta principles, the Islamic perspective in Indonesia tends to emphasize the protection of public morality and the boundaries of aurat. However, there is a dialectical space through the principle of maslahah mursalah to provide safe facilities without disrupting the existing social order. This study concludes that the implementation of gender-neutral toilets in Indonesia requires a hybrid model that takes into account local sensitivities to avoid escalating social conflict.

Abstract

The determination of national disaster status in Indonesia is often the subject of heated debate between humanitarian urgency and considerations of economic and political stability. This article analyzes the pros and cons of declaring a national disaster status in response to flooding on Sumatra Island through legal and social perspectives. Using qualitative methods with a juridical-normative and sociological approach, this study evaluates the implementation of Law Number 24 of 2007 concerning Disaster Management. The research findings indicate that legally, the determination of national disaster status provides unlimited access to fiscal resources and centralized command, but socially, it can create regional dependency and stigmatization, impacting the investment climate. This article concludes that more rigid quantitative indicators are needed in regulations to minimize the politicization of disaster status.
