Abstract

In this era, human life is heavily influenced by technology, especially in terms of business. The use of PayLater, which means "buy now, pay later," is one example of the use of advanced technology in the business world. With technological advances in the modern era, especially e-commerce payment systems, SpayLater is becoming increasingly popular. PayLater is a purchase method that allows payments to be made later in a given period of time. In Islamic law, this is called the sale of Istijrar. However, scholars argue that it is a violation of the sale system when the goods to be bought are unknown to the buyer and there are new buyers who want to buy the same goods and set the price after summing up all the prices to pay. In fact, SpayLater can be permitted if the price of the goods has been determined after both parties involved in the transaction prove that the price is consistent with and in accordance with Islamic rules. This research aims to find out how PayLater transactions are used and how Islamic law views such actions. The method used is qualitative descriptive research, in which the author uses library studies, i.e., scientific references from books, national and international journals, al-Qur'an and Hadiths, and fiqih books. Because of its ease of use, SpayLater can make people prefer to buy something, which in turn will encourage them to make online debts. Therefore, knowing the potential risks, customers should be wise in distinguishing between needs and desires.

Abstract

The problem in this study is how criminal responsibility and proof for embezzlement in employment relations in Decision Number 119 / Pid.B / 2019 / PN Gst, what is the role and function of Judges in the law. The results showed: The criminal liability of perpetrators of embezzlement in employment relations in Decision Number 119/Pid.B/2019/PN Gst, if you look at Article 374 of the Criminal Code as demanded by the Public Prosecutor is a threat through a maximum sentence of 5 years. The role of the Judge in law through his decision is based on Article 1 paragraph (8) of the Code of Criminal Procedure which states that the Judge is a state judicial official authorized by law to prosecute. The legal analysis of the decision of the Gunung Sitoli District Court Judge who decided to acquit the defendant Agustina Ndraha in Decision Number 119/Pid.B/2019/PN Gst was considered inappropriate, because the free verdict decided by the Panel of Judges regarding the embezzlement case in employment relations submitted by the Public Prosecutor on the basis that the Judge did not apply the law properly, namely in legal considerations on incriminating matters and mitigating the Defendant regarding the conviction of the Defendant.

Abstract

Auctions of collateral by Rural Credit Banks (BPR) without going through a credit restructuring process raise legal issues related to debtor protection and the fulfillment of the principle of fairness in banking practices. This study aims to analyze the legality of auctions of collateral by BPR without prior credit restructuring, focusing on Decision Number 260/Pdt.G/2019/PN Dps. The research method used is a normative legal research method, applying the Theory of Statement, Legal Certainty, and Justice to discuss legal issues concerning the validity of collateral auctions without restructuring. This study relies on previously available information (secondary sources). Data collection was conducted through document review and relevant literature, while data analysis techniques were performed using qualitative data analysis. The results of this study include: Credit restructuring is not required in cases of non-performing loans, in accordance with Bank Indonesia Regulation No. 14/15/PBI/2012. This means that banks can auction collateral immediately without restructuring if there is no agreement between the bank and the debtor. Regarding collateral auctioned without prior restructuring, debtors may pursue legal remedies, both non-litigious and litigious. In accordance with Article 21(1) of the Indonesian Financial Services Authority Regulation No. 33/Pojk.03/2018 regarding the Quality of Productive Assets and the Formation of Provisions for the Write-off of Productive Assets of Rural Banks (BPR), the auction conducted by PT. BPR without credit restructuring is valid.

Abstract

Filsafat Hukum di Indonesia mempunyai peranan terbesar dalam pembentukan hukum di Indonesia. Pancasila sebagai sumber hukum mengandung arti keseluruhan dari peraturan maupun hukum, mulai dari konstitusi kita dan seluruh peraturan terlepas dari konstitusi kita pastilah meletakkan Pancasila sebagai dasar dan landasan dari hukum tersebut. Pancasila adalah sistem hukum Indonesia. Oleh karena itu, Pancasila bukan hanya dikenal sebagai filosofi tapi juga dikenal sebagai hukum tertulis di Indonesia yang mengandung hukum yang hidup. Permasalahannya adalah sebesar apa peranan Filsafat Hukum memberikan pengaruh untuk membangun pembentukan sistem hukum di Indonesia. Permasalahan ini pastilah sangat penting untuk dijawab. Penulis mencoba untuk menguji permasalahan ini dengan hukum normatif dalam metode hukum. Pendekatan yang dilakukan oleh penulis diambil dari beberapa buku yang mengandung tentang permasalahan permasalahan yang terkait.

Abstract

Tujuan penelitian ini adalah untuk memberikan pengetahuan baru tentang diskriminasi antara kelompok minoritas atau komunitas-komunitas, khususnya pada kelompok yang berbeda keyakinan berdasarkan dari filsafat hukum dalam menerapkan keadilan. Penulis dalam makalah ini fokus untuk menganalisa diskriminasi antara kelompok atau komunitas minoritas, khususnya pada kelompok yang berbeda keyakinan. Metode penelitian yang digunakan dalam memecahkan permasalahan ini adalah metode normatif yuridis yang menggunakan data sekunder sebagai sumber datanya, seperti teori-teori hukum, jurnal, buku-buku, laporan, dan peraturan-peraturan. Dalam filsafat, keadilan adalah sebuah hal yang sangat mendasar dalam menjaga masyarakat politik yang stabil. Berkenaan dengan masalah minoritas, hal ini berhubungan dengan pembentukan keadilan, karena hal itu adalah bagian yang tidak terpisahkan dalam tujuan hukum.

Abstract

Credit card hacking (carding) constitutes a form of cybercrime in which offenders unlawfully access and use another person’s credit card for payment transactions without the owner’s consent or knowledge. This study aims to examine and analyze: (1) the legal framework governing the theft of credit card information that causes financial losses to customers through cyberspace; (2) the scope of criminal liability for such offenses; and (3) judicial considerations in Decision Number 240/Pid.Sus/2021/PN.Dps. The research focuses on relevant provisions in Indonesian law, specifically Article 30 paragraph (1) of Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 on Electronic Information and Transactions (ITE), which prohibits unauthorized access to another person’s computer or electronic system. In conjunction with Article 46 paragraph (1) of the ITE Law and Article 55 of the Criminal Code, these regulations form the legal basis for prosecuting carding offenses. Decision Number 240/Pid.Sus/2021/PN.Dps reflects the application of these provisions, where the court imposed penalties on perpetrators consistent with statutory mandates. This research underscores the significance of robust legal enforcement to address the evolving challenges of cybercrime and to safeguard public trust in electronic transactions.

Abstract

The construction of state-owned enterprise (SOE) group companies creates a legal relationship between parent and subsidiary entities with significant juridical implications. This study aims to analyze the legal aspects of establishing PT Sinergi Gula Nusantara (PT SGN) as a subholding under the Plantation SOE Holding. The research employs a normative legal method with statutory, case study, and conceptual approaches. The findings show that the establishment of PT SGN is based on Law No. 40 of 2007 on Limited Liability Companies, carried out through acquisition and spin-off mechanisms. Although PT SGN and PTPN III stand as separate legal entities, PTPN III, as the majority shareholder, retains controlling authority over PT SGN within the holding structure. The legal consequence of this arrangement is the transfer of sugar business assets from PTPN to PT SGN, granting PT SGN full responsibility for management, while PTPN III bears limited liability in line with the principles of corporate law. This research contributes to the development of corporate law in Indonesia by highlighting the need for a clearer legal framework in SOE restructuring through subholding models and by offering new insights into balancing authority and responsibility between parent and subsidiary companies. Keywords: SOE; Company; Restructuring; Subholding

Abstract

Abstrack: This study aims to examine the socialization of arbitration based on Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution to business actors, identify factors that cause minimal familiarity of business actors with the Indonesian National Arbitration Board (BANI), and evaluate the role and existence of BANI in resolving business disputes in North Sumatra. Using a normative juridical research method, this study relies on secondary data sources from library materials, legal principles, legal theories, books, and laws and regulations. The results of the study indicate that although arbitration offers advantages such as a simple process, short time, low cost, and mutually beneficial settlements, the lack of knowledge and socialization about BANI among business actors hinders the use of arbitration as a dispute resolution method. Therefore, increased socialization and education are needed so that more business actors understand and use arbitration, especially through BANI, in resolving their business disputes. Keyword: BANI (Indonesian National Arbitration Board), dispute resolution Abstrak: Penelitian ini bertujuan untuk mengkaji sosialisasi arbitrase berdasarkan Undang-Undang No. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa kepada pelaku usaha, mengidentifikasi faktor-faktor yang menyebabkan minimnya daya kenal para pelaku usaha terhadap Badan Arbitrase Nasional Indonesia (BANI), serta mengevaluasi peran dan eksistensi BANI dalam penyelesaian sengketa bisnis di Sumatera Utara. Dengan menggunakan metode penelitian yuridis normatif, penelitian ini mengandalkan sumber data sekunder dari bahan pustaka, asas hukum, teori hukum, buku-buku, dan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa meskipun arbitrase menawarkan keunggulan seperti proses yang sederhana, waktu singkat, biaya murah, dan penyelesaian yang saling menguntungkan, kurangnya pengetahuan dan sosialisasi tentang BANI di kalangan pelaku usaha menghambat pemanfaatan arbitrase sebagai metode penyelesaian sengketa. Oleh karena itu, diperlukan peningkatan sosialisasi dan edukasi agar lebih banyak pelaku usaha memahami dan menggunakan arbitrase, khususnya melalui BANI, dalam penyelesaian sengketa bisnis mereka. Kata Kunci: BANI ( Badan Arbitrase Nasional Indonesia), sengketa , penyelesaian

Abstract

Implementing jinayat law enforcement in Sabang of Aceh Province experiences a dualism of settlement, which causes legal uncertainty. This can be observed in practice where the Sabang District Court instead adjudicates cases that should be under the jurisdiction of the Sabang Sharia Court. This article elaborates on the dualism in the settlement that occurs and identifies the causes of the dualism in the settlement of criminal cases using Soerjono Soekanto's law enforcement factor theory. Based on that, efforts were found that could be made to overcome this dualism. The analysis results indicate that the dualism of settlement can be observed through 6 (six) cases that should be under the jurisdiction of the Sabang Sharia Court but were adjudicated by the Sabang District Court, the majority of which are minor-related cases. There are cases where the same defendant is tried in close succession in both judicial institutions for similar acts with different victims. It happens due to various factors, such as the legal factor: inadequate provisions regarding minors at Qanun Jinayat. Law enforcer factor: other views on minor-related cases and a lack of precision in implementing existing law. Facilitating factor: unavailability of detention rooms at Sabang Sharia Court and budget for executions. Society factors: public lack of legal knowledge. Based on the results of this identification, efforts can be made to include professional law enforcement, harmonization of judicial authority through internal agency regulations, and evaluation of moral offenses in the Qanun Jinayat.
