Abstract

This comprehensive research embarks on meticulously exploring the intricate ethical nuances at the convergence of artificial intelligence (AI) and legal decision-making. Through an exhaustive literature review, the study meticulously navigates the complexities woven into algorithmic bias, the multifaceted dimensions of data privacy concerns, the profound implications on human agency, imperatives surrounding transparency, the socio-economic impacts stemming from the integration of AI, and the global perspectives that cast a profound influence on this intricate landscape. The synthesis of these insights reveals a dynamic interplay between the rapid evolution of technological capabilities and the intricate ethical considerations that underpin responsible AI integration into legal frameworks. The study underscores the need for ongoing interdisciplinary discourse, urging scholars, practitioners, and policymakers to engage in a continuous dialogue to ensure that ethical frameworks evolve in tandem with the relentless progression of AI technology. The conclusion advocates for a flexible and adaptive ethical framework poised to navigate the evolving ethical horizon, thereby ensuring AI's judicious and equitable integration into legal decision-making.

Abstract

The function and existence of environmental Law certainly have an essential role in solving the problem of environmental damage in Indonesia, which has been claimed to be one of the countries that have failed to manage environmental management. Based on this interest, we try to review the Law and the function of environmental Law in an academic context in the hope of obtaining findings from various theoretical and application contexts. In reviewing various sources, we involve a comprehensive data coding system, in-depth data evaluation, and interpretations where we believe it is relevant to answer high facilities' problems. Our data search online on several publications released between 2010 and 2022 considering the last ten years, the issue of damage and the government's efforts to salvage support is increasing. It is hoped that this finding will be a refinement of further studies. At the same time, the purpose of this study is to collect several facts in the form of scientific evidence related to the function of environmental Law in an academic context.

Abstract

This research aims to analyse the role of law in national economic development through a literature study on the relationship between regulation and public welfare. Law functions as a normative framework that provides certainty, protection of rights, and guidelines for economic actors in creating a conducive and equitable investment climate. This study uses normative legal research methods by examining laws and regulations, government policies, and literature related to economic development law in Indonesia. The results of the study show that regulatory harmonisation, consistent law enforcement, and integration of social justice values in every economic policy are the main prerequisites for promoting inclusive economic growth and improving people's welfare. However, regulatory disharmony is still a challenge that can hamper the effectiveness of public policies and reduce the quality of services to the community. Therefore, optimising the role of Pancasila economic law, strengthening coordination between agencies, and public participation in the legislative process are needed so that national economic development truly contributes to the achievement of social justice and shared prosperity.

Abstract

The development of crypto assets in Indonesia in the post-reform era presents complex regulatory challenges regarding the harmonisation of digital economy law, investor protection, and the transformation of Sharia fintech. This study aims to comprehensively examine crypto asset regulation within the framework of the implementation of the new Criminal Code and the Personal Data Protection Act (PDPA) to create a sustainable Indonesian crypto market. The method employed is a literature review (library research) using a qualitative-descriptive analytical approach. The research findings indicate that regulatory fragmentation between Bappebti, OJK, and Bank Indonesia creates legal uncertainty that is detrimental to investors, whilst the implementation of the new Criminal Code and the Personal Data Protection Act presents an opportunity to strengthen protection through more comprehensive regulations on digital crime and personal data protection. The transformation of Sharia fintech offers a regulatory alternative that integrates Sharia principles with blockchain technology to create a fair, transparent, and inclusive crypto ecosystem. This study recommends integrated, adaptive, and value-based crypto regulations with synergy among stakeholders, effective oversight mechanisms, robust law enforcement, extensive investor education, and the integration of ESG principles for a sustainable Indonesian crypto market.

Abstract

The Merah Putih Cooperative (KMP) program is a government initiative aimed at achieving national economic equality in accordance with the mandate of Article 33 of the 1945 Constitution. However, in its implementation in the field, this program still faces various obstacles, mainly due to the accelerated establishment of institutions and limited human resource capacity. Many cooperative administrators and supervisors do not yet have an adequate understanding of the principles of cooperative law and the responsibilities attached to their positions as stipulated in the law. To overcome this problem, legal counseling activities are carried out using the participatory legal education approach based on the AKOSA (Alami–Kemukakan–Olah–Simpulkan–Aplikasikan) model. Through these five stages, participants were invited to identify actual legal issues in cooperatives, discuss their field experiences, analyze them based on legal provisions, draw conclusions together, and apply them through the practice of drafting Bylaws (ART) and simulating minutes of the Annual Member Meeting (RAT). The results of the activity showed a significant increase in participants' legal knowledge and skills, with the effectiveness of participatory learning reaching a level of practical significance (p < 0.05). A total of 92% of participants stated that this activity was relevant to the needs of cooperatives, and 87% wanted ongoing legal assistance. Qualitatively, this activity also showed a shift in legal culture from compliance-based to participatory-based governance, in which administrators and supervisors not only comply with the rules but also internalize legal values as institutional ethical guidelines.
