Abstract

This study aims to determine the extent of swot analysis in the strategy of collecting and utilizing zakat in the Indonesian zakat initiative (IZI) representatives of South Sulawesi, whether it makes a difference to the lives of mustahiq who are empowered and in accordance with the basic principles of Islamic law. This type of research uses qualitative methods with a descriptive approach, the data sources used are primary data and secondary data, then the data collection techniques used are observation, interviews, documentation, how to analyze the data in this study using the Milens and Huberman method, which stages are data collection, descriptive data, data reduction, data presentation, data verification, and conclusion drawing, then test the validity of the data in this study using credibility, transferability, dependability, and confirmability tests. The results of this study indicate that there is a swot analysis in the strategy of collecting and utilizing zakat carried out by the national amil zakat institution IZI South Sulawesi, which provides positive changes for the economic improvement of mustahiq who are empowered, the utilization of this zakat for mustahiq done by IZI South Sulawesi in accordance with the principles of sharia, and the collection carried out by IZI so that muzakki knows more about the obligation to give zakat and mustahiqs are given business capital by IZI not out of eight asnaf, in the provision of zakat funds mustahiqs are not charged to return compensation funds because it has become the absolute right of mustahiqs.

Abstract

The development of Islamic financial institutions in Indonesia has increased quite a bit from year to year. This is because people's interest in saving is quite high in Islamic financial institutions. Interest-based conventional financial institutions can be compared with products from Islamic financial institutions. For example, cooperation-based sharia banking products with a "profit and loss sharing" system such as musyarakah and mudharabah contracts. The implementation of cooperation products with this musyarakah contract did not show significant growth so that the innovation of the musyarakah contract was implemented which resulted in a Musyarakah Mutanaqishah contract in accordance with National Syari'ah Council Fatwa No: 08/DSN-MUI/IV/2000 Concerning Musyarakah Financing and Council Fatwa National Sharia No: 73/DSN-MUI/XI/2008 Concerning Musyarakah Mutanaqisah. The purpose of writing this paper is to analyze the issue of sharia compliance in musyarakah mutanaqishah contracts practiced in sharia banking products in Indonesia. These issues consist of sharia issues, legal issues and operational issues according to the musyarakah and musyarakah mutanaqishah product standard books published by the Financial Services Authority (OJK) in 2016. The results of the analysis in this paper show that first, sharia issues generally occur in this issue. is the existence of "two contracts in one item" where the rental and purchase contracts are agreed at the same time. Second, legal issues related to the existence of different perspectives between fiqh rules and Indonesian positive law related to the recording of ownership certificates. And the third issue, an operational issue where there is price independence when a financing contract with a musyarakah scheme is made that requires a transfer of ownership.

Abstract

The study of Islamic law has always been an interesting discourse to be discussed. Especially when Islamic law used as feedstock national legislation. Indonesian Islamic law reformers among the developing discourse that gave birth to the two groups with the character and tendency of thought is diametrically different. The first group, discuss the application of Islamic law with legalistic -textual approach, namely that Islamic law should be applied textually and enforced for all Indonesian Muslims . Islamic law - textual legally in Indonesia can be realized if supported by political struggle. Civic groups voiced discourse, among others, is Hizbur Tahrir Indonesia (HTI), and the Islamic Defenders Front (FPI). This group tends to struggle line radical - conservative by means of dialogue and anarchism combines street parliament. The second group, using substantial - cultural approach, namely that Islamic law does not need to be formalized in the form of legislation, but the most important is the absorption of Islamic values in the socio-cultural life of Indonesian Muslims. Acculturation Islamic values, such as honesty, liberty, justice, and equality before the law needs to be actualised in the daily life of Indonesian Muslim society is far more important than the formalization of the religious teachings . This group is represented by the Liberal Islam Network.

Abstract

The idea of benefit to Imam Malik has a style of its own, which makes the beneficiaries as a method of law that can provide special insight into the passage of a general nature, and even tend to practice the beneficiaries rather than nas, nas contextually if it is not in accordance with the socio society. Beneficiaries in view of al-Ghazali is an expression of something that will benefit and refused harm, the beneficiaries can maintain the intent Syari'a. The purpose of the Syari'ah concerning humans, there are five cases, which is preserve religion, life, intellect, lineage, and wealth. What are five things related to it are called beneficiaries. Otherwise everything can destroy five of the above named mafsadat. Differences thought benefit to Imam Malik and Imam al-Ghazali lies in the use of the ratio in the determination of the existence of a benefit. Imam Malik freer in the use of ratios to determine the existence of a benefit. While Imam al-Ghazali still assume that the ratio is able to capture the presence or absence of a benefit as justified by the revelation. Thus the applicative, Imam Malik freer in determining beneficiaries than Imam al-Ghazali

Abstract

This article tries to study how the concept of mudharabah in classical Islamic legal theories implemented in Islamic monetary institution, especially Islamic banking. Using library research, this study shows that there exists discrepancy between the concept of mudharabah in classical Islamic books and its implementation in Islamic banking. The discrepancy indicates that the door of ijtihad is still widely open in contemporary Islamic law. The prudential principle necessitates Islamic banking to contextualize the classical concept of mudharabah in contemporary socio-cultural situation.

Abstract

Reactualization of Islamic law can be done through empowerment of fiqh and fatwa to understand that fiqh and fatwa are the product of scholars’ thought affected by the socio-cultural aspects accompanying it. The Product of that thought is used as a device to overcome the problems of the religious dimension of worship, muamalah, family law, civil and criminal. Generally, Muslims tend to assume that the product of fiqh thought is considered as religious because most of the practice and application of religious teachings are derived from fiqh, such as the ordinance of purification, prayer, fasting, pilgrimage, and etiquette for transaction which is appropriate to Shari’a guidance.

Abstract

Sharia Supervisory Board (DPS) is one of the most important part in the system of Islamic financial and banking institutions in Indonesia. The existence of DPS is recognized based on applicable laws and regulations. The existence of DPS in sharia financial institutions and sharia banking aims to oversee sharia principles that must be implemented in real terms in the contract system and transactions in Islamic financial and banking institutions. Empirically, the recognition of legislation on the existence of DPS has not been fully implemented by Islamic financial and banking institutions. In fact, recommendations regarding the findings of sharia principles violations in the contract system and transactions in sharia financial and banking institutions often receive a response from the board of directors. Therefore, the most important indicator that DPS must have is the professionalism of its human resources. Competence is a determinant factor in recruiting DPS. These competencies include aspects of mastery of fiqh muamalah theories, competency in reading financial statements, and competencies in the field of engagement law.

Abstract

The main problem in this research is the large number of shopeepay users so that there are pros and cons in the community regarding the use of shopeepay in islam. Ustadz muhammad ihsan said that if you want to know the islamic view of e-wallet which has a function to save money digitally including shopeepay, then we need to see the contract that occurs between the user and the shopeepay company. The purpose of this study is to find out how the shopeepay transaction system is in the shopee market place and to find out how to analyze sharia contracts related to shopeepay transactions on the shopee application. This type of research uses descriptive qualitative research. In general, descriptive research is non-hypothetical research, which provides a clear and complete form of an occurrence of a phenomenon. Research in qualitative research seeks to understand the meaning of events by trying to interact with actors in these events. The results of the study show that the sharia contract used in shopeepay transactions on the shopee application is the wadi’ah contract. When viewed from the perspective of fiqh muamalah, when the user does a top-up, that's where the wadi’ah contract takes place. But in the contract, the wadi’ah itself is divided into two, namely wadi’ah yad amanah and wadi’ah yad dhamanah. Based on the results of the study, the contract that is closer to the implementation of shopeepay is the wadi’ah yad dhamanah contract. Keywords: Sharia Contract; ShopeePay; Shopee

Abstract

Along with people's desires that are increasingly complex in almost all aspects of life without being related to entertainment or musical performances but are limited to time and energy management, event organizers are an alternative that answers this, where event organizers are committees that work professionally with the aim of design, implement and be responsible for the implementation of these activities. The purpose of this study was to determine the mechanism of the cooperation contract at the event organizer project 13 with service tenants and related to the implementation of the ijarah contract in the cooperation contract agreement in the view of Islamic economics. The research method used is a qualitative method with a phenomenological approach, and the data collection methods used in this study are interviews and documentation. The results of this study showed that the project 13 system in which it complied with the applicable sharia provisions of the contract and there was a binding written cooperation contract, and based on the observations of the cooperation contract carried out by the event organizer project 13 included in the ijarah contract which in harmony and the terms are in accordance with the provisions of sharia. Abstract

The rapid development of information technology can be seen from the massive use of the Internet network, which has also boosted the public's need to always carry out trade transactions using the Internet network. This is a challenge for Muslims to always be careful in transactions because Islam gives freedom to its followers in transactions but still places restrictions according to the Shari'a. Therefore, this study aims to find out the form of transactions in the go-food application and what the Islamic economic perspective is on these go-food transactions. The research method uses a qualitative interpretive approach. Sources of data come from primary data and secondary data and data collected using observation, interviews, and documentation. Respondents in this study were PT. Go-Jek, Go-Jek drivers, merchants, and consumers. This research focuses on the multiple contracts contained in Go-food services and the views of Islamic Economics on the transaction model. The results of this research show that it is true that there are multiple contracts in Go-food transactions because many parties are involved in them, including service leasing transactions between PT. Go-Jek and merchants, partners between PT. Go-Jek and drivers, as well as representative transactions between consumers and PT. Go-Jek and consumers with Go-Jek drivers. Islamic Economics views this transaction model resembles the forms of contracts in Islam, namely ijarah contracts, syirkah, wakalah bil ujrah, and their application does not conflict with Islamic Economics.
