Abstract

The main problem in this research is the large number of shopeepay users so that there are pros and cons in the community regarding the use of shopeepay in islam. Ustadz muhammad ihsan said that if you want to know the islamic view of e-wallet which has a function to save money digitally including shopeepay, then we need to see the contract that occurs between the user and the shopeepay company. The purpose of this study is to find out how the shopeepay transaction system is in the shopee market place and to find out how to analyze sharia contracts related to shopeepay transactions on the shopee application. This type of research uses descriptive qualitative research. In general, descriptive research is non-hypothetical research, which provides a clear and complete form of an occurrence of a phenomenon. Research in qualitative research seeks to understand the meaning of events by trying to interact with actors in these events. The results of the study show that the sharia contract used in shopeepay transactions on the shopee application is the wadi’ah contract. When viewed from the perspective of fiqh muamalah, when the user does a top-up, that's where the wadi’ah contract takes place. But in the contract, the wadi’ah itself is divided into two, namely wadi’ah yad amanah and wadi’ah yad dhamanah. Based on the results of the study, the contract that is closer to the implementation of shopeepay is the wadi’ah yad dhamanah contract. Keywords: Sharia Contract; ShopeePay; Shopee

Abstract

Along with people's desires that are increasingly complex in almost all aspects of life without being related to entertainment or musical performances but are limited to time and energy management, event organizers are an alternative that answers this, where event organizers are committees that work professionally with the aim of design, implement and be responsible for the implementation of these activities. The purpose of this study was to determine the mechanism of the cooperation contract at the event organizer project 13 with service tenants and related to the implementation of the ijarah contract in the cooperation contract agreement in the view of Islamic economics. The research method used is a qualitative method with a phenomenological approach, and the data collection methods used in this study are interviews and documentation. The results of this study showed that the project 13 system in which it complied with the applicable sharia provisions of the contract and there was a binding written cooperation contract, and based on the observations of the cooperation contract carried out by the event organizer project 13 included in the ijarah contract which in harmony and the terms are in accordance with the provisions of sharia. Abstract

The rapid development of information technology can be seen from the massive use of the Internet network, which has also boosted the public's need to always carry out trade transactions using the Internet network. This is a challenge for Muslims to always be careful in transactions because Islam gives freedom to its followers in transactions but still places restrictions according to the Shari'a. Therefore, this study aims to find out the form of transactions in the go-food application and what the Islamic economic perspective is on these go-food transactions. The research method uses a qualitative interpretive approach. Sources of data come from primary data and secondary data and data collected using observation, interviews, and documentation. Respondents in this study were PT. Go-Jek, Go-Jek drivers, merchants, and consumers. This research focuses on the multiple contracts contained in Go-food services and the views of Islamic Economics on the transaction model. The results of this research show that it is true that there are multiple contracts in Go-food transactions because many parties are involved in them, including service leasing transactions between PT. Go-Jek and merchants, partners between PT. Go-Jek and drivers, as well as representative transactions between consumers and PT. Go-Jek and consumers with Go-Jek drivers. Islamic Economics views this transaction model resembles the forms of contracts in Islam, namely ijarah contracts, syirkah, wakalah bil ujrah, and their application does not conflict with Islamic Economics.

Abstract

Adiwarman Azwar Karim is one of the contemporary Muslim scholars in Indonesia who has an important role in the development of Islamic economics in Indonesia. His thoughts and ideas gave birth to various works that became a reference for academics and practitioners of Islamic economics so that it had a major impact on the development of Islamic economics today. The purpose of this research is to look at some of Adiwarman Azwar Karim's thoughts. The method used is a literature study with a descriptive qualitative approach. Data sources come from secondary data sources, namely journals and books related to the discussion. The results showed that the methods and approaches used by Adiwarman Karim in his various works were historical approaches, fiqh and economic approaches. Some of Adiwarman Karim's economic thoughts are Islamic Economic Design, Intellectual Integration and Harakah; Campus-Government-Practitioner, Mudharabah Concept, Gold Pawn and Economic Value of Time. In addition, Adiwarman avoids Islamizing the economy by taking conventional economics and then tracing the verses of the Qur'an and hadith because it forces the Qur'an and hadith to match the human mind.

Abstract

Sistem harga saat ini berfungsi selaku salah satu indikator pembangunan ekonomi suatu negara, penetapan harga dalam pasar merupakan sesuatu yang sangat vital dimana dalam pasar yang sehat harga ditentukan pada kekuatan tawar menawar antara pedangan dan pembeli, terdapat perbedaan pandangan terkait konspe harga yang adil menurut kapitalisme, sosialisme dan Islam, selain selain itu Islam yang berpandangan mekanisme pasar yang terjadi yaitu pasar bebas dimana keseimbangan pasar dilihat pada kekuatan permintaan dan penawaran, tanpa adanya faktor yang menjadi penentu penetapan harga yang adil, oleh karena itu penelitian ini berencana guna melihat seberapa adil penilaian dalam sudut pandang masalah keuangan Islam, sedangkan strategi pemeriksaan yang digunakan yakni teknik subyektif. Hasil dari penelitian ini yaitu dalam penentuan harga dipasar sepenuhnya diserahkan pada kekuatuan permintaan dan penawaran. Harga yang tidak menimbulkan eksploitasi maupun kezaliman, yang bisa merugikan salah satu pihak yang terlibat dalam transaksi tersebut, disebut selaku harga yang wajar. Harga yang wajar yakni harga yang menguntungkan baik penjual maupun pembeli sebanding dengan harga yang dibayarkan. Kekuatan tawar menawar antara pedagang serta pembeli menentukan mekanisme penetapan harga, dimana harga ditentukan tidak hanya oleh penawaran tetapi juga oleh kekuatan permintaan. Meskipun terdapat perbedaan pendapat dikalangan ulama mengenai keterlibatan pemerintah dalam menentukan harga, pihak yang mengaharamkan berpendapat bahwa keikutsertaan dari negara dalam menentukan harga justru akan menyebabkan ketidak seimbangan dari pasar dan berpeluang untuk menzalimi kedua pihak atau salahsatunya, sedangkan pihak yang membolehkan adanya intervensi pemerintah dalam menentukan harga beralasan bahwa dalam kondisi unik otoritas publik perlu melakukan mediasi dalam penetapan biaya, perihal ini berlaku jika menyangkut kelangsungan hidup banyak orang.

Abstract

This research aims to study the economic thinking of Muslim scholars who lived during the Abbasid dynasty, namely Al-Mawardi, and Al-Ghazali. Where does the state get financial resources according to Al-Mawardi, and what is the theory of money and markets from Al-Ghazali's perspective? The research method is qualitative with a literature study approach that originates from international journals, national journals, websites, and books by Al-Mawardi and Al-Ghazali. The results showed that according to Al-Mawardi, the sources of state finance were obtained through the collection of zakat, Khaimah, fa'i, jizyah, kharaj, public ownership, taxes, and debt. Furthermore, Al-Ghazali's perspective on money is as a medium of exchange in trade. It has "intrinsic" value or value contained in itself, such as gold, silver, or paper used as a medium of exchange. Money is a medium of exchange, a unit of account, a measure of the value of goods, providing social welfare and helping to improve social conditions. Meanwhile, the market in AL-Ghazali's concept is not only a place for transactions between sellers and buyers but also a place of worship and to earn the pleasure of Allah through sharia-compliant trading activities. Tujuan penelitian ini adalah untuk mempelajari pemikiran ekonomi cendekiawan Muslim yang hidup di masa dinasti abbasiyah yaitu Al-Mawardi dan Al-Ghazali. Dari mana negara mendapatkan sumber keuangan menurut Al-Mawardi serta bagaimana teori uang dan pasar dalam perspektif Al-Ghazali.  Metode penelitian adalah kualitatif dengan pendekatan studi literatur yang bersumber pada jurnal internasional, jurnal nasional, website, dan buku baik karya Al-Mawardi maupun karya Al-Ghazali. Hasil penelitian menunjukkan bahwa sumber keuangan negara menurut Al-Mawardi diperoleh melalui pengumpulan zakat, ghanimah, fai’, jizyah, kharaj, kepemilikan umum, pajak, dan utang. Selanjutnya perspketif Al-Ghazali tentang uang adalah sebagai alat tukar dalam perdagangan dan memiliki nilai “intrinsik” atau nilai yang terkandung dalam dirinya sendiri seperti emas, perak, atau kertas yang digunakan sebagai alat tukar. Fungsi uang sebagai alat tukar, satuan hitung, pengukur nilai barang, memberikan kesejahteraan masyarakat, dan membantu memperbaiki kondisi sosial. Sedangkan pasar dalam konsep AL-Ghazali tidak hanya sebagai tempat bertransaksi antara penjual dan pembeli tetapi juga sebagai tempat beribadah dan meraih ridha Allah melalui aktivitas perdagangan yang sesuai syariah.

Abstract

Penelitian ini bertujuan untuk mengetahui pengelolaan badan usaha milik Pesantren dan potensi usaha yang dapat mengembangkan ekonomi mandiri di Pesantren Nahdatul Ulum Kabupaten Maros. Penelitian ini menggunakan metode deskriptif dengan pendekatan kualitatif. Dan mengumpulkan data melalui riset lapangan dengan Teknik observasi, wawancara dan dokumentasi. Hasil penelitian ini adalah unit-unit usaha yang dijalankan pondok Pesantren Nahdatul ulum Kabupaten Maros seperti: Aminah Mart, Annisa Laundry, dan Wardah Cafe and Bakery, merupakan unit usaha yang memiliki pengelolaan yang berbeda-beda. Akan tetapi seluruh unit usaha tersebut dikelola dengan metode yang sama. perencanaan, pengorganisasian, pengaktualisasian, dan pengontrolan. Sehingga keuntungan dalam pengelolaan unit usaha tersebut dapat menambah kas operasional pondok pesantren.

Abstract

This study aims to determine the effect of the distribution of productive zakat on the welfare of mustahik at BAZNAS Bulukumba Regency. Using quantitative methods. The population used in this study are productive zakat recipients at the BAZNAS of Bulukumba Regency which were obtained through non-probability sampling techniques and purposive sampling methods. The research data was obtained by distributing questionnaires to 57 mustahik as respondents. Then testing the data either through the classical assumption test, simple linear regression test, hypothesis testing and coefficient of determination test. So it is obtained that productive zakat simultaneously has a significant effect on the welfare of mustahik Baznas Bulukumba Regency. The coefficient of determination is 79.3%. This result shows that the ability of the independent variable (productive zakat) to explain the dependent variable (mustahik's welfare) is 79.3%.

Abstract

Al-Maududi and Abdullah Saeed are Muslim scholars. He contributed various thoughts in the field of economics, one of which is related to usury and bank interest. But there are differences of opinion between the two.  The purpose of this study is to look at the views of Al-Maududi and Abdullah Saeed regarding usury and bank interest. The method used is a literature study with a descriptive qualitative approach. Data sources come from secondary data sources, namely journals and books related to the discussion. The result of the research is that Al-Maududi firmly rejects bank interest because the institution is a source of danger and evil through its influence on human character because it is influenced by the love of money. In addition, Al-Maududi stated that there is an element of injustice in bank interest and it is clearly prohibited in Islam. While Abdullah Saeed views the prohibition of usury based on the historical situation and conditions behind the revelation of the verse, so related to bank interest Abdullah Saeed argues that bank interest is not included in usury because the context of usury in ancient times is very much different from usury today.

Abstract

This study aims to determine the practice of mu'athah buying and selling at STIBA Makassar and elaborate the procedures and laws for carrying out each mu'athah buying and selling transaction without any supervision from the seller. This study used a qualitative descriptive research method with a phenomenological approach. The data collection methods used were observation, interviews, and documentation. The data sources in this study were STIBA Makassar students, sellers of refilled water gallons, buyers, lecturers, and administrators as informants; the sources of primary data and documents in the form of data or tables of information as the secondary data. The results found a basis for the philosophy of mu'athah buying and selling, which existed during the period of the Prophet Muhammad and his companions until now because the ulama would not have different opinions regarding the law if mu'athah buying and selling transactions never existed. The practice of mu'athah buying and selling at STIBA Makassar often involves theft, and the suspect tends to return the thing during the fifth semester and above. The law of mu'athah buying and selling is permissible according to most ulama based on the evidence from the QS. Ali-Imran/3:41 and a hadith narrated by a Jewish enslaved people. The problem that occurs from the practice of buying and selling at STIBA Makassar is not due to problems with the contract, but there are problems out of the contract; when the vendible is often lost, it means that there is a theft and it is illegitimate.
