Abstract

Penelitian ini dilatarbelakangi oleh masih ditemukannya praktik intimidasi yang dilakukan oleh aparat kepolisian terhadap warga negara dalam pelaksanaan kebebasan menyampaikan pendapat di muka umum, yang berpotensi melanggar hak konstitusional dan prinsip negara hukum. Penelitian ini bertujuan untuk menganalisis kecukupan pengaturan perlindungan hukum secara normatif dan menilai pelaksanaannya dalam praktik. Metode penelitian yang digunakan adalah penelitian hukum yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual, serta bersifat preskriptif. Hasil penelitian menunjukkan bahwa pengaturan perlindungan hukum terhadap korban intimidasi dalam Undang-Undang Nomor 9 Tahun 1998 secara normatif telah ada, namun belum memberikan kepastian hukum yang optimal karena masih bersifat umum, termasuk ketentuan sanksi dalam Pasal 18, serta belum mengatur secara tegas bentuk intimidasi, hak korban, dan mekanisme perlindungan serta pemulihan. Penelitian ini menyimpulkan bahwa diperlukan penguatan norma hukum dalam Undang-Undang Nomor 9 Tahun 1998 guna menjamin perlindungan hukum yang lebih pasti dan berkeadilan bagi korban intimidasi, serta disarankan adanya penyempurnaan pengaturan dan optimalisasi peran aparat kepolisian dan lembaga pengawas dalam pelaksanaannya.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisa mengenai bagaimana bentuk perlindungan hukum terhadap konsumen dalam menggunakan aplikasi ojek berbasis online oleh mahasiswa Fakultas Hukum dan Ekonomi Bisnis dan apa saja dasar perlindungan hukum terhadap konsumen dalam menggunakan apikasi ojek berbasis online. Jenis penelitian ini adalah yuridis normatif yaitu pendekatan ysng berdasarkan bahan hukum utama dengan cara menalaah teori-teori, konsep-konsep asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Data yang terkumpul dianalisis secara kualitatif. Hasil dari penelitian menunjukkan bahwa bentuk perlindungan hukum terhadap konsumen dalam mengunakan aplikasi Ojek Berbasis Online. Berdasarkan Undang-Undang Nomor 8 tahun1999 tentang Perlindungan konsumen yaitu perlindungan hukum preventif yang diberikan oleh pemerintah dengan tujuan untuk mencegah sebelum terjadinya pelanggaran terhadap pengguna aplikasi ojek online yang mana sudah di atur di dalam Undang-Undang Nomor 8 tahun 1999 tentang Perlindungan Konsumen. Dan cara penyelesaian sengketa terhadap konsumen dalam menggunakan aplikasi ojek berbasis online adalah ketentuan Pasal 45 ayat (3) Undang-undang Nomor 8 tahun 1999 tentang Perlindungan Konsumen yang berbunyi “penyelesaian sengketa diluar pengadilan sebagaimana diamaksud pada ayat (2) telah menghilangkan tanggung jawab pidana sebagaimana diatur dalam Undang-Undang”. Hal ini bearti meskipun para pihak, pelaku usaha dan konsumen telah atau sedang menyelesaikan sengketa baik melalui pengadilan perdata, tetap berlaku aspek pidana.

Abstract

Perusahaan membutuhkan dana sebagai modal dalam rangka untuk menjalankan usaha nya. sebuah perusahaan dapat diperoleh dari berbagai hal, salah satunya adalah modal atau dana dari pemilik perusahaan itu sendiri. Sedangkan cara lain dapat dilakukan melalui transaksi jual beli saham atau penyertaan modal pada perusahaan. Untuk membiayai kelangsungan perusahaan itu sendiri, misalnya dengan melakukan pembelian aktiva tetap, membeli bahan-bahan yang diperlukan untuk menjalankan proses produksi,atau modal dimanfaatkan sebagai piutang dagang dan persedian kas. Seperti apa mekanisme perjanjian jual beli saham di pasar modal dan perdagangan tanpa warkat dalam memenuhi syarat perjanjian, tujuannya analsis hubungan jual beli saham Buku III BW dan hubungan perjanjian jual beli kaitan dengan scriptlees trading. Metode Yuridis Normatif pendekatan yang berdasarkan bahan hukum utama dengan cara menalaah teori-teori, konsep-konsep asas-asas hukum serta peraturan perundang-undangan,hasilnyatransaksi jual beli saham di pasar modal menurut Undang-Undang No.8 Tahun 1995 dilakukan dengan cara maya bukan secara konvensioal atau secara nyata dengan eraglobalisasi dan perkembangan teknologi Sistem scriptless trading (perdagangan tanpawarkat) di pasar modal memenuhi syarat sah perjanjian, sistem tersebut telah memenuhisyarat sah perjanjian namun mekanisme transaksi jual beli tidak secara menurut KUH Perdata namun adanya peraturan perundang-undangan yang lain seperti asas lexspecialis de rogat lex generalis.

Abstract

The goal of this research is to describe usage of polite and impolite language in the film Sinners, directed by Ryan Coogler, as a means of persuasion. Brown and Levinson’s theory of politeness and Culpeper and Hardaker’s theory of impoliteness was used as the foundational theory of this study. Dialogue and character action from four scenes were analyzed with the qualitative descriptive method to explain how the first party tried to get the second party to do what was asked of them. Results indicate that a varied mix of politeness and impoliteness are utilized as a means of persuasion. Multiple times the first party would often start with polite strategies such as noticing the second party’s interests and quickly devolve into impoliteness such as the bald on record impoliteness superstrategy like. threats as a way to expedite the negotiations with the second party. This shows that a speaker that can adapt strategy usage to the mood of the situation is pivotal to the persuasiveness of the speaker, even if impoliteness like the promise of violence is part of said strategy. This also shows that negotiations can happen as a one sided persuasion battle or a two sided conversation with mutually exclusive goals. Thus this research adds to the body of previous research into how politeness is used as a tool of persuasion, while also offering new insight into how mixing politeness and impoliteness can be critical to persuasion. Abstract

This research is motivated by the increasingly urgent need to integrate ecotheological values ​​into Islamic Education Management (MPI) as a response to the global ecological crisis and environmental moral degradation in educational institutions. The purpose of this research is to analyze how ecotheological values ​​can be internalized in madrasah policies, curricula, and managerial practices, and to develop a conceptual model for managing ecologically-minded Islamic education. The main problem examined is the weak translation of the spiritual values ​​of khalīfah and amanah into a concrete managerial system. This research uses a contextual qualitative approach with data collection techniques through in-depth interviews, participant observation, and documentation review at MTs Al-Hidayah Sukajaya, Bandar Lampung. The results show that the successful integration of ecotheology into MPI depends on the synergy of three main aspects: ontology (spiritual values), epistemology (sources of Islamic and environmental knowledge), and axiology (managerial goals). It was also found that the desire for an ecologically-minded education program requires the support of madrasah policies, teacher capacity building, and partnerships with environmental institutions.

Abstract

This study aims to describe the professionalism of Aqidah Akhlak teachers in improving the character formation of eleventh-grade male students at Madrasah Aliyah Nurul Iman, Ulu Gedong, Jambi City. The study focuses on three main aspects: teachers’ efforts in strengthening students’ character, supporting and inhibiting factors affecting teacher professionalism, and the key aspects of teacher professionalism in shaping students’ character. This research employed a descriptive qualitative approach. Data were collected through interviews, classroom observations, and documentation, and were analyzed using data reduction, data display, and conclusion drawing techniques. To ensure the trustworthiness of the findings, triangulation was applied to meet the criteria of credibility, transferability, dependability, and confirmability. The results show that teachers improve students’ character through advice, exemplary behavior, and the habituation of positive values in daily school activities. Supporting factors include teachers’ educational background and teaching experience, collaboration among teachers and school members, and a supportive school environment. Meanwhile, the main inhibiting factors are limited instructional time and negative peer influences. Furthermore, teacher professionalism is reflected in four core competencies, namely pedagogical, personal, social, and professional competencies, which collectively contribute to the development of students’ discipline, responsibility, and moral conduct.

Abstract

Fraud in banking often occurs through credit manipulation, including fictitious loans or fictitious collateral using customers’ documents, even after previous loans have been settled. Such practices undermine the trust principle that underpins the bank–customer relationship as reflected in Article 29(4) of Law No. 10 of 1998, which requires banks to conduct their business in ways that do not harm the bank or customers’ interests and to maintain public trust. This study examines the urgency of the trust principle in banking and analyzes legal protection for customers harmed by credit manipulation committed by bank employees. The research employs an empirical juridical approach, combining normative analysis of relevant banking and civil law rules with field-based data on how credit manipulation is carried out and addressed in practice. The findings show that customer protection should be structured through preventive measures (internal controls, verification, complaint-handling mechanisms) and repressive measures (dispute resolution and law enforcement) across civil, criminal, and administrative avenues. From a civil law perspective, Articles 1365 and 1367 of the Civil Code provide the basis for holding both the employee and the bank institutionally liable for unlawful acts and vicarious responsibility, including compensation for customers whose identities or credit files are misused. Nevertheless, the quantification of damages remains case-specific and depends on proven material and immaterial losses.

Abstract

Sistem Penyediaan Air Minum (SPAM) Ibukota Kecamatan (IKK) Seulimeum Kabupaten Aceh Besar saat ini beroperasi dengan kapasitas terpasang 10 L/detik melalui Instalasi Pengolahan Air (IPA) yang dibangun tahun 2004. Kapasitas tersebut tidak lagi mampu memenuhi kebutuhan, ditandai dengan adanya 337 Sambungan Rumah (SR) tidak aktif serta tingkat kehilangan air (NRW) sekitar 10%. Seiring pertumbuhan penduduk dan rencana perluasan layanan ke Kecamatan Kuta Cot Glie yang belum memiliki SPAM, diperlukan peningkatan kapasitas sebesar 40 L/detik. Penelitian ini bertujuan menganalisis proyeksi kebutuhan air minum hingga 5 tahun ke depan serta mengevaluasi keandalan sumber air baku Sungai Krueng Seulimeum. Metode yang digunakan meliputi analisis hidrologi dengan model FJ Mock untuk simulasi debit aliran, perhitungan evapotranspirasi dengan metode Penman modifikasi, serta proyeksi kebutuhan air berdasarkan standar Permen PU No. 18/2007. Hasil analisis menunjukkan total kebutuhan air mencapai 44 L/detik dengan 4.382 SR pada tahun 2030. Debit andalan Q90 Sungai Krueng Seulimeum dibandingkan dengan kebutuhan tersebut menjadi dasar penilaian keandalan suplai. Studi ini menegaskan pentingnya peningkatan kapasitas SPAM Seulimeum sebagai solusi strategis regional sekaligus memastikan keberlanjutan suplai air baku untuk mendukung pelayanan masyarakat.

Abstract

Accountability in village financial management is a fundamental principle that must be implemented by village governments to ensure transparency and responsible use of public funds. However, various findings in Sikka Regency indicate weaknesses in financial administration, suggesting that internal organizational factors such as work motivation, organizational commitment, leadership style, and apparatus competency may influence the level of accountability. This study aims to analyze the effect of work motivation, organizational commitment, and leadership style on the accountability of village financial management, and to examine whether the competency of village apparatus moderates these relationships in Sikka Regency. The study employed a quantitative research approach using Structural Equation Modeling–Partial Least Squares (SEM-PLS). Data were collected from village government officials involved in the Village Financial Management Implementation Team (PPKD). The analysis was conducted using SmartPLS software to test the relationships between variables and the moderating effect of competency. The results show that work motivation, organizational commitment, and leadership style have a positive and significant effect on the accountability of village financial management. However, the competency of village apparatus does not moderate the relationship between these variables and financial management accountability. Organizational behavioral factors play an important role in improving accountability in village financial management. Strengthening motivation, commitment, and leadership quality among village officials is essential to promote transparent and responsible financial governance.

Abstract

The Polbeng Research Vessel is a small research ship developed by Politeknik Negeri Bengkalis (Polbeng) in collaboration with CV. Fatih Bahari Engineering. The vessel is constructed from High Density Polyethylene (HDPE) and has principal dimensions of 9 m length overall (LOA), 2.2 m breadth, and 1.2 m depth, powered by an 85 HP outboard engine. This study aims to evaluate the seakeeping and motion comfort performance of the vessel to support research activities involving personnel and onboard equipment. The seakeeping analysis is conducted using a frequency-domain approach based on Response Amplitude Operators (RAOs), where ship motions are evaluated under regular wave conditions. Four operational cases are considered, involving two wave heights (0.2 m and 0.4 m) and two wave encounter directions, namely beam seas (90°) and head seas (180°). Three ship motions are analyzed: heave, roll, and pitch. The results indicate that roll motion in beam seas conditions exhibits the most significant response compared to other motions, which is consistent with the theoretical characteristics of small vessels having shorter restoring arms for roll motion. Overall, the vessel’s motion responses remain within acceptable limits and satisfy established comfort criteria based on NORDFORSK 1987, STANAG 4154, U.S. Coast Guard (USCG), ISO 2631/1, ISO 2631/3, and BS 6841:1987 standards. The findings provide technical insight into the seakeeping behavior and comfort performance of HDPE-based small research vessels and serve as a reference for the design, evaluation, and development of environmentally friendly research and working vessels to enhance operational safety and effectiveness.
