Abstract

This study examines Indonesia’s halal certification as both a legal instrument and an economic policy with direct implications for international trade. Using a normative juridical approach combined with qualitative economic analysis, it explores Law No. 33 of 2014 on Halal Product Assurance (UUJPH) and its application to meat import policies, particularly in the aftermath of WTO disputes DS477/478. Halal certification is framed as a fundamental necessity for Indonesia’s Muslim majority and as a legitimate objective under Article XX(a) of the GATT 1994, which protects public morals. The findings highlight two strategic dimensions of the policy: first, consumer protection and the enforcement of maqāṣid al-sharīʿah through traceable ingredients and production processes; second, its role as an economic tool to enhance product competitiveness, expand international market access, and strengthen Indonesia’s position within the global halal supply chain. However, significant challenges persist. Domestically, limited legal literacy, certification costs, and the constrained capacity of micro, small, and medium enterprises (MSMEs) hinder certification uptake. Internationally, mandatory halal certification is sometimes perceived as an additional technical barrier to trade, sparking trade disputes. Analysis of GATT 1994 Articles III and XI and TBT Agreement Articles 2.2 and 2.4 underscores the need for Indonesia’s policy to avoid unjustifiable discrimination and unnecessary trade restrictions. The study concludes that harmonizing the protection of public morals with multilateral trade commitments is essential. Policy recommendations include revising the UUJPH to align with international standards, strengthening the Halal Product Assurance Agency’s capacity, providing incentives and support for MSMEs, and expanding mutual recognition agreements with key trading partners. With evidence-based, transparent, and inclusive policies, Indonesia can reinforce its role as a global halal industry hub while safeguarding its trade reputation and balancing religious values with international trade obligations.

Abstract

The study examined the regulation of party switching among members of Indonesia’s Regional People’s Representative Councils (DPRD) through an integrated analysis of constitutional law, political rights theory, and Indonesian Islamic jurisprudence. It critically evaluated Constitutional Court Decision No. 88/PUU-XXI/2023 to assess how individual political rights are balanced with institutional stability. Employing a normative legal research approach, the study combined statutory, case-based, and conceptual analyses, enriched with comparative insights from Malaysia, Pakistan, India, and South Africa. The findings found out that current legal mechanisms, particularly the Inter-Temporal Replacement (PAW) procedure under Article 193 of Law No. 23 of 2014, disproportionately empower political parties, undermining electoral legitimacy and legislators’ autonomy. By integrating maqāṣid al-sharī‘ah principles, including al-‘adl (justice), al-maṣlaḥah (public welfare), amanah (trust), and ḥurriyyah siyāsiyyah (political freedom), the study proposed normative and practical reforms to enhance proportionality, transparency, and fairness in regulating party switching. The research contributed to scholarship by linking constitutional law, political representation, and Islamic ethical principles, providing theoretical insights and actionable recommendations to strengthen democratic representation, protect political rights, and reinforce institutional legitimacy in Indonesia.

Abstract

Penelitian ini mengkaji dampak kebijakan unilateralisme dalam perdagangan internasional terhadap arus perdagangan global dan menganalisis peran World Trade Organization (WTO) dalam menghadapi tren tersebut. Menggunakan metode penelitian hukum normatif dengan pendekatan konseptual dan perundang-undangan, penelitian ini menganalisis ketentuan hukum internasional dalam kerangka GATT/WTO serta prinsip keadilan dan non-diskriminasi. Fokus kajian meliputi parameter pembenaran kebijakan unilateralisme, tantangan implementasi, dan dampaknya terhadap negara berkembang. Hasil penelitian menunjukkan bahwa kebijakan unilateral seperti tarif safeguard AS terhadap produk baja Indonesia dan larangan impor minyak sawit oleh Uni Eropa melalui RED II telah mengganggu arus perdagangan global dan merugikan negara berkembang. Meskipun terdapat parameter pembenaran yang meliputi ketentuan hukum internasional, prinsip keadilan non-diskriminasi, dan mekanisme penyelesaian sengketa, implementasinya menghadapi kendala berupa tidak adanya standar objektif yang tegas, potensi penyalahgunaan justifikasi lingkungan atau keamanan, dan ketegangan antara kedaulatan nasional dengan komitmen multilateral. WTO sebagai organisasi multilateral menghadapi tantangan dalam menegakkan prinsip multilateralisme di tengah meningkatnya kebijakan sepihak negara-negara maju. Penelitian ini menyimpulkan bahwa diperlukan penguatan mekanisme objektif dalam menguji validitas justifikasi kebijakan unilateral untuk mencegah diskriminasi dan menjaga keseimbangan sistem perdagangan global yang adil bagi semua negara anggota.

Abstract

This study aims to determine how the principles and provisions of international humanitarian law are applied in the context of the Palestinian conflict and to determine how the application or violation of international humanitarian law affects the Palestinian economy, particularly in the trade, infrastructure, and employment sectors. This study uses a normative legal research method, which is based on library research by analyzing primary, secondary, and tertiary legal materials. From this study, the author can draw the following conclusions: first, that the principles and provisions of IHL in the Palestinian conflict are still widely ignored in practice. Violations of the principles of distinction, proportionality, and prohibition of collective punishment often occur, even though they are clearly regulated in the Geneva Conventions and Additional Protocols. Second, that the impact of the application and violation of IHL is very significant on the Palestinian economy. Trade blockades, destruction of infrastructure, and rising unemployment demonstrate the close link between humanitarian law and economic aspects. In other words, violations of IHL are not only a legal issue, but also a major factor perpetuating the economic crisis in Palestine.

Abstract

This study examines various prevention efforts and efforts to overcome narcotics type metamfetamine in children by implementing diversion. The problems studied are related to the realm of the police in providing diversion to children who commit the crime. What challenges are faced by the police in providing diversion as an effort to overcome narcotics among children. This study uses an empirical research type with a juridical-sociological approach to see the role of the police in providing diversion to children who commit narcotics crimes. The types of data used are primary data and secondary data. Data collection techniques use interviews and document studies with selected quality data that is relevant to the problems raised. Data analysis used qualitative descriptive analysis. Based on the results of the analysis, the police’s considerations in providing diversion to children because they see external and internal factors from the child. Abstract

The participatory paradigm offers a different perspective on crime and justice. Instead of focusing solely on punishment, this paradigm emphasizes restoration, dialogue, and reconciliation. Applying the participatory paradigm could be a breakthrough in the context of high-profile criminal cases such as Ferdy Sambo, providing a more comprehensive and sustainable solution. The research problem in this study is that applying the participatory paradigm in the legal process of high-profile criminal cases like the Ferdi Sambo trial can shift the retributive approach within Indonesia's criminal justice system. It also explores the advantages and disadvantages of implementing the participatory paradigm in high-profile criminal cases like the Ferdi Sambo trial in Indonesia. The case of Ferdi Sambo, a police general in Indonesia involved in a murder scandal, sparked extensive debate and analysis regarding the participatory paradigm in the context of law enforcement and justice. In this context, the participatory paradigm involves various parties in decision-making and law enforcement processes. Implementing the participatory paradigm in science and legal philosophy has several advantages, such as enhancing inclusivity, transparency, and legitimacy by involving multiple stakeholders in knowledge production and legal processes. However, this approach also has drawbacks, including challenges in balancing public participation with the objectivity of the judicial process, potential conflicts of interest, and maintaining the integrity of the legal system.

Abstract

This article examines the interpretation and application of the necessary criterion under Article XX(b) of the General Agreement on Tariffs and Trade (GATT) 1994 through critical doctrinal analysis of the WTO dispute Brazil–Measures Affecting Imports of Retreaded Tyres (WT/DS332). Employing normative legal research with a case-analytical and comparative approach, the article evaluates Brazil's 2007 import ban on retreaded tyres against the tripartite necessity framework legitimate objective, rational contribution, and the absence of reasonably available less trade-restrictive alternatives and critically interrogates the Appellate Body's application of the chapeau's non-discrimination requirements. The analysis finds that while Brazil's measure provisionally satisfied the Article XX(b) necessity criteria on the merits of its public health and environmental justification, the Appellate Body's chapeau ruling deployed a formalist methodology that conflated discrimination rooted in protectionist intent with discrimination arising from pre-existing regional treaty obligations and domestic judicial intervention beyond governmental control. This article argues that this interpretive approach imposes structurally unrealisable demands upon developing country regulatory actors and produces normatively unjustifiable outcomes. The article advances an original analytical framework for contextually differentiated interpretation of the chapeau, grounded in the Vienna Convention's object-and-purpose mandate, that distinguishes between bad-faith protectionism and institutionally constrained regulatory inconsistency.

Abstract

Since 2017, military operations in Myanmar, justified as responses to attacks by Rohingya insurgent groups, have resulted in large-scale ethnic cleansing, forcing over 700,000 Rohingya to flee to neighboring countries, including Indonesia. Aceh, in particular, has become a significant destination due to its historical role as a refuge for displaced populations. The influx of refugees presents substantial challenges for local authorities and humanitarian organizations in meeting essential needs such as food, healthcare, and education. The United Nations High Commissioner for Refugees (UNHCR) has played a central role in responding to this humanitarian crisis by providing assistance and protection to Rohingya refugees in Aceh. Working closely with the Government of Indonesia and local non-governmental organizations (NGOs), UNHCR strives to uphold refugees’ fundamental rights and to mobilize international support effectively. Its interventions include the provision of basic necessities, access to healthcare services, educational programs, and efforts to facilitate integration into the local community where feasible. Despite these comprehensive efforts, significant challenges persist. Coordination among various actors—including government agencies, NGOs, and international donors—is often complex, resulting in gaps or overlaps in service delivery. Additionally, the sustainability of support remains a critical concern, as protracted displacement requires long-term planning, continuous funding, and consistent monitoring. This study focuses on two main issues: the role of UNHCR in delivering assistance and protection to Rohingya refugees in Aceh, and the challenges the agency faces in fulfilling its protection mandate. Employing doctrinal legal research, the study emphasizes international legal frameworks governing refugee protection and state responsibility. The findings indicate that while UNHCR has made substantial efforts to address immediate humanitarian needs, persistent challenges in coordination and sustainability must be addressed. Strengthening these areas is essential to ensure that the protection, welfare, and rights of Rohingya refugees are maintained effectively and sustainably over the long term.
