Abstract

AbstrakPenyalahgunaan ondel-ondel sebagai sarana mengamen di Jakarta telah menjadi permasalahan sosial dan budaya yang perlu mendapat perhatian serius. Berdasarkan hal tersebut, penulis tertarik untuk melakukan penelitian sebagai bentuk pelestarian ondel-ondel sebagai ikon budaya Betawi. Penelitian ini menggunakan metode Penelitian Hukum Yuridis-Empiris. Hasil penelitian menjelaskan bahwa adanya penyalahgunaan ondel-ondel disebabkan oleh tidak optimalnya pengawasan pada beberapa aspek seperti ekonomi, politik, sosial, budaya, dan sipil. Dalam hal ini pemanfaatan hukum sebagai sarana rekayasa sosial dapat menjadi solusi penyelesaian permasalahan dan juga didukung oleh para pemangku kepentingan yang turut serta melakukan perubahan pembangunan yang menjaga keberlangsungan kehidupan dan kualitas lingkungan hidup. Oleh karena itu diperlukan suatu peraturan daerah yang dapat menjadi alat untuk membantu masyarakat dalam pemberdayaan ondel-ondel agar dapat berjalan dengan baik.

Abstract

Mystery box is a product whose sales concept does not explain clearly and completely the information on the goods being traded. The purpose of this study is to find out how the validity and legal accountability of mystery box buying and selling transactions in e-commerce. The research method used in this study is to use normative legal research methods, considering the object/focus of this research study is a product of statutory regulations. The results of the study show that related to mystery box buying and selling transactions, business actors in carrying out these activities do not carry out the principle of good faith so that they are not in accordance with Article 45 paragraph 2 of Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions. In the event that the consumer is not provided with complete and clear information regarding the mystery box product purchased by the consumer, it is not in accordance with Article 4 of the PK Law, Article 7 of the PK Law, Article 8 of the PK Law, Article 18 of the PK Law, Article 48 and Article 50 paragraph (1 ) Government Regulation Number 71 of 2019 concerning Implementation of Electronic Systems and Transactions, for violations of Article 8 of the PK Law according to Article 62 paragraph (1) of the PK Law, can be subject to imprisonment and fines.

Abstract

The practice of stock pump and dump involving influencers such as Belvin Tannadi has become a significant concern in Indonesia following the introduction of the P2SK Law, which expands the legal scope of this practice. This article aims to examine the legal implications of pump and dump practices by influencers in Indonesia, particularly after the revision of Act No. 8 of 1995 as amended by Act No. 4 of 2023 on the Development and Strengthening of the Financial Sector (P2SK Law). This research uses a normative legal approach by applying a statute approach and a case approach to analyze the legal ramifications of pump and dump practices by influencers and their law enforcement in Indonesia. The results show that the perpetrators of the practice of pump and dump shares, especially influencers who violate this provision, may be subject to severe sanctions as stipulated in Article 22 paragraph (43) of the P2SK Law in conjunction with Article 104 of the PM Law with a minimum imprisonment of 5 years to a maximum of 15 years and a minimum fine of five billion rupiah and a maximum of one hundred and fifty billion rupiah. Although Indonesia has taken a step forward in capital market regulation by removing the word "material" from the P2SK Law, law enforcement against this practice still needs to improve speed and firmness. The Belvin Tannadi case demonstrates that the OJK needs to take tangible action, whereas, in the United States, law enforcement appears to be more efficient. Furthermore, safeguarding the integrity of Indonesia's capital market and investors from harmful practices hinges on collaboration among law enforcement agencies, prioritizing investor education, and enhancing transparency and accountability in handling cases.

Abstract

Disabilities are defined as people who show functional difficulties along with the obstacles present from the social environment so as to limit their participation in society. This research aims to provide insight for policy makers, practitioners, and organizations that care about the rights of workers with disabilities in developing and improving existing regulations and policies. This study uses a comparative legal research method that compares existing regulations in Germany, Canada, Australia, Japan, and the US with existing regulations in Indonesia through a statutory law research and a conseptual approach. The novelty in this writing is to conduct a comparative study of the rights of workers with disabilities from 4 continents, especially with 6 different countries to create ideal regulatory and policy concepts that can be implemented in Indonesia. However, Indonesia itself has created a Disability Vocational Training Center (PPVD) which aims to empower disabled workers to welcome an inclusive Indonesia.

Abstract

This paper aims to find out the Passing Off activities that was carried out on service trading brands in the form of Banks owned by State-Owned Enterprises (BUMN), namely PT Bank Mandiri (Persero) Tbk and the impacts it caused. The problem is focused on actions in business competition that occur when an irresponsible party takes advantage of a brand that already has a reputation and is well-known that belongs to another party by carrying out piggybacking and/or pillaging which is known as Passing Off. To approach this problem, a normative type of legal research is used, which then collects data through references from laws and regulations and is complemented by interviews. This study concludes that there is a company called PT Pengelola Investama Mandiri which has had an impact in the form of misinterpretation for the public and/or consumers because it has taken the Passing Off action by owning and using a logo identical to PT Bank Mandiri (Persero) Tbk for approximately 4 (four) years, while they are not part of or affiliated with the company.

Abstract

AbstrakPengabdian masyarakat ini mengeksplorasi implikasi dari ketiadaan legalitas usaha kepada akses bantuan pemerintah terutama Pemerintah Kabupaten Indramayu, Pemerintah Provinsi, dan hingga kepada Pemerintah Pusat. Metode pelaskanaan pengabdian kepada masyarakat ini menggunakan tahap persiapan antara lain proses field trip, penentuan prioritas masalah, dan pengumpulan dana disertai dengan analisis kebutuhan mitra sasaran yang kemudian dilanjutkan dengan tahap pelaskanaan dengan rapat pendapat dari para warga, pelaksanaan penyuluhan hukum, dan pendampingan pembuatan NIB dan PT Perorangan kepada 9 nelayan yang diharapkan dapat menjadi katalisator kemajuan Desa Majakerta, Kab. Indramayu. Hasil observasi menunjukkan bahwa betapa pentingnya pengetahuan masyarakat terkait legalitas usaha khususnya bagi nelayan agar dapat memaksimalkan perlindungan hukum terlebih ketika sudah mendapatkan perizinan dan PT yang mana negara hadir di dalamnya demi keberlangsungan usahanya di masa depan.AbstractThis community service explores the implications of the absence of business legality on access to government assistance, especially the Indramayu Regency Government, the Provincial Government, and up to the Central Government. The method of implementing this community service uses a preparatory stage including a field trip process, determining problem priorities, and collecting funds accompanied by an analysis of the needs of target partners which is then continued with the implementation stage with a meeting of opinions from residents, conducting legal counseling, and assisting in making NIB and Individual PT to 9 fishermen who are expected to be a catalyst for the progress of Majakerta Village, Indramayu Regency. The results of the observation show that the importance of community knowledge related to business legality, especially for fishermen, in order to maximize legal protection, especially when they have obtained licenses and PTs where the government is present in it for providing the sustainability of their business in the future.

Abstract

ABSTRACTThis article discusses a community service program aimed at empowering disabled students (santri) in efforts to prevent stunting through green business initiatives in Babakankaret Village. Stunting is a serious issue that affects child development and the quality of human resources. In this context, disabled students play a crucial role as change agents who can raise community awareness about the importance of balanced nutrition and healthy lifestyles. The program includes training in sustainable agricultural management and the cultivation of productive land utilizing local potential, such as fruit farming. In addition to enhancing the knowledge and skills of the students, this initiative also creates job opportunities and strengthens the village's economy. With support from various stakeholders, it is hoped that this program can help reduce stunting rates and create a healthy and independent generation in Babakankaret Village. This research highlights the importance of an inclusive approach to stunting prevention that involves all segments of society, including individuals with disabilities.Keywords: Stunting, Green Business, DisabilityABSTRAKArtikel ini membahas program pengabdian kepada masyarakat yang bertujuan memberdayakan santri disabilitas dalam upaya pencegahan stunting melalui inisiatif green business di Desa Babakankaret. Dalam konteks ini, santri disabilitas berperan penting sebagai agen perubahan yang dapat meningkatkan kesadaran masyarakat tentang pentingnya gizi seimbang dan pola hidup sehat. Program ini meliputi pelatihan manajemen pertanian berkelanjutan serta pengelolaan lahan produktif yang memanfaatkan potensi lokal, seperti pertanian tanaman buah. Selain meningkatkan pengetahuan dan keterampilan santri, inisiatif ini juga menciptakan lapangan kerja dan memperkuat ekonomi desa. Dengan dukungan dari berbagai pihak, diharapkan program ini dapat membantu menurunkan angka stunting dan menciptakan generasi yang sehat dan mandiri di Desa Babakankaret. Abstract

Patent rights not only facilitate new inventions but also encourage research and development through clear legal protection. They protect inventors from the unauthorized use or exploitation of their work. Patent infringement is a significant issue in intellectual property law that involves third parties. These third parties can be held legally accountable if they are involved in supplying or distributing products that infringe on patent rights. The aim of this research is to assess the effectiveness of patent law in protecting patent holders and to understand the responsibilities of third parties regarding patent infringement in Indonesia. The methodology used in this study is normative legal research with a statute approach. The statute approach is a research method that prioritizes legal materials in the form of legislation as the primary reference in conducting research. The findings indicate that although patent law in Indonesia provides a clear foundation for protecting the rights of patent holders, its implementation still faces challenges that reduce its effectiveness. One of the indicators of the lack of effectiveness of a regulation is that, despite some years with zero cases/complaints, the number of cases reappears in subsequent years, indicating that the system fails to maintain its effectiveness. Weak law enforcement creates uncertainty for patent holders. While there are mediation and arbitration mechanisms available, inconsistent implementation worsens the situation. Furthermore, third parties involved in patent infringement in Indonesia have legal responsibilities that must be fulfilled. Those who infringe patents can be subject to Article 161 of the Patent Law, which may impose penalties of up to four years in prison and/or fines of up to IDR 1 billion, with lighter sanctions for simple infringements. Abstract

The problem of stunting remains a prevalent health issue in Indonesia. Stunting not only affects typically developing individuals but can also occur among persons with disabilities. The suboptimal prevention of stunting is largely due to insufficient knowledge regarding its control and prevention within the disability community. Based on this concern, the Community Service Team of UPNVJ conducted an outreach activity with the aim of educating persons with disabilities about stunting prevention. The implementation method of this activity consisted of three stages: firstly, the pre-activity phase involved preparing the necessary resources and conducting location surveys. Secondly, the execution phase included checking for stunting among participants followed by providing educational sessions on stunting prevention. Lastly, there were discussions on stunting prevention strategies and distribution of support packages to the participants. The result of this activity is that participants gain an understanding of the methods and steps for controlling and preventing stunting among individuals with disabilities, and they are able to create balanced meal patterns or portions to prevent stunting.

Abstract

Penyandang disabilitas sering menghadapi hambatan dalam mengakses pendidikan yang setara, terutama dalam pendidikan inklusif yang belum sepenuhnya diterima atau dipahami oleh masyarakat. Di SLB Negeri 02 Jakarta, terdapat tantangan dalam meningkatkan pemahaman mengenai hak-hak pendidikan inklusif di kalangan penyandang disabilitas dan masyarakat sekitar. Tujuan kegiatan pengabdian ini adalah untuk memberdayakan penyandang disabilitas dengan memberikan pemahaman yang lebih baik mengenai hak dan kewajiban mereka dalam pendidikan inklusif, serta memberikan keterampilan yang dapat mendukung pengembangan diri mereka. Mitra dalam kegiatan ini adalah siswa-siswi SLB Negeri, komite orang tua, interpreter, dan guru atau pengajar SLB Negeri 02 Jakarta. Pelaksanaan kegiatan ini menggunakan metode Participatory Rural Appraisal (PRA), yang berfokus pada pendekatan partisipatif untuk mengumpulkan informasi dan memahami kondisi sosial, ekonomi, serta lingkungan di sekitar penyandang disabilitas. Hasil dari kegiatan pengabdian ini menunjukkan bahwa mayoritas peserta, baik penyandang disabilitas maupun masyarakat sekitar, merasa lebih terinformasi tentang hak-hak mereka dalam pendidikan inklusif. Selain itu, peserta juga merasa lebih percaya diri dalam mengakses layanan pendidikan yang sesuai dengan kebutuhan mereka. Evaluasi kegiatan menunjukkan bahwa peserta sangat antusias dan berkomitmen untuk mengimplementasikan pemahaman yang didapat untuk mendukung pendidikan inklusif di lingkungan mereka. Program ini berhasil meningkatkan pemahaman mengenai pentingnya pendidikan inklusif serta memberi dampak positif pada pengembangan potensi penyandang disabilitas.
