Abstract

The development of financial technology has led to the emergence of ICS as a solution to the limited access to formal credit still experienced by underbanked communities and MSME players in Indonesia. This study aims to analyze the role of ICS in increasing financial inclusion and to examine the implementation of POJK 29/2024 in supporting the optimization of ICS for MSMEs. The research method employed is normative legal research, utilizing a legislative and conceptual approach. The results demonstrate that ICS plays a crucial role in expanding credit access by leveraging AI and ML-based alternative data, thereby reaching underbanked communities and MSMEs that lack a formal credit history. In addition, POJK 29/2024 provides legal certainty and a more comprehensive governance framework for the implementation of alternative credit, particularly in relation to licensing, supervision, and consumer protection. Banks are expected to optimized the use of ICS in the credit assessment process to improve access to financing for MSMEs while continuing to apply the principle of prudence.

Abstract

The problem of stunting remains a prevalent health issue in Indonesia. Stunting not only affects typically developing individuals but can also occur among persons with disabilities. The suboptimal prevention of stunting is largely due to insufficient knowledge regarding its control and prevention within the disability community. Based on this concern, the Community Service Team of UPNVJ conducted an outreach activity with the aim of educating persons with disabilities about stunting prevention. The implementation method of this activity consisted of three stages: firstly, the pre-activity phase involved preparing the necessary resources and conducting location surveys. Secondly, the execution phase included checking for stunting among participants followed by providing educational sessions on stunting prevention. Lastly, there were discussions on stunting prevention strategies and distribution of support packages to the participants. The result of this activity is that participants gain an understanding of the methods and steps for controlling and preventing stunting among individuals with disabilities, and they are able to create balanced meal patterns or portions to prevent stunting.

Abstract

Peraturan Pemerintah Pengganti Undang-Undang (Perppu) dibentuk guna mengatasi keadaan genting dan memaksa. Namun, belum ada yang mengatur lebih detail mengenai makna secara spesifik terkait hal ihwal kegentingan yang memaksa, sementara Putusan Mahkamah Konstitusi masih sebatas tiga syarat sebagai parameter adanya kegentingan yang memaksa. Kewenangan presiden dalam  pembentukan Perppu didasarkan pada Pasal 22 ayat (1) UUD NRI 1945, yang menyebut adanya hal ihwal kegentingan yang memaksa sebagai syarat dalam membentuk Perppu. Tujuan penelitian ini yaitu untuk mengetahui kecenderungan pemakaian mekanisme pembatasan ihwal kegentingan yang memaksa dalam pembentukan Perppu di Indonesia, serta konsep pembatasan ihwal kegentingan memaksa untuk mewujudkan efektivitas dan legitimasi Perppu di Indonesia. Analisis penelitian menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan studi kasus. Metode ini menggunakan sistem norma, atau dengan kata lain sistem kaidah dan aturan, yaitu dengan menggunakan rujukan berupa doktrin hukum, asas-asas hukum, dan juga peraturan perundang-undangan. Hasil penelitian ini menunjukkan bahwa dengan hal ihwal kegentingan yang memaksa penting untuk diatur lebih lanjut dalam undang-undang. Oleh karena itu perlu dibuat aturan terkait pembatasan ihwal kegentingan yang memaksa ke dalam Undang-Undang Pembentukan Peraturan Perundang-undangan sebagai bentuk kepastian hukum. Hal ini untuk menghindari penfsiran secara subjektif oleh presiden dalam memaknai hal ihwal keadaan genting dan memaksa.

Abstract

Pengembangan koperasi untuk penyandang disabilitas merupakan langkah strategis dalam memberdayakan mereka secara ekonomi dan sosial. Namun, terdapat beberapa permasalahan utama yang perlu diatasi, yaitu kurangnya regulasi internal yang jelas, keterbatasan kemampuan anggota dalam pemasaran digital, dan pengelolaan keuangan yang belum terintegrasi. Koperasi PPDI (Perkumpulan Penyandang Disabilitas Indonesia) memiliki potensi besar, tetapi operasionalnya masih terhambat. Solusi yang diusulkan mencakup tiga bidang utama: penyusunan regulasi internal koperasi untuk menciptakan tata kelola yang transparan, pelatihan pemasaran digital agar anggota dapat memanfaatkan platform online, dan pengelolaan keuangan modern dengan penggunaan software keuangan sederhana. Metode pendekatan yang digunakan dalam pelaksanaan pengabdian ini adalah Participatory Action Research (PAR). Hasil pengabdian masyarakat menunjukkan bahwa penyusunan regulasi internal memberikan dampak yang baik kepada koperasi untuk menata tata kelola yang baik. Selain itu, luaran berupa situs web juga memberikan keluwesan kepada koperasi untuk mempromosikan produk yang akan berpengaruh terhadap penjualan dan keuntungan koperasi yang selanjutnya dapat dibagikan kepada anggota sebagai sisa hasil usaha. Pedoman laporan keuangan koperasi juga tidak luput dari pengabdian ini untuk memberikan kejelasan penyusunan laporan keuangan dan memberikan transparansi yang baik bagi koperasi dan anggotanya. Dengan demikian, keseluruhan luaran tersebut sekiranya dapat memberikan manfaat yang konkrit bagi koperasi penyandang disabilitas di kemudian hari.

Abstract

General Background: Well-known trademarks require legal protection to preserve exclusive rights, reputation, and fair market competition. Specific Background: This study compares protection models in Indonesia, Italy, and the United States. Knowledge Gap: Indonesian trademark regulation still lacks explicit and comprehensive provisions on dilution, judicial precedent, blurring, tarnishment, unfair advantage, and likelihood of confusion. Aims: This study analyzes the protection of well-known trademarks through comparative legal analysis using normative juridical and case approaches. Results: Italy and the United States provide broader safeguards through dilution-related doctrines that protect reputation, distinctiveness, and commercial identity, while Indonesia has progressed under Law No. 20 of 2016 but still requires clearer standards and stronger examination guidelines. Novelty: The study proposes reconceptualizing Indonesian well-known trademark protection by adopting explicit dilution provisions and structured assessment criteria. Implications: Future amendments should strengthen legal certainty, prevent bad faith registration, support fair competition, and maintain consumer trust. Highlights: Italy and the United States provide broader safeguards. Judicial precedent needs clearer regulatory recognition. Bad faith registration remains a key concern. Abstract

Industrial design is an applied art where the aesthetics and usability of an item are perfected. Design work is considered intellectual property because it is the product of the designer's thoughts and creativity so the copyright is protected by the government through Law No. 31 of 2000 concerning Industrial Design. This paper will discuss the use of the de minimis principle in the Industrial Design Law as well as the form of violation of Ventela's industrial design against Vans based on the De Minimis principle. This research is a type of normative juridical research, with a statutory approach and a conceptual approach. Based on the discussion that has been carried out in this paper, it is concluded that in the de minimis principle there are known factors that are usually considered by courts in applying the De Minimis doctrine, where these factors consist of the size and type of loss as well as the intention of the perpetrator. Even the industrial design dispute that occurred between Ventela and Vans shoes still has differences and the De Minimis principle can be applied because it fulfills the factors that become the parameters for the application of the De Minimis principle. Thus it is necessary to accommodate the De Minimis principle in the industrial design law as a solution to this problem.

Abstract

Village-Owned Enterprises (BUMDes) do not have legal certainty regarding their form of legal entity and it will make it difficult to meet the hope of all villagers to run businesses together in accordance with their characteristics, potential, and their respective resources. This research aims to provide input and solutions to the government to be able to accelerate the welfare of villages through BUMDes. The method used in this research is literary or library research by using normative juridical approach.  In the processing of data, this journal used qualitative and quantitative approach. This research showed the result that there is disorientation in the implementation of BUMDes regulations and policies, such as: first, the incompatibility of village regulations with other laws and regulations. Second, the low community initiative in driving the village economy. Third, the vagueness of BUMDes position as a social and commercial institution. Fourth, policies that have not directed the professionalism of BUMDes. The solution in accelerating village welfare through BUMDes is to provide the flexibility of BUMDes in the form of legal entity as a bridge to be able to enlarge capital in the investment sector.

Abstract

Prostitution is a complex problem because it intersects with so many aspects, especially in women's rights. However, the complexity of the problem is not accompanied by legal certainty of regulations regarding prostitution. This paper aims to find out and understand how the problem of criminalization of prostitutes and users of prostitution services in Indonesia. This research method is normative juridical law research with a concept and legislation approach. Data used secondary data consisting of primary, secondary, and tertiary materials. The result found is a legal vacuum related to the regulation of prostitution actions so that prostitutes and users of prostitution services often escape the legal snare. The need for criminalization as a countermeasure against users of prostitution services that are key in the practice of prostitution and protecting women's rights. As well as countermeasures by providing rehabilitation for prostitutes and in them to have skills and not fall back into the vortex of prostitution practices.

Abstract

Preparing development plans for the National Capital City (IKN) of Nusantara is one of the authorities that must be carried out by the Government to ensure the continuity and progress of the State's development in accordance with the mandate of Law Number 3 of 2022 concerning the National Capital City. However, in reality, the formulation of development plans for the new National Capital City still experiences problems related to the Nusantara Capital City Authority (OIKN). Problems with OIKN in preparing development plans for the new National Capital City can come from various factors, such as disharmony of laws and regulations. This study aimed to find out the power of the chairman of authority related to the planning and development of the Nusantara Capital City and the concept of the chairman of authority in preparing the Nusantara Capital City development plans in harmony with the Long-Term National Development Plan. The method used in this study was the Normative Method with interviews and Legislative, Conceptual, Philosophical, and Futuristic approaches which were analyzed in a descriptive-analytic manner and processed qualitatively. The results of the study show that in planning for the development of the national capital city, the chairman of authority has the power to determine the location of the new national capital city according to geographical, social, and economic conditions and to prepare a master plan. However, IKN development plans that are not guided by the Long-Term National Development Plan (RPJPN) as national development guidelines, but are instead guided by the Government's Master Plan (RIP) will create their own problems. The recommendation from this research is to launch a Hybrid Government system followed by the process of integrating the RIP into the 2025-2045 RPJPN so that it becomes the country's grand master plan for the next 20 years.

Abstract

In the framework of Indonesia's constitutional governance, the principle of checks and balances among constitutional institutions is an essential component of the legal system. Indonesia adopts a bicameral legislative system involving the House of Representatives (Dewan Perwakilan Rakyat; DPR) and the Regional Representative Council (Dewan Perwakilan Daerah; DPD). However, DPD possesses limited legislative authority, particularly in drafting laws. Additionally, judicial oversight is conducted by the Supreme Court (Mahkamah Agung/MA). This issue gives rise to research questions pertaining to  raised in this study are about the oversight concept in the lawmaking process from the perspective of comparative constitutionalism and the reconstruction of the oversight concept to realize enhance checks and balances. This study employs a mixed -method approach, incorporating normative-juridical, comparative, and conceptual methodologies  and legislative analysis. The findings indicate that Indonesia implements a soft bicameral concept characterized by an asymmetry of authority with in between the two both chambers in the lawmaking process, with the Constitutional Court acting as the primary a judicial oversight mechanism. In contrast, the United States and Russia maintain robust internal oversight within their legislative institutions, complemented judicial authority to oversee law implementation, thereby reinforcing  checks and balances between the legislative and judicial branches. It is recommended that the oversight framework within Indonesia's legislative process be strengthened by reconstructing oversight mechanisms through the expansion of the DPD's role, particularly in reviewing, approving, or vetoing draft legislation. This expansion is advised to enhance internal legislative oversight and create a more balanced system of checks and balances between legislative bodies. Furthermore, the reconstruction of oversight concepts in the lawmaking process should be pursued by granting the DPD greater authority to accept or veto draft laws, thereby reinforcing internal oversight within the legislative process
