Abstract

The Unitary State of the Republic of Indonesia is a country of law that guarantees justice and protection for its citizens. This protection is stated in the 1945 Constitution Article 28G paragraph (1), namely: "Everyone has the right to protection of themselves, their families, their honor, their dignity, and their property under their control, and has the right to a sense of security and protection from the threat of fear to do or not do something that is a basic human right". Fraudulent investment is an act of investment fraud, where the perpetrator asks for funds to be invested in a business that is in fact illegal and does not have a permit from the competent authority. This study aims to determine the form of legal protection for victims and to find out how to avoid fraudulent investment. The research method used is qualitative by using the type of literature study of journal analysis, or other media to become a literature reading that is arranged coherently and neatly. This literature study will look for various relevant articles by citing from various sources.

Abstract

Penelitian ini bertujuan untuk mengkaji pentingnya revitalisasi Stasiun Lambuang sebagai bentuk perubahan fungsi Kawasan, dari stasiun ke pusat kuliner dan dampaknya terhadap perekonomian masyarakat lokal. Penelitian ini menarik untuk dikaji karena terdapat peningkatan UMKM akibat perubahan fungsi stasiun lambuang menjadi pusat kuliner. Teori yang digunakan untuk menganalisis penelitian ini menggunakan teori struktural fungsional oleh Talcott Parsons. Penelitian ini menggunakan metode kualitatif dengan tipe penelitian studi kasus. Lokasi penelitian di Stasiun KA Bukittinggi, Kelurahan Tarok Dipo, Kecamatan Guguak Panjang, Kota Bukittinggi. Pemilihan informan dilakukan secara purposive sampling dengan 7 orang informan dengan kriteria masyarakat, pedagang, wisatawan, dan pelaku wisata. Pengumpulan data dilakukan melalui observasi lapangan dengan mengamati bagaimana aktivitas masyarakat dan pedagang khususnya di stasiun. Wawancara yang peneliti lakukan dengan menanyakan hal-hal yang berkaitan dampak perubahan pada sektor ekonomi. Dokumentasi yang digunakan peneliti kondisi Pasar Kuliner di Stasiun Lambuang. Hasil penelitian menunjukkan bahwa Revitalisasi Stasiun Lambuang ini memberikan manfaat signifikan, yaitu pertama, Revitalisasi ini menciptakan lapangan pekerjaan baru bagi Masyarakat lokal. Kedua, Revitalisasi Stasiun Lambuang mendorong pertumbuhan UMKM di sekitarnya yaitu sebanyak 116 pelaku UMKM di kawasan kuliner Stasiun Lambuang. Ketiga, Revitalisasi tersebut meningkatkan daya tarik wisatawan. Keempat, Revitalisasi ini memperkuat identitas budaya lokal melalui pengembangan infrastruktur yang masih mempertahankan aspek historis dan arsitektur bangunan. Kelima, terdapat penurunan pendapatan UMKM karena masih kurangnya pelatihan dan promosi dari pihak terkait.

Abstract

This research was conducted with the aim of helping MSME actors, particularly salted egg MSMEs in Penanae Village, to understand the importance of applying business ethics principles in their operations to create a good business system. This is also important to establish a healthy relationship between MSME actors and consumers. The method offered to partners/UMKM is in the form of education/socialization using LEAFLETS conducted door to door. The material provided in the leaflet includes discussions on (1) The Role of Ethics in Business for UMKM actors, (2) Benefits of Business for UMKM actors, (3) Application of ethical principles in business activities such as finance, marketing, production, and HR. The results of the education show a change in participants' responses, with a better understanding of attitudes and knowledge regarding business ethics.

Abstract

Although underage marriage without dispensation still occurs in various regions, this practice continues to generate debate between state positive law, Islamic law, and the customs prevailing in society. This study aims to analyze community leaders’ views on the practice of underage marriage without dispensation and to examine it from the perspective of ‘urf in Islamic law in Jorong Lubuak Simato. This study used a qualitative method with a descriptive approach. Data were obtained through interviews with community leaders, customary leaders, religious leaders, and related parties, and were then analyzed using descriptive qualitative analysis techniques. The results showed that some community leaders still justified the practice of underage marriage without dispensation on the grounds of preventing promiscuity, immoral acts, and concealing family disgrace, especially in cases of pregnancy outside marriage. However, community leaders also realized that the practice gives rise to various negative impacts, such as emotional immaturity, economic instability, and health risks for young couples. Viewed from the perspective of ‘urf, this practice can be categorized as ‘urf fasid because it is contrary to the prevailing statutory regulations, particularly Law Number 16 of 2019 concerning the minimum age for marriage. Nevertheless, under certain emergency conditions, the practice is regarded as an effort to avoid greater harm. This study emphasizes the importance of the role of community leaders, families, and the government in providing education and undertaking efforts to prevent underage marriage through social, religious, and legal approaches.

Abstract

The increasing number of cases of theft of community plantation products in Jorong Kampung Pinang indicates a legal problem in handling theft crimes at the local level, particularly when cases are returned by the police to the community to be resolved amicably. This study aims to analyze the legal regulation of plantation product theft based on the Indonesian Criminal Code and Law Number 39 of 2014 concerning Plantations, as well as to examine the conformity of the return of cases by the police with the perspective of Fiqih Jinayah. This study used a normative juridical method by analyzing legal norms related to plantation product theft and the settlement of criminal cases. The results show that the application of legal rules to cases of plantation product theft in Jorong Kampung Pinang is in accordance with applicable norms, both in general criminal provisions and special provisions in the plantation sector, although its implementation still has several weaknesses that need to be improved. In addition, the return of cases by the police to the community for amicable settlement is in line with the concept of ta’zir in Islamic criminal law. The conclusion of the study emphasizes that the settlement of plantation product theft cases needs to consider the conformity between positive law and the principles of Fiqih Jinayah so that law enforcement continues to ensure justice, order, and the public good.

Abstract

Character education is a systematic effort to guide, educate, and develop students’ behavior and morals so that they become accustomed to performing good deeds in accordance with the values of Islamic teachings. Character development needs to be carried out from an early age so that students have commendable behavior when entering the next stage of development. This study aims to analyze the implementation of Malam Bina Iman dan Taqwa (MABIT) activities in shaping students’ character at SD IT Madani 2 Islamic School Payakumbuh. This study used a qualitative descriptive method with a field research approach. Data were collected through direct observation, interviews with teachers, students, and parents, and documentation. The results showed that MABIT activities played a significant role in shaping students’ character, particularly discipline, independence, responsibility, and self-confidence. The implementation of MABIT activities included various spiritual and character-building activities, such as congregational prayers, religious lectures, and self-reflection. The main supporting factors for this activity were full support from the school and students’ enthusiasm, whereas limited facilities became an obstacle in its implementation. The conclusion of this study confirms that MABIT can serve as an effective strategy for Islamic character development in integrated Islamic elementary schools. The implications of this study indicate the importance of strengthening religious programs based on direct experience to support the sustainable development of students’ character.
