Abstract

This study aims to analyze the policy underwriting organization arrangements in insurance companies in Indonesia and the absence of a policy guarantor institution at insurance companies in Indonesia. The method used in research related to the regulation of policy insurance institutions in insurance companies in Indonesia uses normative juridical legal research. This study uses a statutory approach or statute approach to analyze legal issues in this study. Sources of legal materials in this study consist of primary legal materials, secondary legal materials, and also tertiary legal materials. The results of this study found that the insurance company has not regulated the policy guarantor in Indonesia in positive law in Indonesia even though it has been mandated in Law Number 40 of 2014 concerning Insurance. The absence of regulations regarding policy underwriters in insurance companies in Indonesia has resulted in public distrust of insurance companies, so it is necessary to regulate policies related to insurance companies in insurance companies in Indonesia. Penelitian ini bertujuan untuk menganalisis pengaturan lembaga penjamin polis pada perusahaan asuransi di Indonesia serta tidak adanya lembaga penjamin polis pada perusahaan asuransi di Indonesia. Metode yang digunakan dalam penelitian terkait pengaturan lembaga penjamin polis pada perusahaan asuransi di Indonesia ini menggunakan jenis penelitian hukum yuridis normatif. Penelitian ini menggunakan pendekatan perundang-undangan atau statute approach untuk menganalisis isu hukum dalam penelitian ini. Sumber bahan hukum dalam penelitian ini terdiri dari bahan hukum primer, bahan hukum sekunder, dan juga bahan hukum tersier. Hasil dari penelitian ini menemukan bahwa belum diaturnya lembaga penjamin polis pada perusahaan asuransi di Indonesia dalam hukum positif di Indonesia walaupun telah diamanatkan dalam Undang-Undang Nomor 40 tahun 2014 tentang Perasuransian. Tidak adanya pengaturan terkait lembaga penjamin polis pada perusahaan asuransi di Indonesia mengakibatkan ketidakpercayaan masyarakat terhadap perusahaan asuransi, sehingga perlu pengaturan terkait lembaga penjamin polis pada perusahaan asuransi di Indonesia.

Abstract

The principle of droit de suite is one of the most important principles in the law of guarantee,especially in fiduciary security. The principle implies that the rights of the creditor as therecipient of the fiduciary objects continue to follow the object of guarantee, wherever theobject is, to guarantee the repayment of the debts of the debitor. The rights which are ownedby the creditor as the recipient of fiduciary security in the principle seem to be absolute, butin fact if it is related to de practice, the principle of droit de suite has certain limitations.The limitations of this principle is whon it is faced with higher interest, the individual rightsowned by the recipient of fiduciary must succumb, as in the case of illegal logging, whichonce was decided to test the Forestry Law by the Constitutional Court (Case DecisionNumber 012/PUU-III/2005). Although the State can perform fiduciary deprivation of theobject which is used for committing illegal logging, but from the aspect of material criminallaw, it cannot be done immediately to destroy the object of guarantee, since object of thefiduciary collateral, is not considered a dangerous thing. Whereas, from the legal aspects ofcriminal procedure, if the case has been decided, then there is a duty of the State to returnthe object of fiduciary to those who own it.From the aspect of civil law, the creditor as recipient of fiduciary who feel harmed as aresult of illegal logging practices may have standing to sue for damages under Article 1365of Burgerljik Wetboek. The provision is used, because the act of illegal logging is an actagainst the law and there are losses caused to the recipient of fiduciary.

Abstract

The purpose of this paper is to analyze, identify, and elaborate on the concept of escrow or escrow accounts including escrow agreements in relation to buying and selling transactions in Indonesia and to examine the role of Notaries as providers of escrow services in buying and selling transactions in Indonesia based on the prevailing laws and regulations. apply. This paper is a paper that used a normative legal research method using a statutory approach, a conceptual approach and an analytical approach. The results of the study show that the concept of escrow service is a service provided by a neutral or impartial third party with the aim of storing documents, securities, goods or money, based on a written agreement between the seller, buyer and escrow holder, where the agreement contains instructions on the procedures and conditions for the delivery of documents, securities, goods or money to certain parties, as well as the authority of a notary as a provider of escrow services in buying and selling transactions is not regulated in UUJN-P especially in Article 15 UUJN-P does not explain that a notary is authorized as escrow service provider in buying and selling transactions, so in other words a Notary does not have the authority to become an escrow service provider in buying and selling transactions. Tujuan penulisan ini adalah untuk menganalisa, mengidentifikasi, dan mengelaborasi konsep escrow atau escrow account termasuk juga perjanjian escrow dalam kaitannya dengan kegiatan transaksi jual beli di Indonesia serta mengkaji mengenai peran Notaris sebagai penyedia jasa escrow dalam transaksi jual beli di Indonesia berdasarkan peraturan perundang-undangan yang berlaku. Tulisan ini adalah tulisan yang menggunakan metode penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan (statute approach), pendekatan konsep (conceptual approach) dan pendekatan analisis (analytical approach). Hasil studi menunjukkan bahwa konsep jasa escrow adalah suatu jasa yang diberikan oleh pihak ketiga yang bersifat netral atau tidak memihak dengan tujuan untuk menyimpan dokumen, surat berharga, barang atau uang, berdasarkan atas perjanjian tertulis antara penjual, pembeli dan pemegang escrow, dimana perjanjian tersebut berisi instruksi tentang tata cara dan kondisi untuk penyerahan atas dokumen, surat berharga, barang atau uang ke pihak tertentu, serta Kewenangan notaris sebagai penyedia jasa escrow dalam transaksi jual beli tidak diatur dalam UUJN-P khususnya dalam Pasal 15 UUJN-P tidak menjelaskan Notaris berwenang sebagai penyedia jasa escrow dalam transaksi jual beli, sehingga dengan kata lain Notaris tidak memiliki kewenangan untuk menjadi penyedia jasa escrow dalam transaksi jual beli.

Abstract

This research aims to identify the regulation and dispute resolution regarding constructive termination of employment by a company in the perspective of Indonesian Labor Law. This research also compares the constructive termination of employment by companies based on International Law and Japan Labor Law. This is normative legal research with a statutory approach, conceptual approach, and also comparative law approach. The result shows that the constructive termination of employment has not been specifically regulated in the Indonesian Labor Law system, hence it becomes an exploitation gap that is used by companies to be able to terminate employment relations without protecting the worker’s right. The dispute resolution mechanism in terms of constructive termination of employments still refers to the provisions of the Industrial Relations Dispute Settlement Law, namely through bipartite negotiations, tripartite, and industrial relations courts. The constructive termination of employment has been substantively regulated in the ILO Convention C-158 concerning the Termination of Employment, which regulated in Article 4 to Article 6. Further in Japan, the constructive termination of employment is regulated in the Japan Labor Union Act, Act Number 174 of 1949 in Article 7 paragraph (i), (iii), and (iv) with its national enforcement.

Abstract

As a global principal, corporations have the obligation to comply with national and international hard law of human rights, respect soft laws and global standards. The United Nations Guiding Principles on Business and Human Rights (GPs) of 2011 were unanimously endorsed by the Human Rights Council and are respected as a global standard that stipulates that corporations should respect human rights when conducting their business activities. The purpose of this paper is to examine the scope and focus of National Action Plans (NAPs) by comparing the Netherlands NAP on Human Rights (2013) is compared to the UK’s updated NAP of 2016 with the aim of providing ideas and good examples of a NAP for Indonesia. This study used normative legal method. It is considered to be a valuable lesson both for developed and developing countries that for practical matters it is highly important to create and implement a NAP for the implementation of the GPs. Fortunately, Indonesia in June 2017 has launched a National Action Plan on Business and Human Rights (NAP). The burden responsibility to carry out the NAP on Business and Human Rights to corporation to be implemented strongly rests on the government authorities both central government and all levels authorities, including the local level, have the duty to implement human rights obligation, including to convince corporations that upholding the GPs will ultimately be to their benefit.

Abstract

Negara diakui sebagai salah satu subjek hukum dalam Hukum Perdagangan Internasional. Negara memiliki kedaulatan untuk mengatur barang atau jasa yang keluar dan memasuki wilayahnya. Kewenangan mengatur tersebut termasuk dalam kedudukannya pada posisi Negara sebagai pedagang. Dalam perkembangannya kedudukan Negara juga menjadi pihak pembeli. Tulisan ini bertujuan untuk mengekplorasi kedudukan negara sebagai pembeli dalam konteks  hukum perdagangan internasional dan penyelesaian sengketa yang dapat diambil oleh Negara berdasarkan Hukum Perdagangan Internasional. Tulisan ini merupakan penelitian hukum normatif melalui pendekatan peraturan perundang-undangan, pendekatan analitis dan konseptual. Hasil studi menunjukkan bahwa suatu Negara dapat menjadi pembeli melalui BUMN yang diwajibkan untuk memberitahukan perusahaan tersebut kepada Council for Trade in Good sebagai implementasi dari prinsip non-diskriminasi dan juga untuk menjamin transparansi kegiatan perdagangan. Dalam pengertian Negara sebagai pembeli, dapat dipahami bahwa hubungan perdagangan yang terjadi antara Negara sebagai pembeli dan pedagang adalah hubungan kontraktual. Oleh karena itu, prinsip kebebasan berkontrak, termasuk prinsip pemilihan cara penyelesaian sengketa dapat diterapkan, baik mengenai pilihan hukum maupun pilihan forum.

Abstract

This study aimed to examine the effect of the disputes classification in the industrial settlement system, comparing arrangements according to the perspective of the International Labor Organization, China, Japan, and Kazakhstan, and trying to find the ideal concept of the type of industrial dispute to apply in Indonesia. This research is normative legal research. The approaches used in this study were the statutory approach, conceptual approach, fact approach, and comparative approach. The results revealed that the classification of disputes in the industrial relations settlement system in Indonesia has an impact on the difficulty of the parties in classifying their disputes. Comparative studies were conducted to determine the classification of disputes in international law as well as in China, Japan, and Kazakhstan. The ideal concept that can be offered to Indonesia is the simplification or elimination of the classification of industrial relations to provide dispute resolution by applying the principles of fast, precise, fair, and inexpensive methods.

Abstract

Artikel ini menganalisis konsep Perseroan Terbatas pasca diundangkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Penelitian hukum normatif ini dengan menggunakan pendekatan perundang-undangan, pendekatan analisis konsep hukum dan pendekatan perbandingan. Hasilnya bahwa pasca diundangkannya UU Cipta Kerja terdapat bentuk badan hukum baru yaitu Perseroan Perorangan yang dikhususkan bagi pelaku UMK dengan tujuan untuk memudahkan pengembangan usaha bagi pelaku UMK dengan dapat membentuk badan usaha berbadan hukum hanya dengan satu orang pendiri/pemegang saham. Perubahan tersebut telah mengindikasikan terjadinya perubahan paradigma Perseroan Terbatas sebagai asosiasi modal. Hal ini berupa perluasan konsep Perseroan Terbatas dimana pendirian Perseroan Perorangan bagi UMK didirikan oleh 1 (satu) orang. Konsep tersebut bukan merupakan hal yang baru mengingat pada Pasal 7 ayat 5 dan ayat (7) UUPT bahwa perseroan dapat didirikan hanya oleh satu pemegang saham sebagaimana pada pendirian BUMN dan BUMD yang diatur juga di dalam UU BUMN dan PP No. 45 Tahun 2005 yang memungkinkan saham Persero seluruhnya dimiliki negara. Konsep tersebut dapat dipahami sebagai rujukan dalam mendirikan Perseroan Perorangan untuk pelaku UMK.

Abstract

ABSTRAK Negara Indonesia merupakan negara hukum, kalimat ini sudah tidak awam lagi bagi kita sebagai Warga Negara Indonesia, segala hal dalam Negara Indonesia sudah ada pengaturannya masing-masing dalam sebuah dasar hukum. Seluruh belahan dunia pada awal 2020 dikejutkan dengan kehadiran wabah virus Covid-19 yang menyebabkan jumlah kematian meningkat, dan menimbulkan aturan baru untuk meradakan virus dengan cara tetap berada dirumah, work from home, ketika melakukan kegiatan diluar rumah wajib menggunakan masker kesehatan, dan lain sebagainya. Tujuan penelitian artikel ini adalah untuk mengetahui penegakan hukum persaingan usaha terhadap praktek monopoli yang terjadi pada masa pandemi Covid-19 dalam penjualan masker Kesehatan dan untuk mengetahui peran lembaga KPPU dalam penegakan hukum persaingan usaha pada praktek monopoli penjualan masker kesehatan di masa pandemi. Artikel ini menggunakan suatu penelitian hukum normatif dengan pendekatan perundang-undangan dan komparatif. Hasil dari penelitian ini menunjukan bahwa pengaturan utama mengenai larangan praktek monopoli penjualan masker kesehatan di masa pandemi diatur dalam UU 5/1999. Dalam hal ini KPPU memiliki peran dalam menegakkan hukum sesuai dengan aturan UU 5/1999 dimana tugasnya sudah sepadan dengan wewenang KPPU yang diatur dalam Pasal 36, dalam hal ini berkaitan dengan wewenang KPPU melakukan tindakan penyelidikan atau pemeriksaan terhadap kasus-kasus praktek monopoli penjualan masker kesehatan di masa pandemi ini. Kata Kunci: Monopoli, Masker Kesehatan, KPPU ABSTRACT Indonesia is a state of law, this sentence is no longer common to us as Indonesian citizens, everything in the State of Indonesia has its own regulations in a legal basis. All parts of the world at the beginning of 2020 were shocked by the presence of the Covid-19 virus outbreak which caused the number of deaths to increase, and created new rules to contain the virus by staying at home, working from home, when doing activities outside the home, wearing a health mask, and so on. The purpose of this article is to determine the enforcement of business competition law against monopolistic practices that occurred during the Covid-19 pandemic and to determine the role of the KPPU in enforcing business competition law on the monopolistic practice of selling health masks during the pandemic. This article uses a normative legal research with a statutory and comparative approach. The results of this study indicate that the main regulation regarding the prohibition of monopolistic practices on the sale of health masks during the pandemic is regulated in Law 5/1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. In this case the KPPU has a role in enforcing the law in accordance with provisions of Law 5/1999 where the duties are commensurate with the KPPU’s authority as regulated in Article 36, in this case it relates to the KPPU’s authority to carry out investigations or examinations of cases of monopolistic practice of selling health masks during this pandemic. Abstract

Regulations regarding the protection of communal intellectual property in Indonesia are currently scattered in various regulations that are not explicitly stated in the form of Laws, and do not regulate benefit-sharing comprehensively. The purpose of this research is to elaborate on a protection strengthening model of Communal Intellectual Property based on the transplantation of policy content related to works of tradition, culture, custom, traditional knowledge, genetic resources and potential geographical indications from various existing legal policies and other sources both locally, nationally and internationally into the legal form of a Law, as well as a benefit-sharing regulation mechanism related to the commercial use of Communal Intellectual Property. The research method used is normative legal research with statutory, comparative, conceptual and analytical approaches. The results of the research showed that the current policy regarding Communal Intellectual Property in Indonesia is still in the hierarchy of Regulations of the Minister of Law and Human Rights and Government Regulations, namely Permenkumham 13/2017 and PP 56 of 2022. Several articles in the provisions of statutory regulations on Intellectual Property in Indonesia have regulated Communal Intellectual Property, but its nature is still very general. For stronger protection and legal certainty it is very urgent to regulate the protection policy in the form of a Law through a transplantation model of the substance of existing legal products related to Communal Intellectual Property, as well as strengthening of policy content including benefit-sharing in relation to the commercial use of Communal Intellectual Property.
