Abstract

This study examines the implementation of siyasah tanfidziyyah syar’iyyah in protecting migrant workers from Lampung, with a particular focus on the role of the Lampung Provincial Manpower Office. This concept refers to Islamic law-based policies aimed at achieving justice and welfare. Despite the existence of protective regulations, migrant workers remain vulnerable to exploitation. Using a qualitative approach with a case study method, this research collects data through interviews and documentation analysis. The findings reveal that the Manpower Office has implemented various policies, including counseling programs, agent verification, and cooperation with destination countries. However, significant challenges remain, particularly in monitoring illegal agents and ensuring post-return protection. This study recommends enhancing coordination, expanding training programs, and providing legal assistance to strengthen the protection of migrant workers in accordance with Islamic law principles.

Abstract

This article aims to explain the results of the author's analysis of the implementation of halal certificates on food products sold online, inhibiting and supporting factors for the application of halal certificates to food sold online, and the impact of Sharia economic law on the haleness of food products sold online without halal certificates. The results of the 2021 survey on e-commerce statistics show that the types of goods and services sold the most online in Lampung are food and beverage groups, totaling 40.86 percent of all businesses sampled by e-commerce. The rapid progress of buying and selling food online has become an additional task for halal certificate implementation agencies in providing security and comfort, especially for Muslim consumers in Indonesia, so they can consume halal food that is traded online. The research methodology that the author uses is qualitative in terms of the type of research documentation, interviews, and observations. The author goes directly to the field to conduct observations and interviews with primary data derived from the results of interviews with the BPJPH task force and LPPOM MUI. The results of the study show that there are no special strategies for food sold online. Supporting factors include the existence of institutions assisting the halal product process for MSME business actors. The inhibiting factor is that there is no direct regulation of cooperation with online business application server managers, a lack of public understanding of halal certificates, Analysis of Sharia Economic Law on the haleness of food products sold online: the haleness of products sold online or offline without MUI halal certificates are categorized as syubhat. According to Imam Nawawi, doing syubhat is  form of underestimating.the.law.without.realizing.that.they.have.done.haram.

Abstract

Marriage is a sacred institution in Islam that encompasses moral, social, and spiritual implications. The dowry, as an essential element of the marriage contract, has been prescribed to uphold the dignity of women and reinforce the foundation of the family. However, in social reality, the practice of dowry is often reduced to a mere symbol of formality or a burdensome customary obligation. This phenomenon illustrates the disconnect between the implementation of dowry and the objectives of Islamic law. This research employs a qualitative approach utilising normative-theological and sociological methods. Primary data were sourced from classical fiqh texts and al-Syāṭibi's seminal work (al-Muwāfaqāt), while secondary data were obtained from academic journals and customary marriage documents. This article adopts the framework of maqashid sharia and the principles of customary law (al-'ādah muḥakkamah), integrating perspectives from Islamic legal philosophy and cultural sociology theory to analyse the meaning of dowry both causally and contextually. The findings of the study indicate that the transformation of the concept of dowry from a customary symbol to a maqashid necessitates a reinterpretation of local values through a dialogue between tradition and the objectives of sharia. The dowry, restructured within the framework of maqashid sharia, contributes to the preservation of women's dignity, the strengthening of relational justice, and the enhancement of household harmony. This research presents the development of a maqashid causality analysis framework grounded in an Islamic social philosophy approach. Furthermore, it offers insights for both the community and policymakers to facilitate maqashid-based customary deliberation and enhance family law literacy. An extension of this research could involve an exploration of women's perceptions regarding the symbolic and strategic value of dowry within diverse Muslim customary communities.

Abstract

The phenomenon of singlehood or remaining unmarried often sparks debates within society, addressing aspects of religion, psychology, and health. The decision not to marry is often viewed as deviating from social norms and generates negative stigma, leading to various issues related to acceptance and its impact on individuals. This study employs a descriptive qualitative method to examine this phenomenon from multiple perspectives. Islamic law provides flexibility for individuals to remain unmarried, as long as the decision is based on the intention of piety and worship. Prominent scholars such as Imam Shafi'i and Imam Nawawi assert that living without a spouse is permissible, as long as it remains oriented towards spiritual goals. From a psychological standpoint, the choice to remain unmarried is influenced by factors such as family dynamics, views on independence, and life experiences. This decision may offer benefits, such as career development and personal freedom, but it can also present challenges in the form of social pressure and the risk of loneliness. From a health perspective, marital status is closely linked to both physical and mental well-being. Unmarried individuals tend to face a higher risk of mental health issues, such as depression and anxiety, yet they are also spared from marital conflicts that may negatively affect psychological well-being. This study concludes that the choice of singlehood can be understood from various viewpoints, while considering the individual’s circumstances, intentions, and needs. The contribution of this research is to provide a multidimensional insight into singlehood, which can serve as a reference for policymakers, health practitioners, and society in supporting individuals who choose this path wisely and with respect.

Abstract

The purpose of this study is to uncover the factors underlying the use of probono legal aid legal aid services in the Class 1A Religious Court of Tanjung Karang, Bandar Lampung City. This research is a field research (field research), primary data taken from service users, service managers and officials in the Class 1A Religious Court of Tanjung Karang in Bandar Lampung City, through structured free interviews. This research found the fact that the presence of Legal Aid Posts which provide probono legal aid services is very helpful for people who need legal assistance because of their limitations with the factors that become the reasons for using legal aid services for probono legal aid. For those who do not understand the law, the presence of Posbakum in the Class 1A Religious Court of Bandar Lampung City is very helpful in the process of resolving legal issues, as well as for those who do not have sufficient budget and funds to resolve legal issues that are being passed through, the presence of Posbakum is very helpful and reduce their financial expenses. The presence of Posbakum also facilitates and accelerates the resolution of legal issues.

Abstract

This study aimed to analyze the husband and wife partnership pattern due to the wife's role as a member of the Regional Parliament (DPRD) from the mubādalah (reciprocity) perspective. The qualitative descriptive approach was adopted and data were collected through interviews and documentation of 6 female respondents of the DPRD members in Pesawaran Regency, Lampung Province. Respondents were selected using purposive sampling, while the parameters used to examine the husband and wife partnership pattern included division of domestic work, family financial support, and decision-making processes. The result showed an increase in the impact of the partnership pattern on household harmony, which was assessed using the interpersonal communication theory of Joseph A. Devito and Kyai Faqih's mubādalah theory. Furthermore, the division of domestic work among wives as DPRD members could be categorized into two groups. The first was the shared responsibility between husband and wife, while the second was the exclusive responsibility assigned to the wife without the involvement of the husband. In terms of financial support, some wives relied solely on their husbands, while others shared the responsibility. All respondents used the family deliberation approach for decision-making and they agreed on the importance of building a good partnership based on the mubādalah principles between husband and wife. Mubādalah principle consisted of partnership, cooperation, reciprocity, and mutual understanding, which aimed to maintain household harmony.

Abstract

Penelitian ini meneliti perilaku membujang yang banyak kita jumpai di masyarakat. Hal ini lantas menimbulkan pertanyaan, apakah hal ini dibolehkan dalam Islam, sedangkan Islam menganjurkan untuk menikah, sebagai salah satu bentuk ketaatan atas peintah Allah swt. Adapun rumusan masalah dalam penelitian ini ialah bagaimana perilaku membujang dalam tinjauan istishlah. Tujuan dilakukannya penelitian ini adalah untuk mengetahui perilaku membujang dan tinjauan istishlah tentang perilaku membujang. Penelitian ini menggunakan metode kepustakaan (library research) atau kualitatif, Pendekatan yang digunakan adalah pendekatan normatif. Hasil penelitian ini adalah membujang adalah suatu larangan dan juga terdapat banyak mudharatnya. Demikian juga Rasulullah SAW melarang membujang (at-Tabattul) yakni tidak menikah.  Atas dasar itu, selama mampu menikah, maka dianjurkan untuk menikah dan pilih wanita yang memiliki agama yang baik, untuk menjaga keturunan dan membangun rumah tangga yang sakinah, mawaddah, wa rahmah atas izin dan jalan yang di ridhai oleh Allah SWT dan Rasulullah SAW.

Abstract

The advancement of information technology has given rise to various types of online transactions, one of which is marketplace trading. At present, Indonesia is the country with the largest Muslim population in the world, reaching 86.9% of the total population, and they are also active in online shopping. Although awareness and public interest in halal products is increasing, an understanding of the urgency of transactions in accordance with sharia principles is still needed. The purpose of this research is to identify market opportunities as well as existing challenges in order to formulate strategies for developing sharia marketing management in halal marketplaces to be more optimal and in accordance with sharia principles. The research method used in this study is a literature study method. The results show that halal marketplaces in Indonesia have the potential for a large market and are an innovation from previously existing marketplaces. However, in addition to this potential, there are a number of challenges in developing a halal marketplace, including the lack of public understanding of the sharia economy, lack of involvement in the sharia financial system, and the still limited use of the halal marketplace platform by MSMEs focusing on halal products. It is hoped that this potential and challenges can serve as a guide in formulating and developing policies in this field.

Abstract

The concept of kafā’ah (compatibility) in selecting a life partner is one of the fundamental principles in Islamic law, encompassing parity in aspects of religion, social status, economy, and others. In the context of religious organizations, kafā’ah has a more specific dimension, namely equality in terms of beliefs, commitment, and involvement in a particular religious organization. Religious organizations often serve as a medium for shaping an individual's religious identity, making it important to choose a partner from the same organizational background as a factor for maintaining harmony and alignment in family life.In modern times, numerous religious organizations are followed by Muslims. The diversity of these religious organizations affects practices of worship, views on local traditions, and even involvement in social and political issues. Thus, the research problem formulated by the author is: How does choosing a partner with the same religious organization affiliation impact family harmony, and what is the perspective of istihsān regarding marriage between individuals of the same religious organization? The author employs a qualitative research method through a case study approach to produce descriptive and analytical data. The research also uses a normative and sociological approach with a descriptive method. Data collection techniques include interviews, observations, and documentation.Based on field findings, the conclusion of this research is that choosing a partner from the same religious organization does impact family harmony. The harmony within a marriage between partners from the same religious organization can be observed through several indicators: First, there is a balance of rights between husband and wife. Second, there is cooperation in raising and educating children. Third, there is positive interaction with the extended family and society. Fourth, there is mutual support in enhancing spirituality. From the perspective of istihsān, choosing a partner from the same religious organization is preferable for practical application. Istihsān, as a method of istinbāth (derivation of legal rulings), is capable of aligning Islamic law with contemporary issues by selecting the most beneficial option among the good ones. In general principles, the religious criterion in the concept of kafā’ah focuses on a person’s piety and character. However, due to differences in views on piety and character between religious organizations, from the perspective of istihsān, selecting a partner from the same religious organization is prioritized as it is considered more beneficial.

Abstract

ABSTRACT This study discusses the Law of Inheritance from Socio-Historical, Normative, and Psychological perspectives. The objectives of this research are, firstly, to understand the reasons why Islam regulates the division of inheritance, secondly, to determine whether the division of inheritance between men and women as stipulated in Islamic law can be considered just in the context of contemporary society, and thirdly, the impact of the division of inheritance when implemented fairly and unfairly. The research method employed in this discussion is library research conducted with Socio-Historical, Normative, and Psychological approaches. The data analysis method used is Analytical Descriptive. The findings of this research indicate that Islam regulates the division of inheritance to protect the existence of women who, in pre-Islamic times, did not have the right to inherit, so with the advent of Islamic law, women also have rights in inheritance. The division established by Islamic Law is still considered fair when viewed in the context of the present time, although the concept of 2:1 is not the primary reference. If a 1:1 division is agreed upon by each heir, then it can be considered fair if no party feels aggrieved. Fundamentally, the division of inheritance must prioritize the principle of justice, as inheritance issues are sensitive matters that can impact an individual's psychological well-being. Psychologically, an individual may develop feelings of envy and resentment if the division of inheritance is not conducted fairly, thus potentially fracturing family relationships. Keywords : Inheritance Law, Socio-Historical, Normative, Psychological ABSTRAK Penelitian ini membahas tentang Hukum Waris dalam perspektif Sosio Historis, Normatif, dan Psikologis. Adapun tujuan dari riset ini yakni, pertama, agar diketahui alasan Islam mengatur pembagian harta waris, kedua, agar diketahui apakah pembagian harta waris antara pria dan wanita yang telah ditetapkan pada hukum Islam dapat dikatakan sudah memenuhi unsur keadilan pada konteks masyarakat masa kini, ketiga, dampak dari pembagian harta waris jika dilaksanakan secara adil dan tidak adil. Metode penelitian pada pembahasan ini ialah riset kepustakaan (library research) yang dibahas dengan pendekatan Sosio Historis, Normatif, dan Psikologis. Adapun metode analisis data yang dipergunakan ialah Deskriptif Analitik. Hasil dari riset ini, jika Islam mengatur pembagian harta waris untuk melindungi eksistensi wanita yang pada masa pra-Islam tidak punya hak memperoleh harta waris sehingga dengan turunnya hukum Islam, wanita juga memiliki hak dalam harta waris tersebut. Adapun pembagian yang sudah ditetapkan Hukum Islam tetap dikatakan adil jika dikaitkan dalam konteks masa kini, akan tetapi konsep 2:1 tidak menjadi acuan utama. Jika pembagian 1:1 disepakati oleh masing-masing ahli waris, maka bisa dinyatakan adil jika tidak ada pihak yang merasa dirugikan. Pada dasarnya, pembagian harta waris harus mengedepankan prinsip keadilan, karena masalah harta adalah hal yang sensitive yang dapat berdampak pada psikologis seseorang. Secara psikologis, seseorang dapat menimbulkan rasa iri dan dengki jika pembagian harta waris tidak dilaksanakan secara adil, sehingga dapat memecahkan hubungan kekeluargaan.
