Abstract

AbstractCovid-19 pandemic is a virus that attacks the human respiratory system and can be transmitted only to humans. This type of virus has become epidemic in Indonesia and even the whole world, the impact is extraordinary because it has killed tens of thousands of people in Indonesia and also throughout the world. In addition to having an impact on health, this virus also has an impact on economic aspects including the Indonesian economy, which has reduced company productivity and even stopped several business sectors such as in the field of tourism, retail, restaurants and others. Because the impact on business activities is extraordinary, resulting in millions of workers losing their income due to being laid off and terminated by employers. Because the workforce has been laid off and / or terminated by the employer of the employer, legal protection is needed for his rights so that the worker concerned continues to earn income during the co-19 pandemic. According to the Circular of the Minister of Manpower Number 05 / M / BW / 1998 of 1998 concerning wages of workers who were laid off not in the direction of termination of employment, the worker will get full wages for each month and if the employer does not have the ability to pay in full then it needs to be negotiated with workers regarding wages, how they are paid and how long they are laid off. It can also be seen from the Circular of the Minister of Manpower No. SE-907 / MEN / PHI-PPHI / X / 2004 concerning Prevention of Termination of Mass Employment. Whereas for workers who are terminated from employment, it can be seen from Law No. 13 of 2003 concerning Manpower.Keywords: Labor Rights, Pandemi Covid-19AbstrakPandemi Covid-19 merupakan virus yang menyerang pada sistem pernafasan manusia dan dapat menular hanya pada manusia. Jenis virus ini telah mewabah diIndonesia bahkan seluruh dunia, dampaknya luar biasa karena telah menewaskan puluhan ribu manusia di Indonesia dan juga di seluruh dunia. Selain berdampak pada kesehatan, virus ini juga berdampak pada aspek ekonomi termasuk perekonomian Indonesia yaitu telah menurunkan produktivitas perusahaan bahkan hingga menghentikan beberapa sektor usaha seperti dalam bidang parisiwata, ritail, restoran dan lainnya. Karena dampaknya terhadap kegiatan usaha yang luar biasa sehingga mengakibatkan jutaan tenaga kerja kehilangan penghasilan akibat dirumahkan dan diputuskan hubungan kerja oleh pengusaha. Karena tenaga kerja telah dirumahkan dan/atau diputuskan hubungan kerja oleh pengusaha maka diperlukan perlindungan hukum atas hak-haknya agar pekerja yang bersangkutan tetap memperoleh penghasilan selama masa pandemi covid-19. Menurut Surat Edaran Menteri Ketenagakerjaan Nomor 05/M/BW/1998 tahun 1998 tentang upah pekerja yang dirumahkan bukan ke arah pemutusan hubungan kerja maka bagi pekerja tersebut akan mendapatkan upah penuh untuk setiap bulannya dan apabila pengusaha tidak mempunyai kemampuan membayar secara penuh maka perlu dirundingkan dengan pekerja mengenai besarnya upah, cara pembayarannya dan lamanya waktu dirumahkan. Selain itu juga dapat dilihat dari Surat Edaran Menteri Tenaga Kerja No. SE-907/MEN/PHI-PPHI/X/2004 tentang Pencegahan Pemutusan Hubungan Kerja Massal. Sedangkan bagi tenaga kerja yang diputuskan hubungan kerja maka dapat ditinjau dari Undang-undang No.13 Tahun 2003 tentang Ketenagakerjaan.Kata Kunci: Hak Tenaga Kerja, Pandemi Covid-19.

Abstract

The trend of interfaith marriages is currently gaining interest in Indonesia. Data shows that by 2022, data on interfaith marriages will total 1425 spouses. The presence of the polemic about interfaith marriages in society has resulted in the government, through the Supreme Court, issuing SEMA 2/2023, which prohibits courts from accepting applications for interfaith marriages. Therefore, it is necessary to know the legality of interfaith marriages after SEMA 2/2023, especially regarding the legal ratio of the issuance of SEMA 2/20232. This study aims to determine the basis for the publication of SEMA 2/2023 and the validity of interfaith marriages after the publication of SEMA 2/2023. The study's novelty is demonstrated by the actuality of regulations published related to interfaith marriages in Indonesia, where previous studies analyzed the legality of interfaith marriages before the publication of SEMA 2/2023. The normative legal writing method is used by several approaches, such as the statutory regulations approach -invitation, case approach, and conceptual approach. The collection of legal materials in this study used literature study techniques. At the same time, the legal material analysis method is the descriptive analytical juridical method. The results show that the basis for preparing the circular letter is intended to guide judges in recording religious marriages in Indonesia. Also, since the circular letter came into force, the courts no longer have the authority to register interfaith marriages held in Indonesia.

Abstract

The circulation of herbal medicines among the people of Denpasar is very high, there is a perception that herbal medicines are cultural heritage which are felt to be able to cure various diseases. Unfortunately, the existence of herbal medicines is widely misused in the community in inspections carried out by BPOM. Many are found in the distribution of herbal medicines that do not have distribution permits. Of course this is dangerous for society when viewed from the Health and Consumer Protection Law. The problem formulation in this journal is What is the legal protection for the distribution of herbal medicines that do not have a distribution permit in the city of Denpasar? What are the obstacles to BBPOM in preventing the distribution of herbal medicines that do not have a distribution permit? This research method uses empirical legal research, a legislative approach, data collection techniques through interviews. The legal protection provided has been carried out in a preventive and repressive manner but there are still obstacles in preventing distribution permits due to internal and external factors

Abstract

This research focuses on the phenomenon of the large number of state commissions in Indonesia, especially in the post-reform era. The purpose of this study is to describe the classification of state commissions in Indonesia. Furthermore, through the idea of simplifying the state commission, it will be able to overcome the problems that often occur due to the large number of state commissions. Through doctrinal legal research using a conceptual and comparative approach, it is known that state commissions are formed as a form of democracy, where there are independent institutions with the main task of supervising the three axes of state power (trias politica), especially in the sphere of government power. This state commission has a legal basis for the formation of various institutions through laws, government regulations, or presidential regulations so that not all state commissions have an equal position in the state administration. Furthermore, the incidental and responsive nature of the formation of state commissions often results in overlapping powers of state commissions. In order to resolve this, the idea is to make simplifications for the current State commission. The act of simplification is carried out by only maintaining a few State commissions that are capable of supporting the spirit of democracy in the State. Meanwhile, other commissions were merged into institutions of other countries. Furthermore, it is given legitimacy based on law to the State commission, so that it is not difficult to determine its position in the Indonesian constitutional system

Abstract

The advancement of information technology has brought significant changes to society but also generated new crimes, such as online child sexual exploitation (cybersex trafficking). This study examines this phenomenon by focusing on the live streaming application "HOT51," which is frequently used as a medium for child exploitation. The research employs a qualitative descriptive analysis method based on secondary data from official reports and related literature. Findings indicate that the easy access to modified APK applications facilitates sexual exploitation of children, the most vulnerable group. Indonesian regulations already address child protection, but implementation faces challenges such as low digital literacy and weak supervision of digital platforms. This study emphasizes the need for tightened monitoring, digital literacy education, and active parental roles to reduce the risk of sexual exploitation in the digital realm. The contribution lies in enhancing understanding of child protection challenges in the digital era and highlighting the importance of adaptive regulations and multi-stakeholder cooperation to safeguard child rights and safety.

Abstract

PT. Cisarua Mountain Dairy (Cimory), a producer of premium food and dairy products in Indonesia, was established in 2005. This article emphasizes the importance of brand protection education as a marketing strategy for Cimory. This protection is regulated by Law No. 20 of 2016 concerning Trademarks and Geographical Indications, which covers registration, exclusive rights, and law enforcement. Trademark registration provides exclusive rights and prevents unauthorized use. The research method involved a direct visit to Cimory Dairy Land On The Valley in Semarang, where the author gathered information about brand identification, production processes, and trademark protection. The research results indicate that brand protection education is crucial for maintaining brand reputation and integrity, as well as reducing the risk of infringement. Companies like Cimory can be more effective in protecting their intellectual assets, preventing unauthorized use, and maintaining consumer trust. Steps such as trademark registration and internal education are key to marketing strategies aimed at strengthening brand positioning in the market and preventing potential infringements that could harm the company.

Abstract

Penelitian ini menyoroti persoalan penegakan hukum terhadap tindak pidana korupsi yang kerap menemui hambatan, terutama ketika pelakunya merupakan Aparatur Sipil Negara (ASN) yang memiliki kedudukan strategis sehingga berpotensi menyalahgunakan wewenang. Korupsi digolongkan sebagai extraordinary crime karena berdampak langsung pada kesejahteraan publik. Atas dasar itu, pemerintah dituntut menghadirkan kebijakan pemidanaan yang transparan agar masyarakat memperoleh akses informasi sekaligus berperan dalam pengawasan. Tujuan penelitian ini adalah menganalisis implementasi kebijakan transparansi dalam penanganan perkara korupsi di Indonesia. Pendekatan yang digunakan bersifat kualitatif melalui studi kepustakaan (library research) dengan teknik snowball, melibatkan analisis berbagai literatur hukum, regulasi, dan penelitian relevan. Hasil kajian menunjukkan bahwa Undang-Undang Pemberantasan Tindak Pidana Korupsi memiliki kekuatan hukum sebagai dasar utama, sedangkan Undang-Undang ASN berlandaskan Asas-Asas Umum Pemerintahan yang Baik (AUPB) dalam mendukung transparansi pemidanaan. Penelitian ini menekankan pentingnya keterbukaan dalam proses pemidanaan ASN yang terbukti melakukan korupsi.

Abstract

Penelitian ini menganalisis implementasi Free, Prior, and Informed Consent (FPIC) serta perlindungan hak ulayat masyarakat hukum adat dari perspektif hukum internasional dan praktik di berbagai negara. Masyarakat adat di seluruh dunia menghadapi tantangan besar dalam memperoleh pengakuan atas hak mereka di tengah arus globalisasi dan eksploitasi sumber daya alam. Prinsip FPIC dan hak ulayat telah diakui dalam hukum internasional, khususnya melalui United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) dan Konvensi ILO No. 169, yang menekankan partisipasi aktif dan penentuan nasib sendiri masyarakat adat dalam keputusan terkait tanah, wilayah, dan sumber daya mereka. Meskipun kerangka hukum internasional cukup kuat, implementasi di tingkat nasional masih jauh dari ideal. Penelitian ini menggunakan metode hukum normatif dengan studi literatur, analisis peraturan, dan telaah praktik negara yang dianalisis secara kualitatif. Temuan menunjukkan adanya kesenjangan antara standar internasional dan praktik di lapangan, di mana FPIC kerap direduksi menjadi konsultasi formal tanpa substansi. Ambiguitas mengenai hak veto memperburuk efektivitas prinsip ini. Di Indonesia, pengakuan konstitusional terhadap masyarakat adat belum sepenuhnya diikuti dengan legislasi dan kelembagaan yang memadai, sehingga menimbulkan konflik tanah dan marginalisasi. Penelitian ini menyimpulkan perlunya penguatan FPIC melalui interpretasi yang jelas, legislasi nasional yang selaras dengan standar internasional, penyederhanaan formalisasi hak ulayat, serta peningkatan kapasitas kelembagaan untuk menjamin keadilan dan keberlanjutan masyarakat adat

Abstract

The development of artificial intelligence (AI) technology has created new challenges in Indonesia's copyright law system. Artificial intelligence is now capable of producing works of art, writing, music, and other forms of expression that previously could only be produced by humans. However, Law No. 28 of 2014 on Copyright is still oriented towards the concept of human authorship, whereby only humans are recognized as creators and copyright holders. This situation creates a legal vacuum in determining the legal status of creative works produced in part or in whole by AI. Issues arise regarding the determination of the creator, ownership of economic and moral rights, and legal liability for copyright infringement involving AI systems.  This article uses a normative legal research method with a conceptual and legislative approach to analyze the extent to which Indonesia's copyright law system is able to accommodate developments in AI technology. The results of the study show that the current legal system is not yet able to provide adequate protection for AI-based works due to the lack of clear criteria regarding the level of human involvement required to obtain copyright protection. Therefore, regulatory updates are needed in the form of amendments to Law Number 28 of 2014 or the issuance of implementing regulations that regulate the limits of human roles, transparency in the use of AI training data, and legal protection mechanisms for works involving algorithms. These updates are important to ensure legal certainty, protect the rights of human creators, and encourage technological innovation and the national creative economy in the digital era

Abstract

Aktivitas arung jeram merupakan salah satu bentuk wisata petualangan yang menawarkan sensasi menantang bagi wisatawan, namun memiliki tingkat risiko tinggi, mulai dari cedera ringan hingga risiko kematian. Kondisi ini menuntut adanya standar keselamatan yang memadai serta tanggung jawab dari pengelola objek wisata untuk memastikan terpenuhinya hak-hak konsumen dalam kegiatan wisata berisiko. Penelitian ini mengkaji dua permasalahan utama, yaitu landasan pengaturan keselamatan wisatawan pada kawasan objek wisata dan bentuk tanggung jawab pengelola objek wisata atas kecelakaan arung jeram di Sungai Telaga Waja, Kabupaten Karangasem, Bali. Tujuan penelitian ini adalah untuk mengetahui konsep tanggung jawab pelaku usaha pariwisata dalam memberikan perlindungan hukum terhadap wisatawan yang mengalami kerugian, menganalisis dasar hukum yang mengatur keselamatan wisatawan, serta mengidentifikasi bentuk tanggung jawab pengelola terhadap insiden kecelakaan. Penelitian menggunakan metode yuridis empiris dengan pendekatan perundang-undangan, konsep, dan fakta. Data primer dan sekunder dikumpulkan melalui studi dokumen dan wawancara, kemudian dianalisis menggunakan teknik analisis yuridis kualitatif. Hasil penelitian menunjukkan bahwa pengaturan keselamatan wisatawan berlandaskan pada Undang-Undang Nomor 10 Tahun 2009 tentang Kepariwisataan, Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, serta Peraturan Menteri Pariwisata Nomor 6 Tahun 2025. Penerapan regulasi oleh pengelola wisata arung jeram di Sungai Telaga Waja belum sepenuhnya merata, namun menunjukkan adanya kesadaran hukum pelaku usaha dalam mewujudkan keselamatan wisatawan. Kebaruan penelitian ini terletak pada fokus kajian yang menempatkan tanggung jawab pelaku usaha dalam konteks wisata berisiko tinggi.
