Abstract

Narcotics abuse is a very complicated matter in Indonesia, even become alert and dangerous. The government's effort to deal with drug addicts is to provide medical rehabilitation and social rehabilitation. The purpose of this study was to find out and analyze related to the provision of rehabilitation for narcotics addicts at the Badung Regency National Narcotics Agency. The research method that the writer uses is the empirical legal research method through the fact approach and the statute approach. The primary data source that the writer uses is interviews, while secondary data is in the form of laws and regulations, journals, and books. The author's research location is the Badung Regency National Narcotics Agency. The implementation of rehabilitation by National Narcotics Agency is an ongoing rehabilitation that is divided into two stages, namely the rehabilitation and post-rehabilitation processes. The functions and benefits of rehabilitation for narcotics addicts are recovery, productivity, and social functioning. However, facilities, and infrastructure are still not effective because National Narcotics Agency in every regency has not a special place for inpatient care and detoxification tools to medical rehabilitation.

Abstract

Kegiatan Pengabdian kepada masyarakat yang dilaksanakan di Desa Dangin Puri Kauh  bertujuan untuk meningkatkan pemahaman masyarakat tentang prosedur pemilihan dan tata cara pencoblosan yang sah dalam Pemilu 2024. Kegiatan ini dilaksanakan untuk mengatasi masalah tingginya jumlah suara tidak sah pada pemilu sebelumnya di Indonesia dengan menggunakan flyer sebagai alat komunikasi yang mudah diproduksi dan didistribusikan, serta mampu menyampaikan informasi secara sederhana. Kegiatan pengabdian ini dilaksanakan melalui tiga tahapan, yaitu observasi pendahuluan, pelaksanaan dan evaluasi kegiatan. Hasil dari kegiatan pengabdian ini menunjukkan bahwa pendekatan secara humanis yang dilakukan oleh team KPU ini berhasil meningkatkan pemahaman masyarakat tentang panduan pencoblosan dan mengurangi jumlah suara tidak sah. Kegiatan evaluasi dilakukan dengan membandingkan jumlah suara sah dan tidak sah dari rekapan KPPS Desa Dangin Puri Kauh, dengan harapan persentase suara tidak sah kurang dari 10%, di bawah persentase suara tidak sah Pemilu nasional sebelumnya. Lebih dari itu, kegiatan pengabdian ini juga menunjukkan bahwa strategi menggunakan flyer efektif dalam menurunkan jumlah suara tidak sah dan mampu meningkatkan partisipasi pemilih. Dengan demikian, dapat disimpulkan bahwa pendekatan ini merupakan langkah yang efektif dalam mendukung proses demokrasi dan meningkatkan integritas pemilihan di tingkat lokal. The Use of Flyers to Educate the People of Dangin Puri Kauh Village on Voting Guidelines for the 2024 ElectionsAbstract: The community service activity carried out in Dangin Puri Kauh Village aims to increase the community's understanding of election procedures and procedures for valid voting in the 2024 Election. This activity was carried out to overcome the problem of the high number of invalid votes in the previous elections in Indonesia by using flyers as a tool. communication that is easy to produce and distribute, and is able to convey information simply. This service activity is carried out through three stages, namely preliminary observation, implementation and evaluation of activities. The results of this service activity show that the humanist approach taken by the KPU team was successful in increasing public understanding of voting guidelines and reducing the number of invalid votes. The evaluation activity was carried out by comparing the number of valid and invalid votes from the KPPS recap of Dangin Puri Kauh Village, with the hope that the percentage of invalid votes would be less than 10%, below the percentage of invalid votes in the previous national election. More than that, this service activity also shows that the strategy of using flyers is effective in reducing the number of invalid votes and is able to increase voter participation. Thus, it can be concluded that this approach is an effective step in supporting the democratic process and improving the integrity of elections at the local level.

Abstract

Secara spesifik tulisan ini bertujuan untuk menganalisis pengaturan hukum adat di Bali, yaitu kewenangan kerta desa dalam menyelesaikan perkara adat dan kekuatan hukum putusan yang dikeluarkan oleh kerta desa adat dalam menangani perkara adat. Hasil kajian menunjukkan bahwa pengaturan hukum adat di Bali sendiri tertuang di dalam Perda Provinsi Bali No. 4 Tahun 2019 yang mewajibkan setiap desa adat memiliki awig-awig (aturan desa yang mengatur hak dan kewajiban krama desa adat) di Bali. Kewenangan kerta desa adat dalam menggelar peradilan adat dan menjatuhkan sanksi merupakan kewenangan yang langsung diberikan oleh peraturan perundang-undangan, yaitu termuat di dalam Perda Provinsi Bali. Kekuatan hukum putusan yang diberikan oleh kerta desa adat adalah mengikat dan final bagi setiap orang yang melanggar aturan desa adat.

Abstract

Many Indonesian people experience land disputes, not only in rural areas but also in urban areas. The land disputes experienced include various fights over land rights, falsification of land deeds, or the existence of duplicate certificates. These problems are often resolved through non-litigation efforts, especially negotiation and mediation. People rarely take the litigation route to resolve land disputes because of the high court fees charged by the courts, and court decisions are considered not to be executory. Therefore, it is necessary to carry out assistance activities in resolving land disputes prodeo (free of charge) by the legal aid post at the district court. The activity method is carried out by means of preliminary studies and document studies related to land disputes. Next, observe land disputes that occur in district courts. Then, interviews are carried out with parties experiencing land disputes so that they can be assisted in the land dispute judicial process. As a result, people who experience land disputes can get a resolution through a court decision with free court fees (prodeo)

Abstract

Pemilihan umum merupakan kontestasi politik yang terjadi setiap 5 (lima) tahunan di Indonesia. Pelaksanaan pemilu dipergunakan sebagai sarana demokrasi masyarakat untuk turut serta dalam pemilihan umum di Indonesia dilaksanakan untuk memilih anggota legislatif dan eksekutif. Namun salah satu tantangan yang dialami penyelenggara pemilu adalah berkaitan dengan netralitas TNI, Kepolisian, dan ASN dalam proses pemilu baik dalam proses kampanye pelaksanaan maupun pelaporan hasil pemilihan umum oleh karena itu hal ini dapat ditunjukkan melalui hasil pengkajian terhadap netralitas ketiga lembaga tersebut pada pemilu 2019 di tingkat pemerintah daerah. Oleh karena itu badan pengawas Pemilu melakukan sosialisasi dengan mencegah pelanggaran netralitas dalam pelaksanaan Pemilihan Umum tahun 2004 kegiatan tersebut dilakukan dalam bentuk diskusi 2 (dua) arah antara perwakilan masing-masing instansi dan juga seluruh penyelenggara pemilu. Hasil sosialisasi menunjukkan dapat beragam jenis pelanggaran legalitas yang dilakukan oleh TNI, Kepolisian, dan ASN di Indonesia, antara lain ikut serta dalam kampanye menjadi anggota dari salah satu partai peserta kampanye dan alat peraga kampanye dan mensosialisasikan beserta Pemilu baik melalui media sosial

Abstract

General election is an important means for the state to ensure the implementation of a government that obtains the legitimacy of the people. In addition, the general election also aims to uphold democracy within sovereign states and ensure the implementation of the human rights of the citizens. Likewise in Indonesia, which periodically conducts general elections every 5 (five) years. General elections in Indonesia have undergone a shift from closed mechanical systems to open mechanical systems since 2004. This is influenced by the reforms that uphold the democracy and sovereignity, as well as respect for the political rights of citizens. The open mechanical system has variations since its use in 2004 to date, especially concerning the valid vote in the election. Therefore, this research will focus on analysing democracy that is being implemented in the election through open mechanical system, and various variations in open mechanical mechanical system in Indonesia. This research will be conducted by using normative research method by using primary legal materials in the form of laws governing the election, as well as secondary legal materials from various literature and scientific articles related to the problems discussed in the research. The results will be presented iin the form of problem description with analysis of the variety of open mechanical systems practiced in Indonesia. This study portrays the elections that are carried out honestly has manifested democracy and sovereignty of the people in the country. Furthermore there are various weaknesses of democratic interpretation in the variation of the implementation of open mechanical systems in elections in Indonesia.

Abstract

PT. Cisarua Mountain Dairy (Cimory), a producer of premium food and dairy products in Indonesia, was established in 2005. This article emphasizes the importance of brand protection education as a marketing strategy for Cimory. This protection is regulated by Law No. 20 of 2016 concerning Trademarks and Geographical Indications, which covers registration, exclusive rights, and law enforcement. Trademark registration provides exclusive rights and prevents unauthorized use. The research method involved a direct visit to Cimory Dairy Land On The Valley in Semarang, where the author gathered information about brand identification, production processes, and trademark protection. The research results indicate that brand protection education is crucial for maintaining brand reputation and integrity, as well as reducing the risk of infringement. Companies like Cimory can be more effective in protecting their intellectual assets, preventing unauthorized use, and maintaining consumer trust. Steps such as trademark registration and internal education are key to marketing strategies aimed at strengthening brand positioning in the market and preventing potential infringements that could harm the company.

Abstract

Article 280 of Law Number 8 of 2012 concerning Reporting Campaign Fund Fraud obscures the norm that only legislative candidates are responsible and not political parties. This represents a country that operates a democratic system, and freedom of speech and writing is guaranteed by the state and the constitution. Freedom of expression is regulated in Article 1 (1) of Law Number 9 of 1998 concerning Freedom of Expression in Public. Campaign funds are the most important key to honest elections and reflect the ugliness of fraudsters who, if fraud occurs in campaign funds, lead to corrupt electoral practices, namely political corruption of the organizers. In 2019, there were allegations of fraud in the reporting of campaign funds for candidate BuIeeng Dapi from the BaII National Democratic Party in the 2019 general election. It was Somvir who reported the campaign funds. The results of this research show that responsibility for fraud is based on the principle of vicarious responsibility and administrative sanctions. And the types of sanctions given are criminal sanctions and fines in accordance with Article 334 paragraph (1), paragraph (2), and/or paragraph (3) and Article 335 paragraph (1), paragraph (2), and/or paragraph (3 ) Law Number 7 of 2017. Abstract

Technological advances in the financial sector have encouraged the emergence of various digital economic facilities, one of which is investment facilities. However, in practice there are still many companies that use this sophisticated technology for illegal business, one of which is the Ponzi Scheme. The Ponzi scheme itself is an activity of collecting public funds with the promise of paying high profits that far exceed normal investment profits in a short time. This Ponzi scheme is run by recruiting new members so that money continues to flow in and be turned into certain businesses or investments, but rather becomes capital to pay members who have registered first. So the lowest members will find it difficult to get benefits. The author conducted research on law enforcement against Ponzi perpetrators, the aim of this research was to analyze the legal consequences for Ponzi perpetrators and legal protection for Ponzi victims. The research method used is: Normative legal research method examines legal problems using legal materials consisting of legislation, books, legal journals and others. The results of this research are as follows: Ponzi perpetrators in Indonesia can be charged under Article 378 of the Criminal Code concerning Fraud and because they do not have permits related to Ponzi scheme victims because they use electronic media, they can be charged under Article 28 paragraph 1 of Law Number 19 of 2016 concerning Amendments regarding Law Number 11 of 2008 concerning Information and Electronic Transactions against victims of the Ponzi scheme. Abstrak Kemajuan teknologi di bidang finansial mendorong munculnya berbagai macam sarana perekonomian digital, salah satunya sarana investasi. Namun pada prakteknya masih banyak perusahaan yang memanfaatkan kecanggihan teknologi ini untuk bisnis illegal salah satunya adalah Skema Ponzi. Skema ponzi sendiri adalah kegiatan mengumpulkan dana masyarakat dengan janji bayaran keuntungan yang tinggi dan jauh melebihi keuntungan investasi normal dalam tempo waktu yang singkat. Skema Ponzi ini dijalankan dengan merekrut member-member baru sehingga ada uang yang tetap mengalir masuk dan di putar dalam bisnis atau investasi tertentu, melainkan menjadi modal untuk membayar member yang telah mendaftar lebih dahulu. Sehingga member yang paling bawah akan susah mendapatkan keuntungan. Penulis melakukan penelitian tentang penegakan hukum terhadap pelaku Ponzi, tujuan penelitian ini  untuk  menganalisis  akibat  hukum  bagi pelaku Ponzi serta perlindungan hukum bagi korban Ponzi. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan meneliti aturan hukum mengenai sanksi pidana bagi pelaku kejahatan bisnis dengan sistem Ponzi di Indonesia. Hasil dari penelitian ini adalah bahwa salah satu penegakan hukum dipengaruhi oleh hukum itu sendiri, saat ini, penegakan hukum terhadap pelaku Ponzi di Indonesia menggunakan Pasal 378 KUHP tentang Penipuan, oleh karena tidak memiliki izin berkaitan dengan skema ponzi melalui media elektronik maka dapat dikenakan Pasal 28 ayat 1 UU ITE, dan mengenai perlindungan hukum bagi korban kejahatan bisnis dengan skema Ponzi ini adalah dalam bentuk preventif dan reprsif. Kesimpulan yang diperoleh bahwa penegakan hukum terhadap skema Ponzi masih kurang efektif dan efesien, hal ini disebabkan karena tidak adanya undang-undang yang mengatur skema Ponzi secara khusus, untuk itu seyogyanya para investor agar lebih teliti dan berhati-hati sebelum memulai investasi bisnis.
