Abstract

The culture of blaming the victim is so prevalent that many victims of sexual harassment are afraid to report their cases. Some victims may worry that they will be stigmatized. The victim is considered to have damaged the good name of the family or institution. They could even be criminalized for reporting acts of harassment or rape.The purpose of this study is to determine the behavior of blaming victims against law enforcement in Indonesia and to determine legal protection for victims of criminal acts of decency so that they do not become victims in the Indonesian Criminal Justice System. The research method used in this research is normative legal research method. The data obtained from this research are primary data, secondary data, and tertiary data which are processed qualitatively.Based on the results of this study, the provisions of the parties that provide protection for victim blaming victims (victims who are blamed) include, First, the state is considered as one of the important factors because the state has the authority and ability to guarantee the safety of victims. Second, community service providers, in fulfilling the victim's mental state, require community services. Third, society, in fact the community has enormous potential in providing protection and support for victims.Keywords: victim, blame the victim, law enforcement

Abstract

Discourse Surakarta as the Capital is not a new discourse, the discourse is not separated from the long history of the founding of the city of Surakarta trip. The country has recorded the Provincial Solo or Surakarta Special Region (DIS). Surakarta or the existence of the Province of Special Region which began in August 1945 until June 16, 1946 consisting of the Special Region and the Special Region Mangkunagaran Kasunanan and governed jointly by the Regional KNI Surakarta, Susuhunan and Mangkunagara. In Juridical, that privilege Surakarta has been recognized in the Constitution of the Republic of Indonesia in 1945 on pasal18 B paragraph (1) which stated that the State recognizes and respects administration units, local special or that are regulated by law OF.This study is a normative legal research, the research done by examining material library (library research) .sedangkan legal material analysis method used in this research is descriptive. Once the data is collected in full and thorough, then the data are regrouped and adjusted to the type of data obtained, will be discussed and analyzed. The data used are primary data that ingredients binding law, as well as secondary data derived from primary legal materials, secondary and tertiary. Data was collected by the method of literature reviewResults of this study was the Establishment of Central Java province that includes Surakarta and simultaneously remove Surakarta as Special Region is based on Law 10 of 1950, it is contrary to facts other law, notably Article 18 of the Constitution of 1945 (before the amendment) in conjunction with Article 18B paragraph (1) of the Act of 1945 (amendment). Surakarta supposed privilege position may or may not be recognized back that is very dependent on the political will, the central government, parliament, local governments and communities Surakarta. efforts should be made to re-Surakarta recognition as a Special District, namely through the regional division or through judicial review of Law No. 10 of 1950 to the Constitutional Court. Abstract

Law of the Republic of Indonesia Number 32 Year 2009 on the protection and Environmental Management in Rokan Hilir. Carrying capacity and the capacity exceeds that should, as well as the ineffectiveness of the SEA in Rokan Hilir RPJMD be one of the issues that have a major impact on development in Rokan Hilir. Therefore the aim of this Thesis Writing: first, how the implementation of the Strategic Environmental Assessment (SEA) in RPJMD in Rokan Hilir by Act No. 32 of 2009 on the Protection and Environmental Management. second, how the effectiveness of the Strategic Environmental Assessment (SEA) in RPJMD in Rokan Hilir. Third, if the efforts to be made towards the implementation of the Strategic Environmental Assessment in RPJMDdi Rokan Hilir.This type of research can be classified in this type of empirical legal research or sociological, Because in this study the authors directly conduct research on the location or point examined in order to provide a complete and clear picture of the issues examined. This research was conducted in BAPEDALDA office, in the office of Planning, and in the office of Spatial Rokan Hilir. Population and Sample is chairman of the Regional Environmental Management Division of Rokan Hilir, head of Management of Regional Development of Rokan Hilir, chairman of the Department of Spatial Planning Rokan Hilir, Head of Mining and Energy and the Environment Rokan Hilir, Chairman of field development planning Rokan Hilir. Source of data used, namely: primary data and secondary data. Data collection techniques in this study by observation, interview, and literature study.The conclusion that can be derived from the results of the first study, how the implementation of the Strategic Environmental Assessment (SEA) in RPJMD in Rokan Hilir by Act No. 32 of 2009 on the Protection and Environmental Management did not materialize. second, how the effectiveness of the Strategic Environmental Assessment (SEA) in RPJMD in Rokan Hilir ineffective because the budget factor, the factor of human resources, community factors, factors not the implementation of SEA in RPJMD in Rokan Hilir Year 2011-2016, Quality Control Implementation of SEA in the preparation of Rokan Hilir RPJMD 2011-2016. Thirdly, the Government of Rokan Hilir should be more creative to find sources of income and do the regulations and policies that pro against the people in the plantation sector, oil and gas, prepare and provide specialized training for human resources more reliable in the face of environmental problems and improve public awareness to comply with a rule of law.Keywords: Implementation of SEA in RPJMD-Sustainable Development-Rokan Hilir

Abstract

In elections, there are several political parties, political parties (hereinafter referred to as political parties) are a necessity in modern democratic political life. As an organization, political parties are ideally intended to activate and mobilize the people, represent certain interests, provide compromises for competing opinions, and provide maximum political leadership to the maximum extent of legitimate and peaceful political leadership. the law is still unable to access the practice of money politics because of the weaknesses of the Perppu (Legislation) and the low level of law enforcement itself. A little idea from me, it is better if the vote recapitulation process is carried out directly at the Regency / City level to minimize money politics. The government should also be able to see and reduce what are the factors that make money politics happen, which factors include political factors, low institutionalization of political parties, oligarchic and transactional management of political parties, non-transparent financial system of political parties and accountable.This study examines the subject matter in accordance with the scope and identification of problems through a statute approach carried out by examining statutory regulations and regulations related to the legal issue under study. In this study, the authors conducted research on legal synchronization using descriptive methods. This esearch examines the juridical analysis of the limitations om the scope of money politics in elections in indonesia.The results of the research conducted by the author are, first, it is better if in Law Number 7 of 2017 concerning General Elections Article 523 is more explicitly explained about what other materials are, for example money politics in general elections, then achieving ideal arrangements regarding the boundaries of the scope of money politics , whereas the legal instrument for preventing money politics (money politics) in the election is already good, but it must be followed by serious socialization and legal counseling so that none of the prospective voters do not know the rules to be imposed on them in organizing the election.Keywords:Limitation-MoneyPolitic-Election

Abstract

Phedofilia is acts of infringement of the rights of children are classified as vile and evil. Increased Phedofilia criminal act in Indonesia, especially in Pekanbaru become a serious problem currently faced. Therefore Phedofilia should be addressed in a rational way. One rational efforts is with law enforcement policies. The purpose of this study are to know the law enforcement against criminal acts of Phedofilia in jurisdiction of Police Pekanbaru City resort, to know the police barriers in law enforcement against criminal acts of Phedofilia in jurisdiction of Police Pekanbaru City resort, and to know the efforts made of Police to overcome obstacles in law enforcement against criminal acts of Phedofilia in jurisdiction of Police Pekanbaru City resort. This type of research is a juridical sociological research, the data sources used, the primary data, secondary data and data tertiary, data collection techniques in this study with interviews and literature study. Law enforcement against criminal acts of Phedofilia in jurisdiction of Police Pekanbaru City resort not running optimally because of the presence of obstacles, obstacles encountered in law enforcement against criminal acts of Phedofilia in jurisdiction of Police Pekanbaru City resort is in the form of internal factors and external factors, efforts to overcome this barrier is increasing the number of personnel investigator PPA and increase knowledge of investigator in understanding the psychology of the child. Although equipped withsetting role of government and local government in fostering Community Organization,the presence of foreign Community Organizations conducting activities in Indonesia, tothe sanctions for Community Organization who commit certain violations. So when anorganization Kemasyarakatanyang no legal status, have registered to be recognized asCommunity Organisations who can do the organization's activities in the sphere ofregional and national.Instead of a Community Organisations who do not enroll in governmentauthorities can not service of the government, but the state can not establish theCommunity Organization as an illegal organization, even the state can not prohibit suchactivities as long as not violating the law. But if the events and activities of CommunityOrganizations has been proven to have violated the law and threaten security and publicorder, violate the rights of freedom of others, as set forth in the sense of freedom ofhuman rights, or violate the moral values and religion, the state is obliged to ensurepublic order and function can perform law enforcement, can even stop the activities of aCommunity Organization.The explanation was clearly gives understanding to the state or the ruling for notlimiting step and Social Organization activities based solely on their registration status.In addition, the right of individuals to participate in advancing the nation through anorganization or association as prescribed in Article 28E paragraph (3), which in essencestates must respect these rights. Abstract

Disclose information is a kind of democracy that can be realized as people right as form of acknowledgement to human right and is a kind of goverment accountable to the people. Historically, the birth of reformation in Indonesia brough the spirit of revolution in every part of goverment’s system, including revolution to open all accesses information from goverment that previously is closed and manipulated. With birth of law No. 14 year 2008 and the formed of committee of information in Indonesia is expected to be a forum for people as a warranty to get the right of getting information, claim for goverment to open all accesses information, and provider of information to public. However, the implementation of task and authority of the commission of information still have many weaknesses. Abstract

In Law Number 35 of 2014 Amendment to Law Number 23 of 2002 concerning Child Protection which has been regulated in Article 71D paragraph (1) states that every child who becomes a victim as referred to in Article 59 paragraph (2) letter b, letter d, letter f, letter h, letter i, and letter j have the right to submit to the court in the form of the right to restitution which is the responsibility of the perpetrators of crime, but in reality there are still many children who become victims of criminal offenses not getting the right of restitution. Until now there has been no seriousness of law enforcement officials in granting victims' rights regarding restitution so that victims have never been informed of the existence of such restitution rights. The purpose of this Thesis Writing, namely: First, Application of Article 71D of Law Number 35 Year 2014 Amendment to Law - Law Number 23 Year 2002 concerning Child Protection of Victims in the Legal Territory of Pekanbaru City, Secondly, obstacles in the Application of Article 71D of Law Number 35 Year 2014 Amendment to Law Number 23 Year 2002 concerning Child Protection of Victims in the Legal Territory of Pekanbaru City , Third, Ideally in the Application of Article 71D of Law Number 35 of 2014 Amendment to Law Number 23 of 2002 concerning Child Protection of Victims in the Legal Territory of Pekanbaru City.This type of research can be classified into the type of sociological juridical research, because in this study the author immediately conducts research on the place under study in order to provide a complete and clear picture of the problem to be studied, while the population and sample are all parties related to the problems examined this study, data sources used, primary data, secondary data and tertiary data, data collection techniques in this study with interviews, questionnaires and library dataThe results of the study can be concluded. First, the Application of Article 71D of Law Number 35 Year 2014 Amendment to Law Number 23 Year 2002 concerning Child Protection of Victims in the Legal Area of Pekanbaru City is proceeding well due to the lack of seriousness of law enforcement officials, especially the Pekanbaru City Prosecutor's Office in granting victims' rights regarding restitution. Second, Obstacles in the Application of Article 71D of Law Number 35 Year 2014 Amendments to Law Number 23 Year 2002 concerning Child Protection of Victims in the Legal Area of Pekanbaru City are caused by several factors, namely law factors, victim legal awareness and ability factors and the willingness of the defendant. Third, efforts made to overcome obstacles in the implementation of Article 281 of Law Number 22 Year 2009 concerning Road Traffic and Transportation Against Drivers of Underage Children by making improvements to Government Regulation Number 43 of 2017 concerning the Implementation of Restitution for Children Who Become Victims of Action Criminal.Keywords: Application - Child Protection - Victims - Restitution

Abstract

Women business actors processing cassava, especially ganepo products in Paluh Village do not yet have business legality and lack of product innovation, there is no business legality and no product innovation. Women entrepreneurs will find it difficult to expand their business network, and cannot penetrate the modern market, therefore it takes an empowerment that can improve the economy and social, and can create great women and independent villages. The purpose of community service activities that will be carried out is to provide knowledge and understanding of the importance of business legality and the need for product innovation so that later it can increase economic and social income and create jobs. The results of this community service are expected to have a good impact in terms of economic and social changes so that women can help the family economy and create an independent village community.

Abstract

The first fact is still found by parents who have not paid special attention to children with disabilities, resulting in violations of the rights of children with disabilities. The second fact is that the legal instruments are still weak and the regulations have not been fully implemented. These facts are an inhibiting factor in the development of children with disabilities. The purpose of this activity is so that children with disabilities know what their rights are, so that children with disabilities still feel respected by their presence. The output of this activity is the fulfillment of accessibility rights for children with disabilities in their growth and development in the social environment. The result of this activity is that children with disabilities know their rights, so that discrimination against them is not allowed. Children with disabilities also know that they have special rights guaranteed by laws and regulations.
