Abstract

The application of punishment to minors as perpetrators of criminal acts of obscenity in the judge's decision does not provide a sense of justice for minors and their families as victims of obscenity. This study discusses the sentencing of minors as perpetrators of criminal acts of obscenity in cases of obscenity against child victims who are both underage in Decision Number 8/Pid.Sus.Anak/2016/PN.Trt and Decision Number 9/Pid .Sus.Anak/2016/PN.Trt dated September 6, 2016. It was concluded that the imposition of punishment on child perpetrators for the obscenity case in the Tarutung District Court Decision did not fulfill the sense of justice in a balanced manner according to the principle of proportional equality (distributive justice). Considerations for treatment and rehabilitation, as well as utility are not balanced, only for child actors. Child perpetrators are subject to maatregel, but child victims are not recovered from their trauma. Fines, compensation of any kind are not imposed on child perpetrators or their families for the costs of recovery, treatment, rehabilitation of child victims. Alternative legal sanctions for the parents of the perpetrator's child should be subject to civil liability for compensation. In order to have a deterrent effect and special prevention for parents, be careful, alert and control their children from criminal acts, continuous supervision, provide them with formal and non-formal education, and so on. The right to compensation should also be handed down by the court judge to the perpetrator even though it was not requested in the public prosecutor's indictment

Abstract

Law is a social engineering. In order to enforce legal function as a means of social engineering, a law should be transparent toward social dynamics in society. One of the legal fields which is closely related to social life is criminal law. One of the types of crime which is fully concerned by criminal jurisprudence today is criminal act in narcotics. The development in science and technology has caused criminal act in narcotics to be difficult to handle such as the new type of narcotics, Methylene (3,4 Methylenedioxy Metkatinon) which has recently been talked about since Raffi Ahmad case came to the fore; it is not registered in the Appendix of Law No. 35/2009 on Narcotics. The objective of the research was to find out legal provisions, laws, and regulations on narcotics which exists in Indonesia, to find out the prosecution on criminal act in narcotics abuse outside the classification stipulated in Law No. 35/2009, and to find out the obstacles in the prosecution on criminal act in narcotics outside the classification stipulated in Law No. 35/2009. The research used judicial normative and descriptive analytic method. The result of the research showed that the national legal products on criminal act in narcotics were stipulated in Law No. 9/1976 on Narcotics, Law No. 22/1997 on Narcotics, and Law No. 35/2009 on Narcotics. Methylene has chemical structure which resembles ecstasy, but it has great impact; it cannot even be used for medical and cosmetics. The enforcement of criminal law on methylene abuse can be done by legal finding through interpretation. Interpretation method is done in systematical, doctrinaire, teleological, and extensive way. However, interpretation should be done limitedly. The obstacles in prosecuting criminal act in narcotics outside the classification stipulated in Law No. 35/2009 can be viewed from the factors of law, law enforcement, facility and infrastructure in enforcing law, society, and culture. It is recommended that the Minister of Health issue a regulation on the amendment of the Narcotics Classification. Law enforcement, particularly public prosecutors, should dare to make a breakthrough in the case of methylene (3,4 Methylenedioxy Metkatinon) because by interpreting this derivative compound judicially, it can be made similar to cathinone in the list of the Appendix of Law No. 35/2009 on Narcotics

Abstract

The legal arrangements regarding diversion for children who have committed criminal acts are contained in several laws and regulations, government regulations, regulations of the Supreme Court which have regulated the procedures for implementing diversion for children who have committed criminal acts. In Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which has explained about diversion, namely as in Article 1 point 7 states that diversion is the transfer of settlement of juvenile cases from the criminal justice process to processes outside of criminal justice The results of this research can be seen, the legal basis for diversion is regulated in Law Number 11 of 2012 concerning the Criminal Justice System for Children, Government Regulation Number 65 of 2015 concerning the Implementation of Diversion and Handling of Children who are not 12 (twelve) years old, and Regulations Supreme Court Number 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Criminal Justice System. And in these laws and regulations, the objectives of diversion are stated in article 6 of Law Number 11 of 2012, namely: achieving peace between victims and children, resolving cases of children outside the judicial process, preventing children from being deprived of liberty, encouraging the public to participate , and instill a sense of responsibility in children

Abstract

Berdasarkan data pusat statistik pada Tahun 2020 yang diumumkan oleh Komisi Perlindungan Perempuan Dan Anak Indonesia (KPPAI) kasus pelecehan dan kekerasan seksual terhadap anak terus mengalami peningkatan secara signifikan. Kasus tersebut telah mencapai 4.975 kasus. Terhadap pelaku kekerasan seksual yang sudah pernah dijatuhi sanksi pidana atas tindak pidana yang sama atau pelaku yang melakukan kekerasan seksual terhadap lebih dari satu orang anak, dapat dikenai tindakan berupa kebiri kimia dan pemasangan alat pendeteksi elektronik. Hal tersebut memunculkan beberapa isu hukum yang menjadi tujuan dari penulisan ini untuk menganalisis dan mengetahui tentang bagaimana kerangka hukum yang mengatur tentang penjatuhan pidana tambahan kebiri kimia terhadap predator anak, kemudian landasan pertimbangan yuridis penjatuhan pidana tambahan kebiri kimia terhadap predator anak, serta penjatuhan hukuman kebiri kimia terhadap predator anak dalamputusan No. 69/Pid.Sus/2019/PN.Mjk. Hasil penelitian ditemukan bahwa sistem pemberian pidana tambahan berupa kebiri kimia juga memiliki beberapa syarat. Hukuman kebiri kimia dilaksanakan berdasarkan pertimbangan hakim dengan mempedomani Pasal 81 ayat (7) UU RI Nomor 17 tahun 2016. Pemerintah harus menunjuk eksekutor yang berwenang dalam menerapkan kebiri kimia dalam ketentuan RUU KUHP dan hukum acara pidana. Penjatuhan pidana tambahan berupa kebiri kimia terhadap pelaku kejahatan seksual dapat dilakukan melalui tahapan pemeriksaan medis ringan serta tidak hanya dikenakan terhadap pelaku kejahatan seksual dengan klasifikasi berat dan harus disertai kompensasi.

Abstract

This article aims to unravel a shift of control / ownership of communal land of the Malays of Deli in North Sumatra. The commonly well-known communal lands, before the arrival of the Dutch colonial, was still inherent with the authorities of villages and was evolutionarily taken over by the foreign planters through concessionary contracts, which were dully signed by the Sultanate of Deli and the said foreign planters. The Indonesian independence in 1945 and the period that went beyond had in fact not contributed any improvement of the situation and instead it had exacerbated social and legal relations between the Malays of Deli and their ancestral lands. The said successful state laws had been so successful to keep these local natives away from their most important resource of life, namely their very lands. “Deulayatisasi” through state laws that was heavily oriented to the interests of capitalization to have seemingly been so successful to curtail the long journey of communal land rights in this country that seemed to have been pioneered by Van Vollenhoven during the early period of 20th century. The customary land law, in Indonesia, will someday become a kind of a beautiful story in the course of historiographical laws of Indonesia.

Abstract

This article has been developed through an analysis of primary and secondary sources concerning the nationalization’s policy of the Dutch enterprises in Indonesia as had been conducted by Soekarno’s regime back in 1958. The impact of this said policy has been so much felt very strongly to these days, most especially on the ex-concessionary lands of the Dutch enterprises in North Sumatera. The flaws made by the Indonesian government in interpreting the terminology of Concession to the Cultivation Rights on Lands, in the said nationalization policy, have created various endless conflicts among central and regional governments, state-owned enterprises, the Sultanates (mainly the Deli and the Serdang), private-owned companies, the military and other interest groups. At certain ends, these critical disputes have left some saddening and murky situations whereas the ancestral lands belonging to Melayu people, which were put in concession by the Sultanate to the Dutch-owned enterprises, were gradually missing in terms of identity and without any compensation to this ethnic group.

Abstract

The occurrence of divorce cases in sebongi marriages that occurred in the people of Southeast Aceh, namely the marriage age was so short that it was even only one night. So this study is intended to examine related to the problem of factors causing divorce in overnight marriages, legal protection for husbands due to divorce in a sebongi marriage according to Law No. 1 of 1974 concerning Marriage and KHI. As well as the basis for the judge's consideration in granting the divorce permit.The results of this study show that there are 4 (four) factors for the occurrence of divorce in a sebongi marriage in southeast Aceh society, namely the factor that the wife is no longer a virgin before marriage, the factor that the wife does not want to be invited to have sex, the factor that the wife has the intention to divorce before marriage and the factor of the bride's reluctance to return to the husband's house after the custom of winning. legal protection for the husband is the loss of the husband's obligation to provide a living to the wife due to the Nusyuz wife either living still in marriage or living iddah when there has been a divorce as explained in article 80 paragraph (7) and article 152 of the KHI

Abstract

Peran pemerintah dalam pengembangan ekonomi kreatif sub sektor kuliner di Provinsi Sumatera Utara khususnya di Kota Medan diantaranya peran pemerintah sebagai regulator yaitu membuat kebijakan-kebijakan sehingga mempermudah pelaku usaha ekonomi kreatif dalam mengembangkan usahanya. Sebagai regulator pemerintah berfungsi untuk menjaga kondisi lingkungan usaha tetap kondusif sehingga pelaku usaha industri kreatif itu sendiri dapat berkembang. Pemerintah merupakan pihak yang mampu menerapkan aturan agar kehidupan dapat berjalan baik dan dinamis, dalam hal ini peran Pemerintah Provinsi Sumatera Utara khususnya dalam penjelasan dinas terkait merasa sudah melakukakan perannya sebagai regulator. Peran pemerintah sebagai regulator memang sudah dijalankan dan pelaksanaanya juga sudah dijalankan, akan tetapi dalam menjalankan perannya sebagai regulator, masih belum ada sinergitas terkait pembagian tupoksi tugas dan kewenangannya antara dinas-dinas terkait dalam pemberdayaan UMKM dan ditambah pelaku UMKM sendiri kebanyakan besar tidak atau kurang mengetahui perihal regulasi atau aturan-aturan yang ada menyebabkan peran pemerintah masih belum bisa dikatakan optimal. Guna meningkatkan daya saing industri kreatif subsektor kuliner sehingga mampu tumbuh menjadi usaha yang berkelanjutan dengan skala yang lebih besar dalam rangka mendukung kemandirian perekonomian nasional. Pemerintah Provinsi Sumatera Utara telah membuat kebijakan-kebijakan yang mendukung pengembangan ekonomi kreatif terkhusus sub sektor kuliner, hanya saja pelaksanaan dari kebijakan tersebut belum berjalan dengan baik.

Abstract

Tujuan penelitian ini untuk mengetahui dan menganalisis tentang pemerintahan Kabupaten Labuhanbatu Utara dalam memberikan perlindungan terhadap anak yang menjadi korban kejahatan pelechan seksual di daerah tersebut. Selain itu untuk melihat peran dari Pemerintahan Kabupaten Labuhanbatu Uatara melalui stakeholder yang berkaitan dengan perlindungan anak seperti Komisi Perlindungan Anak Indonesia Daerah (KPAID) beserta Dinas Pemberdayaan Perempuan dan Perlindungan Anak (DPPPA) Kabupaten Labuhanbatu Utara. Kajian penelitian ini berisifat normatif dan empiris. Hasil penelitian disimpulkan bahwa peran serta pemerintah Kabupaten Labuhanbatu Utara dalam memberikan perlindungan hukum terhadap anak korban kejahatan pelecehan seksual melalui dibentuknya Komisi Perlindungan Anak Indonesia Daerah (KPAID) dan Dinas Pemberdayaan Permpuan dan Perlindungan Anak (DPPPA) Kabupaten Labuhanbatu Utara dengan mengacu kepada Peraturan Daerah Nomor 2 Tahun 2013 tentang Penyelenggaraan Perlindungan Anak. Kejahatan pelecehan seksual terhadap anak yang di adukan baik di Dinas Pemberdayaan Permpuan dan Perlindungan Anak (DPPPA) serta Komisi Perlindungan Anak Indonesia Daerah (KPAID) Labuhanbatu Utara di selesaikan secara diversi dan proses laporan di Kepolisan Resor Labuhanbatu. Akan tetapi ketika proses diversi tidak ditemukan hasil kesepakatan maka lanjut ke proses Kepolisian dan persidangan di Pengadilan. Maka disarankan kepada pemerintahan Kabupaten Labuhanbatu Utara meningkatkan pelayanan dan pendampingan baik pada saat dimulainya pengaduan dan sampai berakhirnya proses hukum agar anak merasa aman dan mendapat perlindungan hukum.
