Abstract

Land is one of the valuable natural resources that is highly beneficial to humans, thus necessitating specific regulation by the government. It serves as the foundation for societal development and is considered an enduring asset for a community with rightful ownership of the land. However, disputes over land have arisen among communities. The existence of land can lead to conflicts over land rights, requiring parties involved to present evidence based on applicable regulations. The objective of this research is to examine and analyze the legal status of the land ownership certificate as evidence in the verdict of the District Court of Gorontalo City No. 2/Pdt.G/2020/PN Gto. This study employs a normative legal method with legislative and conceptual approaches. The research findings indicate that the legal strength, based on legal considerations in the District Court's decision, is related to the certificate of land ownership No. 00561/Desa Moutong. This certificate, held by the claimant, was deemed legally non-binding due to the unlawful possession of the disputed land without the consent and knowledge of the plaintiff and other heirs, as evidenced by a statement issued during a meeting in 1989, attended by local village authorities. Therefore, the defendant was proven to have acted against the law.Keywords: Legal Position; Certificate of Ownership; Land Dispute. ABSTRAKTanah merupakan salah satu sumber daya alam yang sangat bermanfaat bagi manusia, maka perlu adanya pengaturan khusus terkait pertanahan oleh pemerintah. Tanah juga merupakan sebuah dasar bagi Pembangunan Masyarakat dalam kehidupan serta memiliki sifat kekal dengan suatu Masyarakat yang memiliki hak atas tanah tersebut. Namun tanah ini juga sudah dianggap sebagai salah satu sumber sengketa antar Masyarakat lainnya. Eksistensi tanah dapat menimbulkan terjadinya sengketa perebutan hak atas sebidang tanah. Sehingga dalam proses pembuktian, para pihak harus mampu menampilkan bukti berdasarkan ketentuan yang berlaku. Tujuan penelitian ini yakni untuk mengkaji dan menganalisis kedudukan hukum sertifikat hak milik atas tanah sebagai alat bukti pada Putusan Pengadilan Negeri Kota Gorontalo No. 2/Pdt.G/2020/PN Gto. Penelitian ini menggunakan metode hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Adapun hasil penelitian ini menunjukkan bahwa kekuatan hukum berdasarkan pertimbangan hukum tersebut yakni Putusan Pengadilan Negeri Kota Gorontalo No. 2/Pdt.G/2020/PN Gto terhadap surat keterangan dalam hal ini surat pernyataan bagi harta pada Tahun 1989 yang dihasilkan dari hasil musyawarah telah ditandatangani dan bersesuaian dengan keterangan saksi hidup serta memenuhi asas pemerintahan yang baik, karena pada saat itu juga dihadiri oleh pemerintah desa setempat,  dan menyatakan bahwa sertifikat tanda bukti hak milik nomor 00561/Desa Moutong atas nama pemegang hak tidak mempunyai kekuatan hukum yang mengikat karena penguasaan tanah objek sengketa tersebut tanpa seizin dan sepengetahuan pihak penggugat beserta ahli waris lainnya, sehingga tergugat terbukti melakukan perbuatan melawan hukum.

Abstract

Pola asuh orang tua memiliki peran penting dalam mempengaruhi tumbuh kembang anak. Perkembangan anak dapat diketahui dari skrining yang dilakukan secara berkesinambungan dan sistematis. Sayangnya, masih banyak orang tua yang belum mendapatkan sosialisasi mengenai bagaimana pola asuh yang baik. Penelitian ini bertujuan untuk melihat pengaruh pengasuhan positif melalui modifikasi program Tripel P terhadap status perkembangan anak usia dini berdasarkan Parents’ Evaluation of Developmental Status (PEDS). Desain ekpserimental dilakukan di mana partisipan dibagi menjadi dua kelompok yaitu kelompok kontrol dan intervensi. Instrumen penelitian yang digunakan untuk mengukur pengasuhan positif orang tua adalah skala Positive Parenting yang diambil dari Alabama Parenting Questionnaire – Preschool Revision. Perkembangan anak di nilai dengan kuesioner Parents’ Evaluation of Developmental Status (PEDS) yang dikembangkan oleh Glascoe. Pengujian hipotesis dilakukan dengan analisis two-way ANOVA repeated measures untuk megetahui pengaruh pengasuhan positif terhadap perkembangan anak. Peneltian dilakukan pada Bulan Juli 2024 di Desa Penyengat Olak Kabupaten Muaro Jambi. Hasil menunjukkan bahwa intervensi pengasuhan positif pada Ibu dapat memberi dampak positif terhadap perkembangan anak.

Abstract

The aim of this PkM activity is to explain to children from orphanages about the importance of improving English literacy in this era of globalization. Improving English literacy is the most important key in facing global challenges in this information era. With the development of technology and globalization, the ability to communicate in English is not just an additional skill, but has become an urgent need. Therefore, English language proficiency education is an important foundation for individuals to acquire the skills needed in various life situations.English has a very important role in improving literacy. In this case, we chose the target participants as children from Budi Mulia’s orphanage, so that awareness of the importance of literacy and mastery of foreign languages is embedded from an early age which will be useful in the future.

Abstract

This intersectional study investigates the harmonisation of Islamic law and human rights in the context of empowering Muslim women through Islamic economics. This study applies an intersectional approach in carrying out the library research method with literature analysis carried out integratively and comprehensively to explore and review various literature sources relevant to the research topic, including journal articles, books, research reports, policy documents, and other related sources of information. The results show that harmonisation between Islamic law and human rights in empowering Muslim women through Islamic economics significantly impacts achieving gender equality and supporting sustainable development. The complexity of Muslim women's identities influenced by factors such as religion, gender, and social class demands a holistic and integrated policy approach in the economy. While the Islamic economy offers great potential to enhance the role of women as agents of change and key drivers of economic development, the incompatibility between Islamic law and human rights conventions and issues of gender inequality points to the need for more inclusive legal and policy reforms. Identifying and recognising these challenges underscores the importance of adopting a comprehensive and coordinated approach. Specific measures that need to be strengthened include inter-agency cooperation, legal and policy reforms to support better gender equality, capacity building of women in the Islamic economic sector, and raising public awareness on the importance of women's empowerment. As such, this study enriches the academic literature and offers practical guidance for policymakers, stakeholders in the Islamic economy, and the general public in advocating and implementing effective and sustainable women's empowerment.

Abstract

The purpose of this study was to analyze the evidentiary testing system through pretrial for the crime of child intercourse, as well as to find out and analyze the basic considerations of the judge in deciding the pretrial request for the crime of child intercourse. This research used normative legal research method which were carried out by studying theories, concepts, views and legal norms related to this research as well, empirical research was carried out by approaching facts and existing phenomena. The results of this study indicated that in testing pretrial evidence, negative statutory evidence can be called negative wettelijk. determining a suspect was obtained at the investigation stage by considering the nature of the results of the post mortem et repertum, the judge can use this evidence as one of the pieces of evidence to designate someone as a suspect. As for the recommendation that law enforcement officers, especially judges, in making decisions, must be guided by the Criminal Procedure Code and the Constitutional Court Decision Number 21/PUU-XII/2014

Abstract

Law No. 16 of 2011 concerning Legal Aid stipulates legal protection for citizens (access to justice) and equal rights for all citizens before the law (equality before the law), especially for the poor people of Gorontalo city. In Gorontalo City there are still people who have contact with the law who have not received the right to assist in investigations based on Law No. 16 Legal Aid of 2011 and Article 56 of the Criminal Procedure Code. Therefore, the current research addresses this issue, namely. problems in the implementation of legal aid to poor people who stumbled on criminal acts. The purpose of this study is to examine the problems of implementing legal aid for poor people who stumble on criminal cases. This study used an empirical approach, data collection techniques by interviewing respondents in this case, researchers, legal advisors, poor people who intersect with the law, and direct observation of the Criminal Investigation Unit of the Gorontalo City Police. The criminal police is a place where basic information is collected and then evaluated descriptively. The results of this study indicate that the legal assistance provided by the Gorontalo City Police is not very effective or maximal in helping the poor in mentoring and there are few human resources who work with the Gorontalo Police to help, so that the implementation of the provision of legal aid is not very effective.

Abstract

Social media allows the public, especially the younger generation, to access information and knowledge or communicate with others online. Unfortunately, the phenomenon of bullying has evolved into cyberbullying, encompassing various forms of violence such as taunting, insults, intimidation, or harassment carried out by young individuals through digital technology or social media platforms. Therefore, considering the available data, there is a need for a method to classify text comments on social media, whether they fall into the category of cyberbullying or not. One of the methods used is the creation of a cyberbullying classification model using a Support Vector Machine (SVM), Random Forest (RF), and Naive Bayes algorithms. This research aims to analyze cyberbullying in social media by comparing three different algorithms, namely Naïve Bayes, Random Forest, and SVM. The research results show that in the classification analysis, the Support Vector Machine (SVM) model performed the best, with an accuracy of 85%, precision of 79.93%, and recall of 94.29%. The Naive Bayes model also provided satisfactory results, with an accuracy of around 82.19%, precision of 81.29%, and recall of 85.10%. Meanwhile, the Random Forest (RF) model had a lower accuracy of approximately 73.15%, with a precision of 74.05% and a recall of 77.79%.

Abstract

This research aims to determine the judge's considerations in carrying out his juridical function to adjudicate cases, whether they align with legal principles governing marriage and protecting children's rights, and how social stigma influences the judge's decision-making process in many instances.  Interviews were conducted directly to create effective and efficient discussions to collect the primary data. In addition, data was obtained through literature and research studies, including regulations, documents, and related books.  This paper examines a case study concerning a judge's decision to grant dispensation to a married couple not yet of legal age due to a request for parental guardianship submitted to the Gorontalo Religious Court in decision Number 10/Pdt.P/2021/PA. The findings show that the convergence of various legal aspects, cultural values, and social norms can influence judges' considerations in determining child marriage dispensations. The issue of child marriage in Indonesia is complex and needs serious attention. A legal framework must support objective legal principles, take into account the needs and interests of all parties, and overcome social stigma against child marriage.

Abstract

Upaya optimalisasi tumbuh kembang anak adalah pengasuhan yang baik. Gambaran kondisi pengasuhan anak di Indonesia saat ini, terdapat 95,3% anak yang diasuh oleh orangtua baik ibu kandung, ayah kandung ataupun keduanya. Sebanyak 4,7% anak lainnya diasuh keluarga lain atau orangtua pengganti (Profil Anak Indonesia, 2018). Selain itu, sebanyak 3,73% balita diketahui mendapat pengasuhan yang tidak layak, angka ini tergolong besar, berdasarkan keadaan ini, pemerintah memberikan lima arahan kepada Kemen KPPPA, yang salah satunya meningkatkan peran ibu dan keluarga dalam pengasuhan anak. Kegiatan pengabdian kepada masyarakat melalui pembinaan pola pengasuhan positif berdasarkan Modifikasi Program Positive Parenting pada Anak Usia Dini di Desa Penyengat Olak Kab. Muaro Jambi bertujuan melakukan sosialisasi dan meningkatkan pengetahuan keluarga tentang pentingnya pengasuhan positif bagi anak usia dini. Pelaksanaan kegiatan dilaksanakan pada tanggal 10 – 13 Juli 2024. Terjadi peningkatan pengetahuan pengasuhan positif berdasarkan nilai pre test dan nilai post test sebesar 30%, dan terlihat motivasi ibu untuk belajar lebih banyak lagi tentang pengasuhan yang baik bagi anak melalui program parenting lainnya. Antusias ini dapat dijadikan masukan bagi program parenting yang ada di puskesmas penyengat olak Kabupaten Muaro Jambi.

Abstract

The basic concept of zakat is a religious commandment to enhance faith and piety, and at the same time, it is considered the most essential aspect of human life because it provides valuable benefits as an act of worship, purifying the hearts and souls, and bringing blessings to life. However, on the other hand, the expected benefits of zakat have not been fully optimized due to several factors, such as the crisis of trust in zakat management institutions and the lack of awareness among those obligated to pay zakat. As a highly valuable asset, zakat has the potential to address social issues for society, including poverty. To achieve this, it is important for zakat to be managed properly based on the principles of Islamic Sharia as explained in the Qur'an and hadiths.
