Abstract

Industri musik digital sedang berkembang pesat di Indonesia. Namun, semakin banyaknya pelanggaran hak cipta dalam industri musik tersebut juga disebabkan oleh perkembangan ini. Maka dari itu, memperkuat perlindungan hak cipta dalam industri musik digital di Indonesia menjadi penting. Hak cipta di Indonesia dilindungi oleh hukum dari tindakan reproduksi, distribusi, dan publikasi tanpa izin dari pemilik hak cipta. permasalahan antara Keenan Nasution dan Vidi Aldiano terhadap lagu ‘Nuansa Bening’, maka judul proposal penelitian adalah “Analisis Yuridis Terhadap Penyelesaian Sengketa Royalti Lagu Nuansa Bening Antara Keenan Nasution dan Vidi Aldiano Menurut Undang-Undang Hak Cipta” Penelitian ini berfokus kepada perlindungan hak cipta atas lagu menurut UU Hak Cipta dan mekanisme penyelesaian sengketa terhadap lagu Nuansa Bening menurut UU Hak Cipta. Metodologi penelitian adalah inti dari upaya ilmiah. Ini adalah peta jalan yang membimbing peneliti dalam menjawab pertanyaan-pertanyaan yang mendasar dalam penelitian, mengungkap misteri-misteri ilmiah dan memahami dunia di sekitar kita. Pada hakikatnya penelitian merupakan suatu kegiatan atau proses sistematis untuk memecahkan masalah yang dilakukan dengan menerapkan metode ilmiah. Sengketa royalti lagu “Nuansa Bening” menunjukkan bagaimana UU Hak Cipta diterapkan secara konkret untuk melindungi hak ekonomi Pencipta ketika karya digunakan secara komersial tanpa izin. Kasus yang melibatkan Keenan Nasution dan Rudi Pekerti melawan Vidi Aldiano ini berfokus pada dugaan penggunaan lagu dalam 31 penampilan komersial tanpa lisensi.

Abstract

Well-known marks are vulnerable to violations, including in Indonesia. Registered trademark disputes often occur between well-known and local mark owners regarding substantive similarities with well-known marks. Ironically, the dominant dispute resolution protects local marks with the rationality of mark protection based on Territorial Principles. The purpose of this study is to clarify how well-known marks are protected related to the exception applying the Territorial Principle to substantively similar marks and to examine the advantages of the Distinctiveness Theory for more legal certainty. The study used a normative legal research method. Study reveals that the Territorial Principle applies to mark protection through Article 6 of the Paris Convention, Article 15 of TRIPs, Article 3 of Indonesian Law No.20/2016 on Mark and Geographical Indication. Protection of Well-Known Marks is excluded from the Territorial Principle as agreed in 1925 by member countries of the Paris Convention. The exception arrangements are through Article 6bis of the Paris Convention, Article 16 of the TRIPs Agreement, and Article 21 of Law No.20/2016. Marks that are substantively similar with similar elements in visuals, phonetics, and concepts are important for mark examiners, law enforcers, and the public to understand. Understanding the mark distinctiveness theory from the weakest to the strongest, namely: Generic, Descriptive, Suggestive, Fanciful, and Arbitrary as an alternative solution for advantages in mark registration. That will also minimize mark disputes. Good faith in the mark registration is referring to uniqueness theory, it is able to differentiate items or services.

Abstract

Businesses build trademarks to promote products or services while maintaining their reputation and competitiveness. However, the practice of using well-known brands without the license owner's permission is still found. The case of counterfeiting the Arc'teryx brand by PT ATX Asia Sport Products demonstrates a violation of the exclusive rights of the brand owner. This study aims to analyze law enforcement against the circulation of counterfeit Arc'teryx products in Bali based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications and review the role of the TRIPs Agreement in protecting brands in Indonesia. The method used is normative with a literature review of laws, books, journals, and literature related to unauthorized trademark infringement. The results show that the use of the Arc'teryx brand without official permission confirms the weak supervision and law enforcement of foreign brands that have not been registered in Indonesia. Although the first-to-file system applies, Indonesia still provides legal protection for foreign brands through its membership in the Paris Convention and the TRIPs Agreement. This study emphasizes the need to strengthen the role of the Directorate General of Intellectual Property Rights (DJKI), the Commercial Court, and increase public legal awareness to prevent trademark infringement and create legal certainty for rights owners and consumers.

Abstract

This study examines the relationship between freedom of contract and state intervention within the framework of foreign investment law in Indonesia and Sudan, focusing on how both countries balance legal certainty for investors with the protection of national interests. Employing a normative legal research method with comparative and conceptual approaches, this study analyzes primary legal sources, i.e. the 1945 Constitution of Indonesia, Sudans Investment Promotion Act (2021), and relevant investment regulations, alongside secondary sources including academic literature and economic policy documents. The findings reveal that Indonesia adopts a regulated freedom model, where the principle of contractual autonomy is recognized insofar as it aligns with the constitutional mandate of Article 33 of the 1945 Constitution through the doctrine of State Control Rights (Hak Menguasai Negara, HMN). State intervention is implemented under the Right to Regulate framework, particularly through strategic sector restrictions and the industrial downstreaming (hilirisasi) policy designed to ensure domestic value creation. Conversely, Sudan applies a value-based freedom model rooted in Islamic law, in which contractual freedom is constrained by the principles of Hisbah and prohibitions against riba (usury), gharar (uncertainty), and maysir (speculation). The legitimacy of Sudans intervention also derives from post-conflict reconstruction needs and the imperative to safeguard economic stability. The comparative analysis demonstrates that although their philosophical foundations differ, both countries reject the notion of absolute contractual freedom and reaffirm that state sovereignty remains a fundamental element in their investment law regimes. This research emphasizes the importance of a socially responsible freedom model as a convergence point between national investment law and the evolving global economic legal order.
