Abstract

Technological advancements have driven the growth of the financial industry in Indonesia. A more complex financial system provides benefits but also raises issues, such as the rise of illegal investments by business entities without official authorization. Investment involves allocating capital with the expectation of future profits. The growing middle class and economic development in Cangkring Village have increased public interest in investing. Unfortunately, many are tempted by high returns with minimal capital without considering legality. This community service program, as part of the Tri Dharma of Higher Education, aims to educate the public about legally compliant investments. The activities were conducted through lectures and participatory methods. The results indicate that public awareness of investment remains low due to limited financial literacy. Further education is needed to help people distinguish between legal and illegal investments, ensuring they invest safely and in accordance with applicable laws.

Abstract

Abstract The unitary state of the Republic of Indonesia is one of the major countries that prioritizes applicable legal provisions. One of the fields of law in order to maintain order and security of Indonesian citizens themselves is criminal law. Differences can sometimes affect the interaction process and can trigger conflicts either motivated by different interests, and then cause reactions either subtly in the form of conflicts of ideas or violently in the form of violence. Problem in case file B/405/VIII/2023/Sek. Ja with a brief description when the witness named Fajar Alwiyuda was asked for information that it was true that the witness had been molested by the suspect Rifki Agoesti on Saturday, May 20, 2023 at approximately 22.00 WIB at Kp. Cakung Rt 01/05 Kel. Jatisari Kec. Jatiasih Bekasi City. The legal basis and elements of the legal provisions of the case proved that the defendant was charged with Article 352 of the Criminal Code investigated by the investigator. The conclusion obtained is correct There has been a criminal offence of "mistreatment of persons and such abuse does not cause pain or hindrance to the performance of work". That Rifki Agoesti bin Agus Sugiharto based on existing evidence is strongly suspected as the perpetrator. Keywords: Verbal Abuse, Light Assault, KUHP of Law

Abstract

Correctional Institutions are places for providing guidance to prisoners and correctional students. The target of implementing the correctional system is basically to realize the goal of correctional institutions, namely to shape correctional inmates into complete human beings, aware of their mistakes, improve themselves, and return to society as good and useful people. Through this correctional system, the training provided to prisoners is more humane while still upholding their honor and dignity as human beings. One of these processes can be seen in efforts to classify prisoners as an idea of criminal individualization in training prisoners based on the correctional system. Guidance and education will be maximized if there is classification of prisoners, based on age, gender, type of crime, length of sentence and so on. This research aims to find out what the procedures are and how important it is to classify prisoners at the class IIB Blangpidie penitentiary. The research method used is an empirical legal approach, where the data obtained is based on direct observations according to what happens in the field. The results of this research indicate that the classification of prisoners in the Class IIB Blangpidie penitentiary is in accordance whit correctional objectives. Abstract

The practice of prostitution is currently evolving rapidly, primarily driven by the dissemination of information through electronic media. The lack of comprehensive regulations regarding prostitution allows the law to contribute to the development of this phenomenon. Insufficient regulation has created a new legal culture among those involved in prostitution, which has widespread effects on society. One of the most severe consequences of the widespread practice of prostitution is the spread of sexually transmitted diseases, which can impact the health of both those directly involved and individuals nearby, such as the partners of sex workers. This research aims to analyze the regulation of prostitution in Indonesia's criminal law today. Through this analysis, the importance of reforming the law to comprehensively regulate prostitution in the future is highlighted. The method used in this research is legal research with a normative approach, utilizing secondary data obtained through literature review and examination of legislation. The analytical method applied is prescriptive analysis. The findings indicate that although some regional regulations have addressed prostitution practices, there is no national regulation that explicitly governs prostitution. Recommendations for the future include providing a clear definition of prostitution, criminalizing consumers or users of prostitution services, criminalizing sex workers, reformulating offenses for pimps, implementing a double track system for sanctions, increasing criminal penalties, and clarifying the formulation of offenses. Abstract

Class action lawsuits serve as a vital instrument in the enforcement of environmental law, particularly in advocating for the interests of affected communities. Although the regulation of class actions has been recognized in Indonesian legislation, such as Law Number 23 of 1997 in conjunction with Law Number 32 of 2009, as well as Supreme Court Regulation (PERMA) Number 1 of 2002, its implementation continues to face various legal and technical challenges. One of the main issues is the frequent rejection of environmental class action lawsuits by courts on the grounds of not meeting formal requirements. Therefore, the purpose of this paper is to identify procedural obstacles in the implementation of class actions and to provide policy recommendations to improve public access to environmental justice. This study employs a normative juridical method using a statutory approach. The findings indicate that PERMA Number 1 of 2002, as the legal basis for class action lawsuits, is no longer responsive to contemporary developments. To address this, two primary solutions are proposed: first, to elevate the status of PERMA to a law; and second, to establish environmental courts as a specialized forum for resolving environmental disputes. It can be concluded that a more comprehensive regulatory reconstruction and harmonization of norms within Indonesia’s civil judicial system for environmental matters is necessary to ensure the effectiveness of environmental protection through the class action mechanism.

Abstract

Formalin merupakan bahan tambahan pangan yang berbahaya bagi organ tubuh manusia apabila dikonsumsi. Tujuan utama dari kegiatan ini adalah untuk meningkatkan pengetahuan dan kesadaran masyarakat di Pulau Pramuka, Kepulauan Seribu, tentang bahaya penggunaan formalin pada produk hasil perikanan. Metode pelaksanaan yang digunakan dalam kegiatan sosialisasi secara umum terdiri atas tahap persiapan, tahap sosialisasi dan tahap evaluasi. Hasil kegiatan menunjukkan adanya peningkatan pengetahuan dan pemahaman masyarakat setelah dilakukan kegiatan sosialisasi. Terlihat ada 3 partisipan mengalami peningkatan sebesar 100%. Kemudian ada 6 partisipan yang mengalami peningkatan sebesar 80%, 2 partisipan mengalami peningkatan 70%, 3 partisipan yang mengalami peningkatan 60%, 4 partisipan yang masing-masing mengalami peningkatan 50% dan 40%, 3 partisipan yang mengalami peningkatan 30%. Secara keseluruhan rata-rata peningkatan pengetahuan dan pemahaman responden sebesar 60%.

Abstract

Bankruptcy is one of the options available for debtors to resolve financial difficulties when the debtor is unable or is estimated to be unable to pay the obligations owed to the debtor's creditors which are due and billed. Everyone seeking justice must follow certain procedures, including bankruptcy and suspension of debt repayment obligations. The application for bankruptcy and suspension of debt payment obligations is the first step, followed by a decision to declare bankruptcy and suspension of debt payment obligations, as well as all legal remedies. OJK has issued a Credit Restructuring Policy based on Financial Services Authority Regulation Number 11/POJK.03/2020 concerning Economic Stimulus as a Countercyclical Policy for the Impact of the 2019 Coronavirus. This procedure will require debtor restructuring to avoid bankruptcy, either through debt restructuring or corporate restructuring. The purpose of this study is to obtain an overview of the implementation of restructuring in the process of bankruptcy and payment delays, as well as a reference for maximizing debtor restructuring plans. This study finds that debt restructuring and deferred payments are mostly debt restructuring and begin with a settlement plan. Rescheduling consists of selling assets, acquiring new equity, and engaging in debt-to-equity swaps. When the debtor arranges a plan restructuring, fixation begins. Some of the main causes are debtors' misunderstandings about how to use the restructuring plan. Furthermore, in other situations, the implementation of the restructuring may fail due to the debtor's inability to manage the business and its obligations.

Abstract

Studies on Mutual Legal Assistance (MLA) in various countries around the world have been carried out. However, for Indonesia, this is a new thing. So this article aims to examine Mutual Legal Assistance from the perspective of law and social contracts. This study explores methods for obtaining witness statements of foreign nationals. The writing of this article uses a normative legal research method, with a conceptual and statutory approach. The technique of analyzing legal materials used in writing this article is literature study. The results of this study are that it can be seen that foreign nationals have the right to refuse to give their statements before an Indonesian court, and there are no legal consequences whatsoever. Based on this phenomenon, it causes a lack of evidence that is very important in the examination of criminal cases, namely witness statements.

Abstract

Petty theft is one of the most common criminal offenses and contributes to prison overcrowding, even though the losses involved are minimal and often committed by economically vulnerable individuals. The retributive criminal justice system in Indonesia has proven less effective in resolving such cases fairly and efficiently. This study aims to analyze the optimization of restorative justice in handling petty theft cases in Indonesia, while comparing its application with Malaysia and New Zealand. The research employs a normative juridical method, using statutory and comparative legal approaches. The research shows that Indonesia has introduced restorative justice through the Attorney General's Regulation Number 15 of 2020. However, practical implementation faces challenges, including limited awareness among law enforcement, insufficient institutional synergy, and a lack of supporting facilities. In Malaysia, restorative principles are reflected in local practices, although not formally adopted in national legal frameworks. In contrast, New Zealand has institutionalized restorative justice, especially in youth cases, with comprehensive procedures and strong community participation. The comparative analysis suggests that successful implementation depends on regulatory clarity, trained human resources, and active community involvement. Indonesia must therefore enhance its legal infrastructure and cross-sector collaboration to ensure that restorative justice becomes an effective tool in resolving petty theft cases.

Abstract

Penelitian ini membahas perlunya keseimbangan hak dan kewajiban antara pengguna Pekerja Rumah Tangga (PRT) dan PRT dalam konteks Hak Asasi Manusia (HAM). Konsep HAM dalam perspektif pekerja menuntut perlakuan adil tanpa diskriminasi, dan artikel ini menyoroti pentingnya memberikan perlindungan hukum yang komprehensif terhadap PRT di Indonesia, dengan fokus pada Rancangan Undang-Undang Pekerja Rumah Tangga (RUU PPRT). RUU ini menjadi langkah reformasi hukum dalam mewujudkan demokrasi ekonomi di lingkup domestik. Penelitian ini menyoroti beberapa poin upaya, termasuk reformasi hukum, advokasi, peran paralegal, dan pembentukan pusat-pusat pelayanan untuk membantu organisasi serikat pekerja PRT. RUU PPRT menciptakan kejelasan hubungan hukum antara PRT dan majikan serta memberikan perlindungan kepada PRT. Meskipun telah diajukan sejak periode 2004-2009, RUU ini belum disahkan, meski dianggap penting untuk melindungi hak-hak PRT dengan  penghitungan jam kerja PRT dengan formula pendapatan per jam, berfokus pada keadilan ekonomi. RUU PPRT diharapkan dapat menciptakan demokrasi ekonomi di rumah tangga, meningkatkan partisipasi perempuan di pasar tenaga kerja, dan memperbaiki kesetaraan gender. Pengesahan RUU ini dianggap krusial untuk mencapai tujuan pembangunan berkelanjutan.
