Abstract

The purpose of this research is to analyze Legal Challenges in E-commerce Dispute Resolution: Arbitration and Litigation Approaches. This type of research is a literature review. Data collection with documentation. Data analysis with SLR. Research results Legal challenges in resolving e-commerce disputes involve regulatory complexity which is growing rapidly amidst the dynamics of online transactions. Arbitration and litigation approaches are the two main options that parties involved in e-commerce disputes must consider. Arbitration offers speed and confidentiality, while litigation provides a more structured process and public disclosure of information. However, the biggest challenge remains adapting the existing legal system to the dynamics of changing technology and the ever-growing e-commerce business.

Abstract

The revision of the Criminal Code (KUHP) is a strategic step in realizing the reform of national law based on the values of Pancasila and the 1945 Constitution of the Republic of Indonesia. The old Criminal Code as a product of Dutch colonialism (Wetboek van Strafrecht) is considered irrelevant to social, cultural, economic, political, and technological developments in Indonesia, which is undergoing reform. Through the establishment of the new Criminal Code, the government seeks to present a criminal law system that is more humane, fair, and reflects the nation's identity. This reform is also a form of legal decolonization and national independence in building a national legal system with Indonesian personality. This study aims to analyze the urgency of revising the Criminal Code in the context of national law reform and assess its implications for the criminal law system in Indonesia. Using a normative juridical approach, this study emphasizes that the revision of the Criminal Code is not just a textual change, but a substantial transformation towards a criminal law that is in accordance with the values of social justice and universal humanity.

Abstract

BUMDes as a village-managed business institution has a strategic role in efforts to improve the village economy. However, unfortunately, there are still very few villages that are able to optimize the role of BUMDes, so that many BUMDes are "in suspended animation" and are not developing. For this reason, revitalization measures are needed for existing BUMDes. For example, in several BUMDes in the Karanganyar, Klaten and Sukoharjo areas. This is important because the BUMDes revitalization process ultimately seeks to make the village a competitive village. The location of the activity was held at the LPPM Building, Sebelas Maret University. The methods that will be used in this activity are through lectures, discussions, focus group discussions, and mentoring. The results of this activity show that understanding regarding the strategic role of BUMDes and the revitalization of the village economy has increased. Apart from that, BUMDes administrators in the Karanganyar, Klaten and Sukoharjo areas can be more enthusiastic and optimistic in carrying out BUMDes activities.

Abstract

Pengabdian Kepada Masyarakat (PKM HGR-UNS) dilakukan dengan sosialisasi ke mitra yakni BUMDesa Jaya Janti dengan judul “Revitalisasi Badan Usaha Milik Desa (BUMDes) Jaya Janti sebagai Upaya Recovery Perekonomian”. Pengabdian ini berupa pendampingan kepada mitra dalam upaya revitalisasi pengelolaan dan manajemen BUMDesa. Kegiatan ini dilaksanakan melalui beberapa langkah persiapan, teknis, dan kumulatif. Program PKM HGR-UNS tentang revitalisasi BUMDesa Jaya Janti di Desa Janti Kecamatan Pulonharjo, Klaten telah terlaksana dengan baik. Kegiatan ini dapat membantu mengatasi permasalahan mengenai penyusunan laporan keuangan dan tumpang tindihnya pajak pusat dan daerah dengan menerapkan langkah-langkah yang tepat sehingga memberikan sumbangsih terhadap kenaikan pendapatan asli daerah yang digunakan sepenuhnya untuk kemakmuran masyarakat desa.

Abstract

This article aims to provide a prescription regarding the urgency of living legal recognition society in the principle of legality viewed from the perspective of legal sociology. Indonesia is a country that uses criminal law inherited from colonial products. At that time, there was an ideology of individuality, which is still the case today using the new colonial Criminal Code. With the principle of legality still in effect, then it has a big influence on the existence and development of law in Indonesia, especially in relation to existing customary law. This is because the laws that live in society are original Indonesian laws and constitute of Indonesian national identity. So this recognition is not only related to legal recognition but also recognition of Indonesia's pluralistic society. Until now, the idea of ​​legal recognition that lives in society is reflected in the thoughts of academics' thoughts on the principle of material legality. The principle of material legality in basically it is unknown in the European world, because it is the result of people's thoughts Indonesia about the wisdom tribes and nations in Indonesia. The principle of material legality is tried outlined in the Concept of the Criminal Code. Even though it's new tt is only hoped that the draft will soon be ratified by law makers.

Abstract

This research aims to find out two things, namely the amendments to the articles ofLaw Number 20 of 2008 concerning Micro, Small and Medium Enterprises (MSMEs) in Law Number 11 of 2020 concerning Job Creation, especially regarding the requirements for establishing MSMEs, as well as cost analysis andbenefits in comparison to Law Number 20 of 2008 concerning MSMEss and Law Number 11 of 2020 concerning Job Creation. The research design used is a normative legal research method, namely the comparison of legislation between Law Number 20 of 2008 concerning MSMEs and Law Number 11 of 2020 concerning Job Creation. The data analysis technique used is content analysis andcost and benefit analysis to determine the impact of the Job Creation Law on society. The Job Creation Law makes it easier for prospective MSMEs players and MSMEs entrepreneurs. MSME will get legality to facilitate tax administration, making it easier to get incentives. Based on the analysis of costs and benefits, the Job Creation Law can increase economic growth, increase the number of jobs, andincrease income. In contrast, the costs incurred include administrative costs,monitoring costs, risk control costs, conflict costs, and environmental damage costs. The Job Creation Law must provide a single database management status, especially regarding OSS for MSMEss, related to regulated data and its functions so that business actors can feel a positive impact

Abstract

The practice of predatory pricing is a sales strategy that sets very low prices with the aim of removing competitors from the market and attracting buyers at low prices. Article 20 of the Law of the Republic of Indonesia No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition states that business actors are prohibited from supplying goods and or services by selling at a loss or setting meagre prices with the intent to eliminate or terminate the business of its competitors in the relevant market to result in monopolistic practices and or unfair business competition. The type of research that will be used to analyse problems related to the alleged practice of selling at a loss on the Shopee e-commerce site is normative juridical. The legal approach that the author will use is the statutory approach. The development of the e-commerce industry can benefit consumers and businesses. In searching for a case, 2 sources can be found by KPPU, namely based on reports and initiatives from KPPU itself. Not only that, an in-depth examination process and sufficient evidence are needed so that the case can be followed up to the next stage. Regarding preventive measures, KPPU has continued to conduct in-depth research since 2017 to be able to map the digital economic ecosystem and the potential for anti-competitive behaviour that might occur in the future in the digital era. This matter is also stated in the KPPU's Strategic Plan for 2020-2024.

Abstract

This study aims to examine the application of restorative justice for children as criminal offenders under the 2012 Juvenile Criminal Justice System Law (UU SPPA) and the 2014 Qanun Jināyat. The research is an empirical legal study that utilizes a statutory approach and the theory of restorative justice. The findings show that Article 5, paragraph (1) of the 2012 UU SPPA stipulates that children who commit criminal acts (jarīmah) must prioritize a restorative justice approach. Moreover, Article 7, paragraph (1) mentions that at the stages of investigation, prosecution, and trial of child offenders in the district court, diversion efforts must be made. The 2014 Qanun Jināyat does not specifically regulate the handling of cases involving children as offenders but refers to laws concerning juvenile justice. It outlines that the handling of children involved in jarīmah ikhtilaṭ must follow the procedures set out in the aforementioned laws. However, if a child commits an ikhtilaṭ crime and is investigated by the police, the process must be handled through restorative justice and diversion. The forms of restorative justice resolution include: reconciliation with or without compensation, returning the child to their parents/guardians, social rehabilitation, and religious rehabilitation. This study argues that restorative justice treats children offenders with dignity, focusing on fairness and the best interests of the child. It also demonstrates that the UU SPPA and Qanun Jināyat complement each other in the context of juvenile justice.

Abstract

Gadget merupakan salah satu perkembangan teknologi komunikasi yang paling populer. Saat ini, penggunaan Gadget bukan hanya bisa dinikmati oleh kalangan dewasa, anak-anak pun bisa menikmatinya dengan mudah. Tak dapat dipungkiri bahwa anak-anak zaman sekarang lebih sering bermain gadget dibandingkan dengan kesempatan belajar atau berinteraksi dengan lingkungan sekitarnya. Hal ini sangat memprihatinkan, karena dalam masa kecil mereka, pemikirannya masih labil dan anak-anak seringkali merasa penasaran akan hal baru. Peran orang tua merupakan hal yang sangat penting. Perhatian khusus juga perlu diberikan kepada anak agar tidak menyimpang dari penggunaan gadget di kemudian hari, karena penggunaan gadget secara terus menerus pasti akan berdampak buruk bagi perilaku anak. Dalam kehidupan sehari-hari, apabila anak usia dini terus menggunakan gadget, anak akan mengalami ketergantungan. Oleh karena itu, diperlukan sosialisasi mendalam kepada orang tua atau wali murid maupun anak-anak sekolah dengan tujuan memberikan edukasi terhadap bahaya ketergantungan gadget. Lokasi Penyuluhan diambil di Kelompok Bermain/Taman Kanak-kanak Immanuel Karanganyar, yang beralamatkan di Jalan KH. Samanhudi 8 RT 01 RW 14, Dusun Cangakan, Desa Cangakan. Metode yang digunakan adalah pendekatan komunikasi kepada orang tua secara interpersonal dengan melakukan penyuluhan terkait pentingnya peran orang tua dalam melindungi anak dari ketergantungan gadget serta membagikan media leaflet. Hasil dari serangkaian kegiatan yang didapat yaitu meningkatnya kesadaran atau kewaspadaan orang tua akan bahaya dari penggunaan gadget secara terus-menerus serta berubahnya pola perilaku anak ke arah yang lebih positif.

Abstract

The principle of legal certainty, as formulated by Gustav Radbruch, is recognized as one of the essential values of law. It demands that legal rules be written clearly and systematically to avoid ambiguity in interpretation and application. This principle plays a crucial role in ensuring predictability, stability, and public confidence in the legal system. Within the framework of legal positivism—especially in the thoughts of John Austin and Hans Kelsen—clarity, hierarchy of norms, and the separation between law and morality serve as key foundations that strengthen the idea of legal certainty. This study adopts a normative juridical method using a conceptual and philosophical approach. It examines primary legal materials and classical theories of legal positivism to understand how the principle of legal certainty is constructed and justified within positivist reasoning. The findings show that legal certainty functions not only as a procedural guarantee to uphold the rule of law but also as a philosophical reflection of the autonomy and objectivity of the legal system. Furthermore, the study highlights that Radbruch’s theory of values enriches the positivist perspective by introducing a moral dimension to the discourse on legal certainty. The research contributes to the academic discussion by offering a theoretical synthesis between positivist and post-positivist views of legal certainty. This synthesis provides a broader understanding of law as both a normative structure and a moral framework, offering insights that can strengthen the legitimacy and consistency of modern legal systems.
