Abstract

Keadilan retributif lebih cenderung menerapkan penderitaan penjeraan dan pencegahan, sedangkan keadilan restoratif menerapkan restitusi. Tujuan dilakukannya penelitian ini adalah untuk mengetahui bagaimana perspektif Utilitarianisme dalam memandang pengaturan restitusi terkait Tindak Pidana Kekerasan Seksual Di Indonesia. Metode penelitian yang digunakan adalah studi kepustakaan. Hasil yang didapat, bahwa Pengaturan restitusi dalam UU No 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual merupakan suatu bentuk peralihan dari tujuan pemidanaan dari yang sebelumnya bersifat pembalasan (retributif) menjadi memulihkan ke keadaan semula (restoratif). Hal tersebut dipengaruhi oleh ajaran Bentham terkait the great happiness of the greatest number utamanya dalam kemungkinan adanya restitusi ketika pelaku dan korban tindak pidana kekerasan seksual berdamai. Hasil Penelitian menemukan bahwa seringkali ada ketimpangan relasi kuasa antara korban dan pelaku yang dapat mengakibatkan korban terpaksa berdamai. Sehingga ajaran Bentham terkait the great happiness of the greatest number yang harusnya aturan hukum memberikan rasa kebahagian yang besar pada masyarakat belum terpenuhi dalam UU No 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual.

Abstract

The implementation of the Bilateral Investment Treaty in Indonesia with foreign investors must still pay attention to the existence of Indonesian state sovereignty. State sovereignty must be maintained by the host state to maintain the existence of the country in the international world. BIT has the main function as an international legal instrument that is useful in foreign investment activities with reciprocal relations in obtaining benefits between the guarantee of legal protection of the home state of foreign investors and the economic growth of the host state. BIT signatories are theoretically balanced and reciprocal, but they are often detrimental to host states, most of which come from developing countries. This research aims to find out the extent of Indonesia's implementation of BIT and still protect the existence of state sovereignty. The method used in this research uses normative and comparative juridical and this research has an analytical descriptive nature. Normative legal research is obtained by studying the Churchill Mining case approach and collecting data from articles, web, books, and websites and then comparing the implementation of BITs in Indonesia as a developing country and the United States as a developed country and comparing the implementation of BITs in fellow developing countries between Indonesia and Brazil. The first victory achieved by Indonesia against Churchill Mining in the resolution of the international investment dispute at the ICSID forum proved the BIT reform in Indonesia that continues to develop. This study showed that: first, The Bilateral Investment Agreement provides legal protection guarantees for foreign investors and settlement of settlement disputes through ICSID, an international investment settlement arbitration agency between the two countries that signed the BIT so that the BIT is a protection guarantee for investors. Second, Indonesia's victory against Churchill Mining proves that it has reformed the BIT that applies to Indonesia in a balanced manner to provide legal protection (host state) and the existence of state sovereignty (home state).

Abstract

Terrorism has become a significant concern throughout the world. This concern is supported by the increasing use of the internet, which has triggered an increase in cyberattacks. This research aims to determine the role of governance in counter-cyber terrorism. The normative legal methodology utilized in this study results from an exhaustive literature evaluation. This research shows that the government's role is needed to counter cyber terrorism. Although the Indonesian government has initiated a national cybersecurity strategy and implemented short-term and long-term programs, some obstacles and challenges hinder its implementation. The ITE Law has encouraged Indonesia to establish policies and regulations regarding information security. There have yet to be any regulations regarding cyber-attacks to counter cyber terrorism. Various institutions with common interests in national defense and security, including the cyber domain, must collaborate with BSSN. Other government agencies that depend on each other include the TNI, Polri, Ministry of Defense, BIN, and Ministry of Communication and Information. Apart from that, governance is also needed, including international organizations, several non-governmental organizations (NGOs), government and private governance, and several other components.

Abstract

The realization of justice in a criminal process cannot be separated from the position of the victim in the criminal justice system. Victims as parties directly dealing with criminal acts certainly expect their rights and interests to be properly accommodated. This article is written based on a method of normative juridical research with a comparative approach in victim protection regulation in Russia and Indonesia. In the process of resolving criminal cases through the criminal justice system in Indonesia, the victim's interests are represented by the Public Prosecutor so that they do not have access to have their wishes heard further. Even though in Law Number 1 of 2023 concerning the Criminal Code, sentencing guidelines and purposes of sentencing have been regulated, which in this case requires the role of the victim and/or their family, and further regulation is needed in practice. This is of course very different from the position of the victim in the Criminal Procedural Code in Russia, which places the victim actively in the process of the criminal justice system. The presence of the prosecutor in court does not diminish the victim's right to fight for their rights, including by conducting private prosecution of the perpetrator in the form of material or immaterial compensation. To be able to realize the values contained in Pancasila which are not only as Grundnorm but also as Grundwerten, it is necessary to place this victim in the process of resolving criminal cases at every level in the criminal justice system

Abstract

This study highlights the critical role of economic assistance as a non-penal policy in countering terrorism among ex-prisoners in Indonesia. Economic stability emerges as a significant factor in mitigating criminal behavior, particularly terrorism, by addressing the economic roots of radical ideologies. Traditional counterterrorism measures in Indonesia have predominantly focused on punitive approaches, targeting individuals who have committed terrorism offenses through formulation, judicial application, and executive enforcement of penal policies. However, there is an increasing recognition of the limitations of solely punitive measures in preventing recidivism and addressing the broader socio-economic factors that contribute to radicalization. The findings underscore the efficacy of economic interventions in disrupting the cycle of terrorism by providing viable alternatives to individuals vulnerable to radical ideologies due to economic hardships. By offering economic assistance, such as vocational training, job placement programs, and financial support, governments can empower ex-prisoners to reintegrate into society positively. This approach not only enhances the economic stability of former offenders but also reduces their susceptibility to re-engaging in terrorist activities. Moreover, integrating economic welfare assistance into broader counterterrorism strategies promotes a holistic approach that complements punitive measures with preventive measures. It acknowledges the need for synergy between punitive and non-penal policies to effectively combat terrorism. Such integrated strategies are essential for long-term success in reducing terrorism by addressing its socio-economic underpinnings and fostering sustainable peace and stability. In conclusion, this study advocates for the prioritization and implementation of economic assistance programs tailored for ex-prisoners in Indonesia as a crucial component of comprehensive counterterrorism efforts. By investing in economic stability, governments can effectively undermine the appeal of radical ideologies and contribute to lasting security and societal resilience.

Abstract

This research is related to the reform of criminal law in Indonesia through community service order as an alternative to imprisonment. The type of research used in this study is normative legal research. The specifications used in this legal research are descriptive analytical, with a statute approach and a conceptual approach. The types of legal materials used in this research are primary and secondary legal materials. The method of collecting legal materials used by the author in this research is literature study. The method of legal material analysis conducted in this research uses qualitative analysis. The results of this research show that based on Law Number 1 of 2023 concerning the Criminal Code (KUHP), community service order is one of the main types of penalties that also serves as an alternative to short-term imprisonment, specifically for criminal offenses with a potential penalty of less than five years and where the judge imposes a maximum prison sentence of 6 (six) months. It also serves as a substitute for fines that do not exceed category II. This is an implementation of community service order to achieve the objectives of punishment and with the perspectives of justice and legal expediency.

Abstract

Justice Collaborator, which refers to the cooperation between a non-primary perpetrator and law enforcement in uncovering organized crimes, is often used to expose cases of extraordinary crimes. The concept of a Justice Collaborator has become a topic of public discussion following the case involving the murder ordered by Ferdy Sambo, where Ferdy Sambo instructed Richard Eliezer to kill Jhosua Hutabarat. Richard Eliezer was found guilty by the court and was designated as a Justice Collaborator.

Abstract

Menurut data Komnas Perempuan tahun 2024, kekerasan seksual Indonesia masih tinggi, dengan 25.330 kasus dengan korban perempuan sejumlah 21.952 orang. Padahal pemerintah telah lama terapkan Undang-Undang Nomor 12 Tahun 2022 (UU TPKS) sebagai upaya penghapusan dan pencegahan Crime Against Humanity khususnya eksploitasi seksual perempuan Indonesia. Studi ini bertujuan untuk mengidentifikasi muatan aturannya, menemukan tantangan yang dihadapi, serta memformulasikan langkah pengoptimalan penerapannya. Hasil analisis menunjukkan bahwa sejatinya UU TPKS ini muatannya lengkap, melindungi kita dari segala bentuk kekerasan seksual, seperti pembentukan UPT PPA yang tersebar di 38 provinsi. Tantangan yang teridentifikasi yakni minimnya partisipasi masyarakat dalam upaya pencegahan TPKS karena kentalnya budaya patriarki. Maka langkah pengoptimalan UU TPKS yang disarankan adalah sosialisasi menyeluruh terkait pentingnya kerjasama antara pemerintah dan masyarakat dalam menjalankan program pemberantasan kekerasan seksual.

Abstract

Restitution is compensation provided to victims of a crime or their families by the perpetrator or a third party to cover losses from damage to property or income, suffering caused by the crime, and costs for medical or psychological care. Restitution serves as a critical mechanism for ensuring legal protection by aiding in the recovery of victims affected by criminal acts. This is regulated under Law Number 31 of 2014 on the Protection of Witnesses and Victims. However, challenges arise in its implementation, as seen in cases like Decision 1/PID.SUS/2023/PT Bdg, along with various issues in the application of restitution in court rulings, which will be analyzed in this study. This research examines these issues using normative legal research, employing both a legal and case study approach.

Abstract

Abortion remains one of the most controversial legal and ethical issues, balancing between reproductive rights, religious doctrines, and state regulations. In Indonesia, abortion laws are primarily governed by the Health Law No. 36 of 2009 and the Criminal Code, which generally prohibit abortion except under specific circumstances, such as medical emergencies or rape-induced pregnancies. These legal restrictions reflect Indonesia’s socio-religious landscape, where Islamic principles significantly influence legislative frameworks. From an Islamic legal perspective, abortion is largely prohibited but with nuanced interpretations depending on the gestational stage and underlying reasons. Classical Islamic jurisprudence generally forbids abortion after ensoulment (believed to occur at 120 days of pregnancy), though some scholars permit it under limited circumstances, such as to preserve the mother’s life or in cases of severe fetal abnormalities. However, differences exist among Islamic schools of thought regarding permissibility before ensoulment, leading to diverse legal applications across Muslim-majority countries, including Indonesia. This study critically examines the intersection of Indonesian state law and Islamic law on abortion, highlighting their points of convergence and divergence. It explores how legal, religious, and ethical considerations shape abortion policies and the implications for women's reproductive rights. The paper also addresses ongoing debates over potential legal reforms, considering global human rights perspectives and the influence of Islamic jurisprudence in shaping reproductive health policies. By comparing these legal frameworks, this study aims to provide a comprehensive understanding of abortion law in Indonesia within both secular and religious contexts.
