Abstract

Abstract

The consequences of the Kanjuruhan incident during Indonesian football matches prompted the implementation of punitive measures, aiming to ensure the protection of fundamental rights. The incident, which resulted in dissatisfaction among fans, particularly the Aremania supporters, was triggered by their team's defeat. The conclusion of the match saw a surge of discontent, leading fans to descend onto the field to express their disappointment. In conducting this research, a doctrinal legal approach, specifically of the normative type, was employed. The methodology involved a literature study, encompassing legal principles, rules, regulations, doctrines, theories, and legal dictionaries that contribute to legal literacy. The research aimed to gain insights into the necessity, harmony, and intentionality of legal measures, employing a scientific approach through doctrinal laws. The normative legal methods used positive law, context, and literature as their specifications. The research approach incorporated positive law and a case study method, focusing on the Kanjuruhan commotions. The findings and discussions unveiled the court's decision in accordance with Decision 13/Pid.B/2023/PN Sby, which acquitted the defendant. Legal efforts were subsequently initiated by the public prosecutor (JPU) in case 922/K/Pid/2023 to overturn the previous decision. The Supreme Judge determined a violation of Article 359 in conjunction with Article 360 of Law Number 1/1946 concerning Criminal Law Regulations, citing negligence leading to death. The causal link in this case was established when security forces (police) deployed tear gas into the spectator stands in response to the anarchic behavior of the Aremania supporters who had descended onto the field.

Abstract

This paper delves into the intricate challenge of striking a delicate balance between national security imperatives and the protection of individual liberties in the context of contemporary counterterrorism laws. In the aftermath of global terrorist threats, governments worldwide have enacted a myriad of legislative measures aimed at preventing and combating acts of terrorism. However, the implementation of these measures often raises concerns about potential encroachments on civil liberties, privacy rights, and due process. The study critically examines the evolving landscape of counterterrorism laws, analyzing key legal frameworks and their impact on individual freedoms. It scrutinizes the delicate equilibrium required to effectively address security threats without sacrificing the fundamental rights and values that underpin democratic societies. Drawing on case studies from diverse jurisdictions, the research explores the implications of counterterrorism measures on marginalized communities, surveillance practices, and the rule of law. Furthermore, the paper assesses the effectiveness of oversight mechanisms and judicial review processes in mitigating the risks of abuse and overreach. It considers the role of technology, international cooperation, and intelligence sharing in contemporary counterterrorism efforts and evaluates their potential impact on individual privacy and human rights. In addition, this paper aims to contribute to the ongoing discourse on counterterrorism policy by offering insights into the challenges of balancing security imperatives with the preservation of civil liberties. It advocates for a thoughtful and nuanced approach that fosters security without compromising the core values that define democratic societies.

Abstract

Acts of terror invariably commence with the cultivation of radicalism, making it imperative to implement preventive measures to curtail the proliferation of these extremist ideologies. Particularly noteworthy is the rise of social radicalism, which requires vigilant attention. The recent uptick in religious radicalism further underscores the urgency of fostering a preventive mindset. The objective of this initiative is to instill a preventive attitude among the residents of Gunungpati District in Semarang City, countering the influences of both terrorism and radicalism. Simultaneously, it seeks to offer valuable insights to the government, outlining necessary actions to provide legal protection for the people of Gunungpati District against religious sects associated with terrorism and radicalism. In collaboration with the Ats-Tsaqofah Semarang Foundation, an institution dedicated to community empowerment, particularly in the realm of religious morality development, this activity employs a combination of lecture, dialogue, and focused discussion methods. The utilization of the brainstorming method from the audience further enhances the initiative, extracting their initial knowledge about terrorism and radicalism. The anticipated outcome of this collaborative effort is the cultivation of preventive attitudes within society, acting as a counterforce against the infiltration of radical ideologies. By leveraging educational and community-based strategies, the initiative aims to equip individuals with the awareness and resilience needed to resist the allure of radicalism, thereby contributing to the overall security and well-being of the Gunungpati community.

Abstract

The emergence of various cases of radicalism in universities is the responsibility of all parties. Various cases that occur in universities show that campuses in Indonesia are very vulnerable to being compiled by radical ideas and terrorism movements, even considered to have no clear curriculum direction in preventing radicalism and terrorism. This study aims to analyze three important things in the issue of radicalism and terrorism in universities, especially at Semarang State University, namely, first how radicalism prevention policies in universities (study at UNNES); second, how to implement policies to prevent radicalism and terrorism at UNNES; and third, how UNNES campus efforts to overcome students or lecturers exposed to radicalism and terrorism. The method used in this study is a mixed method that combines normative juridical research with empirical data in the field. The projected results of this study are in the form of real data regarding the implementation of religious freedom regulations on the UNNES campus. The output of this research is in the form of articles published in accredited national journals.

Abstract

Central Java, as a reflection of a calm and peaceful society, is disturbed by the rise of terrorism, which has made the region a base for recruitment and terror regeneration. Acts of terror are always preceded by the implantation of radical ideologies. Therefore, preventive efforts are necessary to thwart the spread of these radical ideologies. This activity aims to foster a preventive attitude to counter radical ideologies in the Batursari community, Kledung Sub-district, Temanggung Regency, and to provide recommendations to the government on the necessary actions to ensure legal protection for the Batursari community against terrorism and radicalism. This activity is in partnership with the Ansor Youth Movement (GP) PAC of Kledung Sub-district, Temanggung Regency, which is one of the autonomous bodies of Nahdlatul Ulama. The methods used in this activity include lectures and dialogues, as well as focused discussions. Additionally, brainstorming—collecting opinions from the audience—will be used as an initial effort to gauge their knowledge about terrorism and radicalism. This activity is expected to cultivate a preventive attitude to counter the infiltration of radical ideologies into the community.

Abstract

Hal tersebut dipengaruhi oleh ajaran Bentham terkait the great happiness of the greatest number utamanya dalam kemungkinan adanya restitusi ketika pelaku dan korban tindak pidana kekerasan seksual berdamai. Sehingga ajaran Bentham terkait the great happiness of the greatest number yang harusnya aturan hukum memberikan rasa kebahagian yang besar pada masyarakat belum terpenuhi dalam UU No 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual.
