Abstract

Abstract. Based on the provisions of Article 56 and Article 57 of Law Number 8 of 2011 concerning Amendments to Law Number 24 of 2003 concerning the Constitutional Court only limited to the cancellation of the norm (negative legislator). However, from a number of decisions that not only invalidate the prevailing norms, positive legislators are proposed against the limiting bill from the authority of the Constitutional Court. One example of the verdict is the Constitutional Court decision Number 102 / PUU-VII / 2009 which is in the decision of the Constitutional Court (positive legislator), namely by allowing parliamentarians registered in the permanent voters list to be able to choose the identity card and passport. In this case, the authority of the state institution as the legislator of the House of Representatives (DPR) was taken over by the Constitutional Court, therefore the research in this thesis was conducted to explain and analyze the decisions of the Constitutional Court No. 102 / PUU-VII / 2009. The research carried out is normative legal research and the research discussion used is invitational research (statute approach) and renewal (case approach), namely by using legal data sources of secondary data which consists of primary legal materials, secondary legal materials and tertiary legal materials by means of analyzed using qualitative methods to deduce conclusions. Decision of the Constitutional Court No. 102 / PUU-VII / 2009 which influences agreed new norms (positive legislators) is very useful and useful for protecting constitutional rights. real justice. Justice is manifested in a sense of justice that is valued and lives in the midst of society. The implementation of this decision was finally set forth in a law, namely Law No. 7 of 2017 concerning general elections so that the use of identity card or passports in each general election becomes stronger in the implementation of the Court's decision No. 102 / PUU-VII / 2009 can find legal objectives, namely for justice, legal certainty and benefit for the community. Abstract

Abstract. The imposition of a threshold on constitutional presidential elections violates the constitutional rights of citizens. Based on the provisions of Chapter 6A Verse (2) of the 1945 Constitution, the presidential candidate and vice presidential candidate pairs are proposed by political parties or a combination of political parties participating in the general election before the general election. This provision provides space for political parties to propose candidates for president and vice president. but in article 222 of law number 7 of 2017 concerning general elections it provides a limit of 20% of the number of seats in the DPR or 25% of nationally valid votes in previous DPR member elections. in a presidential system the imposition of a threshold is irrelevant because theoretically separation of power is not known as the existence of a presidential accountability to the parliament, thus the threshold is not appropriate if the votes used are from the DPR elections. for this reason, the decision of the constitutional court should provide justice for the people by considering the sovereignty of the people.   Keywords: threshold, presidential election, constitutional court decision.

Abstract

Abstract. The demand for awareness of the protection, respect, enforcement, fulfillment and promotion of human rights is the commitment and responsibility of the state. This form of ethical awareness is manifested and normalized in the form of Presidential Regulation Number 75 of 2015 concerning the National Action Plan for Human Rights as an elaboration of the Vienna Declaration and Program of Action June 25, 1993. This study uses a normative juridical method that is descriptive analytical. While the National Action Plan on Human Rights of the province of North Sumatera is regulated and recommended based on the Minister of Home Affairs Circular Letter No. 180/1319/SJ, which was previously regulated and must be determined based on Presidential Instruction; On the other than funding for the application of National Action Plan for Human Rights in the Regional Government of the province of North Sumatera in the 2015-2019 period is still experiencing budget limitations. So it needs to be recommended to increase the commitment of both central and regional governments by forming legal policies on a human rights perspective and improving and reinforcing the position and governance of the Presidential Instruction as well as the Minister of Circular Letter which is used as a reference or implementing regulation policy rather than Presidential Regulation Number 75 of 2015 concerning National Action Plan on Human Rights as a reference and reporting procedure for regional human rights actions that have been established. Then, the implementation of National Action Plan on Human Rights in the Regional Government of the province of North Sumatera needs to be addressed with a synergy of more rational and adequate budget coverage, as well as establishing harmonious relations between the province of North Sumatera Government's Human Rights Action Team, especially between the Regional Head and the Regional Representative Council in encouraging understanding for protection and the promotion of human rights through a comprehensive and accountable regional budgeting process.   Keywords : human rights, national action plan on human rights, legislation.

Abstract

Abstract. The regional authority in collecting taxes and levies is regulated by Law No. 28 of 2009 concerning Regional Taxes and Regional Levies. Based on this law, regions are given the authority to collect 11 types of taxes and 33 types of user fees, with the consideration that these types of taxes and user charges are generally good. This research is used normative legal research method. Normative legal research is research by only processing and using secondary data relating to the issue of "Implementation of the Regional Parliamentary Oversight Function Against Increasing Local Revenue in Langsa City". The type of research used is normative juridical, then the approach taken is the statute approach. The DPRD in general, especially the Langsa City DPRD in carrying out its supervisory function, is expected to truly be able to ensure that the regional government is in the public interest, and must be able to realize the shared goals and interests agreed in the legislation and budgeting process. The aspirations of the community are essentially institutionalized through their representatives in the DPRD, especially in the field of supervision.   Keywords: supervision, enhancement, locally genereted revenue

Abstract

Abstract. The State of Indonesia is a state of law that cannot be separated from the regulations so that many regulations are produced, but there are conflicts, multiple interpretations, inconsistencies, and not operational, so that President Joko Widodo issues a legal revitalization policy package throught the regulation structuring program, institutional reform, and legal culture development. One of the sub programs on structuring regulations is the evaluation regulations by the Minister of Law and Human Rights. Since 2016 The Minister of Law and Human Rights has evaluated 759 legislations central with detail: in 2016 there were 193 legislation; in 2017 there were 295 laws and regulations; and in 2018 there will be 271 laws and regulation, but the results of the evaluation regulations by The Minister of Law and Human Rights don’t yet have a binding capacity for the ministries/institutions mentioned in the recommendations and don’t yet have a legal umbrella that requires the recommendations to be followed   Keywords: minister of law and human rights, regulations, evaluation of regulations

Abstract

In the post-reform, the establishment of the Law No. 25 year 1999 about the Financial Proportionality between Central Government and Local Government and the Law No. 33 year 2004 about the Financial Proportionality between Central Government and Local Government, Distribution of Proportionality Resources have turned into the distribution of natural resources of local areas. The issue to be analyzed deals with in what financial sector the local areas initiatively find the revenue sources needed to implement their autonomy as a reflection of a decentralization-based implementation as stated in Constitutional of 1945. The method used in the research is based on the judicial-normative approach by applying the materials of primary law, secondary law, and tertiary law. This research additionally applies a normative-qualitative analysis. The establishment of Regulation on the Financial Proportionality in the post of reform shows a very significant outcome for the implementation of autonomy in the local areas. It is due to the local budget is not merely based on the local revenue but, much more than that, the local areas also have the budget resources originated from the local areas alone – that currently is absorbed by the Central Government.

Abstract

The idea of democracy demands that every form of law and various decisions be approved by the representatives of the people and perhaps consider the interests of the people. Authorization, a law is in the hands of the DPR together with the President and does not involve the holders of sovereignty, namely the people in the process of ordering it, but currently the role and the people in influencing policies to produce a law and to assess the validity of a law laws cannot be underestimated. The research aims to provide immunity rights for members of the DPR RI as public officials in carrying out their duties and authorities. The research method used in this research is normative juridical legal research using an invited approach and the doctrine applied to a legal problem and is prescriptive in nature which is expected to be applied in society. The results of the study concluded that in carrying out their duties and authorities, members of the DPR RI need to be properly and respectably protected with their level of honor as people's representatives who have been elected by the people and each member of the DPR RI must also reflect respectable and foremost personal and behavior in law enforcement

Abstract

Article 28H, paragraph 2 of the 1945 Institution states that “Every person shall have the right to receive facilitation and special treatment to have the same opportunity and benegit in order to achieve equality and fairness.” Therefore, affirmative action can be used for a certain group of peopke that needs special treatment and facility.Law No.21/2001 on Special Autonomu for Papua is the Indonesian commitment to give new perspective in handling any probnlem in Papua by changing problem solving approach from security/stability approach to social/welfare approach. The realization of affirmative action can be seen from the establishment MRP (Papua People’s Assembly) as the culture representation of native Papua. It is the only State’s institution in Indonesia.Law on Special Autonomy gives the opportunity for Papua women to develop their self and position them as equal partners of men. Abstract

Penyusunan peraturan tentang Keistimewaan Yogyakarta salah satunya yang memerlukan waktu pembahasan yang cukup panjang, bahkan mencapai kurang lebih 7 (tujuh) sampai 8 (delapan) tahun. Hal ini diyakini syarat dengan nuansa politis mengingat kedudukan yogyakarta sangat strategis dalam sistem ketatanegaraan indonesia. Polemik dan konflik mengenai keistimewaan Yogyakarta mulai memanas dengan pernyataan Presiden Susilo Bambang Yudhoyono yang menyebutkan sistem monarki di Provinsi Daerah Istimewa Yogyakarta bertentangan dengan nilai demokrasi. Menurutnya Presiden melihat aspek demokrasi, monarki, dan konstitusi sebagai satu kesatuan yang tidak dipisahkan. Perlu dipertimbangkan secara keseluruhan di dalam rumusan undang-undang baru ini yaitu RUU Keistimewaan Yogyakarta, bersamaan dengan itu disusunlah RUU Keistimewaan Yogyakarta dengan berbagai versi sampai akhirnya RUU Keistimewaan Yogyakarta versi Pemerintah Pusat yang secara resmi diajukan oleh Pemerintah kepada DPR RI dan ditindak lanjuti dengan penyampaian keterangan pemerintah atas RUU Keistimewaan Provinsi Yogyakarta yang telah disampaikan pada Rapat Kerja dengan Komisi II DPR RI pada tanggal 2 Januari 2011 maupun pertemuan-pertemuan atau rapat kerja yang lain, sampai akhirnya pada tanggal 30 Agustus 2012 RUU Keistimewaan Daerah Istimewa Yogyakarta telah disepakati dan ditetapkan menjadi Undang-Undang Nomor 13 Tahun 2013 tentang Keistimewaan Daerah Istimewa Yogyakarta.
