Abstract

This study examines the fairness and legality of dudukan in the practice of customary village autonomy in Bali, particularly in the context of the implementation of Bali Provincial Regulation No. 4 of 2019 concerning Customary Villages and Governor Regulation No. 34 of 2019 concerning the Management of Customary Village Finances. Dudukan, a mandatory contribution from krama adat (traditional community members) and krama tamiu (non-traditional community members) to support traditional and social activities, often causes controversy because it is associated with illegal levies. This study aims to analyse the model, regulations, and nature of dudukan within the framework of customary law and national law. The research was conducted using a sociological legal-normative approach through interviews, literature studies, and analysis of regulations and practices in the field. The results show that, according to customary law, the dudukan has a basis of legitimacy through the customary village's pararem (customary law). However, its implementation often does not meet the principles of fairness, transparency, and legal certainty stipulated in the rule of law. It was also found that there was a difference in perception between state officials and indigenous peoples regarding the legal limits of customary levies. This study recommends the need for harmonisation between customary law and positive law, strengthening the role of local government in facilitation and supervision, and applying the principle of substantive justice so that dudukan truly functions as an instrument of welfare and social harmony for the Balinese people.

Abstract

Indonesia is a country based on the rule of law that adheres to Pancasila and the 1945 Constitution, guaranteeing equality before the law for all citizens. However, advances in information technology, particularly in the banking sector, have given rise to serious challenges, including digital crime, particularly the theft of personal data through skimming methods. Skimming is a cybercrime and information technology crime in which a customer's ATM card data is illegally duplicated using specialised tools. Perpetrators then use this stolen data to access and drain customer funds. This banking crime is closely related to the Electronic Information and Transactions Law (EIT Law), specifically Articles 30 and 31, which regulate illegal access and interception of electronic systems. This study adopts a normative juridical method with a literature review approach, examining various legal materials. The focus of the study is on the legal regulations governing criminal skimming technology in the national banking system. The study's results show that, although the ITE Law has become the legal basis for prosecuting skimming, there remain structural weaknesses. These weaknesses stem from a lack of clarity in the definition and scope of the offence, which ultimately creates difficulties in consistently and fairly enforcing the law. The protection of customers' personal data is emphasised in ITE Law, which makes it part of the right to privacy that banks must guarantee. Skimming perpetrators can be prosecuted under the criminal provisions of ITE Law or under Articles 362 and 363 of the Criminal Code (KUHP) on theft.

Abstract

There are conflicting norms (conflict norms) in Article 4 and Article 54 of the Narcotics Law which essentially guarantees rehabilitation for narcotics abusers for themselves, however in Article 127 of the Narcotics Law the threat of imprisonment is at the same time that the act also meets the qualifications for the act as regulated in Articles 111 and/ or Article 112 or even Article 114 of the Narcotics Law. These conditions are the background for this research in order to analyze (1) the regulation of the rights of Indonesian citizen workers and citizen workers which are considered by judges to decide on rehabilitation sanctions or prison sanctions for narcotics users or addicts; and (2) regulation of sanctions for future narcotics users or addicts (ius constituendum). The research method used is a type of normative legal research with a statutory approach and a conceptual approach. The research results show (1) The judge's considerations in deciding on rehabilitation sanctions or imprisonment for narcotics users or addicts include juridical considerations, especially Article 54 of the Narcotics Law which requires narcotics addicts and victims of narcotics abuse to undergo medical rehabilitation and social rehabilitation. If the judge cannot apply the applicable law, in this case the Narcotics Law, then the judge is obliged to find the law in order to achieve a fair decision; and (2) Regulation of sanctions for narcotics users or addicts in the future (ius constituendum) prioritizing rehabilitation sanctions which can be used as depenalization efforts as well as legal protection for narcotics addicts in order to optimize sanctions which so far have not been effective in preventing and overcoming narcotics abuse, so that the only The only way to cure it is to undergo rehabilitation.

Abstract

Abstract

Purpose: This study analyzes the legal regulation of foreign nationals within the Indonesian legal system and the sanctions imposed on them as perpetrators of online lending activities. Research Methodology: This research employs a normative legal approach using statutory, conceptual, and case analyses. Legal materials are examined qualitatively through literature review and deductive reasoning. Results: The findings show that foreign nationals are recognized as legal subjects under the principle of territorial jurisdiction and are subject to Indonesian law when conducting legal acts within its territory. Sanctions for involvement in online lending may include civil liability for breach of contract and unlawful acts under the Civil Code, criminal penalties, and administrative measures such as immigration sanctions. Conclusions: Indonesian positive law provides a sufficient legal framework to impose civil, criminal, and administrative sanctions on foreign nationals engaged in online lending. However, enforcement remains limited by practical constraints. Limitations: This study focuses on existing regulations and court decisions and does not examine international legal cooperation mechanisms in depth. Contributions: This study contributes to the literature by offering an integrated analysis of the legal position of foreign nationals in Indonesia’s online lending regulation.

Abstract

The resolution of gross human rights violations in Indonesia continues to face various obstacles due to the dominance of formalistic legal positivism, which emphasizes procedural compliance rather than substantive justice. This study aims to analyze the transformation of legal reasoning from formalistic positivism to constructive utilitarianism as a basis for reconstructing the mechanism for resolving gross human rights violations in Indonesia. This study uses a normative juridical method, a statutory approach, a conceptual approach, and a historical approach. The source of legal material is obtained from relevant laws and regulations, legal literature, court decisions, and international human rights instruments. The results of the study show that the formalistic positivist approach in resolving gross human rights violations has led to stagnation in case resolution, the marginalization of victims, and the perpetuation of impunity. The limitations of Law No. 26 of 2000 concerning Human Rights Courts and the legal vacuum following the repeal of Law No. 27 of 2004 concerning the Truth and Reconciliation Commission have also weakened the effectiveness of the human rights settlement system in Indonesia. This research offers constructive utilitarianism as an alternative paradigm for assessing the success of the law based on real social benefits, such as victim recovery, truth disclosure, reconciliation, and the prevention of the recurrence of gross human rights violations. Therefore, it is necessary to integrate judicial and non-judicial mechanisms through a criminal justice framework oriented towards victim protection, harmonization with international human rights standards, and the re-establishment of the Truth and Reconciliation Commission Law as an ius constituendum to realize an accountable, just, and future-oriented human rights settlement system

Abstract

As academics, the Warmadewa University Community Service Team provided assistance in the socialization and basic training of paralegals in Tenganan Dauh Tukad Village, as mandated by Minister of Law and Human Rights Regulation Number 3 of 2021 concerning Paralegals in the Provision of Legal Aid. The KPIs achieved in this Community Service Program were KPI 1: Students Gain Experience Off-Campus. KPI 2 was the lecturer's off-campus activities. This indicator aims to ensure that lecturers are not only active on campus, but also off campus. Tenganan Dauh Tukad Village, located in Karangasem Regency, Bali, is a traditional village rich in tradition and culture. This village is known for its various traditional ceremonies, handicrafts, and sustainable agricultural systems that reflect the local wisdom of the Balinese people. In every corner of the village, visitors can witness the beauty of traditional architecture and the implementation of rituals that are an integral part of the daily lives of its residents. However, despite their strong love for tradition, the people of Tenganan Dauh Tukad often lack an understanding of the importance of legal aspects. This impacts their ability to protect their rights and resolve conflicts legally. This lack of understanding has the potential to cause problems in various aspects, including land, marriage, and inheritance. For example, without adequate legal knowledge, land disputes can escalate into more serious conflicts, which in turn can damage social relations among villagers. Tenganan Dauh Tukad Village has a unique culture and rich traditions. However, in practice, village officials often face challenges in managing legal issues related to land ownership, permits, and social conflicts within the community. Without an adequate understanding of the legal aspects, they struggle to resolve existing issues, which can lead to conflict within the community. Basic paralegal training is designed to provide village officials with basic legal knowledge so they can become effective mediators in resolving disputes and educating the community about their legal rights and obligations. The outputs of the community service team include: an international journal entitled "Community Journal Service of Law," a 40-second video, print media and online YouTube videos, and a final report on the 2026 Community Service Program.
