Abstract

This paper discusses good environmental governance in the framework of environmental protection and management. The evironmental view of governance itself provides a conceptual framework in which public and private behavior is regulated in supporting more ecologically oriented arrangements. The framework forms a reciprocal relationship between the community (global, regional, national and local) in dealing with the access and use of environmental goods and services and binds them (at any level) with certain specific environmental ethics. Then as a system, Environmental Governance consists of socio-cultural aspects, political and economic interactions among many actors in civil society. In managing and protecting the environment around it is needed cooperation between humans, humans are very important to manage and protect the environment in which they live. Starting from the government and until the people have the same rights and obligations in managing and protecting the environment without exception. Not limited wherever domicile. Both rural communities, rural and urban areas, become an important part of the realization of a good and healthy environment. The existence of the community will be very effective if its role in controlling the management of the exis ting environment.

Abstract

Criminal Law Reform endeavours to establish legal frameworks that meet society's evolving needs within the realm of criminal justice. It involves revising existing legal standards to craft new regulations that can effectively address contemporary challenges. The core aim is to keep pace with societal changes, ensuring that criminal law remains relevant and responsive to real-world circumstances. Central to this is the concept of due process, a cornerstone of criminal justice systems worldwide, which safeguards individual liberties and human rights. It underscores the intrinsic connection between criminal law and due process, highlighting their indispensable unity. This study explores the vital role of due process in shaping law enforcement practices within the criminal justice domain, seeking to assess its significance in upholding individual rights while facilitating efficient law enforcement. The research methodology involves qualitative analysis through the examination of legal texts, case studies, and evaluations of policies. Findings suggest that due process of law plays a vital role in balancing law enforcement effectiveness with civil liberties protection. The conclusion emphasizes the importance of integrating due process principles uniformly into criminal justice systems to promote fairness and strengthen the rule of law.

Abstract

The focus of the research is on the urgency of regulating foreign bribery crime in Indonesia aswell as the Indonesian constitution perspective. This issue raises concerns, because theregulation of foreign bribery crime has not been included in Indonesian Laws, makingIndonesia a country that cannot follow up on this criminal act. The questions that arise are 1)what the urgency of the regulation of the law on foreign bribery crime in Indonesia is is 2)what the perspective of the Indonesian constitution regarding foreign bribery crime is is. Thepurpose of this study is to describe the urgency of legal regulation of the concept of foreignbribery crime in Indonesia, and the perspective of the Indonesian constitution regardingforeign bribery crime. The research method uses juridic-normative research with a qualitativeapproach to law. The results of the research show that 1) Indonesia is a participating countryof UNCAC and has ratified it through Law Number 7 of 2006. However, until now there is noregulation to criminalize foreign bribery. In fact, according to the researcher, this is an urgencybecause the opportunity for variation in corruption cases but not followed by criminal reformof the criminal offense, resulting in the enforcement of corruption crimes is not optimal. 2) TheIndonesian Constitution, by adopting Foreign Bribery in Indonesian legislation, it is hoped thatIndonesia can enforce its laws fairly

Abstract

The prevention of mother-to-child transmission (PMTCT) of HIV remains a major public health challenge in Indonesia, particularly in regions where stigma, limited knowledge, and weak social support hinder optimal program implementation. This study aimed to identify determinants influencing PMTCT efforts among HIV-positive pregnant women in Jombang Regency. An analytical observational design with a cross-sectional approach was employed, involving 30 pregnant women selected through systematic sampling. Data were collected using structured questionnaires and analyzed with univariate and bivariate methods using Spearman-Rho correlation. The results showed that 60% of respondents demonstrated adequate prevention efforts, while 40% were inadequate. Attitude (p = 0.006), parity (p = 0.010), peer support (p = 0.000), husband support (p = 0.010), healthcare worker support (p = 0.010), and accessibility (p = 0.028) were significantly associated with prevention behaviors. Peer support emerged as the strongest determinant, reflecting the importance of social networks and interpersonal influences. The findings indicate that PMTCT success requires more than clinical interventions; it depends on strengthening social support systems, improving counseling quality, and enhancing access to maternal health services. Integrated, community-based strategies are essential for reducing HIV transmission and achieving PMTCT targets.

Abstract

This study examines the role of criminal law in curbing unlawful land-use practices in Indone-sia's broader spatial-planning framework. Its primary interest lies not only in asking whether the threat of criminal enforcement deters potential offenders but also in investigating whether those who violate the rules receive sanctions that are credible, consistent, and sufficiently severe. Employing a normative legal methodology, the author examines statutory texts, cornerstone legal principles, and leading judicial opinions, deftly navigating between major codes and significant academic commentary. The analysis shows that although sanctions appear to be codified, they operate with limited force in the real world because of vague language, poorly trained investigators, and an enduring pattern within government agencies to rely on softer administrative fines before resorting to stricter penalties. On that ground, the paper insists that criminal tools must still act as an ultimum remedium if Indonesia hopes to defend the rule of law and head toward truly sustainable land management. To make the system stronger, the author(s) calls on lawmakers to clarify enforcement paths, improve coordination between ministries, and fund training for the officers who face spatial violations day after day.

Abstract

Lemdiklat Akpol there is a discrepancy in the alignment between government regulations and police regulations in Indonesia. Career patterns have various very important roles in an agency for the development of an employee's career because they have an impact on the level of expertise and professionalism of employees individually or their performance in an agency. This article aims to describe and analyze the retirement age related to the functional position of Civil Servants from the perspective of justice and welfare at the Police Academy education and training institution. The study uses a qualitative legal approach, non-doctrinal research type (Sociological Juridical), data collection techniques using interviews, observations, and document studies, data validity Triangulation and data analysis using data reduction, data presentation and conclusions. The results of the study show that Lemdiklat Akpol applies a retirement age of 58 years even though there is a regulation from Menpan RB which is 65 years for functional lecturers. The application of the retirement age at Lemdiklat Akpol refers to the Police Law although there are still problems of discrepancy and inconsistency between government regulations and regulations in the Police.

Abstract

This study examines the legal protection of illegal Indonesian migrant workers, who are considered both as lawbreakers and victims of exploitation, in the context of compliance with Indonesian migrant worker and immigration laws and the protection of human rights based on Islamic law. Using normative legal research, the study analyses the imbalance between Law No. 18/2017, which limits protection for migrant workers who have legal documents, and the 1990 CMW Convention and the 2000 Palermo Protocol, which guaranty the basic rights, regardless of the legal status. The results of the study reveal that the pros and cons regarding illegal procedural Indonesian migrant workers are in substance to the violation of the law. From an Islamic law perspective, this issue needs to be addressed and a solution sought by updating Law Number 18 of 2017 so that there is no difference between official and unofficial Indonesian migrant workers. This is in line with the maqashid syari'ah in Islamic law, the 1990 CMW Convention and the 2000 Palermo Protocol.

Abstract

It is crucial to ascertain whether halal tourism regulation can stimulate economic growth and promote sustainable national development to achieve community well-being. This research aims to advance halal tourism regulation to encourage the community's well-being. This research employs a qualitative methodology to conduct sociological and legal research. The research’s findings show that the decentralization of halal tourism regulation is intended to enhance the community's well-being. Nevertheless, the central level has not engaged in any discussions regarding the legal framework governing halal tourism implementation. The number of tourist visits, destinations, and hotels can be increased by the implications of halal tourism regulation in the form of Regional Regulations, particularly in West Nusa Tenggara. However, this has not resulted in community well-being. In contrast, Malaysia maintains robust institutions and regulations. The regulation of halal tourism in Malaysia is crucial for enhancing community well-being, as it promotes economic growth, employment opportunities, and adherence to Islamic principles. Consequently, it is crucial to enhance the institutional framework in Indonesia to supervise the implementation of halal tourism, foster collaboration among stakeholders, and strengthen regulations surrounding halal tourism to encourage community well-being.

Abstract

One of the main instruments for implementing democracy in Indonesia is the General Election (Pemilu), which serves to elect the President, the House of Representatives (DPR), the Regional Representative Council (DPD), and the Regional House of Representatives (DPRD). To elect members of the DPR, DPD, and DPRD, Indonesia adopts an open-list proportional representation system where candidates are elected based on the highest number of votes. This system offers significant advantages by ensuring more accurate political representation and proportional seat distribution, thereby valuing each vote. This article focuses on critically examining the application of the open-list proportional system in the 2024 DPRD election in Central Java. The research method used is a socio-legal approach with qualitative analysis, emphasizing the implementation of open proportionality in the second-level DPRD elections in Central Java. The findings reveal legal uncertainty in the Election Law, particularly in Article 426, which contains structural loopholes that undermine the core principles of open proportional representation and potentially harm the essence of democracy itself. This issue was evident in the 2024 DPRD election in Central Java, where manipulation of the people's choice through resignation or dismissal from party membership, along with formalistic judicial decisions, created a legal gap that was exploited to disregard legitimate votes. This not only invalidates the legitimacy of individual representatives but also raises serious questions about who truly holds sovereignty in determining the composition of the legislature.
