Khaled Abou El Fadl’s Perspective on Hadith Hermeneutics Ahmad, Miladu Ahadi; Syamsuddin, Syamsuddin; Sumbulah, Umi

Abstract

This article discusses the method of hadith hermeneutics according to Khaled M. Abou El Fadl. El Fadl's academic concern is related to the authoritarianism of fatwas issued by several ulama and fatwa institutions. These fatwas are considered authoritarian and discriminatory towards women, seem rigid, and can’t adapt to the times. This authoritarianism phenomenon appears due to methodological errors in understanding legal texts, and the absence of negotiations between the text, the author, and the reader, each of whom has problems. Therefore, Khaled offers a hermeneutic method that consists of three things: text competence, meaning determination, and the concept of representation in Islam. If these three elements are met, then the fatwas of Islamic law produced by the ulama are authoritative, authoritarian, and discriminatory.

Abstract

This article contains the moderate thoughts offered by Yusuf al-Qardhawi in understanding al-Sunnah. Sunnah is defined differently according to the scientific field emphasized. There is a definition of sunnah according to hadith experts, ushul fiqih experts and jurists. Sunnah in terms of content, there are sunnah qauliyyah, sunnah fi'liyah and taqririyah. The degree of sunnah is second only to the Qur'an. The division of the sunnah into tasyri'iyah and ghairu tasyri'iyah had its seeds in the classical period of the history of Islamic law. In the contemporary period the division of the sunnah into tasyri'iyah and ghairu tasyr'iyah got its perfect form. One of the scholars who developed the distribution of the sunnah is Yusuf al-Qardhawi. He emphasized a moderate understanding in understanding the sunnah. The trick is to divide the sunnah into sunnah tasyri'iyah and ghairu tasyri'iyah so as not to fall into an extreme understanding, as groups that claim sunnah in its various forms must be obeyed and groups that claim to separate worldly things from religions that are too extreme. This idea is an idea that is considered effective in balancing religious understanding so as not to become a group that is too extreme left or right. Especially in the midst of widespread intolerance, extremism and radicalism that is exposed to some contemporary Muslim society.

Abstract

Violence in the name of religion often occurs because of the ideologicalinterpretation of religion. Well-formulated ideology is obeyed by its followers to achievecertain goals. Ideology may also be appropriated by its proponents to rebel against thestatus quo that they think is not in line with their belief system. A closed-ideology thatperpetuates intolerance is a latent source of conflict and violence. In addition, manyreligion-oriented violence is associated not only with religion per se as a source of inspirationand legitimacy, but also with such factors as social, economic, political as well aspsychological conditions of human being. One-sided explanation of violence in the nameof religion is therefore insufficient as religion is not monolithic phenomenon.

Abstract

This study aims at understanding the perception of Nahdlatul Ulama (NU), Muhammadiyah and Hizb al-Tahrir leaders in Malang, East Jawa, about the relation of Islam with Ahl al-Kitāb, includes their implications toward social life. The result shows that there are varied concepts on the meaning of Ahl al-Kitāb. According to NU and Muhammadiyah, Ahl al-Kitāb are Jewish and Christian community who still or not recognize the oneness of Allah. Conversely, Hizbut Tahrir state that the term refers merely to Jewish and Christian who embrace the “genuine” theological system. In understanding the hadis, the three organizations are polarized into three models; combining pure Islamic sciences with modern sciences as performed by the NU’s followers (Nahdhiyin); applying contextual approach and modern sciences as used by Muhammadiyah; and focusing on text as Hizbut Tharir choose. However, although the three organizations have different understanding on the concept of Ahlal-Kitab, they they have no objection to establish social relationship with them.

Abstract

This paper examines how the views of Joseph Schacht is an orientalist scholar in the field of Islamic law who has done a lot of hadith criticism. Through his work, The Origins of Muhammadan Jurisprudence, Schacht states that the hadiths were made by scholars of the second and third centuries of hijra because in the past the hadiths had not been well codified. The view of this student of Ignaz Goldziher towards the hadith was developed by three theories, namely, the projecting back theory, the theory of argumentum e silentio, and the common link theory.

Abstract

This article explains the concept of waḥdah al-wujūd and its relevance to the diversity of religions and beliefs. The idea of the unity of being developed by Ibn ʽArabī is an explanation about the existence of every entity which prevails in the universe. It means that nothing has essential substance except God. Therefore, all things that exist in the universe, including the diversity of religions and the pluralistic paths of faith, are rooted in God. The diversity of God’s laws occurs only due to the diversity of the doctrines revealed to the different prophets and apostles. So, Ibn ʽArabī, who has the typical philosophical thought of Sufism manifested through waḥdah al-wujūd, is considered as the supporter of the idea about the unity of religions emphasizing the inner aspect and the qualities of faith. This idea will tighten the relationship among those who love each other "within" God. DOI: http://dx.doi.org/10.20414/ujis.v20i1.793

Abstract

This article discusses the discourse of hadith in the Sunni and Shi’ah traditions, covering aspects of historicity, classification, parameters, and hadiths among these two major schools of Islam. There are very striking differences regarding the position of the Prophet as the source of hadith, the distribution of hadiths, the justice and credibility of the companions, the criteria for the validity of hadith, and so on. In the Sunni view, one of the requirements of the sahih hadith is that the sanad is continuous from narrator to Rasul without being interrupted, while the Shi’ah group views the sanad of valid hadiths when it is connected to the Prophet or imam ma’sum without being interrupted. Sunnis also have the view that all companions are credible, while Shi’ah is not.
