Abstract

Islam is a religion that highly upholds justice without discriminating between men and women. However, in line with the times, limitations and differences in understandingreligion have become a scourge that glorifies certain genders and demeans others. Inequality in social roles based on gender is still maintained under the pretext of religious doctrine. Religion is involved to preserve conditions in which women do not consider themselves equal to men. It is not impossible that behind this theological awareness there is anthropological manipulation aimed at establishing a patriarchal structure, which is generally detrimental to women and only benefits certain classes in society. Seeing this paradigm shift, Amina Wadud tries to boost understanding that has strayed far from the Al-Qur'an's respect for women.

Abstract

This article explores aspects of gender equality in the context of divorce, with a study focus on the hadith that discuss divorce actions taken by women. This study aims to explore a deeper understanding of the Islamic view of divorce initiated by women and its impact on gender equality in society. By detailing the various relevant hadiths, the study analyzes the context, law, and wisdom behind the ruling. The results of this study show that women can terminate their marriage by filing a khul' (sue for divorce) before a religious court. With this, it is hoped that every married couple has the awareness to carry out their duties and treat their spouses well, so that the harmony and integrity of the household can be maintained.

Abstract

Islam considers that women and men are the two foundations of society where they have the same role in creating, forming, regulating and utilizing society. Islam has also given various rights, honors and obligations to women in accordance with their honor and dignity as creatures who are responsible before Allah, both towards themselves, their families, society and the state. If Allah had given women the rights and responsibilities, namely to be “human” as servants of Allah, there would be no reason for men to feel superior to the female gender. Men and women are both creatures of Allah who will be held accountable in the afterlife for the rest of their lives. Women’s empowerment and gender issues are very interesting to discuss at the moment. This research discusses the Living Hadith perspective on women’s leadership in the Fatayat Nahdatul Ulama organization in Jobang District, Jember Regency in 2022. This non-formal institution operating in the religious, social and educational fields is phenomenal and has become a trend in society. One of the problems that arises among women’s empowerment activists is their form of involvement in the public sphere which causes controversy. The aim of this research is to explain: what, why and how the Living Hadist perspective on women’s leadership at the Nahdatul Ulama fatayat in Jombang sub-district - Jember district. This research will be studied in more depth by collecting information from various sources; books, internet, social media, and articles. Descriptive qualitative methods were used to analyze the collected data. The results of this research provide enlightenment that women’s leadership from the Living Hadith perspective can explain a new understanding that there is a Watasiyah Principle in the context of women’s Islamic organizational leadership.[Islam memandang bahwa perempuan dan laki-laki merupakan dua landasan masyarakat dimana keduanya mempunyai peranan yang sama dalam menciptakan, membentuk, mengatur dan bermanfaat untuk masyarakat. Islam juga telah memberikan berbagai hak, kehormatan dan kewajiban kepada perempuan sesuai dengan kehormatan dan martabatnya sebagai makhluk yang bertanggung jawab di hadapan Allah, baik terhadap dirinya sendiri, keluarganya, masyarakat dan negara. Seandainya Allah telah memberikan hak dan tanggung jawab kepada perempuan, yaitu menjadi “manusia” sebagai hamba Allah, maka tidak ada alasan bagi laki-laki untuk merasa lebih superior dibandingkan perempuan. Laki-laki dan perempuan sama-sama makhluk Allah yang akan dimintai pertanggung jawaban di akhirat seumur hidupnya. Isu pemberdayaan perempuan dan gender sangat menarik untuk dibahas saat ini. Penelitian ini membahas tentang perspektif Living Hadis tentang kepemimpinan perempuan pada organisasi Fatayat Nahdatul Ulama di Kecamatan Jobang Kabupaten Jember Tahun 2022. Lembaga nonformal yang bergerak di bidang keagamaan, sosial, dan pendidikan ini sangat fenomenal dan menjadi tren di masyarakat. Salah satu permasalahan yang muncul di kalangan aktivis pemberdayaan perempuan adalah bentuk keterlibatannya di ranah publik yang menimbulkan kontroversi. Tujuan penelitian ini adalah untuk menjelaskan: apa, mengapa dan bagaimana perspektif Living Hadist terhadap kepemimpinan perempuan pada fatayat Nahdatul Ulama Kecamatan Jombang – Kabupaten Jember. Penelitian ini akan dikaji lebih mendalam dengan mengumpulkan informasi dari berbagai sumber; buku, internet, media sosial, dan artikel. Metode kualitatif deskriptif digunakan untuk menganalisis data yang dikumpulkan. Hasil penelitian ini memberikan pencerahan bahwa kepemimpinan perempuan dalam perspektif Living Hadis dapat menjelaskan pemahaman baru bahwa terdapat Prinsip Watasiyah dalam konteks kepemimpinan organisasi Islam perempuan].

Abstract

Abstract: Along with the development of the times, some individuals perform sex reassignment surgery because they feel that their current body is not following their psyche. Individuals who perform sex reassignment surgery are called transsexuals. In Indonesia, after performing a sex change operation, you can apply to the District Court to get a change of identity on your residence card. When they have officially changed their gender and identity, the question that will be asked is whether the rights they will get will be the same as the rest of the general public. One of the rights of each individual is to carry out marriage, which is a marriage between a man and a woman. However, in Indonesia, there are no regulations regarding marriages carried out by transsexuals. So there is a need for a study of transsexual marriage, which would be appropriate if viewed from the perspective of natural rights theory. The purpose of this study is to describe transsexual marriage from the perspective of natural rights theory. This type of research is normative legal research using a conceptual approach. Based on the analysis carried out, it can be seen that marriages performed by transsexuals are not legal according to religion and the state because they violate the boundaries and rules that have been set by the state.Keywords:  Marriage; Transsexual; Natural Rights.Abstrak: Seiring dengan perkembangan masa terdapat beberapa individu yang melakukan operasi pergantian kelamin karena merasa tubuh yang dimilikinya sekarang tidak sesuai dengan kejiwaannya. Individu yang melakukan operasi pergantian kelamin disebut dengan transeksual. Di Indonesia sendiri, setelah melakukan operasi pergantian kelamin maka dapat mengajukan ke Pengadilan Negeri untuk mendapatkan perubahan identitas pada kartu kependudukannya. Ketika secara resmi telah berubah kelamin serta identitasnya, maka yang akan menjadi pertanyaan adalah terkait hak-hak yang akan didapatkannya apakah akan dipersamakan dengan masyarakat umum lainnya. Salah satu hak setiap individu adalah melaksanakan perkawinan, yang mana perkawinan tersebut antara laki-laki dengan perempuan. Namun di Indonesia tidak ada aturan terkait perkawinan yang dilakukan oleh transeksual. Sehingga perlu adanya kajian tentang perkawinan transeksual, yang mana akan tepat jika ditinjau dari perspektif teori hak kodrati. Tujuan dari penelitian ini adalah untuk mendeskripsikan perkawinan transeksual yang ditinjau dari perspektif teori hak kodrati. Jenis penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan konseptual. Berdasarkan analisa yang dilakukan dapat diketahui bahwa perkawinan yang dilakukan oleh transeksual tidak sah menurut agama dan negara karena melanggar batasan-batasan dan aturan yang telah ditetapkan oleh negara.Kata Kunci: Perkawinan; Transeksual; Hak Kodrati.

Abstract

This study aims to explain the experiences of people with gender dysphoria who seek to fulfill subsistence obligations in daily life, determine how religion handles them, and analyze the efforts of individuals and communities (in-laws and parents) in building bridges between tradition and social change. This research uses a case study method with a qualitative approach to understand the experience of individuals with gender dysphoria in fulfilling their income obligations in the Islamic context and in the perspective of parents or in-laws. The finding of this study is that gender identity is not something that is completely influenced by the social environment, but is also caused by certain biological factors. People with gender dysphoria face challenges in fulfilling subsistence obligations, these challenges are caused by their discomfort with traditional gender roles and the discrimination they experience, Islam argues that husbands remain responsible for the living. However, some people with gender dysphoria have support from their parents or in-laws.

Abstract

This research analyzes Hassan Hanafi's liberation thoughts: Al-Turats wa Al Tajdid, hermeneutics of liberation, and the Islamic left. The method used in this research is library research with a descriptive-analytic method, namely using interpretive analysis of books by Hassan Hanafi as primary data and articles, research journals, and other scientific works related to the research object as secondary data. The research results show that Al Turats Wa Tajdid is a significant project in the revival of Islam. This Hanafi idea changed the concept of Islamic theology from theocentric to anthropocentric. The second is Hassan Hanafi's hermeneutics of liberation using three methods: 1) Historical-Criticism, 2) Eidetic-Conciusness, and 3) Practical-Conciusness. The third is the movement for the liberation of Islamic thought called the "Islamic Left". This movement is intended to fight colonialism, Zionism, and Western hegemony, as well as the oppressive ruling elite, as well as against ignorance and confinement. This research makes a significant contribution in inspiring readers to follow the renewal of Hanafi thought, which elevates Islamic theology as a driver of social change and solutions to social problems, as well as changing the Islamic theology curriculum to focus on social reality rather than just God.

Abstract

Harald Motzki initiated a theory of hadith analysis called Isnad Cum Matn analysis to counter hadith criticism by orientalist groups who are skeptical of hadith. They assume that all hadiths are fake, and also assume that common links are hadith forgers. This study aims to analyze the hadith authentication method initiated by Harald Motzki. Sources of research come from the work of Motzki, books and other articles that review this theory. The results of this literature study are: 1) Moztki rejects the opinion of Gholdziher, Schacht and Juynboll who state that hadith is inauthentic; 2) A common link does not mean a forger of hadith; 3) According to Motzki, to assess the authenticity of a hadith, one must study both sanad and matn (isnad cum matn analysis); 4) This method was applied by Kamaruddin Amin to the hadith of shaum by comparing historical variants and paying attention to the characteristics of the hadith editorial staff, which finally led to the conclusion that the hadith of shaum had been spread starting in the first half of the Hijri century; 5) Motzki's critique of skeptical orientalists points to the emergence of hadith and their assumption of common link and single strand, that hadith has been the basis of law since the first century of hijriah, then common link is considered as a collector of hadith, while single strand is the most trusted path.

Abstract

This research aims to elucidate the relationship between religion, local wisdom, and power relations in the dynamics of Madurese community life from an Islamic perspective, religious scripture texts, and social theory. The research employs qualitative methods focusing on the Madura community as a distinct ethnic group in conducting social interactions and identifying language expressions that symbolize everyday peace. This study employs various data collection methods, including observation, interviews, and documentation. A thorough examination of the dynamics of religion, traditional knowledge, and power dynamics within the Madurese community serves as the data analysis technique employed in this study. By focusing on ontological and epistemological issues, this research utilizes social theory and an Islamic viewpoint to conceptually explain the study of religion, local wisdom, and power relations. The findings show that the Madurese people are known for their unwavering commitment to togetherness, balance, peace, and harmony. This is reflected in 'rampak naong bringen korong,' a concept of local wisdom that represents their deeply ingrained cultural values and moderate religious teachings. These insights hold implications for further studies in exploring the practical applications of local wisdom in promoting social cohesion, governance effectiveness, and community well-being. Penelitian ini bertujuan untuk menjelaskan hubungan antara agama, kearifan lokal, dan hubungan kekuasaan dalam dinamika kehidupan masyarakat Madura dari perspektif Islam, teks-teks agama, dan teori sosial. Penelitian ini menggunakan metode kualitatif yang berfokus pada komunitas Madura sebagai kelompok etnis yang berbeda dalam melakukan interaksi sosial dan mengidentifikasi ekspresi bahasa yang melambangkan perdamaian sehari-hari. Studi ini menggunakan berbagai metode pengumpulan data, termasuk observasi, wawancara, dan dokumentasi. Pemeriksaan menyeluruh terhadap dinamika agama, pengetahuan tradisional, dan dinamika kekuasaan dalam komunitas Madura berfungsi sebagai teknik analisis data yang digunakan dalam penelitian ini. Dengan memfokuskan pada isu ontologis dan epistemologis, penelitian ini menggunakan teori sosial dan sudut pandang Islam untuk menjelaskan secara konseptual studi tentang agama, kearifan lokal, dan hubungan kekuasaan. Temuan menunjukkan bahwa masyarakat Madura dikenal karena komitmennya yang teguh terhadap kebersamaan, keseimbangan, perdamaian, dan harmoni. Hal ini tercermin dalam 'rampak naong bringen korong,' sebuah konsep kearifan lokal yang mewakili nilai-nilai budaya mereka yang sangat tertanam dan ajaran agama yang moderat. Temuan ini memiliki implikasi untuk penelitian lebih lanjut dalam mengeksplorasi aplikasi praktis kearifan lokal dalam mempromosikan kohesi sosial, efektivitas tata kelola, dan kesejahteraan masyarakat.

Abstract

The phenomenon of Islam and the relationship of its true religions already exists and is exemplified directly in the life of the Prophet SAW. Where one of the goals is Rahmatan lil 'alamin. One of his commentaries is the Qur'an based on Jalalain's tafsir. This study uses a phenomenological approach with explanatory methods and triangulation data analysis, including data reduction, display and data verification, by looking at the phenomenon of Sam Poo Kong and Soen Ang Ing communities. The results showed that Islam and the relations of religions conveyed by Jalalain through his interpretation stated the 'recognition' of religions, while still emphasizing the internal doctrinal of Muslims. The community around Sam Poo Kong and Soen Ang Ing is a portrait of the progress of religious confession and the Muslim community carries out its religious activities well. The portrait of Islam and the relations of religions shown in the society of Sam Poo Kong and Soen Ang Ing is the realization of several verses in the Qur'an, such as Ali Imran 159; Ar-Rum 22; al-Hujurat 13; which if concluded is that a Muslim should be soft on the outside, the inside, and flexible over the existence of others.

Abstract

This study specifically looks at Abdullah Saeed as a minority Muslim scholar whose topic specifically addresses non-Muslim discourses in the Qur'an. with the aim of seeing Abdullah Saeed's construct of thought in interpreting the Qur'an and to see how Abdullah Saeed interprets non-Muslim verses in the Qur'an. Meanwhile, in the research process, the researcher uses the library research method which is descriptive-analytical which functions to interpret data with a historical- critical approach. In general, there are two sources of data, namely primary and secondary. Primary data sources will be seen from the works of Abdullah Saeed. As for the secondary data from several documents and other related articles. Data analysis used three techniques of descriptive analysis, taxonomic analysis and interpretive analysis. The results of this discussion are divided into 3 things. The first is the presentation of Abdullah Saeed's socio-historical background. Second, the exposure about Abdullah Saeed's contextualist approach who is elaborative, argumentative and comprehensive in interpreting the Koran. Third. non-Muslim discourse in this regard, Abdullah Saeed reviews the doctrine of the crucifixion of Isa in the Koran and freedom of religion and interfaith brotherhood in the verses of the Koran; Abdullah Saeed highlighted the apostasy law as the basis for freedom of religion
