Abstract

The use of instant messaging applications has led to significant changes in people's communication patterns. The resulting positive impacts include increased efficiency, speed and expansion of social connectedness. These apps facilitate faster and more responsive communication with additional features such as video and voice calls, and enable the formation of more diverse virtual communities and discussion groups. However, there are also emerging challenges, such as the risk of misunderstandings, technology dependency, and a decline in the quality of face-to-face interactions. In addition, the rapid spread of information through these applications may increase the risk of disinformation. Therefore, it is important for people to improve their digital literacy and use instant messaging technology wisely to maximise the benefits while minimising the negative impacts.

Abstract

The important role of e-commerce in improving the local economy in the digital era by focusing on the empowerment of Micro, Small and Medium Enterprises (MSMEs). E- commerce provides wider market access for MSMEs, opening up sales opportunities to the global level without geographical restrictions. Digital literacy and adequate internet infrastructure are key elements that enable local businesses to run online businesses eflectively, thereby improving their operational efficiency and competitive ability. In addition, the optimisation of logistics and the implementation of appropriate digital marketing strategies contribute to the success of e-commerce in supporting the local economy. With efficient logistics infrastructure and modern technology, MSMEs can fulfil consumer expectations for fast and safe delivery. Data-driven digital marketing strategies help MSMEs attract and retain customers. Overall, e-commerce is creating new opportunities for local businesses and driving inclusive and sustainable economic growth.

Abstract

Privacy and security are two crucial issues in the era of digital communication. The rapid development of technology has created various challenges in protecting personal information and maintaining security in cyberspace. The main challenges faced in digital communication include identity theft, data breaches, cyber attacks, and misuse of personal information. Solutions include the use of encryption, security software, education and awareness raising, regulation and enforcement, and individual responsibility. Therefore, it is important to emphasise the collective efforts and constant vigilance of various parties, including individuals, companies, and governments, to create a safer and more trusted digital environment. With a comprehensive and adaptive approach to technological developments, it is expected to protect privacy rights, reduce the risk of cyber threats, and promote sustainable growth of the digital economy.

Abstract

This study was motivated by the disharmony between central government regulations and local regulations (perda) in Indonesia. The study aims to analyze the forms and causes of disharmony, as well as to formulate ways to strengthen the harmonization mechanism within the framework of a unitary state. The method used is normative legal research with a legislative and conceptual approach, based on the study of primary and secondary legal materials. The results of the study show that the disharmony of local regulations is influenced by the ambiguity of the harmonization norms in the draft local regulations, the weak capacity of regional legislation, the dominance of local political interests, and the lack of vertical coordination between the central and regional governments. Therefore, it is necessary to affirm the norms and procedures for harmonizing draft local regulations, strengthen harmonization mechanisms (ex ante and ex post), conduct periodic evaluations, and optimize the role of relevant ministries/institutions and the Supreme Court to ensure the harmony of norms, certainty, justice, and the benefits of law.

Abstract

Digital healthcare services in Indonesia have brought about significant changes in nursing practice, whilst also introducing new complexities in legal and professional ethical aspects. This article aims to analyse the legal responsibilities and protections of nurses in the practice of digital healthcare services, as well as to examine the relevance of national regulations and professional nursing ethics in Indonesia. The method used is a normative-analytical approach involving a literature review of laws, government regulations, Ministry of Health regulations, and scientific journals on ethics, nursing law, electronic medical records, telemedicine, and telenursing. The findings indicate that nurses in digital practice remain subject to criminal, civil, and administrative legal liability, whilst legal protection is only afforded if actions comply with professional standards, ethics, standard operating procedures (SOPs), and applicable regulations. On the other hand, professional nursing ethics and digital ethics serve as crucial pillars for nurses in safeguarding patient autonomy, privacy, and data security, as well as limiting the exercise of authority in the digital domain. Consequently, this article emphasises the need for adaptive regulatory strengthening, the development of specific SOPs for digital practice, and a strong integration between legal and professional ethical aspects to ensure the protection of nursing staff whilst maintaining the quality and safety of technology-based healthcare services in Indonesia.

Abstract

The expansion of legal liability on hospitals has brought about significant changes in the operations and management of these healthcare institutions. This discussion explores how increased legal liability affects regulatory compliance, quality of care, administrative burden, and risk management strategies. The findings show that while there are positive impacts in the form of improved service quality and patient safety, hospitals also face challenges in the form of increased administrative and operational burdens. In addition, hospital management is forced to implement more comprehensive risk management strategies to manage potential legal issues. In conclusion, while the expansion of legal liability creates challenges for hospital management and operations, it also contributes to the overall improvement of healthcare standards and patient safety.

Abstract

The implementation of the Health Law in Indonesia has the main objective of providing strong legal protection for patients, ensuring they receive proper and quality healthcare. The law outlines the rights of patients, such as transparent information on medical conditions, consent to medical treatment, and protection of medical privacy. In addition, the law also stipulates the responsibilities of medical personnel and health facilities to provide services in accordance with professional standards and codes of ethics. Nonetheless, the implementation of this law is faced with challenges such as lack of socialisation and limited resources in some areas. Therefore, cooperation from various parties is needed so that legal protection for patients in Indonesia can be realised effectively.

Abstract

The application of the principle of the rule of law in Indonesia has led to the emergence of state administrative courts. The establishment of the State Administrative Court is a legal eflort that can be taken by the public to protect their rights from the arbitrariness of state administrative officials. The purpose of establishing the State Administrative Court is to balance the position of Administrative Officials and the public as plaintifls. As a judicial institution, the content of the judge's ruling should be respected and must be obeyed by the litigating official. But in reality, so many officials do not comply and implement it. Even though the verdict has been pronounced by the judge and has legal force, seeing the attitude of officials who do not want to implement the decision seems to disrespect the judge's decision and can be interpreted as a form of resistance to non- compliance. Therefore, this research discusses extensively through a normative point of view regarding the lack of compliance of state administrative officials and what eflorts the plaintifl can make to ensure that the decision is implemented to the fullest.

Abstract

This study examines the possibility of recognising Acehnese criminal law as national law in Indonesia, a country known as a constitutional state according to Article 29 of the 1945 Constitution. Through the constitutional guarantee of freedom of religion, this study examines the prospects for the national application of Islamic criminal law in Aceh. The lack of understanding among some members of the public regarding Islamic criminal law has led to the perception that these rules are harsh and inhumane. For example, sharp criticism of the punishment of amputation of the hand in Islamic Sharia often fails to consider the specific conditions that must be met before such a punishment is imposed. The application of Islamic criminal law can be effective, especially if its primary objective is to serve as a deterrent. Conversely, the implementation of this law becomes irrelevant if law enforcement is merely seen as a pragmatic tool or a subject of conceptual debate. A strong constitutional foundation and significant opportunities exist to incorporate Aceh's criminal law into national regulations, given that the 1945 Constitution, particularly Article 29, paragraphs 1 and 2, guarantees freedom of religion.

Abstract

This study discusses the role of judicial review in the Indonesian legal system using a literature review approach, focusing on two main aspects, namely constitutional protection and legal accountability. Judicial review conducted by the Constitutional Court has a strategic function in maintaining constitutional supremacy through a mechanism for reviewing laws against the 1945 Constitution, thereby ensuring that applicable regulations do not violate the constitutional rights of citizens. In addition to acting as a guardian of the constitution, judicial review also acts as an instrument of accountability that demands openness and accountability from the legislative and executive branches in the formulation and implementation of laws. The literature review method was used to explore literature, Constitutional Court decisions, and related legal documents, thereby obtaining a comprehensive understanding of the contribution of judicial review in the Indonesian legal system. The results of the study show that judicial review is not only important in protecting rights and the rule of law, but also in strengthening transparent and accountable governance. Strengthening access and balancing the authority of state institutions are key to the development of effective judicial review in the future.
