Abstract

This study aims to analyse the role of anti-racism and anti-ethnocentrism education within a social justice-based curriculum framework as an effort to prepare students to become agents of social change. The background of this study is based on the urgency of building critical awareness and inclusive attitudes amid increasing social challenges resulting from racial and ethnic discrimination. The method used is library research through a systematic review of academic literature, previous studies, educational policy documents, and examples of curriculum implementation in various contexts. The results of the study indicate that integrating anti-racism and anti-ethnocentrism values into the curriculum can strengthen students' social awareness, empathy, and critical thinking skills regarding issues of injustice. The success of implementation requires participatory learning strategies, support from competent teachers, and an inclusive school environment. This study recommends strengthening teacher training, selecting multicultural teaching materials, and formulating education policies that prioritise social justice to ensure the sustainability of positive impacts on society at large.

Abstract

This study aims to analyse the role of systematic control and evaluation systems in improving the effectiveness of public policy through a literature review method. Control systems are seen as mechanisms that ensure policy implementation is in line with plans, prevent deviations, and maintain accountability. Meanwhile, systematic evaluation plays a role in providing data-based assessments of the relevance, effectiveness, efficiency, and impact of policies, while also providing constructive feedback for future policy improvements. The study findings indicate that the integration of these two mechanisms creates a continuous learning cycle that strengthens the policy formulation and implementation processes. Thus, the consistent, adaptive, and evidence-based application of control and evaluation systems is key to achieving effective, transparent, and accountable public policy governance.

Abstract

There are several consequences that must be faced, including imprisonment for the perpetrator based on the principle of legality, complicating the evidentiary system, especially in terms of the limits of value that can be classified as gratification so that it can cause a decrease in the markat and dignity of a person, restrictions on the KPK to classify the gratification, and the inability of sexual relations to be assessed as nominal. The purpose of this study is to determine the construction of Indonesian law in regulating criminal acts of gratification in the form of sexual services, and the mechanism of legal protection in Indonesia in the occurrence of criminal acts of gratification in the form of sexual services. The research method used in this study is juridical-normative which uses secondary data, with a statutory regulatory approach and a case approach. The legal sources used include the Criminal Code, the Corruption Law, and other related regulations. The results of the study concluded that the Corruption Law has not explicitly regulated gratification in the form of sexual services, making law enforcement difficult because there is no clear classification. The main obstacles are the principle of legality and the difficulty of proof. Legal reform is needed to expand the definition of gratification as well as clearer technical guidelines and standards of proof, so that the legal system is more responsive to new forms of crime and able to protect from authorities.

Abstract

The development of digital technology has driven significant transformation in Indonesia's financial and taxation systems. Financial technology (fintech) has emerged as an innovation that facilitates access to financial services and payment transactions, including tax payments. This study aims to analyse the role of fintech in optimising tax revenue through digital payment innovations. Using a qualitative approach through literature review and regulatory analysis, this study found that the integration of fintech into the taxation system can expand the tax base, increase transparency, and significantly encourage taxpayer compliance. The digital payment innovations introduced by fintech not only accelerate the tax payment and reporting process but also facilitate the government in monitoring and managing state revenue in real time. However, challenges related to regulatory harmonisation, data protection, and digital literacy among the public still need to be addressed in order to optimise the potential of fintech in supporting an inclusive and efficient taxation system in Indonesia.

Abstract

This study aims to examine the shift in the concept of imposing responsibility for medical negligence losses in the past to the present. From the review of the Supreme Court's decision regarding the imposition of liability for losses for medical negligence until the issuance of Law No. 17 of 2023 concerning Health, it was found that there was a shift in the concept of imposing liability for losses caused by medical and health workers. This shift in concept occurred because the use of civil law as a reference for the imposition of losses became irrelevant with the birth of health law in 2023. In the past, the concept of imposing medical negligence losses used the concepts of vicarious liability and responded liability, which later changed to the concept of ostensible liability where the characteristics are different from the previous two concepts. The use of the concept of ostensible liability is relevant as the basis for imposing liability for losses incurred by medical personnel who practice independently. The research method used is normative legal research where research is carried out on legal norms, rules, jurisprudence and principles in laws and regulations (statute approach) with the aim of analyzing the harmony of norms and providing legal arguments or finding legal concepts of liability and losses.

Abstract

Regulation of the Minister of Trade of the Republic of Indonesia Number 8 of 2024 (Permendag 8/2024) is a significant change in import policy, including certain import prohibitions and restrictions. The implementation of this regulation has an impact on increasing the flow of imported goods to Indonesia, but has also drawn attention from the United States. The US government responded to this policy by implementing high reciprocal import tariffs on Indonesian products as a retaliatory measure. This study examines the normative-juridical content of Permendag 8/2024 along with its impact on international trade, as well as the United States' legal response through reciprocal tariffs. The analysis focuses on the conformity of the policies of the two countries with the legal provisions of the World Trade Organization (WTO), especially the General Agreement on Tariffs and Trade 1994 (GATT 1994) and the Dispute Settlement Understanding (DSU). Through the normative-juridical research method, this paper finds indications of violations of WTO principles in Indonesian policies as well as unilateral US retaliatory actions. Trade dispute simulations indicate that settlement options may be pursued through diplomacy and WTO dispute resolution mechanisms rather than unilateral retaliatory actions that violate the DSU. This in-depth study is expected to provide a comprehensive understanding of the legal implications of Indonesia's trade policy and the United States' reciprocal response within the framework of international trade law.

Abstract

This article aims to analyze the role of the Witness and Victim Protection Agency (LPSK) in the distribution of losses experienced by victims and its contribution to realizing distributive justice. The problem formulations proposed in this research are: (1) What is the form of loss distribution provided by LPSK to victims of crime? and (2) What are the challenges faced by LPSK in implementing loss distribution and realizing distributive justice for victims? This research uses a normative juridical approach by analyzing the applicable laws and regulations as well as the LPSK annual report as research material.

Abstract

Health is a fundamental right of every person in the world. To be healthy, health services are necessary. These health services are provided by health workers, one of which is nurses. The practice allows nurses to work independently outside hospitals and/or community health centres. This study aims to analyse the regulations and responsibilities of nurses who practise independently in providing nursing care as part of health services, as stipulated in Law Number 17 of 2023 concerning Health. The method used in this paper is a normative juridical method with a conceptual and regulatory approach. The data used is secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The analysis was conducted qualitatively. The research findings show that Law Number 17 of 2023 concerning Health regulates legal relationships in the provision of health services differently from the old regulations. Within this framework, the analysis shows that it is necessary to provide clear regulations on nursing care activities carried out by independent nurses, particularly those related to the responsibilities that independent nurses must fulfil.

Abstract

Dispute resolution in Sharia economic transactions is essential to align settlement processes with Islamic legal principles. This study examines the function and role of Sharia-based arbitration, focusing on its alignment with the values of justice, efficiency, and confidentiality within Islamic law. Using a literature-based methodology, the research analyzes secondary data from legal sources and previous studies on Sharia arbitration in Indonesia, particularly the practices of the Sharia Arbitration Body (BASYARNAS-MUI). The findings indicate that Sharia arbitration offers a streamlined, confidential, and fair dispute resolution method, fostering outcomes based on Islamic values such as justice (adl), truth (haqq), and public good (maslahat). Unlike conventional court procedures, Sharia arbitration provides faster and more effective resolutions, while ensuring privacy and protecting the involved parties' reputations. The study also reveals that Sharia arbitration strengthens the application of Islamic law across various sectors, including finance and inheritance, by embedding ethical considerations into modern economic dispute resolutions. This research underscores the practicality and moral alignment of Sharia arbitration as a robust alternative to conventional litigation, offering readers insights into the benefits of a Sharia-compliant approach to economic dispute resolution.

Abstract

The rapid spread of hoaxes in the digital era poses a significant threat to social, political, and economic stability worldwide. Artificial Intelligence (AI) has emerged as a promising solution for detecting and mitigating hoaxes through advanced techniques such as natural language processing, machine learning, and deep learning. This study employs a literature review method to examine the role of AI in identifying, verifying, and limiting the dissemination of false information across digital platforms. Data were synthesized from relevant academic articles, reports, and previous studies to provide a comprehensive understanding of current approaches and challenges. The findings reveal that AI technologies enhance the efficiency and accuracy of automatic hoax detection, enabling real-time analysis of large-scale digital content. However, challenges persist, particularly related to data scarcity, algorithmic bias, and the complexity of understanding cross-linguistic and cross-cultural contexts. To address these limitations, collaborative efforts involving governments, technology developers, academic researchers, and society are required. Strengthened regulatory frameworks, cross-sector partnerships, and improved digital literacy are essential to ensure the sustainable and ethical application of AI in combating hoaxes. This study contributes to the growing body of knowledge by highlighting the dual role of AI as both a technical and socio-ethical tool in countering misinformation. It provides practical insights for policymakers, educators, and technology practitioners on integrating AI-based detection systems with broader strategies for digital literacy and regulatory governance. By presenting a comprehensive framework, the study underscores how AI can be leveraged responsibly to safeguard information integrity in the digital age.
