Abstract

This study examines the codification of post-colonial national criminal law in Indonesia through a literature review of Law No. 1 of 2023 and its implementation, which is scheduled to come into effect in January 2026. Using a normative-legal literature review method, this study examines changes in the substance and philosophy of criminal law that reflect the values of Pancasila, human rights, and adaptation to social dynamics and technological developments. Additionally, this study highlights challenges in implementing the new Criminal Code, including the readiness of law enforcement officials, public awareness, and adjustments to the judicial and legal administrative systems. The findings indicate that the codification of criminal law through Law No. 1 of 2023 is a strategic step toward building a modern, sovereign, and just criminal legal system in Indonesia; however, the success of its implementation depends heavily on the synergy of all stakeholders and their readiness to adapt to change.

Abstract

This study examines the challenges of media education in addressing the spread of hoaxes among Generation Z, who are digital natives living in the digital era. Although Generation Z has extensive access to technology and social media, their levels of digital literacy vary significantly, particularly in information verification and digital ethics. Their susceptibility to hoaxes is influenced by the intensity of social media use, limited critical thinking skills, and the insufficient integration of media literacy into formal education. Using a literature review method, this study analyzes the characteristics of Generation Z, the factors contributing to their vulnerability to hoaxes, and effective strategies for strengthening media literacy. The findings highlight the need for comprehensive, collaborative, and adaptive media literacy education that aligns with technological developments and the specific characteristics of Generation Z, enabling them to become smart, critical, and responsible digital citizens. This study contributes to the understanding of how media education can be optimized to enhance Generation Z’s resilience against misinformation, offering a conceptual framework for developing more effective and contextually relevant media literacy programs

Abstract

The advancement of digital technology has introduced a novel trend in marketing via social media platforms, specifically through influencers promoting products or services. Nonetheless, numerous endorsements by influencers contain misleading, inaccurate, or harmful claims to consumers. This research aims to analyze the civil liability of influencers for product claims that cause consumer harm in digital media endorsements, referencing Law No. 8 of 1999 on Consumer Protection. Utilizing a normative juridical method based on literature review of laws, legal doctrines, and pertinent cases, the findings reveal that influencers can be held civilly liable under the tort principle (onrechtmatige daad) as stipulated in Article 1365 of the Civil Code, if proven to provide false or unsupported claims resulting in consumer harm (Setiawan, 2019). Therefore, there is a pressing need to enhance regulations governing the role of influencers in consumer protection frameworks alongside effective liability mechanisms as a form of accountability in the evolving digital marketing landscape.

Through a human rights approach, Health Law has great potential to realise a more equitable and comprehensive national health system. With proper monitoring and implementation, this law can be the main foundation for achieving rights-based and equitable public services.

Abstract

The use of big data from a Islamic economic perspective is certainly an important issue and cannot be postponed any longer, because the disparity in big data between the real sector and the financial sector, which has so far resulted in a lack of completeness in assessments, can be overcome by the limited data provided through big data. It is also possible that various matrices and cluster variants will emerge for various business sectors in an ecosystem. So it will make it easier to determine supply and demand in an ecosystem system. In this way, a closed loop economy based on a sharia ecosystem will be built automatically when big data is formed. This research uses an exploratory descriptive approach by analyzing the role of big data analysis in financial decision making: the case of Islamic banking. This scientific work was also developed using a literature review or library study approach. This research discusses the basic concepts of big data analysis consisting of the definition and characteristics of big data, financial decision making in sharia banking, and the potential application of big data analysis in Islamic banking.

Abstract

Law enforcement against acts of abuse, as regulated in Article 351 of the Criminal Code, has significant implications in the context of justice and protection of individuals. Effective law enforcement requires thorough investigative steps, the collection of strong evidence, and the firm prosecution of perpetrators of violence. Protection of victims is the main focus in this law enforcement process, which includes physical, psychological and legal aspects. The importance of providing holistic support to victims, including access to health services and adequate legal protection, cannot be overstated. Fairness in handling cases is also very important, with an emphasis on fair and transparent legal principles. The judge must be able to weigh the evidence objectively and make a decision in accordance with the law. Apart from that, prevention and rehabilitation efforts also have a crucial role in reducing incidents of abuse. Through public education, prevention campaigns and rehabilitation programs for perpetrators of violence, it is hoped that a safer and more empowering environment can be created for all individuals. Thus, law enforcement and legal implications for acts of abuse based on Article 351 of the Criminal Code emphasize the importance of cooperation between law enforcement agencies, government, non-governmental organizations and society in creating an environment free from violence and protecting the human rights of every individual.
