Abstract

Pembicaraan tentang Badan Usaha Milik Negara (BUMN) tidak penah lepas dari pembahasan yang kontroversial. Masalah utama yang selalu didebatkan adalah kedudukan Direksi BUMN yang seringkali disetarakan dengan Pejabat Negara dan pegawai BUMN yang disamakan dengan Aparatur Sipil Negara (ASN). Hal ini membawa akibat pada perbuatan pengurusan BUMN sebagai perusahaan sebagai perbuatan yang beranahkan tindak pidana korupsi. Tulisan ini merupakan sosialisasi perubahan ketiga terhadap Undang-Undang No.19 Tahun 2003 tentang Badan Usaha Milik Negara dari aspek hukum perusahaan. Tulisan ini akan mengambil sisi pengurusan BUMN dalam bentuk perseroan terbatas yang dikenal dengan nama Persero. Sosialisasi ini menunjukkan bahwa selama BUMN dikelola dengan Tata Kelola Perusahaan yang baik, maka tidak akan ada masalah tindak pidana korupsi di dalamnya.

Abstract

The purpose of this study is to examine the legal certainty of Priority Rights holders as outlined in Government Regulation No. 18 of 2021 concerning the Registration of Rights for holders of Building Use Rights (HGB) if the rights holder has been declared bankrupt. It also examines the responsibility of the National Land Agency (BPN) in issuing certificates in the legal protection of third parties who have signed a Deed of Sale and Purchase (AJB) and Sale and Purchase Agreements (PPJB) made before a notary or privately as a form of legal protection and legal certainty for the community before the company is declared bankrupt, while the HGB on the land has not been registered/separated from the certificate. This study uses a normative legal method with three main approaches, namely: a legislative approach, which examines various related regulations such as the 1945 Constitution, the 1960 Basic Agrarian Law (UUPA), Law No. 20 of 1961, and Government Regulation No. 24 of 1997 in conjunction with Government Regulation No. 18 of 2021 to understand the legal and ontological basis of the issue being studied, a historical approach, and a philosophical approach. The analysis was conducted by combining inductive and deductive methods. The results of the study show that the National Land Agency (BPN) continues to provide legal certainty for holders of Priority Rights to Land Use Rights (HGB), including in bankruptcy cases, by taking into account the protection of third parties who have signed a Deed of Sale and Purchase Agreement (AJB) or a Letter of Intent to Purchase (PPJB) in accordance with the provisions of Government Regulation No. 18/2021.

This article highlights the importance of transparency as an essential component of a democratic and accountable political system. By increasing openness in decision-making processes, citizens gain better access to information necessary for active participation in democracy. Transparency helps reduce corruption and ensures that policies are implemented more fairly and in line with public needs. study The claims that with transparency, improvements in people's welfare can be achieved as policies are made based on clear information and strong participation from citizens. results The final show a positive relationship between transparency in political decision-making and improved quality of life.

Abstract

The application of blockchain technology in the tax system offers opportunities to improve the transparency, security, and efficiency of tax data management. With its decentralised and immutable nature, blockchain minimises the risk of fraud and manipulation, and reduces the potential for tax evasion. However, there are also a number of challenges and risks to be faced, including dependence on technology and cybersecurity threats. In addition, regulatory updates are required to accommodate the use of this technology. Overall, if implemented appropriately, blockchain can revolutionise the tax system, support fiscal justice, and increase public participation in tax obligations.

This article discusses the role of digitalisation in supporting green economic sustainability in the era of Economy 5.0. Digitalisation, through the use of technologies such as the Internet of Things (IoT), big data and artificial intelligence (AI), offers solutions to optimise resources and reduce environmental impacts. In addition, digital platforms increase transparency and accuracy in sustainability monitoring, enabling stakeholders to make wiser data-driven decisions. The integration of digital technologies in sustainability strategies not only provides economic benefits, but also contributes to environmental protection, forming the basis for a greener and more responsible economic future.

Abstract

This study aims to examine the implementation of patient rights protection in hospitals based on Law No. 44 of 2009 concerning Hospitals through a literature review. The results of the study indicate that, normatively, this law has provided a strong legal basis for the fulfilment of patient rights, such as the right to information, privacy, quality service, and the right to file complaints. However, implementation in the field still faces various obstacles, including low patient awareness of their rights, lack of socialisation from hospitals, and suboptimal complaint mechanisms and law enforcement against violations of patient rights. Efforts made by hospitals include education, the provision of complaint facilities, and the application of service standards, but strengthening is still needed in the areas of socialisation, transparency, and supervision so that the protection of patient rights can be realised effectively and evenly. This study recommends the need for collaboration between various parties, increased human resource capacity, and reformulation of regulations to strengthen access to justice for patients.

Abstract

This study aims to analyse the integration of economic law and health law in policies addressing petty theft through a literature review. Petty theft is often triggered by economic factors such as poverty and unemployment, as well as health factors such as mental disorders, which are not fully accommodated in the conventional criminal justice system. Literature analysis shows that policies for handling petty theft that are solely oriented towards punishment tend to be ineffective and have the potential to cause social injustice. The integration of the two fields of law through a restorative justice approach and cross-sector collaboration can provide a more comprehensive, fair, and humane solution. Synergy between law enforcement agencies, social institutions, and health services is needed, as well as regulatory reforms, so that policies for handling petty theft can be more responsive to the economic and health conditions of the perpetrators.

Abstract

This study aims to analyse the interdisciplinary approach of law, economics, and health in the protection of children who commit petty theft through a literature review. The protection of children as perpetrators of minor crimes requires the application of the principles of restorative justice and diversion as stipulated in the Juvenile Criminal Justice System. However, economic factors such as poverty and social inequality are often the main drivers of children committing petty theft, so interventions in the form of economic empowerment and social assistance are urgently needed. In addition, health aspects, particularly the mental and psychological health of children, must also be a primary concern in protection and rehabilitation efforts. The results of the study show that synergy between a humanistic legal system, appropriate economic intervention, and comprehensive health services is very important to ensure optimal protection for children who commit petty theft and to prevent recidivism. Cross-sector collaboration and regulatory strengthening are key to the successful implementation of fair and sustainable child protection.

Abstract

This study discusses efforts to build effective digital infrastructure for taxation in Indonesia through a literature review. Digital transformation in the field of taxation, such as the implementation of e-Filing, e-Billing, and the Core Tax Administration System (Coretax), has brought significant changes in administrative efficiency and increased taxpayer compliance. However, the effectiveness of this digital infrastructure still faces various challenges, including the internet access gap, low digital and taxation literacy, and data security risks. In addition, regulations that are not yet fully adaptive to the development of the digital economy are also a separate obstacle. This study highlights the importance of equal access to technology, digital literacy education and training, strengthening cyber security, and updating responsive regulations as determining factors for the success of tax digitalisation. With the right strategies and cross-sector collaboration, Indonesia's digital tax infrastructure can become the foundation for a more equitable, efficient, and sustainable tax system.

Abstract

The military court system in Indonesia is the implementation of judicial authority within the military to enforce just and fair legal proceedings. (See: Selected Cases in Military Court Proceedings. https://dilmil-aceh.go.id/tentang-peradilan-militer/) Meanwhile, the military court system in the Kingdom of Malaysia is a military judicial institution that forms part of the integrated military power structure. It also carries out the task of safeguarding the integrity of the territory and sovereignty of the Kingdom of Malaysia, protecting it from various threats and disturbances from within and without. This research uses the normative legal method. The results of this research reveal fundamental differences between the military court system in the Republic of Indonesia and that of the Kingdom of Malaysia. The military justice system in the Republic of Indonesia is an independent system, not part of the general justice system. This is because it has the primary duty of maintaining integrity; protecting and defending the sovereignty of the nation and state. Meanwhile, the military court of the Armed Forces of the Kingdom of Malaysia has the responsibility of supporting civil authority in countering international disturbances, maintaining public order, handling natural disasters, and participating in national development programmes.
