Abstract

Tulisan ini mencoba memotret fenomena banyaknya kedai, warung makan, resto dan sejenisnya, yang secara sepintas hanya menuliskan tulisan halal, tapi tidak memiliki logo resmi bahkan nomor registrasi halal dari LPPOM MUI, terurama yang ada di Kota Malang. Oleh karena itu, perlunya dilakukan sosialisasi kepada masyarakat terutama pengusaha makanan dan minuman atau mamin agar bisa mengajukan sertifikasi halal tersebut dan memberikan kepastian hukum bagi konsumen. Menggunakan metode pengabdian sosialisasi, pengabdi mencoba memebrikan edukasi yang menyeluruh terhadap masyarakat, terkait pentingnya (awareness) mengkonsumsi makanan dan minuman halal. Hasil dari pengabdian ini diharapkan masyarakat di Kota Malang, baik itu produsen, distributor maupun konsumen, memahami urgensi makanan dan minuman halal, terutama bagi komunitas Muslim.   The Urgency of MUI Halal Certification for Food & Beverage Entrepreneurs in Malang City. This paper tries to imagine the phenomenon of the number of shops, food stalls, restaurants and the like, which immediately only write halal text, but do not have an official logo or even a halal registration number from LPPOM MUI, especially in Malang City. Therefore, it is necessary to disseminate information to the public, especially food and beverage entrepreneurs or food and beverage, so that they can apply for the halal certification and provide legal certainty for consumers. Using the socialization service method, the servant tries to provide comprehensive education to the community, regarding the importance (awareness) of consuming halal food and drinks. The results of this service are expected that the people in Malang City, both producers, distributors and consumers, understand the urgency of halal food and beverages, especially for the Muslim community.

Abstract

The large number of child abuse rates in the school environment forces the government to make policies to tackle it. Through child-friendly schools, it will provide protection for children in educational units. Furthermore, this paper aims to give a solution through child-friendly school. Not only creating schools that are safe from violence, but child-friendly schools also provide opportunities for children to carry out enjoyable learning processes and strengthen children's character. Child friendly schools have provided legal protection for children's rights while in the education unit. Through a child friendly school program based on the principles of child protection and prioritizing the fulfillment of children's rights, it will be a solution for the government today in dealing with various forms of violence that occur in schools.

Abstract

Artikel pengabdian ini dibuat karena melihat banyaknya produk legislasi di tingkat Desa, baik itu berupa Peraturan Desa, Peraturan Kepala Desa, Peraturan BPD dan sejenisnya, yang tidak memiliki nilai dan dibuat serta dibentuk seolah sebagai formalitas saja. Oleh karena itu, perlunya dilakukan edukasi kepada masyarakat terutama masyarakat Desa dna perangkat penyelenggara Pemerintahan Desa agar bisa menyusun dan membentuk Peraturan Desa yang berbasi pada nilai-nilai Ketuhanan. Menggunakan metode pengabdian edukasi, pengabdi mencoba memberikan sosialisasi dan pengetahuan baru tentang cara menyusun Peraturan Desa sesuai kaidah dalam ilmu perundang-undangan dan berbasis nilai-nilai Ketuhanan Hasil dari pengabdian ini diharapkan masyarakat Desa, terutama para pengurusnya di wilayah Malang Raya dan sekitarnya, bisa menyusun dan membentuk Peraturan Desa berbasis nilai-nilai Ketuhanan Yang Maha Esa.   Education on the Formation of Village Regulations Based on the Values ​​of Belief in the One and Only God This dedication article was made because of the many legislative products at the village level, whether in the form of Village Regulations, Village Head Regulations, BPD Regulations, and the like, which have no value and are made and formed as if they were just a formality. Therefore, it is necessary to educate the community, especially the village community and the Village Administration apparatus, so they can compile and form Village Regulations based on God's values. Using the educational service method, the servant tries to provide socialization and new knowledge about how to draw up Village Regulations in accordance with the rules in the science of law and based on Divine values—and forming Village Regulations based on the importance ​​of Belief in the One and Only God.

Abstract

Cases of criminal acts of corruption and Money Laundering have such fundamental ties. In this case the act of corruption is a part of the special criminal law in addition to having special specifications or different from the general criminal law or other, such as a deviation of procedural law and when viewed from the material regulated, the act of corruption directly or indirectly there is a the case or further criminal action from the existence of this criminal act of corruption resulting in a loss that affects the country's economy, namely by committing the crime of money laundering as an act of laundering or busting the trace rather than the original criminal activity. In addition, in these two acts there is a form of indictment which is very important in the Money Laundering Act because this is very much a part of the determination by the judge in proving an element of guilt from the offender, therefore, the preparation of an appropriate indictment in the Criminal Act of Laundering The money in which the part can't be ignored. So, in the development of the case, we need to know a lot about the continuity of corruption in the money laundering law, the use of money laundering legislation in its handling of corruption to optimize the efforts to recover state losses, and also the mechanism of imposing criminal penalties in proving the crime of money laundering without first proving the crime predicate as the most important element in imposing sanction.

Abstract

Regional assets are regional wealth earned from spending using APBD and grants. Therefore, regional asset management must be professional and modern oriented towards good government. Technically asset management in each region refers to Regulation of The Minister of Home Affairs No. 16 Year 2019 On the Management of Regional Assets. This research discusses the asset management of Batu City area using sociological juridical research methods that raise the issue of asset management barriers and the effect of asset management in Batu City. This research shows that; First, there are barriers in terms of human resources, both in understanding the rules as well as on the understanding related to administration that impacts on the disorder of the administration until now. Second, asset management in Batu City has not been effective because there has not been a clear measure that is used as a guideline for the assessment of effectiveness but only based on compliance with the rules.

Abstract

The government's policy of releasing thousands of public prisoners from various prison institutions in Indonesia is a dilemma. The granting of guarantees of rights to prisoners on the other hand will have various consequences when prisoners re-mingle in the community with social and economic conditions that are not easy in the midst of the current pandemic. Caused by a pandemic that occurred in the world today, namely a disease called Coronavirus Disease (Covid) 19. This disease is caused by the virus Systemic Acute Respiratory Syndrome (SARS) Coronavirus-2 (SARS-COV2). The covid pandemic 19 outbreak in addition to being a breath of fresh air for prisoners in Indonesia, also caused confusion in the community. Because the minister of law and human rights released thousands of prisoners in prison, while the police tried to arrest PSBB violators (Large-scale Social Restrictions) and of course criminalized and put offenders into prison cells. With these conditions, did this pandemic outbreak go down, because previously prisoners had been isolated in prison and were not touched by the outside environment. So the prisoner is actually safe in the cell, and there is no need for parole. Then with the decision to release prisoners during the Covid-19 pandemic it had several impacts on the community, which led to committing crimes. This crime occurred due to the community's economy which declined dramatically, there was no work in the midst of the plague that made the prisoners determined to commit crime.   Abstrak Kebijakan pemerintah membebaskan ribuan narapidana umum dari berbagai lembaga permasyarakatan (lapas) di Indonesia menjadi dilema tersendiri. Diberikannya jaminan hak kepada narapidana tersebut di sisi lain akan menimbulkan berbaAgai konsekuensi ketika narapidana kembali membaur di lingkungan masyarakat dengan kondisi sosial dan ekonomi yang tidak mudah di tengah pandemi saat ini. Disebabkan adanya pandemi yang terjadi di dunia saat ini yaitu sebuah penyakit yang dinamai Coronavirus Disease (Covid)-19. Penyakit ini disebabkan oleh virus Systemic Acute Respiratory Syndrome (SARS) Coronavirus-2 (SARS-COV2). Wabah pandemi Covid-19 selain menjadi angin segar bagi para narapidana di Indonesia, juga menjadi kebingungan dalam masyarakat. Karena menteri hukum dan ham membebaskan ribuan narapidana di penjara, sedangkan aparat kepolisian berupaya menangkap pelanggar PSBB (Pembatasan Sosial Berskala Besar) dan tentunya mempidanakan serta memasukkan pelanggar ke dalam sel penjara. Dengan kondisi yang demikian, apakah membuat wabah pandemi ini menjadi turun, karena sebelumnya narapidana sudah di isolasi di dalam penjara dan tidak tersentuh lingkungan luar. Jadi napi sebenarnya sudah aman di dalam sel, dan tidak perlu adanya pembebasan bersyarat. Kemudian dengan adanya keputusan dibebaskannya narapidana di tengah pandemi Covid-19 menimbulkan beberapa dampak bagi masyarakat, yang mengarah untuk melakukan kejahatan. Kejahatan ini terjadi di akibatkan ekonomi masyarakat yang menurun drastis, tidak ada pekerjaan di tengah wabah yang membuat para narapidana nekat melakukan kejahatan.

Abstract

The COVID-19 pandemic has implications for the postponement of the Simultaneous Pilkades in Indonesia. It's interesting to examine more deeply how the Simultaneous Pilkades policy arrangements during the COVID-19 Pandemic are viewed from the aspect of legal certainty and the legal consequences of postponing the Pilkades during the COVID-19 Pandemic. The research method uses a normative juridical approach with the statute approach and case approach. Legal materials (primary, secondary ,tertiary) were collected through literature study and analyzed in depth using content analysis. Research shows that prior to the pandemic in the laws and regulations the rules regarding the postponement of Simultaneous Pilkades due to force majeure had not been regulated. The authority of the Ministry of Home Affairs to determine the postponement of the Simultaneous Pilkades also has multiple interpretations. The government's policy of issuing the Mendagri Circular is also inaccurate and does not provide legal certainty, the circular is not classified as a statutory regulation. The presence of Permendagri No.72 of 2020 provides legal certainty, the substance clearly regulates the authority of the Regent/Mayor to postpone the Simultaneous Pilkades. The legal consequence of postponing the Pilkades during the Pandemic Period is that many villages will be led by an Acting Village Head. In the future, the provisions regarding the postponement of Simultaneous Village Head Elections due to force majeure are clearly regulated in the legislation and in carrying out tasks by the Acting Village Head must be carried out with full responsibility, because the Acting has the same duties, authorities, obligations and rights as the definitive Village Head. Abstrak Pandemi COVID-19 berimplikasi pada penundaan Pilkades Serentak di Indonesia. Namun pengaturan ihwal penundaan Pilkades Serentak dalam peraturan perundang-undangan ternyata kurang jelas. Menarik untuk mengkaji lebih dalam bagaimana pengaturan kebijakan Pilkades Serentak di masa Pandemi COVID-19 ditinjau dari aspek kepastian hukum dan akibat hukum dari adanya penundaan Pilkades di masa Pandemi COVID-19. Metode penelitian menggunakan yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Bahan-bahan hukum (primer, sekunder, tersier) dikumpulkan melalui studi kepustakaan dan dianalisa secara mendalam menggunakan metode analisis konten. Penelitian menunjukan bahwa sebelum pandemi dalam peraturan perundang-undangan (UU, PP, Permendagri) aturan mengenai penundaan Pilkades Serentak karena force majeur (bencana non alam) belum diatur. Kewenangan Kemendagri menetapkan penundaan Pilkades Serentak juga multitafsir. Kebijakan pemerintah mengeluarkan Surat Edaran Menteri Dalam Negeri juga kurang tepat dan tidak memberikan kepastian hukum, surat edaran bukan dikelompokkan sebagai sebuah peraturan perundang-undangan. Akhirnya kehadiran Permendagri No. 72 Tahun 2020 memberikan kepastian hukum, subtansinya mengatur secara jelas kewenangan Bupati/Walikota menunda Pilkades Serentak karena situasi darurat COVID-19 serta mekanisme dan teknis pelaksanaan Pilkades Serentak dalam situasi darurat COVID-19. Akibat hukum dari penundaan Pilkades di Masa Pandemi adalah banyak desa yang akan dipimpin oleh seorang Penjabat Kepala Desa. Kedepan ketentuan mengenai penundaan Pilkades Serentak karena force majeur diatur secara jelas dalam peraturan perundangan-undangan dan dalam pelaksanaan tugas oleh Penjabat Kepala Desa harus dilakukan dengan penuh tanggung jawab, karena Penjabat memiliki tugas, wewenang, kewajiban dan hak yang sama seperti Kepala Desa definitif.

Abstract

The Illegal logging is an organized illegal timber use activity. This crime is usually carried out by more than two people in a certain time for the purpose of destroying forests and selling wood products illegally. In Decision No.39/Pid.B/2015/PN.Sit the defendant Asyiani was dropped by a criminal witness of illegal logging thanks to a special criminal offense. Where the defendant has carried out illegal logging on Perhutani's land. The problem with this research is What is the basis for the judge's consideration in Decision No.39/Pid.B/2015/PN.Sit regarding the crime of illegal logging and How due to the law of Decision No.39/Pid.B/2015/PN.Sit about the crime of illegal logging is reviewed from the justice aspect. The research methods used are normative legal methods that use primary legal materials, secondary legal materials, tertiary legal materials and data analysis. The results of the study show less precisely the judge's consideration in the case against the defendant and the legal consequences reviewed from the aspect of pancasila justice were less appropriate because the defendant was given a probation sentence in which the criminal act of illegal logging was one special crime. The author's advice needs to be done with fair funding according to the crime committed by the defendant and this problem can be resolved by deliberation

Abstract

Part of the Keerom Regency area is a forest owned by the Keerom Indigenous people, in Articles 1 and 2 of the UUPA. the implementation of ulayat rights and similar rights of indigenous peoples, as long as in reality they still exist, must be so that they are in accordance with the national and state interests. The problem in this study is a sociological juridical review of the release of customary land rights into property rights certificates in Keerom Regency. This study raises the problem studied are, First how to release customary land rights to become property rights certificates. Second, what are the obstacles to releasing customary land rights into title certificates? Third, what are the efforts to overcome the obstacles to the Release of Customary Land Rights into Ownership Certificates in Keerom Regency? The research was conducted using a sociological juridical approach. Sources of data, primary data, secondary data, and tertiary flat. Data collection techniques are observation, interviews, and document studies. Based on the results of research and discussion; First, the transfer of rights carried out by indigenous peoples in Keerom Regency are of several kinds, namely; imnaway twa, Ken Baa, maafowor, Mararap Kambiswap, and Kin tuwri Ngkwaf. Second. obstacles, because customary land is not measured on the boundaries of the customary land. Third, to overcome obstacles, the Regional Government and Regency BPN must be active in conducting socialization with the community regarding the importance of registering land rights to ensure legal certainty. The author's suggestion in this study, the local government, and the customary council in Keerom Regency must make a regulation related to customary land so that customary land has legal clarity regarding land ownership.

Abstract

The current job transformation is one of the challenges for the state of Indonesia. Crimes over time have been carried out systematically, including corruption. The interesting thing about the development of efforts to combat corruption is the development of the concept of returning state finances. Legal entities in Indonesia have long experienced legal pluralism, as can be seen from the configuration of the community that carries out Islamic criminal law and customary law as local wisdom. This study uses a normative approach with secondary data support with the specification that the confiscation of corruptor's property in Islamic criminal law is divided into: Reproaches and reprimands/warnings, dismissing from his position (al-azl min al-wadzifah), by beating (whipping), punishment in the form of property (fines) and physical punishment, exile, crucifixion, death penalty. The relevance between these concepts is a form of legitimacy for the legal significance that comes from the beliefs and needs of the community. This article raises the concept of positive law with concepts in Islamic criminal law to find the relevance of the two which will later become part of the effort to function Islamic criminal law into Indonesian positive law in order to achieve the goal of a fair law and reduce corruption.
