Abstract

When viewed from a historical perspective, marriage existed and was carried out before the arrival of Islam. However, it is known that marriages carried out before Islam tended to be more towards political reasons not based on love, impressed because of the power factor so that at that time men could have more than one wife, dozens or even unlimited. The culture of marriage for men who have more than one wife is known as polygamy. Historically, the culture of pre-Islamic polygamy was carried out by ancient civilizations so that the Arabian peninsula, especially the Middle East, was not the main propagator of the polygamous tradition, which is often embedded. Therefore, one of the prominent scholars, namely KH. Husain Muhammad described in his writings that the tradition of polygamy was not a tradition that originated in Islam. Formulation of the problem of how to analyze polygamy related to non-Islamic traditions according to KH. Husein Muhammad and why KH. Husein Muhammad is of the view that polygamy is not an Islamic tradition? The research method used is qualitative research of the type of literature study, the approach used is a historical approach related to Islamic studies, this research is descriptive-analytical with the object of research being polygamy not Islamic tradition. The research results conclude that the culture of polygamy didn’t originate from Islam, because pre-Islamic polygamy in practice seemed misogynistic and tended to dehumanize after Islam arrived. Polygamy improved this situation with the main principles of justice and prioritizing women's rights.

Abstract

Purpose: This study analyzed the impact of government size in the field of infrastructure on digital inequality in Indonesia. Method: This study uses panel data analysis with the CEM, FEM, and REM approaches using research samples from the Central Bureau of Statistics, Ministry of Finance, and International Telecommunication Union in Indonesia. Results: The results of this study indicate that government-sized infrastructure has a negative and significant effect on the ICT Index, while the square government-sized infrastructure/infrastructure expenditure optimization effect has a positive and significant impact on the ICT Index, and the implementation of the infrastructure budget supports digital equity; therefore, it is necessary to have an equal distribution of infrastructure in all corners in order to proportionally increase the allocation of the infrastructure budget. This means that the size of the government is still too small to equalize the increase in the ICT development index. Based on the government size threshold, the average for each province in Indonesia reached 68 percent. Limitations: This study was limited to the national level of each region in Indonesia. Contributions: This study aims to serve as a reference for government considerations in strategic policies related to infrastructure spending and issues of the technology change strategy.

Abstract

Polygamy remains one of the most dynamic and contested issues in Islamic family law, with regulatory frameworks varying significantly across Muslim states. This article examines the regulation of polygamy in the marriage laws of Muslim countries, with a primary focus on Asia and Africa, in order to identify prevailing patterns of restriction, conditional authorization, and prohibition. Employing a normative and comparative legal approach, the study draws on national legislation, judicial decisions, and relevant scholarly literature from journals and academic books. The analysis is conducted through a descriptive-analytical method by examining the principles of Islamic law and their implementation within the positive legal systems of different states. The findings demonstrate that polygamy regulation in Muslim countries generally falls into three dominant models: permissibility subject to strict legal limitations, conditional permissibility under strong judicial supervision, and total prohibition. These regulatory models reflect ongoing efforts by Muslim states to reconcile the normative legitimacy of Sharīʿah with the demands of gender justice and contemporary family law reform. This study argues that the maqāṣid al-Sharīʿah approach plays a pivotal role in the transformation of modern Islamic family law by reorienting marriage law policies toward substantive justice and the protection of women’s rights.

Abstract

The land development process carried out by the company in recent decades has caused many conflicts with the community. It is undeniable that Riau Province is one of the eight provinces in Sumatra located in the eastern part which is mostly lowland with the potential for natural resources, especially in the field of plantations and forestry which makes oil palm plantation companies build many mills, control and develop land into plantations. Through the analytical descriptive method, situations and phenomena that become conflicts are presented, especially the causes and efforts to resolve the conflict. Some of the conflicts that occurred were given recommendations for alternative resolutions including; in the form of a study of government policies on right-to-use permits, mapping forest and plantation areas to obtain clear boundaries, eliminating the basis of conflict from their actions in conflict, victory of one party and defeat on the other, compromise, peace and impossibility of reconciliation, intensifying mediation between conflicting parties and the application of religious teachings as an effort so that the intensity and duration of conflict can be reduced or even can be reduced, especially conflicts that have been going on for a long time due to the repetition of previous conflicts.

Abstract

The National Sharia Council of the Indonesian Ulema Council (DSN-MUI) plays a central role in shaping the principles of Islamic economic law in Indonesia through its fatwas. These fatwas serve as primary references in the practices of Islamic financial institutions. However, the legal status of DSN-MUI fatwas within national legislation remains a subject of debate, particularly regarding their binding authority. This article aims to analyze the position of DSN-MUI fatwas from the perspective of Islamic law and legislative theory within the national legal system. This study employs a qualitative method with a normative and literature-based approach, examining various legal regulations and legal theories. The findings indicate that in Islamic law, fatwas are not absolutely binding unless institutionalized by an official authority. In the national context, DSN-MUI fatwas attain functional binding power as they are used as references in regulatory frameworks by Bank Indonesia, the Financial Services Authority (OJK), and Islamic financial institutions. Although these fatwas do not possess formal legal authority within the hierarchy of national legislation, they have become part of the living law that is internalized in national economic legal practices. Therefore, normative reinforcement is needed through explicit recognition in sectoral regulations to prevent legal vacuums. This study recommends the codification of DSN-MUI fatwas into derivative regulations to enhance their juridical legitimacy in supporting a just and legally certain Islamic economic legal system.
