Abstract

The issue of legal certainty for consumers in good faith in buying and selling houses becomes even more important when the developer company is declared bankrupt. Consumers who have carried out their obligations, whether in the form of down payment, installments, and repayment, are often only positioned as concurrent creditors in the bankruptcy settlement process. This study uses normative juridical legal methods with a statutory approach and a conceptual approach. The source of research data was obtained through literature studies which include primary legal materials in the form of the 1945 Constitution of the Republic of Indonesia, the Civil Code, Law Number 8 of 1999 concerning Consumer Protection, Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations, as well as several Supreme Court decisions related to developer bankruptcy cases. Secondary legal materials are derived from books, legal journals, and the results of previous research. Data analysis is carried out by interpreting laws in a systematic, contextual, and comparative manner to obtain the right legal construction. The results of the study show that there is a legal disharmony between the Consumer Protection Law and the Bankruptcy Law. Consumers in good faith are often only placed as concurrent creditors so that they do not get optimal legal protection. In fact, Article 28H of the 1945 Constitution guarantees the right of everyone to live and live properly. Therefore, there is a need for legal reconstruction that places consumers as preferred creditors or given a special position in developer bankruptcy, in order to realize legal certainty, justice, and utility. The author recommends that regulatory reform be carried out through amendments to the Bankruptcy Law by accommodating the legal protection of consumers in good faith as a form of implementation of the principles of social justice.

Abstract

Nurses, as the backbone of healthcare services in Indonesia, face high multidimensional occupational risks, encompassing biological, physical, psychosocial, and legal hazards. Ironically, these high risks are not compensated with fair wages, as many nurses still receive remuneration below feasibility standards. This research aims to analyze the fundamental gap between occupational risks (Das Sein) and wage justice (Das Sollen) from a legal perspective. Using a normative-juridical method supported by the Theory of Distributive Justice and the Theory of Legal Protection, this study dissects the regulatory architecture of the healthcare sector’s wage system. The findings identify three primary juridical obstacles: First, the current wage system fails to apply a fair principle of proportionality between the level of risk and the amount of remuneration. Second, a crucial operational norm vacuum exists due to the absence of a Ministry of Health Regulation, which is mandated by Government Regulation (PP) No. 28 of 2024 to technically implement risk factor calculations. Third, wage justice is hampered by institutional weaknesses, including the limitations of PPNI as a professional organization lacking the formal bargaining power of a trade union, and insufficient state supervision.

Abstract

The Indonesian Maritime Security Agency (Bakamla) plays a strategic role in ensuring security, safety, and law enforcement within Indonesia’s maritime jurisdiction. Although its authority is normatively stipulated through regulations such as Law No. 32 of 2014, Presidential Regulation No. 178 of 2014, and Government Regulation No. 13 of 2022, in practice Bakamla has yet to fully function as an ideal Indonesian Coast Guard. The absence of a specific law, overlapping authorities with other agencies, and limited resources hinder its operational effectiveness. This study aims to analyse Bakamla’s legal position and authority within the national legal system, identify discrepancies between regulation and operational reality, and formulate institutional strengthening strategies. Using a normative juridical approach, this research concludes that establishing a dedicated Coast Guard Law is an urgent step to develop a unified, professional, and effective national maritime security system

Abstract

The proliferation of slums in cities with limited land availability calls for regulation on how best to utilize and control Land and initiatives to streamline and improve land use in metropolitan areas through land consolidation. Therefore, the government can use land consolidation to ensure the quality of the urban environment and the social functions of Land. Land consolidation itself is mainly carried out on city properties due to the high concentration of people and lack of planning that characterizes many urban environments. In urban slum programs, vertical land consolidation is an alternative land supply to reorganize slums. By reorganizing who owns what, where it can be used, and how it can be used, land consolidation is carried out to enhance natural resource conservation and improve environmental quality through community involvement and public use of previously privately owned Land. Community participation is a major part of the framework for improving the quality and quantity of land functions. Vertical land consolidation can serve as a useful solution to urban problems such as housing affordability and density. By consolidating Land vertically, more housing units can be built in a smaller area, providing more affordable housing options for residents. In addition, vertical land consolidation helps reduce urban sprawl and results in more sustainable and livable cities. This paper uses normative legal research techniques, including research into applying positive law and legal principles or norms.

Abstract

The development of digital payment technology has changed the landscape of the payment system in Indonesia, with electronic money (e-money) becoming increasingly popular as an alternative to cashless payments. This study aims to analyze the legal protection of the use of the rupiah currency amidst the widespread use of electronic money in Indonesia. The research method used is a normative legal research method with a qualitative approach, utilizing secondary data through literature studies and documentation. The results of the study indicate that there are legal problems in the implementation of e-money related to Law Number 7 of 2011 concerning Currency which requires the use of the rupiah in all transactions in Indonesia. Problems arise when some merchants refuse cash payments and only accept e-money, which contradicts the legal provisions prohibiting the refusal of payments using the rupiah with a maximum criminal penalty of one year imprisonment and a fine of up to IDR 200 million. Bank Indonesia Regulation Number 20/6/PBI/2018 concerning Electronic Money has not explicitly regulated the position of cash in the era of payment dualism, thus creating legal uncertainty. This study recommends the need for regulatory harmonization that accommodates non-cash payment policies without eliminating the public's right to use cash, as well as the importance of educating the public about the rights, risks, and responsibilities of using electronic money.

Abstract

Perkembangan teknologi digital telah mengubah paradigma hukum pembuktian di Indonesia, terutama dalam konteks tanda tangan elektronik sebagai pengganti tanda tangan manual. Di satu sisi, tanda tangan elektronik memberikan efisiensi dan kepastian hukum dalam transaksi elektronik. Namun di sisi lain, kemudahan manipulasi data digital menimbulkan potensi kejahatan baru berupa pemalsuan tanda tangan elektronik pada dokumen Portable Document Format (PDF). Penelitian ini bertujuan untuk menganalisis bentuk pengaturan hukum terhadap pelaku pemalsuan tanda tangan elektronik dalam perspektif Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE) beserta perubahannya, serta menelaah mekanisme penegakan hukum terhadap tindak pidana tersebut. Metode yang digunakan adalah pendekatan yuridis normatif, dengan menganalisis peraturan perundang-undangan, doktrin, dan putusan pengadilan yang relevan. Hasil penelitian menunjukkan bahwa walaupun UU ITE telah memberikan dasar hukum yang sah terhadap tanda tangan elektronik, mekanisme pembuktian dan penegakan hukum masih menghadapi tantangan, terutama dalam aspek keaslian identitas digital dan otentikasi sertifikat elektronik. Oleh karena itu, diperlukan pembaruan sistem verifikasi digital yang lebih kuat serta peningkatan kapasitas aparat penegak hukum dalam memahami forensik digital.

Abstract

Korupsi lintas negara menimbulkan tantangan serius dalam upaya pemulihan aset hasil kejahatan yang disembunyikan di luar yurisdiksi nasional. Indonesia telah memiliki instrumen hukum berupa Mutual Legal Assistance (MLA) sebagaimana diatur dalam Undang-Undang Nomor 1 Tahun 2006 serta ratifikasi United Nations Convention against Corruption (UNCAC). Namun demikian, praktik pemulihan aset masih menghadapi hambatan, terutama ketika pelaku tindak pidana tidak dapat dipidana karena melarikan diri, meninggal dunia, atau berada di luar wilayah hukum Indonesia. Dalam konteks tersebut, Non-Conviction Based Asset Forfeiture (NCB) menjadi mekanisme alternatif yang strategis untuk perampasan aset tanpa menunggu putusan pidana. Penelitian ini bertujuan untuk menganalisis optimalisasi penerapan MLA serta urgensi pengaturan NCB dalam penanganan aset korupsi di luar negeri. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa sinergi antara MLA dan NCB sangat diperlukan untuk memperkuat efektivitas pemulihan aset korupsi lintas negara. Oleh karena itu, pengesahan Rancangan Undang-Undang Perampasan Aset menjadi kebutuhan mendesak dalam rangka memperkuat rezim pemberantasan korupsi di Indonesia

Abstract

Introduction: The assignment of receivables through cessie is an essential instrument in Indonesian civil law practice, including within the mechanism of Postponement of Debt Payment Obligations. In practice, however, legal uncertainty often arises concerning the legal standing of substituted creditors who acquire claims through cessie when involved in Postponement of Debt Payment Obligations proceedings. The absence of explicit regulation in the Civil Code and Law Number 37 of 2004 creates juridical ambiguities that may disadvantage both creditors and debtors.Purposes of the Research:  The purpose of this research is to examine the legal certainty of cessie within Postponement of Debt Payment Obligations by exploring the synergy between positive law, customary law, and legal pluralism theory.Methods of the Research: This study employs a normative juridical method, utilizing both the statute approach and the conceptual approach, with data collected through literature review of primary and secondary legal sources.Results of the Research: The findings demonstrate that legal certainty of cessie in Postponement of Debt Payment Obligations cannot rely solely on positive law but must also incorporate the legitimacy rooted in living customary law. The novelty of this research lies in the integration of legal pluralism theory to bridge positive law and customary law, thereby providing more comprehensive legal protection for both creditors and debtors. This research advances scholarly discourse by offering a model of synergy that may guide policymakers and judges in interpreting the status of cessie in Postponement of Debt Payment Obligations cases, thus ensuring legal certainty in both formal and substantive terms.

Abstract

This study aims to analyze the arrangement and implementation of online medical dispute resolution in hospitals to ensure legal certainty, as well as formulate an ideal form of the resolution model to realize justice in the future. The research method used is normative juridical with a qualitative approach through a statute approach to health regulations and electronic transactions. Legal materials were collected through literature studies at the National Library and analyzed descriptively analytically to answer the complexity of medical disputes in the digital ecosystem. The arrangement for online medical dispute resolution currently still relies on Law Number 17 of 2023 concerning Health, which requires non-litigation mediation as a first step, as well as the ITE Law as the basis for the validity of electronic documents. Implementation in hospitals is still fragmentary through medical committees or internal complaint units that are limited to simple online communication, but do not yet have special regulations for Online Dispute Resolution (ODR) outside the courts that comprehensively regulate mediator standards and data security. The condition of the absence of a standard standard creates legal uncertainty, especially regarding the strength of execution of the results of online mediation agreements. The ideal model of the future requires an integrated ODR platform that includes video mediation features, encrypted medical records, as well as the involvement of a certified neutral mediator who understands health law and professional ethics. This system prioritizes the principle of restorative justice to restore the therapeutic relationship between patients and medical personnel through a transparent, efficient, and accountable process.

Abstract

The development of the car rental business in Indonesia faces significant legal challenges, particularly related to default by renters. This study aims to analyze the legal protection available to car rental businesses when facing renters who default, by examining two court decisions: Decision Number 32/Pdt.G/2019/PN Btl and Decision Number 1065/Pdt/2023/PT.DKI. The research method used is normative juridical with a case-based approach and a statutory approach. The results show that legal protection for car rental businesses can be achieved through preventive and repressive channels. Preventive protection is carried out through the creation of a comprehensive written agreement, while repressive protection can be achieved through a lawsuit for default or unlawful acts. Both decisions analyzed show that the courts provide legal protection to business owners by punishing renters who default by paying compensation. However, the implementation of this legal protection still faces obstacles, particularly in terms of executing decisions and recovering losses. This study recommends the need to strengthen regulations specifically for the car rental business and improve guarantee mechanisms that can protect the interests of business owners.
