Abstract

This study discusses the Optimization of the Use of Islamic Religious Education Laboratories in the Practice of Student Worship at State Junior High Schools in Pangkajene District, Pangkep Regency. The main problem is how the Islamic Religious Education Laboratory can be optimized as a facility and infrastructure that supports the development and progress of Islamic Religious Education. The author uses a research approach with qualitative methods in data collection, as well as testing and analyzing data qualitatively. The research paradigm is constructivism; data sources are Principals, PAI Teachers, Students (primary data) and documents related to the management of the PAI Laboratory (secondary data); The research instrument is the researcher himself and is assisted through data collection tools, namely observation guidesheets, interview guidelines and document study guidelines; Data collection techniques are participation observation, in-depth interviews, and documentation; and testing the validity of the research results applying source triangulation and triangulation techniques. The research was carried out in four State Junior High Schools in Pangkajene District, Pangkep Regency. The results of the study showed that 1) The condition of PAI laboratories in the schools studied varied in terms of availability and quality of facilities. All schools have PAI laboratories, but there are gaps in infrastructure and equipment due to differences in budget allocation. 2) Laboratory use of PAI showed variation in intensity and effectiveness. Some schools have integrated the use of laboratories into the curriculum, while others still face challenges in optimization. 3) The practice of students' worship varies in the level of consistency and understanding. The majority of students have awareness of the importance of worship, but the level of practice varies. 4) Factors that affect the use of PAI laboratories include the availability of infrastructure, teacher competence, budget allocation, school management, student motivation, and education policies. This study recommends increasing budgets, developing teacher competencies, integrating curriculum, collaboration between schools, utilizing technology, and periodic evaluations to optimize the use of PAI laboratories and improve students' practice of worship.

Abstract

This study aims to analyze the social learning that occurs in the Tahfiz class program at SMAN 1 Sidrap, which integrates religious education of the Quran with the formal curriculum. This program was initiated by the school principal, Syamsul Yunus, with the goal of providing a space for students who already have memorized parts of the Quran to continue and deepen their memorization. This study uses a qualitative approach with in-depth interviews with students to explore the social aspects influencing the Tahfiz learning process. The results of the study show that social learning in the Tahfiz class is highly influenced by the interactions between students, the role of teachers, and the physical and social environment around them. Factors such as observation and imitation of learning methods, motivation from peers and teachers, and support from parents play a significant role in improving students' memorization quality. However, there are also challenges such as weak social norms in the class and a lack of positive reinforcement that can reduce intrinsic motivation among students. Therefore, this study recommends enhancing positive reinforcement, developing supportive social norms, and improving the classroom environment to create a more conducive learning atmosphere. Social learning in the context of the Tahfiz class demonstrates that social interaction and environmental support are crucial in supporting the learning and memorization process of the Quran

Abstract

This study aims to integrate the Tawhidic paradigm with the local wisdom found in Amatoa ri Kajang to develop a comprehensive framework for ecological fiqh. The research adopts a qualitative approach, utilizing content analysis of the Amatoa ri Kajang text and Islamic theological sources such as the Qur’an and Hadith. By examining the teachings on ecological balance, simple living, and resource management from Amatoa ri Kajang, the study explores how these principles align with Islamic values of tawhid (oneness of God), Khalifa (stewardship), and ihsan (ethical conduct). The results show that both frameworks emphasize the importance of maintaining harmony between humans and nature, with strict prohibitions on environmental exploitation. The originality of this study lies in its integration of Islamic jurisprudence with indigenous wisdom, offering a new perspective on how ecological fiqh can be developed to address contemporary environmental challenges. The research implications suggest that this framework could be institutionalized within Islamic legal systems, providing culturally relevant and ethically grounded solutions for environmental governance.

Abstract

This study analyzes post-divorce child custody as an important aspect in the context of Islamic family law. This article examines various aspects of post-divorce child custody, focusing on the Islamic legal framework. Through an analysis of the perspective of Islamic family law, this article discusses the rights and obligations of parents towards children, the role of the court in determining custody, and the principles that guide the post-divorce child custody process. This study aims to provide an in-depth understanding of the concepts of Islamic family law related to child custody, and their implications for child welfare in divorce situations. The method used in this study is a qualitative method with data collection used, namely data by collecting from the results of observations, documentation, and interviews. The results of the study obtained are the implementation of child custody after divorce in Pangkep Regency in reality does not comply with the decision of the Religious Court with the existence of obstacles, obstacles in the Implementation of Child Custody After Divorce in Pangkep Regency are as follows: Lack of sense of responsibility of the mother, the mental condition of the mother who is not ready to face divorce, lack of religious knowledge of the mother and the solution to these obstacles is: providing an understanding to the mother of a sense of responsibility that the child is a trust from Allah and will be accounted for, providing an understanding that not every divorce has a negative impact, increasing religious understanding that Allah has predestined divorce. The conclusion of this article provides insight into how Islamic family law regulates child custody after divorce by considering legal aspects, ethics, and the best interests of the child.

Abstract

This study investigates the phenomenon of unregistered marriage and efforts to prevent underage marriage in Wajo Regency. The research aims to examine the motivations behind unregistered underage marriages through the lens of Maq??id Mukallaf and evaluate the effectiveness of local legal interventions. Wajo Regent Regulation No. 64 of 2022 serves as a key policy instrument aimed at curbing underage marriage and promoting legally recognized unions. Using a qualitative juridical approach, data were collected through in-depth interviews with marriage officials, parents, community leaders, and underage couples, supported by observation and document analysis. The study integrates Maq??id Mukallaf theory to assess the legality and ethical validity of marriage motives, alongside Ibn Qayyim al-Jawziyyah’s theory of legal change and Weber’s bureaucratic management theory to evaluate policy responsiveness and implementation. Findings indicate that although unregistered marriages involving underage couples may fulfill internal aspects such as personal capability and social support from parents and family, they are often driven by defensive motives such as avoiding complex legal procedures or social stigma which ultimately fail to meet the criteria of valid Maq??id Mukallaf.  Such acts are legally and morally untenable when they cause harm to others, particularly to children. This study highlights the importance of aligning legal frameworks with religious principles and community engagement to protect children’s rights and foster sustainable social change.

Abstract

Zakat is not only an act of worship to Allah but also a vital instrument for enhancing social welfare when managed effectively. In Ajatappareng, the potential for zakat is substantial; however, actual collections have yet to meet targeted levels. This shortfall is largely attributed to limited understanding and awareness among potential payers. This study aims to examine the collaborative governance process in zakat management by BAZNAS Ajatappareng. The research adopts the collaborative process framework of Ansell and Gash, which includes four dimensions: initial conditions, leadership, institutional design, and collaborative process. A qualitative phenomenological approach was employed, with data collected through observation, interviews, and supporting documents. Informants were selected via purposive sampling, and data analysis followed three stages: reduction, presentation, and conclusion drawing. Findings indicate that while BAZNAS Ajatappareng has engaged in collaborative efforts with multiple stakeholders, certain aspects particularly human resource capacity and impact assessment remain suboptimal. The study recommends adopting best practices from other BAZNAS branches with proven success in zakat collection to strengthen future collaborative strategies.

Abstract

This article delves into the comprehensive examination of the dispute resolution in adultery cases within the Tolaki Tribe, specifically through the traditional practice of "Kalosara." The research also explores the relevance of Kalosara to the al-Ishlah concept in Islamic criminal law. This research uses the literature review method to establish a robust theoretical foundation. This research indicates a significant relevance between the Kalosara custom and the concept of Ishlah in the context of Islamic criminal law. The practice of Kalosara in resolving cases of adultery within the Tolaki Tribe reflects the principles of Ishlah, emphasizing reconciliation, restoration, and conflict resolution. The stages of the resolution process, from the acknowledgment of the perpetrator to the purification ceremony, mirror a holistic approach to achieving restorative justice. The research results show that the integration of Kalosara customary law in the Ishlah process reflects the aspirations of the Tolaki community for a comprehensive resolution and effective recovery at various levels, including individual, social, and broader community contexts. In the settlement through Kalosara, adulterers are expected to admit their actions, express regret, and carry out a purification process with a holistic approach to resolving conflicts and restoring social relations.

Abstract

Currently, the problem of poverty is one of the social problems in Indonesia. Therefore, it needs a strategy to solve it. The purpose of this paper is to present an approach of Rumah Zakat aimed at mobilizing civil society in reducing the poverty gap. This study used the descriptive method and qualitative analysis. The data source was secondary data collected from documents and texts related to the topic, be it books, articles, newspapers, and journals. This study found the that socio-economic empowerment of Rumah Zakat had a role in providing social change in the communities where the contribution of the program’s productive implementation has an impact in reducing the depth severity of poverty in Indonesia. The provision of voluntary charity through empowering programs in Muslim civil society is needed to bring welfare to the communities

Abstract

Fazlurrahman's approach to reading the law differs from that of earlier interpreters; yet, his view of the law was essentially a concretization of the paradigm to which they subscribe. The purpose of this article was to examine Fazlurrahman's understanding on the transformation of Islamic law. Utilizing a literature review, the notion of Fazlurrahman's interpretation of Islamic theoanthropocentrism was thoroughly analyzed. According to the findings of the study, Fazlurrahman constructed a worldview that simultaneously centered on God and people. His hypothesis was dubbed the twofold movement theory by Rahman. Rahman has a holistic view of Islamic law. Islamic law was a continuity of faith, Islam, and ihsan doctrines.

Abstract

Government Regulation Number 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants in article 3 stipulated that all civil servants intending to divorce had to have prior permission from their superiors or a letter of recommendation from a relevant official. This administrative requirement was mandatory, allowing the judge to consider and decide on divorce cases involving civil servants. This research employed field research with an empirical juridical approach, which was conducted directly to understand the real issues and was then linked to applicable laws, the legal certainty theory, and the maslahah theory (maintaining the objectives of shari'a and achieving benefits/avoiding harms). The research findings concluded that: 1) the divorce requirements in the maslahah theory aimed to reduce the divorce rate among civil servants. Superiors or authorized officials had the right to guide employees to try to preserve their marriages; 2) the Parepare Religious Court granted six months to obtain permission from superiors. If, by the specified deadline, the individual did not have this permission and still wished to divorce, they were required to submit a statement willing to bear the consequences of divorce without the superior's permission. The related consequences were outlined in Government Regulation Number 94 of 2021 on Civil Servant Discipline; 3) there was a connection between the judge's consideration and the maslahah theory. In addition to considering the applicable laws, the judge also took into account aspects of maslahah when making decisions. The maslahah obtained from a formal divorce in the Religious Court included legal certainty and justice in the judge's divorce decree.
