Abstract

This study aims to find out how the Response of Micro, Small, and Medium Enterprises of Fast Food to the Obligation of Halal Certification in the City of Bima, West Nusa Tenggara Province. This uses a type of qualitative research descriptive with a sociological approach. As for collection techniques namely observation, interviews, and documentation. While technique processing data analysis using reduction, data presentation, and conclusion. The results of this study indicate that first, the response of UMKM  in fast food regarding the understanding of halal certification has partially been understood even though details have not been conveyed. Second, UMKM response to PPH Act indicates strongly agrees with the existence of halal certification required by regulations to obtain halal guarantees from a food product served. Third, the response of UMKM  to the benefits of labeling halal certification provides a good value because in the future UMKM  want halal certification to be able to bring in material profit values as well as benevolent values (spiritual). Therefore, it is hoped that the latest Law will be a solution to various kinds of emerging problems and obstacles faced by UMKM.

Abstract

This study aims to examine the strategy of the Islamic economic system in realizing the prosperity of the people in the modern era. This type of research uses a qualitative type with library research. While the research approach used is descriptive analysis. The data analysis used is using qualitative data analysis. The results show that the Islamic economic system in Indonesia has not shown good and significant results in realizing the prosperity of the people. So that it requires steps and strategies in developing sharia economics, namely first, strengthening in increasing public awareness regarding sharia economic literacy, increasing and empowering Human Resources both in quality and quantity, strengthening research and development (R&D) capacity. Second, Strengthening Fatwas, Regulations (Laws) and governance. Third, strengthening and expanding the halal network until the formation of halal in every region throughout Indonesia from upstream to downstream and the halal value chain. Fourth, strengthening the Islamic financial sector Strengthening the Islamic finance sector. Fifth, strengthening micro, medium and macroeconomic enterprises. Sixth, strengthening and developing a digital-based economy.

Abstract

PurposeThis article aimed to examine the moral concepts of peta kapanca ceremony as a tradition of the Bima people at every wedding ceremony.MethodThis study used an exploratory case study design which mainly depended so much on qualitative taken directly in the Bima Community of West Nusa Tenggara. The data collection applied observation, interviews and documentation and a literature study. In analyzing the data, it used classical hermeneutics and sociology. In addition, the study implemented data reduction, data presentation, and drawing conclusions stages of analysis.Results/findingsThe results showed that peta kapanca ceremony in the marriage of the Bima community had moral values, comprising how to worship Allah, how to behave and treat oneself and his family and how to behave and treat the society.ConclusionThe values contained in the peta kapanca are very relevant to the values in Islamic teachings. Thus, it is necessary for the Bima Regency government, community leaders, traditional leaders, and all levels of Bima society and the younger generation to increase awareness of the importance of preserving and caring for peta kapanca tradition and other local cultural traditions, so that they can grow and develop in line with the Islamic teachings and local wisdoms of Mbojo tribe in Bima.

Abstract

The aim of this research is to raise the issue of wage payment schemes. Based on the data, there are still many people who pay wages using a process that is not in accordance with the contract that has been determined, and there are still many people who make wage payments without paying attention to the appropriate time period and amount of wages. So in this research we will discuss how the implementation of worker wage payments in the self-help housing stimulant assistance program (BSPS) is appropriate from a Maqashid Syariah perspective. The government has a program to eradicate uninhabitable housing with a housing assistance program for low-income communities through the PUPR ministry. West Kalimantan, especially Kuburaya district, is in the spotlight with a larger aid allocation quota than other districts. This assistance was in the form of money which was then spent collectively by the beneficiaries amounting to twenty million, with details of seventeen million five hundred thousand for building materials and two million five hundred thousand for workers' wages. Wage payments are made after the house is built by the beneficiary with their own self-sufficiency, so a problem arises in the payment of workers' wages which is deferred until the house is completely built and still has to wait for the entire group to complete its obligations as a condition for paying workers' wages. Based on Maqashid Syariah's review, the process of paying wages in the BSPS program is seen from the indicators of protecting religion, protecting the soul, protecting offspring, protecting property, protecting, and reason. These are not all contradictory, but need to be reviewed from the perspective of dharuriyyat, tahsiniyyat, hajjiyat

Abstract

Penelitian ini bertujuan untuk meneliti positivisasi hukum Islam di Indonesia dengan mengkaji Perundang-undangan tentang Wakaf sebagai bagian dari pengembangan hukum Islam Di Indonesia. Metode yang digunakan menggunakan kualitatif dengan studi kepustakaan. Adapun pendekatannya menggunakan analisis deskriptif dan history dengan Analisis data kualitatif normatif. Hasil penelitian menunjukkan bahwa banyaknya aturan perwakafan, mulai dari masa pra kemerdekaan dan setelah Indonesia merdeka, sangat terasa bahwa regulasi perwakafan kering akan aturan dan pelaksanaannya. Setelah bertahun-tahun terjadinya stagnasi regulasi perwakafan, pada tahun 1977 lahirlah Peraturan Pemerintah no. 28 tahun 1977. Inilah era baru perwakafan di Indonesia dimana Peraturan Pemerintah ini bertujuan untuk menjadikan tanah wakaf sebagai suatu lembaga keagamaan khususnya bagi umat Islam. Peraturan pemerintah No. 28 tahun 1977ini kemudian menjadi salah satu dasar lahirnya peraturan/perundang-undangan tentang wakaf seperti Kompilasi Hukum Islam dan yang paling utama adalah Undang-undang No. 41 Tahun 2004 tentang wakaf. Terlihat jelas bahwa Bijblad yang pernah berlaku pada masa Hindia Belanda dan Pra kemerdekaan merupakan usaha untuk mengadministrasikan harta wakaf semata. Sedangkan pada masa kemerdekaan, perlakuan terhadap harta wakaf menuju kepada unifikasi wakaf menuju kesejahteraan umat.

Abstract

This article aims to examine the relationship between religion and the state in responding to the politics of Islamic law in Indonesia. The research method uses descriptive qualitative research with literature studies aimed at examining primary data, namely laws, similar regulations, journals, books, and other sources related to research problems. The research approach is social legal research. The technique of data collection with literature study with data analysis with qualitative descriptive methods. The results of the study show that Indonesia is not a religious state but religion is one of the most important elements, so that the relationship between religion and the state has implications for the positivization of Islamic law into national law as a form of state manifestation as a unit that cannot be separated from religious life which is symbiotic- integralistic, by giving birth to a product of Islamic law as a national law until it remains valid. so as to provide harmony, peace, in the life of religion, nation and state is achieved and remains sustainable.

Abstract

This study aims to multiply Ali Yafie's thoughts on the development of Islamic law in Indonesia. This research uses qualitative research with a literature study approach. The data collection techniques use the library research, namely: trying to collect data from books or literature related to the researcher's discussion. The data analysis uses deductive analysis with interpretative. The results of the study show that Ali Yafie's thoughts in the field of social fiqh try to understand Islamic teachings, at least with several approaches, namely: Combining Text/nash with Reason, Blending Text with reality, and combining text with Maslahah makes fiqh more contextual and directs it more towards issues of a more social nature. in the dynamic development of Islamic law in Indonesia.

Abstract

Kajian ini bertujuan untuk mengetahui nikah via internet ditinjau dari hukum Islam dan hukum Positif. pendekatan penelitian yang digunakan yaitu deskriptif analisis yuridis dan fikih. Hasil penelitian menunjukkan bahwa nikah via internet dalam hukum Islam memiliki perbedaan pendapat yaitu pertama, pendapat  menurut imam Hanafiyah dan Imam Hambali, akad nikah via internet hukumnya sah karena memenuhi syarat dan rukunnya. Kedua, menurut Imam Syafi’i hukumnya tidak sah  karena belum memenuhi syarat dan rukun nikah yaitu tidak dilangsungkan dalam satu tempat atau majelis. Para Ulama dalam memahami hukum akad nikah via internet menggunakan metode al-jam’u,takhyir dan tarjih . Adapun dalam hukum positif berdasarkan Undang-undang Nomor 1 Tahun 1974 dan kompilasi hukum Islam tidak memiliki aturan dan ketentuan secara eksplisit yang mengatur ketentuan hukumnya, sehingga nikah via internet  hukumnya sah karena memenuhi rukun dan syaratnya berdasarkan  hukum positif.

Abstract

This research aims to analyze the juridical, philosophical and sociological aspects of the legal dynamics of coenant via the internet in Indonesia. This research uses a qualitative type with library research. Meanwhile, the research approach used is descriptive, juridical, philosophical and sociological analysis. The data analysis used is qualitative data analysis. The results of the research show that there are differences of opinion among Ulama regarding coenant via Internet which are based on differences in methods of understanding the texts of the Koran and hadith regarding marriage, and are related to the development of science and technology. In Indonesia, from a juridical-philosophical perspective, the practice of coenant via the Internet is recognized as legal because all legal facilities and requirements have been fulfilled. However, from a sociological perspective, most Muslim communities in Indonesia still strongly believe marriage is a sacred moment. Therefore, even though the practice of coenant via teleconference is legally recognized, it is still difficult for society to accept it widely because the traditional paradigm related to the sacredness of marriage still dominates. As a legal state, strategic steps are needed to establish a clear and comprehensive legal status regarding the legality of carrying out marriages via the Internet. There is an excellent possibility in the future with advances in science and technology, it is not without reason that the Indonesian Muslim community uses the internet as an instrument in carrying out coenant.

Abstract

This study aimed to examine the concept and system of vehicle pawning with a review of Sharia economic law. The research used descriptive qualitative with the type of field research at the Pawnshop Branch Office of the City of Bima, West Nusa Tenggara Province. While the data collection techniques were interviews, observations and documentation with data analysis using data reduction, data presentation and conclusion. The results show that,  first, the practice of vehicle pawning financing products at the Bima City Pawnshop is relatively easy and practical. The view of Islamic law on vehicle pawning practices at the Bima City Pawnshop is considered to be by Sharia principles because it does not contain 3 elements that are prohibited in the practice of vehicle pawning. Such as Gharar, Maysir, and Sury. Because the suitability of the application for pawning vehicles at the Bima City Branch can be seen in three things, namely the pillars, the legal requirements for the pawn, the costs and the mechanism for the settlement of collateral goods. And the practice of pawning vehicles at the Bima City Pawnshop is governed by the Fatwa of the National Sharia Council No.26/DSN-MUI/III/2002 concerning Rahn Emas or similar items such as Vehicles.
