Abstract

Sertipikat merupakan tanda bukti hak kepemilikan tanah yang harus mendapatkan kekuatan dan kepastian hukum, tetapi ini belum menjamin sepenuhnya tentang kepastian hukum pemiliknya karena masih memberikan kesempatan kepada pihak lain yang juga merasa memiliki tanah tersebut. Sertipikat didapatkan setelah dilaksanakan proses pendaftaran tanah yang diselenggarakan oleh pemerintah dalam hal ini Badan Pertanahan Nasional (BPN) yang meliputi pengukuran, pendaftaran hak dan pemberian surat tanda bukti hak yaitu sertipikat. Proses pendaftaran tanah ini yang menimbukan berbagai macam permasalahan atau kasus pertanahan yang salah satunya yaitu terbitnya 2 (dua) sertipikat atas satu bidang tanah yang dikenal dengan sertipikat ganda. Sengketa sertipikat ganda ini dialami oleh dana pensiun semen padang yang merupakan suatu badan hukum yang didirikan oleh PT Semen Padang sebagai anak usaha Badan Usaha Milik Negara (BUMN) sehingga aset dana pensiun ini dapat dikategorikan sebagai Barang Milik Negara (BMN). Rumusan masalah dalam penelitian ini adalah (1) mengapa terjadi sertipikat ganda atas tanah aset Dana Pensiun Semen Padang (2)  bagaimana penyelesaian sengketa sertipikat ganda atas tanah aset Dana Pensiun Semen Padang sebagai barang milik negara. Metode yang digunakan dalam penellitian ini adalah pendekatan yuridis empiris atau dapat disebut dengan penelitian lapangan. Sumber data yang digunakan yaitu sumber data primer dan sumber data sekunder. Dalam penelitian ini kemudian didapatkan kesimpulan yaitu hal yang menyebabkan timbulnya sertipikat ganda dalam satu bidang tanah yang sama karena kesalahan penunjukan objek dan penyelesaian sengketa sertipikat tanah ganda dapat dilakukan upaya perlindungan hukum yang berbentuk represif dan dapat juga dilakukan dengan jalan musyawarah serta penyelesaian melalui jalur peradilan Tata Usaha Negara maupun peradilan umum.

Abstract

This study investigates the implementation of the obligation to allocate 20% of plantation land to farmers from a jurisdictional perspective by using a case study of PT. Wanasari Nusantara in Kuantan Singingi Regency, Riau Province. The obligation, stipulated under the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 26 of 2007, aims to empower local communities and foster regional economic development. Employing an empirical legal research methodology, this study analyzes legal frameworks and qualitative data gathered through stakeholder interviews. The findings indicate that the company has not fully complied with its obligations, largely due to inadequate oversight and a lack of transparency in the management and expansion of Land Use Rights (Hak Guna Usaha or HGU). From the perspective of spatial planning law, land allocation policies are vital to ensure equitable access to land resources. However, these policies require stronger regulatory frameworks and enforcement mechanisms to achieve their objectives. The study concludes by recommending a comprehensive revision of supervision mechanisms and an enhanced governmental role to ensure effective implementation of land allocation policies. This approach is essential for achieving distributive justice and promoting sustainable social and economic development.

Abstract

Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation (hereinafter the Job Creation Law) has fundamentally transformed business licensing governance in the marine sector. Through the Omnibus Law approach, this law centralizes authority that was previously decentralized to regional governments, particularly regarding marine spatial utilization licensing and regional levy collection. This study aims to examine the synchronization and harmonization of legal norms in the hierarchy of legislation after the enactment of the Job Creation Law in the marine sector, and to identify its legal implications for fiscal decentralization and Regional Original Revenue (PAD). This research employs a normative legal research method with a statutory approach. The findings indicate that the Job Creation Law creates a contradiction in terminis between norms granting authority in formal laws and norms limiting their implementation in implementing regulations, resulting in regulatory gaps at the regional level. Fiscal centralization through Government Regulation Number 85 of 2021 implies the loss of regional government potential revenue from the marine sector, estimated at IDR 205 billion from a single instrument alone, and worsens fiscal capacity disparities between regions. The regulatory framework needs refinement through proportional delegation of authority to regional governments, combined with administrative discretion under strict oversight and the formulation of local initiative regulations to address existing legal gaps.

Abstract

The Commitment Making Officer (PPK) in government procurement activities carries a fundamental dual legal standing: as a state administrative official subject to the public law regime, and simultaneously as a government representative bound in civil law relationships. This duality creates real legal accountability complexities, particularly when the fulfillment of public law obligations—namely the follow-up of the State Audit Board (BPK) recommendations—conflicts with previously agreed contractual obligations. This study aims to analyze the legal implications of BPK audit recommendation follow-up on PPK civil liability and to examine the mechanisms and obstacles in executing court judgments ordering regional governments to pay compensation to goods/services providers. The study employs normative-empirical legal research with a case study approach focusing on Civil Case Decision Number 22/PDT.G.S-2022-PN PDG at the Padang District Court. Results show that: first, the breach of contract arising from contract value deductions without a valid addendum constitutes the liability of the government as a public legal entity not PPK's personal liability based on the faute de service theory; second, execution of court judgments against regional governments faces structural obstacles including prohibition on government asset seizure and the regional budget mechanism, rendering compensation fulfillment entirely dependent on the regional government's good faith.

Abstract

Penelitian ini mengkaji penguasaan dan pemilikan tanah pada sektor hulu minyak dan gas bumi (migas) yang berstatus Barang Milik Negara (BMN). Fokus penelitian berkenaan tumpang tindih hak atas tanah antara PT. Pertamina EP Lirik Field sebagai Kontraktor Kontrak Kerja Sama (Kontraktor) dengan masyarakat yang mengklaim kepemilikan pada areal pengamanan migas pada wilayah kerja yang telah digunakan sebagai blok sumur migas di Struktur Sagodom Desa Gudang Batu. Penelitian ini bertujuan menganalisis pola penyelesaian konflik pertanahan yang tepat. Penelitian ini menggunakan pendekatan yuridis empiris dengan sifat deskriptif kualitatif. Hasil penelitian menunjukkan bahwa tanah tersebut merupakan BMN hulu migas, sehingga adanya penerbitan satu dan/atau beberapa sertipikat hak atas tanah pada satu bidang tanah yang sama mengindikasikan cacat administrasi dan/atau cacat yuridis. Menurut Permen ATR/BPN Nomor 21 Tahun 2020 tentang Penanganan dan Penyelesaian Kasus Pertanahan Nasional, konflik pertanahan ini diklasifikasikan sebagai kasus berat namun penanganannya belum dapat diproses oleh Kantor Pertanahan karena ketiadaan pengaduan dari Kontraktor. Pola penyelesaian yang disarankan mengacu PMK Nomor 140 Tahun 2020 tentang Pengelolaan BMN hulu migas yang mengutamakan musyawarah serta mengakomodir upaya hukum dan pengamanan atas adanya perkara di pengadilan seperti pengajuan pemblokiran sertipikat.

Abstract

Forests are a natural resource used by communities around the forest to support their lives, including the Customary Law Community or Masyarakat Hukum Adat (MHA). However, various tenurial conflicts are often encountered in forest utilization, such as claims over forest areas. The basis of the problem, which then causes the community around the forest, often conflicts with government policies. However, the issuance of Constitutional Court Decision No.35/PUU-X/2012 provides a form of recognition to MHA in managing forests and determines customary forests as the forest within the territory of MHA. This research will focus on two issues: first, how is the recognition and determination of customary forest by MHA after the presence of the Constitutional Court Decision No.35/PUU-X/2012. Second, how are efforts to recognize and determine customary forests through social forestry schemes in the Province of West Sumatra. To answer the focus of the study, this study used normative juridical research methods with descriptive research specifications and analyzed them through library research. Abstract

The title certificate over land is a form of State Administrative Decree, based on Article 1 number 3 of Law Number 9 of 2004 concerning the Second Amendment 2 to Law Number 5 of 1986 concerning the State Administrative Court. Related to that, if there are individuals and legal entities who object to the decision, the objection can be made through a lawsuit to the State Administrative Court based on the absolute compatibility of State Administrative Procurement. There are legal facts, the Sungai Full District Court of Jambi Province accepted, examined, tried and decided objections to the certification further in its decision stating that the certificates of the Defendants were invalid.

Abstract

Indonesia merupakan sebuah welfare state, tercermin dari sila kelima Pancasila, “Keadilan sosial bagi seluruh rakyat Indonesia” dan Alinea keempat Pembukan Konstitusi, “memajukan kesejahteraan umum” yang berkeadilan sosial bagi seluruh rakyat Indonesia, beserta berbagai pasal dalam Batang Tubuhnya. Untuk mewujudkan visi negara kesejahteraan diperlukan pemerintahan. Penyelenggaraan pemerintahan dan pembangunan memerlukan biaya yang tertuang dalam APBN.  Biaya dikumpulkan dari sumber penerimaan negara yang aman, berkelanjutan, dan murah, yakni dari sektor perpajakan. Faktanya, penerimaan dari sektor perpajakan masih kecil dibandingkan potensinya karena masih tingginya tax gap atau rendahnya tax ratio.  Penelitian ini bertujuan untuk mencari penyebab tingginya tax gap atau rendahnya tax ratio dengan metode penelitian normatif yuridis.  Hasil penelitian menunjukkan bahwa akar masalah rendahnya penerimaan perpajakan adalah masih belum optimalnya efektivitas dan efisiensi kinerja institusi perpajakan walaupun telah 40 tahun (1983-2023) dilakukan reformasi administrasi perpajakan. Buktinya berupa fakta masih rendahnya tingkat kepatuhan sukarela Wajib Pajak dalam memenuhi kewajiban konstitusional untuk membayar perpajakan sebagaimana diatur dalam Pasal 23A Konstitusi. Rendahnya penerimaan perpajakan dibandingkan dengan kebutuhan APBN mengakibatkan terjadinya defisit anggaran yang berlangsung secara terus-menerus. Defisit anggaran ditutupi dengan pembiayaan berupa utang, baik utang dalam negeri maupu luar negeri. Kesimpulan penelitian adalah diperlukan langkah fundamental (radikal) untuk meningkatkan efektivitas dan efisiensi kinerja DJP dan DJBC berupa peningkatan kapasitas kelembagaan dengan membentuk Badan Penerimaan Perpajakan Negara (BPPN) yang merupakan badan hukum tunggal hasil penggabungan DJP dan DJBC, berstatus hukum setingkat kementerian, dan bertanggung jawab langsung kepada Presiden.
