Abstract

Citizenship plays a crucial role in the legal system and judicial process of any country, including Indonesia. This abstract examines the impact of citizenship status on legal processes in Indonesia, detailing how citizenship affects various aspects of law enforcement, particularly in the context of criminal offenses. In Indonesia, the legal system categorizes individuals as Indonesian citizens (WNI) or foreigners, with each category receiving different legal treatment in criminal cases. In criminal law contexts, the difference in citizenship status can influence several factors, including jurisdiction, legal treatment, and specific rights afforded to both offenders and victims. For Indonesian citizens, legal proceedings are generally conducted under national law, referring to the Indonesian Criminal Code (KUHP) and other relevant statutes. Conversely, foreign nationals involved in criminal acts in Indonesia are subject to special regulations that govern how these cases are handled, including international cooperation and extradition. This study reviews pertinent regulations and judicial practices in Indonesia and explores how citizenship status affects the legal rights of offenders and victims, as well as the procedural aspects of the legal system. The research method used is a qualitative approach, involving case studies and normative analysis. Case studies will include analysis of various criminal cases involving individuals with different citizenship statuses, both Indonesian citizens and non-citizens. Data will be collected through literature reviews, interviews with legal practitioners, and analysis of legal documents and court decisions. The research also addresses the challenges faced in implementing laws related to citizenship status, including issues of human rights, legal protection, and justice. The findings suggest that while Indonesian law provides different treatments based on citizenship, there is an urgent need for harmonization and reform to ensure that legal processes are fair and transparent for all individuals, regardless of their citizenship status. This insight offers guidance on how the Indonesian legal system can be improved to ensure consistent legal protection and justice for all individuals involved in criminal cases.

Abstract

Pancasila, as the foundational philosophy of Indonesia, plays a central role in shaping national policies, including foreign policy. This paper aims to explore the implementation of Pancasila values in Indonesia's foreign policy, focusing on how humanitarian principles are integrated into diplomatic practices and international law. The study employs a qualitative approach by analyzing recent literature, policy reports, and interviews with relevant experts. The findings reveal that Pancasila, particularly the principle of Just and Civilized Humanity, serves as a moral guide in foreign policy decision-making. However, the application of these values often faces challenges due to global political dynamics and competing national interests. The evaluation shows that while there are efforts to align foreign policy with Pancasila’s humanitarian principles, there remains a need to enhance consistency and effectiveness in their implementation. This research aims to provide insights into how Indonesia can improve the integration of Pancasila values in its foreign policy and contribute to a more just and humane international legal framework.

Abstract

Pancasila, as the foundation of the Republic of Indonesia, is an ideology that influences various aspects of the life of the nation and state, including in the context of international law. This study aims to explore the interaction between the principles of Pancasila and the norms of international law, particularly in relation to state sovereignty and human rights. The main focus of this study is how the principles of sovereignty and human rights, which are pillars in international law, are integrated and translated in the context of Pancasila, and how this affects Indonesia's position in the global arena. This research uses a qualitative approach with a documentary study method, collecting data from books, scientific journal articles, and recent legal documents. It analyzes the application of Pancasila principles in Indonesian national law and its impact on international obligations, particularly in terms of human rights protection. The study also examines the challenges faced by Indonesia in harmonizing the principles of national sovereignty with its commitment to international human rights standards. The results show that the principles of Pancasila, such as Social Justice and Indonesian Unity, provide a strong foundation for safeguarding state sovereignty. However, there are significant challenges in integrating international human rights principles, particularly in the context of protecting minority rights and upholding global human rights standards. The research also identifies Indonesia's efforts in balancing national interests with international obligations through foreign policy and diplomacy. The implications of this research suggest the need for a more holistic and strategic approach to address the tension between state sovereignty and human rights in the global context.

Abstract

This study investigates the role of customary law in determining citizenship status in Indonesia, with a particular emphasis on how customary law interacts with the state legal system and how this impacts Indigenous communities. Indigenous communities often face administrative issues, such as the process of citizenship registration and access to public services, due to the misalignment between uniform state laws and traditional local customary laws. This study found the main issues faced by indigenous communities in Indonesia, such as legal uncertainty and social marginalization. This research aims to comprehensively study the influence of customary law on the determination of citizenship status in Indonesia and to compare it with experiences in other countries. The research method used is normative, doctrinal, or library research method. This study provides information on how to improve the integration between customary law and state law to create a citizenship system that is fairer and more inclusive for Indigenous communities. Reducing inequality and increasing the participation of indigenous communities in social and political life is expected through policy reforms that take into account the needs of indigenous peoples.

Abstract

As the basic ideology of the Indonesian state, Pancasila not only provides philosophical and normative guidelines for governance, but also plays an important role in the recognition and implementation of customary law throughout Indonesia. This study aims to provide an in-depth analysis of the relationship between Pancasila and customary law in the context of the Indonesian constitution, evaluating how Pancasila influences the recognition, regulation, and implementation of customary law, while exploring historical and legal challenges and solutions. This study also examines how regulations governing customary law should be adjusted to continue to respect customary norms while remaining consistent with national law and human rights. Through comprehensive analysis and strategic recommendations, this study aims to contribute to strengthening the integration of customary law into the Indonesian national legal system, strengthening the implementation of the principles of Pancasila, and promoting justice and harmony within the framework of a unitary state. This study aims to ensure that customary law is not only respected but also implemented effectively in supporting the basic values ​​of the state and the interests of indigenous peoples throughout Indonesia.

Abstract

The relationship between citizenship, human rights, national law, and Islamic law. Citizenship provides a formal basis for individuals in a state, while human rights are fundamental rights guaranteed by the constitution and international instruments. Islamic law also emphasizes the protection of human rights based on the principles of justice and dignity. This study compares how national law and Islamic law regulate citizenship and human rights, and seeks how both can complement each other in strengthening the protection of individual rights in Indonesia. With a normative and comparative legal approach, it is hoped that this study can contribute to creating an inclusive, just, and humanist legal system that respects diversity and moral values, and is able to handle contemporary issues such as the protection of minority groups and women's rights.

Abstract

This research aims to explore the influence of Pancasila in Islamic criminal law reform, focusing on efforts to combat terrorism. Using a qualitative approach, this research collects and analyzes various literature sources and relevant legal documents. In addition, document analysis was conducted to evaluate existing policies and practices, as well as challenges in the application of Pancasila principles. The results show that the integration of Pancasila can strengthen Islamic criminal law by ensuring a more just and humane application in dealing with terrorism. However, there are challenges in the reform process, including differences between sharia and Pancasila principles and implementation issues. This research recommends in-depth reforms, development of oversight mechanisms, and increased dialogue between relevant parties to create a more effective legal system that is in line with Pancasila values. The findings provide important insights for Islamic criminal law reform that is more harmonious and responsive to the threat of terrorism. The research method used is normative legal research with statutory, conceptual case, historical and comparative approaches.

Abstract

This research discusses the integration of Pancasila values in the Indonesian constitutional legal system and its implications for the protection of customary law. Pancasila as the basis of the state and the source of all sources of law in Indonesia plays an important role in shaping applicable legal norms. In the context of customary law, the values of Pancasila must be reflected in legislation and policies governing indigenous peoples. This article highlights the importance of a comprehensive understanding of Pancasila values to ensure indigenous peoples’ rights are protected in a fair and sustainable manner. This research uses a normative juridical approach by analyzing relevant laws and regulations, literature studies, and legal documents. The results of the study show that although there has been formal recognition of customary law in the constitution and various laws, its implementation still faces challenges, especially related to conflicts of interest between the interests of the state, the market, and indigenous peoples. This article concludes that the integration of Pancasila values in the constitutional legal system should be strengthened through more inclusive and equitable policies, as well as more effective legal protection mechanisms for indigenous peoples.

Abstract

This study explores the regulation of citizenship under Article 26 of the 1945 Constitution of Indonesia and its implications in the context of globalization. Article 26 defines who qualifies as an Indonesian citizen and provides a legal basis for more detailed citizenship regulations. In light of increased global mobility and complex international relations, new challenges have emerged that necessitate a reassessment of citizenship policies, particularly regarding dual citizenship. A normative juridical methodology is utilized in this research to explore the concept of citizenship from a constitutional viewpoint and compares Indonesia’s policies with those of other countries that recognize dual citizenship. The study finds that Indonesia’s current citizenship regulations need to be updated to be more adaptable and inclusive in addressing global changes. It is suggested that the Indonesian government consider revising its citizenship laws to better safeguard the rights of Indonesian citizens abroad and enhance connections with the diaspora.

Abstract

In the laws of war, citizenship plays an important role in determining the type of protection provided to a person during an armed conflict. Drawing on the principles of international humanitarian law and the latest practices, this article investigates how citizenship status affects the protection of civilians and refugees in conflict zones. The study focuses on the problems faced by people who have lost their citizenship status or are in situations of legal uncertainty during conflict. In addition, the study assesses how effective international conventions such as the Additional Protocol and the Geneva Convention are in protecting civil and refugee rights. This article provides insight into how citizenship affects access by analyzing recent case data, countries' policies, and expert perspectives.This article provides insight into how citizenship affects access to protection and basic rights in conflict zones. The findings aim to offer policy recommendations to improve protection for individuals affected by future armed conflicts.
