Abstract

This study attempts to examine the Legal Protection for Doctors in Providing Health Services at the Bener Meriah Regency Health Center. A doctor in carrying out his profession will very likely get a situation that leads to the realm of law, it can be due to the final result of a treatment process carried out by the doctor which if the patient who is being treated dies or is disabled, it could get a response from the patient's family that this is malpractice. The problems written in this study are: How is the inpatient health service system at the Bener Meriah Regency Health Center, what are the factors of inpatient health services that can bring doctors at the Bener Meriah Regency Health Center into the realm of law, How is the legal protection for doctors in providing inpatient health services at the Bener Meriah Regency Health Center. This research is a qualitative research that is descriptive in nature with an empirical legal approach whose data consists of primary data and secondary data, then primary data is taken through interviews and secondary data sourced from legal materials based on concepts, theories, laws and regulations. The research shows that the inpatient health service system at the health center that was the object of the research has carried out and provided maximum and quality health services for the local community, and has carried out its duties in accordance with the applicable SOP, while the factors that can bring doctors into the legal realm are referral factors, availability of equipment and drugs, and visas requested by members of the community, legal protection is given to doctors who treat patients at the health center in Bener Meriah Regency after being assessed as having carried out their duties properly.

Abstract

Protected Forest Areas are forests or large areas of land that contain a collection of types of flora and fauna that form naturally or not. Forest areas designated as protected forest areas have a role as providers of clean water reserves, flood prevention, erosion protection, city lungs, and many more. The problems in this research are: How is the Legal Regulation of the Policy on Acquisition of Land Rights Objects of Agrarian Reform in the Perspective of Settlement of Land Tenure in Forest Areas, How is the Implementation of the Policy of Acquisition of Land Rights Objects of Agrarian Reform in the Perspective of Settlement of Land Tenure in Forest Areas, and What are the Factors? Constraints/Obstacles and Solutions to Policy Acquisition of Land Rights Objects of Agrarian Reform in the Perspective of Settlement of Land Tenure in Forest Areas. This research aims to determine the Legal Regulations for Acquisition of Land Rights for Objects of Agrarian Reform in the Perspective of Settlement of Land Tenure in Forest Areas. To find out how the policy for acquiring land rights over objects of agrarian reform is implemented in the perspective of resolving land tenure in forest areas, to find out the obstacles/obstacles and solutions to the policy of acquiring land rights over objects of agrarian reform in the perspective of resolving land tenure in forest areas. This research uses a descriptive method using a normative approach (Legal research) to obtain primary data through field research (research). The results of the research show that the Policy for Acquisition of Land Rights for Agrarian Reform Objects in the Perspective of Settlement of Land Tenure in Forest Areas (Research Study at the Karimun Regency Land Office) has basically been implemented well although there are still many obstacles in the field, especially the lack of professional and dedicated human resources high For this reason, it is hoped that the work mechanism of the Environment and Forestry Service of Riau Islands Province will be optimized so that obstacles related to the control of land rights in forest areas can be resolved.

Abstract

With the rapid technological developments that are occurring today, it has greatly influenced the technology of the cosmetics industry in making cosmetic products easily, which has led to the proliferation of producers trading in cosmetics without distribution permits and of course this violates consumer rights as regulated by Article 4 and Article 5 of the Law. Law Number 8 of 1999 concerning Consumer Protection and Regulation of the Food and Drug Supervisory Agency Number 17 of 2023 concerning Guidelines for Cosmetic Product Information Documents. The Head of BPOM reiterated that the use of cosmetics without a distribution permit and/or containing prohibited ingredients in cosmetics in accordance with the technical requirements for cosmetic ingredients is very risky for health. Health risks that have the potential to occur due to the use of cosmetics containing prohibited ingredients in cosmetics.

Abstract

The purpose of researchers using this type of descriptive research with a qualitative approach, so that researchers can collect information that is in accordance with reality and can answer all formulations that focus on Implementation and Supporting and Inhibiting Factors for Regional Management Information System (SIMDA) Utilization Policy in Financial Reporting of the Biak Numfor Regency Government. The primary data obtained comes from SIMDA Structural Officers and Operators at the Regional Equipment Organization (OPD) of the Regional Financial and Asset Management Agency (BPKAD) of Biak Numfor Regency and Secondary comes from financial statement data for the last 4 years. Data collection techniques are carried out by means of interviews, observations and documentation studies using data analysis, data presentation, data condensation, data presentation so as to draw a conclusion. The results showed that the implementation of the SIMDA Finance policy in BPKAD Biak Num Regency went well. However, there are still inhibiting factors such as limited competent officers/operators, limited budget/funds, and human error in inputting data.

Abstract

This study examines state legal responsibility in addressing corporate- driven climate violations in developing countries, focusing on the gap between normative commitments and actual enforcement. The central question is how state liability should be constructed to effectively regulate corporations that contribute significantly to greenhouse gas emissions and environmental degradation. Using a juridical normative and comparative approach, the analysis covers Indonesia, Brazil, and South Africa to identify similarities, differences, and weaknesses in integrating international principles into domestic legal systems. The findings reveal that while national laws recognize the duty to protect the environment and uphold human rights, enforcement remains fragmented, symbolic, and subordinated to short-term economic interests. This creates a structural accountability gap that facilitates corporate impunity, compounded by power imbalances, inadequate institutional capacity, and the absence of robust extraterritorial enforcement mechanisms. The novelty of this research lies in an integrated framework combining state responsibility, corporate accountability, and climate justice, emphasizing extraterritorial obligations and independent national climate adjudication mechanisms. This model operationalizes climate justice as a binding legal standard, harmonizes domestic laws with international obligations, and improves access to justice for affected communities. The tangible output of this study is a normative–comparative regulatory model and policy recommendations for legislators, environmental law practitioners, and international organizations to reform legal frameworks for corporate climate accountability in developing countries. By bridging the gap between norms and practice, the framework offers both conceptual contributions and practical guidance for legal reform, ultimately promoting sustainable development grounded in ecological protection and intergenerational equity.

Abstract

Abstrak Peran ahli dalam perkara perdata di Indonesia memiliki posisi strategis sebagai pihak yang membantu hakim menemukan kebenaran materiil. Kehadiran ahli diatur dalam Pasal 154 HIR dan Pasal 180 RBg serta berbagai peraturan terkait lainnya. Penelitian ini menggunakan metode yuridis-normatif untuk menganalisis kedudukan hukum, fungsi, serta batasan kewenangan ahli dalam praktik peradilan perdata. Hasil penelitian menunjukkan bahwa ahli memberikan kontribusi signifikan dalam menjelaskan persoalan teknis yang tidak dikuasai hakim, meskipun keterangannya bukan merupakan alat bukti yang berdiri sendiri. Oleh karena itu, diperlukan penguatan regulasi terkait standar profesionalisme saksi ahli untuk mencegah penyalahgunaan perannya dalam proses peradilan.

Abstract

Indonesia has experienced significant growth in foreign direct investment (FDI) inflows, reaching USD 47.5 billion in 2023 and exceeding the target of IDR 1,714 trillion in 2024. However, strict foreign worker regulations potentially affect the investment decisions of multinational companies. This research aims to analyze the impact of foreign worker restrictions on FDI realization in Indonesia with a case study in North Sumatra Province. The research method uses a qualitative approach with regulatory analysis and secondary data. The results show that although foreign worker restrictions through Government Regulation Number 34 of 2021 and Minister of Manpower Regulation Number 8 of 2021 aim to protect local workers and encourage technology transfer, these policies create trade-offs against Indonesia's investment attractiveness. Requirements such as mandatory local counterparts, Foreign Worker Utilization Compensation Fund (DKPTKA), and position restrictions create additional costs for investors. The Omnibus Law on Job Creation has simplified licensing procedures, but implementation challenges remain, particularly in regions like North Sumatra. The research recommends a balance between local workforce protection and investment facilitation through more flexible sector-based regulatory reforms.

Abstract

Pengabdian kepada masyarakat ini bertujuan untuk memperkenalkan dan meningkatkan pemahaman siswa mengenai olahraga kabaddi melalui kegiatan sosialisasi di SMA Negeri 16 Makassar. Kabaddi merupakan salah satu cabang olahraga tradisional yang berkembang menjadi olahraga kompetitif internasional, namun masih kurang dikenal di lingkungan sekolah, khususnya di Kota Makassar. Kegiatan pengabdian ini dilaksanakan melalui dua tahapan utama, yaitu pemaparan materi dan praktik lapangan. Pada tahap pemaparan materi, peserta diberikan penjelasan mengenai sejarah kabaddi, pengertian dan karakteristik olahraga kabaddi, teknik dasar permainan, serta peraturan pertandingan. Setelah sesi teori, kegiatan dilanjutkan dengan praktik lapangan untuk memberikan pengalaman langsung mengenai cara bermain kabaddi, termasuk latihan teknik menyerang (raider) dan bertahan (defender), strategi permainan, serta simulasi pertandingan. Metode demonstrasi, latihan terstruktur, dan bimbingan langsung digunakan untuk memastikan siswa memahami dan mampu mempraktikkan permainan dengan baik. Hasil kegiatan menunjukkan bahwa 90% siswa dan siswi yang mengikuti program ini telah mampu bermain dan memahami aturan dasar olahraga kabaddi. Hal ini membuktikan bahwa sosialisasi dan pelatihan langsung efektif meningkatkan pengetahuan dan keterampilan siswa terhadap olahraga kabaddi. Kegiatan ini diharapkan dapat menjadi langkah awal dalam pengembangan minat olahraga kabaddi di sekolah serta mendorong kegiatan olahraga alternatif yang edukatif dan menyenangkan.
