Abstract

Prostitution is a despicable act because it violates the norms that live and develop in society,especially moral norms. One of the crimes that is a concern in today's society is prostitution in thecyber world (cyber prostitution). Along with the increasingly widespread use of the internet inIndonesia, cyber prostitution activities are also developing. The perpetrators and pimps began touse social networking sites such as MiChat to carry out their actions. MiChat which wasoriginally used for friendship, is now used to market sex transactions. Cyber prostitution cases inIndonesia currently require a criminal law policy in an ef ort to overcome this. The regulationsgoverning this problem are the Law on Information and Electronic Transactions, the Law onPornography and the Criminal Code. This research is a descriptive normative legal research witha statutory approach, namely examining the laws and regulations related to the legal issues raisedand with an analytical approach. The results of this study indicate non-penal countermeasures,government institutions have carried out supervision or monitoring of applications that are oftenused as media for cyber prostitution. Meanwhile, legally, the Criminal Code and the ITE Law donot clearly regulate the definition of online prostitution.

Abstract

The use of Youtube social media is often misused for purposes that violate the law or unwittingly thecontent uploaded contains criminal acts. One of these cases is Decision Number1327/Pid.Sus/2019/Pn Jkt.Sel or more virally known as the "salted fish" case in which the contentcontains content that violates decency and insults/defamation. The research problem emphasizes moreon how to apply evidence against criminal acts of humiliation through Youtube social media in thecase of decision Number 1327/Pid.Sus/2019/Pn Jkt.Sel? The method used is normative juridical withdeductive data analysis techniques. The application of evidence to prove the criminal act charged withremains refers to Article 184 of the Criminal Procedure Code regarding evidence, namely witnessstatements, expert statements, letters, instructions and statements of the defendant. In this case, theevidence submitted is the testimony of witnesses including victim/reporting witnesses, statements ofexperts, namely ITE experts and criminal law experts, as well as statements of the defendants. Forelectronic evidence and print outs. The indictment of Article 27 paragraph (1) the prosecutor wasunable to prove the existence of a moral violation charge so that the judge chose the primaryalternative indictment Article 27 paragraph (3) was proven as a criminal act of defamation and eachperpetrator was qualified as "a person who participated in committing" (mede pleger). Thegovernment and the legislature need to revise the ITE Law because there are many articles withmultiple interpretations that allow for wild interpretations to obscure the true meaning.

Abstract

Along with the development of technology, crime has also evolved. Crime, which used to happen inconventional ways, is now expanding through cyberspace. Crime that happened in cyberspace alsoknown as cybercrime. Sexual harassment in social media or cyber harassment was a cybercrime thatwas often occured nowadays. In Indonesia, there are several applicable laws to countering the sexualharassment in social media, which are Indonesian Criminal Code (KUHP) and Law of ElectronicInformation and Transactions (UU ITE). Unfortunately, those applicable laws still have hugeweaknesses. Law of Sexual Violence Crimes (UU TPKS) comes as a specific law that against sexualviolence. Basically, Law of Sexual Violence Crimes (UU TPKS) can be used to deal sexual harrasmentin social media. But, this applicable law still has some weaknesses thus may obstructed thecountermeasures of sexual harassment in social media. The main issue of this paper is how policyformulation in tackling sexual harassment in social media viewed from Law Number 12 of 2022 aboutSexual Violence Crimes (UU TPKS)? The ef ort to counter sexual harassment in social media shouldbe formulated by observing the characteristic of those crime as a cybercrime. Sexual harassment insocial media should be formulated clearly, and the definition of sexual harassment in social media alsoought to be in the body of the Sexual Violence Crimes Law (UU TPKS). It aims to maximize thecountermeasures and prevention of sexual harassment in social media.

Abstract

Abstract

The disparity in sentencing is something that naturally occurs in a decision. The generalunderstanding of disparity is that there is a wide range of dif erences in the sentencing of criminals incases of the same type or level of seriousness. Disparity is divided into two, namely disparity that canbe accounted for and also disparity that cannot be accounted for. There is no concrete definitionregarding the meaning of the disparity. To find and find out whether there are disparities in a decision,numerical punishment guidelines are needed using a consistency of outcomes approach. In thesentencing guidelines there are variables that have dif erent weights and will then be included in thesentencing table so that this is very helpful for judges in imposing criminal penalties. In writing thisthesis, the researcher uses 2 (two) decisions which are considered to have sentencing disparities. Theresearcher uses the decision No.Pid.Sus/2019/PN.Smn and the decision No.445/Pid.Sus/2020/PN.Pal.in the decision of the Sleman District Court, the defendant was sentenced to prison for 4 (four) months.Meanwhile, in the Palu District Court's decision, the defendant was sentenced to 2 years and 3 monthsin prison. It is clear that there is a disparity, but it cannot be judged whether this is a disparity that canbe accounted for or not. The 2 (two) decisions are also reviewed with the ITE Law and the CriminalCode.

Abstract

From a criminal law perspective, terrorism is a unique crime. The essence of terrorist acts isfunding and applies to all terrorist acts. Law Number 9 of 2013 concerning the Prevention andEradication of the Crime of Financing Terrorism regulates the crime of financing terrorism. Theevil conspiracy regulated in Article 5 of the Terrorism Financing Law is one of the conditions thatmust be fulfilled by criminals. In this study, the defendants in the decision of the East JakartaDistrict Court No. 398/Pid/Sus/2018/PN.Jkt.Tim were used as the object of research to assess howthe crime of financing terrorism to finance terrorism was applied and to assess the factorsconsidered by the judge. in applying the criteria for conspiracy in the financing of criminal acts ofterrorism. Through an inventory of sources from books and laws and regulations, this research wasconducted using a normative juridical approach. The defendant was charged with Article 4 jo.Article 5 of Law Number 9 of 2013 concerning Prevention and Eradication of Terrorism FinancingCrimes and Article 15 jo. Article 7 of Law Number 15 of 2003 concerning Criminal Acts ofTerrorism and sentenced to 4 years in prison. The activities of the accused, who have been provento be part of a conspiracy to finance terrorism, can be identified according to the qualifications ofthe articles charged by the public prosecutor. The decision was considered inappropriate inapplying the crime of conspiracy as in the judge's decision.

Abstract

Criminal procedural law regulates the proceedings with all existing authorities in accordance with written procedures, this is in accordance with lex scripta which means that everything carried out in the investigation and investigation process must be in accordance with the Regulation of the Head of the Indonesian National Police Number 6 of 2019 in article t. -10 regarding the process of investigating criminal acts. This raises in the discussion of this research case, which has a problem regarding how the validity of the act of reducing the status of the investigation case to an investigation by the Bangka Belitung Police against Police Report Number: LP 3388/VII/2016/PMJ/DITRESKRIMSUS? This study uses a deductive research method that relies on theories as a research tool in presenting the results of the analysis in the form of a qualitative descriptive objective assessment in order to answer the problems in the research. The results of the study indicate that the act of delegating is legally valid based on Presidential Regulation Number 52 of 2010 concerning Organizational Structure and State Work Procedures of the Republic of Indonesia accompanied by opinions and quotes collected from experts in criminal procedural law, it can be said that Polda Metro Jaya and Polda Bangka Belitung have equal authority and rights to carry out an investigation/investigation of a criminal case, so the views and decisions of each investigation must be carried out.

Abstract

Basically Justice Collaborator is a term in the criminal justice process in Indonesia which is a convict who cooperates with law enforcement to uncover a certain crime. One of the rarities that can be used in implementing effectiveness to eradicate organized crime networks is to use assistance from perpetrators who are insiders, and are directly involved in crimes that have been committed together with other perpetrators, especially narcotics criminals. With the presence of the Justice Collaborator, it is very important to uncover a narcotics crime case in Indonesia. This research is normative research. The research specifications used are prescriptive. The result of this study is that there is no application of reducing the prison term to the defendant Farida als Ida bint Abdul Rojak who has the status of a Justice Collaborator which is a reduction in the detention period is one of the rights that the defendant should be able to obtain. It was concluded that the application of the Justice Collaborator setting to the North Jakarta District Court Decision Number 770/Pid.Sus/2020/PN Jkt.Utr in the decision the application of the Justice Collaborator was not in accordance with the Justice Collaborator setting that had been stipulated in the United Nations Convention Against Corruption (UNCAC). ) 2003 which has been ratified by Indonesia with Law no. 7 of 2006, Article 37 paragraph (2), SEMA No. 4 of 2011 point 9 letter c, because the defendant has been applied as a Justice Collaborator but there is no reduction in detention time.

Abstract

Praktik kodifikasi hukum ditemukan dalam berbagai lapangan bidang hukum, utamanya bidang hukum pidana. Bidang hukum pidana yang biasanya dirumuskan dalam sebuah kodifikasi adalah hukum pidana materiil dan formil, walaupun dalam berbagai negara dapat pula ditemukan kodifikasi hukum pelaksanaan pidana. Dengan demikian, kodifikasi menjadi sesuatu yang tidak bisa dipisahkan dari hukum pidana. Tulisan ini berupaya mengidentifikasi aspek manfaat kodifikasi hukum pidana. Hasil kajian menunjukkan bahwa tujuan kodifikasi bukanlah untuk mengumpulkan peraturan; sebaliknya, tujuan kodifikasi adalah untuk meningkatkan kualitas hidup masyarakat melalui penerapan hukum pidana yang sistematis dan inovatif. Ragam manfaat yang diwujudkan melalui kodifikasi antara lain kodifikasi membuat hukum pidana lebih jelas, lebih mudah diakses oleh pencari keadilan, lebih konsisten dan koheren.
