Abstract

One of the goals of the state is to provide welfare for the people through the administration of a state that is free from corruption, collusion and nepotism. Corruption is a crime with a crime rate classified as serious crime because this action is detrimental to the state, corruption itself is an activity where the perpetrator takes state funds for personal gain. To run a government that is clean from KKN at the village government level, it is necessary to pay attention to Law no. 28 of 1999 concerning the Implementation of a Clean and Free State from Corruption, Collusion and Nepotism and also Law no. 6 of 2014 concerning Village Government. The village government as the part that is most closely related to the community, the village government has an important role in aspects of national development in order to create a prosperous, just and prosperous society in accordance with the constitution of the Republic of Indonesia. Regarding the concept of clean government in Garanta Village, Kec. Ujungloe Kab. Bulukumba, the village government in this case as the village head of Garanta explained that the concept of clean government is to prioritize the principles of transparency and accountability in order to inform the public of the activities and developments that are planned. To encourage good government implementation, the village government also seeks to develop its village community to be more advanced and increase human resources in the Garanta village. The intended guidance is community development in the health sector and in other fields there is also youth development. Regarding the Garanta Village development plan that has been discussed with the village community, namely by building in each hamlet a Qur'an Education Park, building a Tugu or Village Triangle Park, as well as improving drainage and irrigation. The researcher was involved in assisting the process of implementing the selection of new village officials, taking into account the entire selection process. It can be concluded that the entire flow of government in Garanta Village has been free from Corruption, Collusion and Nepotism, this is based on the government that prioritizes transparency in carrying out all activities and development, as well as involving the community to actively participate in overseeing village government activities. Seen from the perspective of Siyasah Syar'iyyah, the government of Garanta Village has carried out the mandate well which refers to the Qur'an and Hadis.

Abstract

Pariwisata merupakan salah satu sektor andalan perekonomian nasional, penelitian ini dimaksudkan untuk mengkaji pengelolaan Wisata Taman Hutan Raya Abd. Latief Kabupaten Sinjai dari perspektif hukum Islam, dengan permasalahan yaitu, bagaimana peran pemerintah Kabupaten Sinjai, faktor penghambat dan bagaimana pandangan hukum Islam terhadap pengelolaan Wisata Taman Hutan Raya Abd. Latief. Penelitian ini merupakan penelitian lapangan dengan pendekatan penelitian yuridis normatif, pendekatan sosiologis dan pendekatan syar’i. Hasil penelitian menyimpulkan bahwa secara regulatif Pemerintah Kabupaten Sinjai telah memperlihatkan komitmennya dalam pengelolaan pariwisata dengan menerbtikan Peraturan Daerah Nomor 6 Tahun 2013 tentang Penyelenggaraan Usaha Kepariwisataan. Konkretisasi peran Pemerintah Kabupaten Sinjai dalam mengelola Wisata Taman Hutan Raya Abd. Latief dimulai dari perencanaan yang sudah mempertimbangkan aksesibilitas, tingkat interaksi sosial, keterkaitan atau kompatibilitas dengan sektor lain, daya tahan akan dampak pariwisata, tingkat resistensi komunitas lokal, serta keseimbangan antara kebutuhan wisata dengan kelestarian lingkungan. Adapaun faktor yang menghambat diantaranya ketersediaan anggaran, dan kesadaran serta daya saing masyarakat. Pengelolaan Wisata Taman Hutan Raya Abd. Latief telah sejalan dengan prinsip-prinsip syariat Islam, seperti prinsip menata, memanfaatkan, merawat, dan melestarikan sumber daya alam yang telah diciptakan oleh Allah dengan mempertimbangkan segala aspek, baik untuk alam (lingkungan) maupun untuk masyarakat setempat.Kata Kunci: Hukum Islam; Taman Hutan Raya Abd. Abstract

This study aims to examine the legal protection of unilateral termination of employment during the Covid-19 pandemic from the perspective of Siyasah Dusturiah. The method used is literature research with a juridical and normative approach to syar'i. The results showed that one of the reasons for employers in terminating their employment was a decrease in turnover during the implementation of Large-Scale Social Restrictions (PSBB) as a government policy to minimize the spread of Covid-19. But regulatively, unilateral termination of employment is not allowed, and if under certain circumstances and forced to do so, then the employer must still fulfill the rights of workers in accordance with labor legislation. In the perspective of Siyasah Dusturiyah, the policy is one way to avoid greater mafsadat (ugliness), but this condition cannot be used as legitimacy for employers to unilaterally terminate employment, without going through negotiations to ensure that workers' rights remain protected and fulfilled.

Abstract

The pension fund program is one of the efforts to improve the welfare of Civil Servants who have entered retirement for their service and dedication to the country. This study aims to analyze how the welfare of old age for Civil Servants in Jayapura City Islamic Law Perspective. The type of research used is qualitative research (field research) with juridical and normative syar'i approaches, data sources in the form of primary and secondary data obtained through observation, interviews, documentation and literature studies. The results showed that Civil Servants who have entered retirement will receive pension funds through two main programs, namely the Tabungan Hari Tua program and dana pensiun managed by PT. Taspen Jayapura City Branch, the pension scheme aims to provide income continuity, especially to meet daily needs in old age. Security of the necessities of life is an aspect of concern in Islam, even one of the principles of maqashid al-shari'ah is the obligation to maintain property (economic ability) in addition to the obligation to maintain religion, soul, reason, and offspring.

Abstract

The purpose of this study was to determine the handling and legal protection by the regional government of Bulukumba district for people with mental disorders (ODGJ). The results of this study are that the treatment carried out by the regional government of Bulukumba Regency for people with mental disorders (ODGJ) has gone well, namely doing homecare, checking identity and car facilities for treatment. The legal protection provided by the regional government of Bulukumba Regency does not yet have specific rules regarding people with mental disorders (ODGJ), but it is included in Regional Regulation No. 2 of 2018 concerning protection and services for persons with disabilities. In the siyasah syar'iyyah perspective, the regional government of Bulukumba district has carried out its responsibilities based on Q.S an-Nisa/4:58 and 59, also based on several hadiths, such as providing social rehabilitation facilities and infrastructure for people with mental disorders.

Abstract

Prior to independence, the people of Herlang sub-district still used a monarchical system of government which required the people under the protection of the kingdom to submit and obey the rules and traditions in force, but after independence we can still find this in the Herlang indigenous people. This study aims to find out the role, position and views of siyasah syariyyah regarding the Langnge-langnge customary institution in Herlang sub-district, Bulukumba district. The type of research used is qualitative research with a juridical approach. The results of the study show that the Langnge-langnge customary institution in Herlang sub-district plays an important role in assisting the government in administering governance in Herlang sub-district such as resolving conflicts between communities and as a place for mediation for indigenous peoples. The position of the Langnge-langnge customary institution in the Herlang sub-district government is as a government partner to regulate, manage and resolve various life problems related to customs and applicable customary laws. By using the maslahat approach, siyasah syar'iyyah emphasizes the extent to which these institutions can benefit society. As long as the Regional Customary Institution can benefit the Herlang sub-district, its existence does not conflict with the principles of Islamic governance

Abstract

Penelitian ini dilatarbelakangi oleh kehidupan umat manusia yang tidak dapat dipisahkan dengan aktivitas konsumsi, dan sebagai umat Islam aktivitas konsumsi harus sesuai dengan syariat Islam, disatu sisi Indonesia berkomitmen untuk mewujudkan Sustainable Development Goals (SDGs), termasuk dalam kegiatan konsumsi sehingga perlu adanya suatu konsep konsumsi berkelanjutan dalam ekonomi Islam yang didasarkan pada Q.S Al-Qasas/28:77. Metode penelitian yang digunakan penelitian kualitatif dengan jenis penelitian library research, dengan menggunakan pendekatan deskriptif. Tujuan dari penelitian ini adalah memberikan gambaran mengenai bagaimana pembentukan perilaku konsumsi berkelanjutan yang berdasarkan atas kajian Q.S Al-Qasas/28:77. Hasil penelitian menunjukkan bahwa berdasarkan Q.S Al-Qasas/28:77, memberikan pandangan mengenai pola konsumsi dalam islam dan mendukung konsep konsumsi yang berkelanjutan atau Sustainable Development Goals (SDGs), karena ayat di atas menekankan bahwa dalam melaksankana konsumsi kita harus memiliki orientasi terhadap dunia dan akhirat. Serta dalam ayat ini juga menjelaskan bahwa dalam melakukan konsumsi atau mengambil kebermanfaatan dari sumber daya, maka manusia wajib mengelolanya dengan baik sebagai wujud rasa syukur dan tanggungjawabnya kepada Allah swt.

Abstract

This study aims to analyze the existence of interpretation from the point of view of its methodology and objectives. This research uses a type of qualitative research with a literature approach that relies on the use of data sources in the form of reputable books and articles to carry out critical analysis by means of content analysis which is the focus of discussion. The steps for analyzing documents in the form of literature start from reconstructing concepts, describing objects, and looking for goals related to interpretation. The results of the study show that the existence of interpretation from the point of view of the object and purpose of tafsir research has made it easier for mufassir and tafsir researchers to understand and interpret the verses of the Qur'an, to ensure that there will be no misunderstandings in interpreting and interpreting these verses; so that in the future the people will be guided properly and correctly in practicing the teachings of Islam, especially in understanding and implementing the verses which he made as divine instructions in the reality of life for both worldly and ukhrawi purposes

Abstract

Debt is a transaction in which two people voluntarily give money to another person and then return it to them in the same way. This study aims to determine how Ibnu Katsir views the concept of accounts payable and receivable from an Islamic economic perspective. Although we know that debts and receivables are permitted, Islam advises its followers to avoid debts as much as possible, regardless of whether they can afford to buy something with cash or not when they are in limited economic conditions. Because debt is always a heavy burden and threatens morality. Rasulullah saw. once refused to pray for the body of someone who owed a lot of debt to his family and did not have the means to pay it. As explained in the Koran, recording or writing is the first step in debt and receivable transactions. This research uses library research methods with an interpretive science approach using the tahlili method. The results of this research show that people who owe money are obliged to tell the clerk about the debt they admit because they are worried that there will be fraud against those who owe it. If it is a buying and selling transaction, it is permissible not to record or write down the transaction. Furthermore, there is a need for fair witnesses. In terms of testimony, Ibnu Katsir stated that being a witness is fardlu kifayah or not mandatory for the person concerned unless there is another person who can replace his position

Abstract

Penelitian ini membahas tentang konsep perilaku produsen dalam ekonomi islam berdasarkan tinjauan Q.S Al – Maidah ayat 87. Studi ini didasarkan pada apa yang telah ditulis dan menggunakan sumber informasi sekunder. Metode deskriptif kualitatif dan pendekatan interpretasi maudhu'i (tematik) digunakan untuk mendeskripsikan dan mengkaji data. Metode dokumentasi digunakan untuk mengumpulkan data kajian, dan analisis isi digunakan untuk mengetahui apa maksud dari data tersebut. Data yang terkumpul disatukan dan dianalisis untuk menarik kesimpulan. Hasil penelitian menunjukkan bahwa produsen dalam ekonomi Islam bertindak dengan cara yang memenuhi standar kejujuran dan moralitas tertinggi. Hal ini karena dalam ekonomi Islam, manusia bekerja tidak hanya untuk menjadikan dunia ini lebih baik dan sejahtera, tetapi juga untuk mendatangkan kebahagiaan di kehidupan selanjutnya. Alasan mengapa para pendiri Islam melakukan apa yang mereka lakukan harus selalu melakukan hal yang sama dan hasil yang mereka inginkan. Jika tujuan produksi adalah untuk memenuhi kebutuhan fisik dan mental agar maslahah dapat dibuat, maka tujuan pembuat adalah membuat maslahah.
