Abstract

Abstract This research originated from an inheritance dispute between the Panjaitan Family and the Siahaan Family in Lintong Nihuta Village, which was resolved through mediation conducted by the Dalihan Na Tolu Customary Institution based on Batak Toba customary law. The problem arises because the mediation results of the Dalihan Na Tolu Customary Institution possess strong social legitimacy but have not yet fully obtained legal certainty within the national legal system. This study aims to analyze the role of the Dalihan Na Tolu Customary Institution in resolving inheritance disputes and the legal strength of its mediation outcomes according to customary law and national law. The research method employed is empirical normative legal research with a qualitative approach through literature study, observation, interviews, and documentation. The findings indicate that mediation conducted by the Dalihan Na Tolu Customary Institution encourages deliberation to achieve fair agreements while maintaining harmony among the disputing parties. However, the mediation results are still categorized as privately executed documents, thereby requiring legal reinforcement through a deed of settlement or administrative legalization. Therefore, harmonization between customary law and national law is necessary to strengthen the legal certainty of mediation outcomes produced by the Dalihan Na Tolu Customary Institution. Keywords:  Dalihan Na Tolu Customary Institution, Mediation, Inheritance Dispute.   Abstrak Penelitian ini berangkat dari permasalahan sengketa waris antara Keluarga Panjaitan dan Keluarga Siahaan di Desa Lintong Nihuta yang diselesaikan melalui mediasi oleh Lembaga Adat Dalihan Na Tolu berdasarkan hukum adat Batak Toba. Permasalahan muncul karena hasil mediasi lembaga adat Dalihan Na Tolu memiliki legitimasi sosial yang kuat, tetapi belum sepenuhnya memiliki kepastian hukum dalam sistem hukum nasional. Penelitian ini memiliki tujuan dalam menganalisis peran Lembaga Adat Dalihan Na Tolu dalam penyelesaian sengketa waris serta kekuatan hasil mediasinya menurut hukum adat dan hukum nasional. Metode penelitian yang digunakan adalah penelitian hukum normatif empiris dengan pendekatan kualitatif melalui studi kepustakaan, observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa mediasi lembaga adat Dalihan Na Tolu mendorong penguatan musyawarah untuk mencapai hasil kesepakatan yang adil dan tetap menjaga kedamaian antar pihak yang bersengketa. Namun, hasil mediasi masih berkedudukan sebagai alat bukti di bawah tangan sehingga memerlukan penguatan hukum melalui akta perdamaian atau legalisasi administratif. Oleh karena itu, diperlukan harmonisasi antara hukum adat dan hukum nasional untuk memperkuat kepastian hukum hasil mediasi dari lembaga adat Dalihan Na Tolu. Abstract

This study aims to examine the nature of conflicts over the management of customary land in Partungko Naginjang Village, Harian Subdistrict, Samosir Regency. The study focuses on determining the status of customary land, the causes of conflicts over its management, and the factors hindering conflict resolution in Partungko Naginjang Village. The research method employed by the author in this study is a qualitative descriptive approach. This study was conducted in Partungko Naginjang Village. Two types of data sources were used: primary data, which was collected directly in the field, and secondary data, which was obtained from books, journal articles, and official documents related to the research issue. Data collection techniques included observation, in-depth interviews, and documentation. The results of the study indicate that traditional leaders play a crucial role as mediators in resolving conflicts over customary land rights through traditional deliberations grounded in the Dalihan Na Tolu principle. They do this by tracing the root causes of the problem, bringing the conflicting parties together, and formalizing the agreement in a written contract without involving the formal legal system. However, traditional leaders face a number of obstacles, including third-party interference, selfishness, and the community’s limited knowledge of the history of customary lands; a lack of coordination with village officials; limited authority in conflicts with criminal elements; and a low level of community willingness to compromise during deliberations.

Abstract

This study is motivated by the importance of political participation as an indicator of the quality of local democracy in the 2024 Medan City Regional Election. Vegetable vendors in the MMTC area, as an informal economic group, hold significant voting potential; however, the determinants of their political participation have not been extensively studied. The research problem is the factors influencing the political participation of MMTC vegetable vendors in the 2024 Regional Election. The study aims to analyze the determinants of political participation based on structural, sociological, ecological, psychosocial, and rational choice factors. The method used is qualitative descriptive. Primary data was obtained through observation and in-depth interviews with vegetable vendors as research subjects, while secondary data was sourced from relevant literature and documents. Data analysis was conducted through data reduction, data presentation, and drawing conclusions. The results of the study indicate that the political participation of MMTC vegetable vendors in the 2024 Medan City Regional Election is influenced by structural, sociological, ecological, social-psychological, and rational choice factors, where structural factors are not yet dominant due to a low level of understanding of the Regional Election system, while sociological, ecological, psychosocial, and rational choice factors are the ones that more significantly influence the vendors’ political choices.

Abstract

This study aims to describe the role of teachers in internalizing multicultural values ​​to students and teacher strategies in overcoming obstacles encountered during the learning process and school activities at SMP Negeri 1 Namorambe. The background of this study is based on the highly pluralistic conditions of Indonesian society, which have the potential to trigger cultural and value clashes if not managed through appropriate multicultural education. The research method used is descriptive qualitative with a field approach. The research subjects consisted of teachers at SMP Negeri 1 Namorambe, especially Pancasila and Citizenship Education teachers. Data were collected through participatory observation techniques, in-depth interviews, and documentation. The data analysis technique follows the Miles and Huberman model which includes three stages: data reduction, data presentation, and conclusion drawing and verification. The focus of value internalization in this study includes aspects of pluralism (mutual respect), democracy (equality of rights and obligations), and humanism (human dignity). The internalization process is reviewed through three main stages: the value transformation stage, the value transaction stage, and the transinternalization stage. The research results show that teachers at SMP Negeri 1 Namorambe have optimally internalized multicultural values ​​through learning channels, school activities, and the formation of an inclusive culture. Teachers have successfully carried out four key roles: as professional educators who ensure equality, creative learning agents based on digital media, superior human resources who are adaptive in guiding students persuasively, and real role models in acting fairly without discrimination of religion and ethnicity.
