Abstract

The legal process from the detention to the court session for the activist of KOMJI (Jihad Commando) seems to be unprofessional, not transparent and mostly engineered by the lawgivers. The topic being examined includes how to accommodate the Human Rights aspect during the process of investigation and verdict in the case of Jihad Commando. The research using doctrinal and non-doctrinal approach is focused on the primary and secondary data. This research shows that there has been a human rights abuse in the case of Jihad Commando in all stages of the case either in the process of detention and preparing the documents bearing the case (BAP) by Kopkamtib/ Laksusda (Command for the Restoration of security and public order), Police Department, Attorney, or in the examining process in court.

Abstract

Through the pure legal theory, within the thesis of normativity (without the thesis of morality) and the thesis of separation (without the thesis of reductive), Hans Kelsen proposes an object of legal science that is different from the one proposed by the philosophy schools of natural law and empirical-positivistic law. The idea transforms the legal science into a unique and distinctive science. Based on the philosophical research method, a legal norm, according to Hans Kelsen, must have two characters: the meaning of actions that want legal norm; and the relative moral norms with normative characteristics.Ontologi Ilmu Hukum: Tawaran Hans Kelsen dalam ‘Pure Theory of Law' AbstrakDi dalam pure theory of law, melalui tesis normativitas (tanpa tesis moralitas) dan tesis keterpisahan (tanpa tesis reduktif), Hans kelsen menawarkan objek ilmu hukum yang berbeda dengan madzhab filsafat hukum alam, dan madzhab filsafat hukum empiris–positivistik, sehingga ilmu hukum memiliki objek ilmu yang khas. Abstract

Tujuan: Penelitian ini bertujuan untuk mengetahui penerapan Peraturan Perundang-undangan di Indonesia dalam kasus penyandang disabilitas korban tindak pidana asusila, kemudian perlindungan hukum terhadap penyandang disabilitas korban tindak pidana asusila, serta peran Sasana Inklusi dan Gerakan Advokasi Difabel dalam proses advokasi terhadap korban difabel.Metodologi: Metode pendekatan yang digunakan adalah pendekatan non-doktrinal kualitatif. Jenis penelitian yang digunakan adalah penelitian deskriptif. Penelitian ini menggunakan sumber data primer dan data sekunder. Metode pengumpulan data yang digunakan adalah studi kepustakaan, dan wawancara.Temuan: Terdapat perbedaan penerapan Peraturan Perundang-undangan terhadap kasus penyandang disabilitas korban tindak pidana asusila (perkosaan dan pencabulan) antara korban dewasa dengan korban anak. Perlindungan hukum terhadap penyandang disabilitas korban tindak pidana asusila dilakukan melalui pemenuhan hak yang berkaitan secara langsung. Peran SIGAB dalam mendampingi korban difabel meliputi proses litigasi dan non litigasi.Kegunaan: Pemerintah perlu segera menyusun dan menerbitkan Peraturan Perundang-undangan yang berkaitan dengan Perlindungan Penyandang Dsabilitas, serta tentang Sistem Peradilan Pidana Penyandang Disabilitas.Kebaruan/Orisinalitas: Penyelenggaraan pendidikan dan pelatihan tentang “Teknis Peradilan Pidana Penyandang Disabilitas Berhadapan Dengan Hukum” bagi Penyidik, Jaksa, dan Hakim dapat menambah pemahaman dan pengetahuan para penegak hukum tersebut dalam proses pemeriksaan di setiap tingkatan terhadap penyandang disabilitas berhadapan dengan hukum.

Abstract

Purpose of the study: The benefits of the internet during a pandemic bring opportunities for cybercrimes, such as online data theft and leakage of consumers’ personal data. For this reason, the objectives of this study are 1) to determine the phenomenon of misuse of consumer’s personal data amidst COVID-after19 in Indonesia and 2) to describe strategies in preparing consumer personal data protection as the key to the success of the new normal in Indonesia. Methodology: This study used non-doctrinal research. To describe the phenomenon of misuse of consumers’ personal data amidst COVID-19 in Indonesia, the data were collected by distributing questionnaires to internet users in Indonesia and applying qualitative methods employing survey data collection techniques with stratified multi-stage random sampling technique. Results: It was found that the consumers’ personal data in Indonesia is still unprotected, so the conception adopted by the European Union and the OECD can be used as a reference for Indonesia in making a Law on Personal Data Protection.Applications of this study: To raise the people's awareness in protecting online personal data and encourage the government to educate society on cyber security through the National Cyber and Crypto Agency Novelty/ Originality of this study: This paper analyzes the protection strategy of e-commerce consumers during the new normal situation in Indonesia. The originality is that it discusses amidst Covid 19 cyber security.

Abstract

Purpose of the study :Describe the comparison of Online Prostitution Law in Indonesia and Egypt Methodology :Research methodology is qualilative approach with normative legal research. Therefore, in this study, it is preferable to secondary data collected by literature studies. Data that has been processed for further qualitative analysis Results:The results of this study found that the comparison of the two countries has similarities, namely the lack of legislation on online prostitution and the existence of a police specialty that investigates cases of prostitution in Egypt namely "Good Moral Police" while in Indonesia there is such police available. Novelty/ Originality of this study:The novelty value of this study is the comparison of the law with the specificity of the police who are in the case of prostitution in Egypt.

Abstract

Purpose: This study aims to determine the criminal law policy on sexual exploitation in Indonesia and discover the current legal policy from the perspective of victimology.Methodology: This study is based on doctrinal legal research or normative juridical procedures with a legal perspective in the traditional sense of “law in the book”. Normative legal research is essentially a legal research library in which the author studies the legal principles beginning with specific sectors of the legal system and the identification of legislatively enacted legal norms.Results: The findings revealed that the criminal law policy on sexual exploitation in Indonesia and the current legal policy from a victimology view, comprising the legal protection from Law Number 21 of 2007 concerning the Crime of Trafficking in Persons, Law Number 23 of 2002 concerning Protection Children, and Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, have attempted to fulfill the rights of victims, although a detailed explanation of legal protection efforts has been more based on the child protection law. Moreover, according to victimology, focusing on victims, criminal law policies addressing incidents of human trafficking or, more specifically, commercial sexual exploitation of children have prioritized victims’ interests.Benefits: This study was designed to serve as a reference for the government and parties concerned with Indonesia’s criminal law policy on sexual exploitation and its current legal policy from a victimology viewpoint. It is intended to result in law enforcement being more equitable and capable of combating sexual exploitation in the digital age.Novelty/Originality: Regarding responsibility for certain sorts of child sexual exploitation, the child protection legislation is more onerous than the trafficking statute in terms of penalties and threats. The two laws have endeavored to uphold victims’ rights in legal protection. However, the child protection statute includes a more extensive description of the legal protection measures. According to victimology, focusing on victims, criminal law policies addressing incidents of human trafficking or, more specifically, commercial sexual exploitation of children have emphasized victims’ interests

Abstract

Based on research that aims to describe and mengekspla-nasikan patterns political intervention in the judicial process Komando Jihad, and basing on non-doctrinal approach, it is known that the process of checking and passing judgment in the case Komandi Jihad, can not be separated from the executive power and the intervention or military, conducted through: (a) the use of military kekuatasan, which shall: (1) structural interventions, whether made directly or indirectly, (2) non-structural interventions, (b) through Intelligence Operating System, which is done through the strategy are: stocking, fishing rods and nets as well; glassware and mastered. Key word : Komando jihad, intervention, trial.

Abstract

The mosque is not only a place for congregation to pray five times a day. Mosques have social, educational and even economic functions. LP3M IAIN Ponorogo has developed mosque posdaya with the aim of empowering the community on the basis of a mosque. The principle of empowerment used is emancipatory, which is to organize the community by placing the community as the subject (subject) with the empowerment paradigm that rests on the community (community based development). The program called the mosque's Posdaya is centered at the Thoriqul Huda mosque, Dorokenong Hamlet, Tulung Village, Sampung Ponorogo District. The revitalization of the function of the Thoriqul Huda mosque is carried out by empowering the economy of congregations who are economically disadvantaged or called pre-prosperous communities. Economic empowerment activities are manifested through entrepreneurship training activities for plastic bag making and marketing. The activity is aimed at providing life skills for preprosperous families of mosque congregations. In the next stage, improving the life skills of congregations from underprivileged families must be supported by capital and network access. Mosques develop amil zakat institutions and mosque cooperatives by strengthening mosque religious management.

Abstract

Abstract: The internet offers unprecedented power to provide users with health information for patients, health professionals, and professionals. Maintaining the integrity, data systems, and confidentiality of individual health information, quality of content, and consumer protection and the commercial interests of the health industry against unethical practices, are areas of greatest concern in the implementation and use of the Internet. However, there is no national and international legislation for regulating the use of online-based health services. This research is a Literature review that aims to explore ethical and legal issues in the use of online-based health services (E-Health). The review process begins by identifying journal articles that are relevant to the research topic. This study concludes that the use of online-based health services (E-Health) is an important public health issue. E-Health emerged as a tool for developing new diagnostics and therapeutic interventions. Ethical issues related to crossing clinical practice and online communication about health services. This allows discriminatory or unethical behavior and is not following the professional code of ethics. E-Health licensing standards and regulations have not been implemented in many countries. So that health workers are required to code of ethics in the use of online-based health services (E-Health).

Abstract

This study aims to compare the teaching of the philosophy of law in Universities in Indonesia. The approach used in this article is a comparative study. The results of this study indicate that in general the teaching of legal philosophy in Indonesia is dominated by the content of the European-Western legal philosophy. This study also finds that the schools of Islamic legal philosophy comprehensively discuss aspects of ontology, epistemology, legal sources and methodologies, and legal axiology through various themes that are also studied by Western European legal philosophy without separating but placing them in certain parts. In this regard, it is necessary to add a school of Islamic legal philosophy as part of the disciplines taught by law faculties in Indonesia, especially to treat equally between the Faculty of Islamic Law and the Faculty of Western Philosophy of Law, moreover, Islamic Law is part of the Indonesian legal system.Keywords: Law, School, Teaching, University, Philosophy
