Abstract

The right to control from the state is a right that at the highest level is controlled by the state as an organization of power for all the people. This right gives the state authority as stated in Article 2 paragraph (2) of the UUPA. However, these various regulations and policies at the level of implementation do not harm the principles of the rights of the Indonesian people. The presence of the Job Creation Law which regulates land acquisition for development is considered pragmatic, more oriented towards investment and economic interests so it is considered to ignore the ideals and rights as well as the spirit of agrarian reform that favours the interests of farmers. The right of control of this state builds relations between the state and the nation, namely a kind of customary rights relationship that is raised at the highest level, namely the level that affects the entire territory of the country. The meaning of being controlled by the state contained in Article 33 of the 1945 Constitution is not explicitly formulated in its explanation. This allows the emergence of various interpretations of the meaning of this service trying to socialize land acquisition policies in the context of agrarian reform.

Abstract

Resolving environmental dispute through court litigation often ends up with failure. As a consequence, society in ccoperation with Non-Governmental Organization (NGO) and environmental organization prefer to use Alternative Dispute resolution (ADR) to reslove environmental dispute. In this regard, mediation is often chosen by the parties as it promotes a “win-win solution”. Moreover, mediation offers efficient, cheap and fast dispute resolution process. However, Indonesian law has not adequately accomodated the use of ADR in environmental dispute. As a consequence, the problem of legal certainty often come up. In order to overcome this situation, it is important to develop a mediation process that ensures the legal certainty for both of the disputants. This can be done by developing a mediation forum which is legalized by court.

Abstract

Rape can be occured in all women from all side of life, occupations, age, and marital status, which was done alone or abuzz. The perpetrators of violence also come from various circles, work, age, social class and marital status. In this case, the number of women violence against in Atambua is quite high. Sexual abuse cases and sexual harassment turned out most of the perpetrators are still related to blood with victims, such as biological father, siblings, uncle and neighbors. The cases of sexual assault against women in Atambua are resolved in customary. However, any form of resolution, the act of violence of rape against viewed from various aspects still must be responded as a criminal act, for example the custom settlement of tallitan tafani still apply penal sanction in the form of penalty as one of the effort of restoration of good name, and also dignity for the victim.

Abstract

The placement program of Indonesian migrant workers overseas is the Indonesian government’s program for the society’s welfare. One of the referential laws used in the working relations between the Indonesian migrant workers and the Arabic employers is the employment agreement. The Saudi Arabian employment agreement implements the sharia law which is influenced by the Hambali school of taught. The King’s decree No. M/51 year 2005 regulates the labor laws in Saudi Arabia, and this country’s government only accepts employment agreements written in Arabic. The solution is that the employment agreements written in two languages are prepared, with Arabic as the authoritative language. Apart from implementing the Kafala System, as a substitute of tax, Saudi Arabia also implements the Nitaqat Policy. The employment agreements in Saudi Arabia have a high risk of being misused by the agencies, as the position of the Indonesian migrant workers is under the responsibility and under the power of the agencies, who have the right to terminate or to send the workers back home if there are some problems. The employment agreements are made because of the employer’s complaints on how the migrant workers often run away, which undoubtedly causes them a high loss. The aim of the contract is so that both parties may achieve a win-win solution, and that they are both given protection. Yet, the contract also limits the participation of the host country’s delegates, as all affairs are given to the Saudi Arabian Immigration Office. The employment agreement must be owned by both parties. Yet, based on some researches established by the Embassy of the Republic of Indonesia’s safe house, it is known that almost none of the migrant workers keep an employment agreement. Another problem is that there are multiple contracts: one before departing for Saudi Arabia, and a different one after having arrived in the country. Another written agreement that is signed by the employer and the agency in Saudi Arabia doesn’t involve the domestic worker. The three contracts which are signed in Indonesia, in front of the Immigration Office, and the one-sided contract between the employer and the agency regulates the same thing, though there is a chance that in all three contracts, the wages written are different.

Abstract

Islamic law gives a high appreciation for the human equality. It happens because all humans come from one source, Allah S.W.T. Respecting of human rights is regulated in fiqih, holy Qur’an, and hadist. From the Islamic law perspective, the differentiate of human level is on their devotion. Working as a migrant worker is allowed in Islamic Law. State gives regulation for the Indonesian migrant in a constitution No 18, 2017 year. The constitution is provide to give all society to have work both of domestic and overseas with a certain period, of course they get salary. Working is a citizen’s right. The purpose of migrant is to get bigger result. Other factor which triggers the Indonesian citizen of Indonesia to change the fate is the difficulty of getting work. There are many kinds of work in this country. Various job opportunities that exist in this country but most of them have been occupied by Indonesian society. Consequently, it is being minimum opportunity for the next generation. Indonesian mindset of working abroad to be a migrant worker is a necessity. The real fact is when women work, and then they have to perform two roles, as a wife or a mother as well as a worker.  This article will discuss about the female position as a migrant viewed from the religion point of view, especially in term of Islamic law related to Indonesian female migrant workers.

Abstract

Penelitian yang bertujuan untuk mendiskripsikan dan mengeksplanasi keefektifan program yang telah dilakukan TP4D Kejaksaan Negeri Surakarta ini mendasarkan pada metode pendekatan non-doktrinal kualitatif. Oleh karena itu dalam penelitian ini lebih mengutamakan pada data primer yang dikumpulkan dengan wawancara dan observasi serta didukung data sekunder yang dikumpulkan dengan studi kepustakaan. Data yang sudah diolah untuk selanjutnya dianalisis secara kualitatif. Berdasarkan hasil penelitian ditemukan bahwa TP4D secara efektif telah mencapai tujuan terbentuknya TP4D melalui PERJA RI Nomor PER-014/A/JA/11/2016 dalam pencegahan tindak pidana korupsi. Efektivitas pelaksanaan TP4D tersebut, didukung oleh faktor sarana (fasilitas pendukung), masyarakat, dan kebudayaan Akan tetapi belum didukung oleh faktor hukum dan penegak hukum. Nilai kebaruan dari hasil penelitian ini adalah penegakan hukum dengan faktor masyarakat dan kebudayaan lebih mempengaruhi pelaksanaan TP4D.

Abstract

Konten animasi merupakan suatu video animasi yang diunggah oleh beberapa orang melalui chanel miliknya yang tersedia pada platform youtube untuk memasarkan atau mempromosikan hasil karyanya berupa video animasi. Namun semakin berkembangnya teknologi memudahkan siapa saja termasuk anak-anak untuk dapat mengakses konten animasi di youtube padahal tidak semua konten animasi di youtube sudah sesuai dengan ketentuan yang ada dalam UU Penyiaran dan UU ITE. Anak dalam hal ini adalah sebagai konsumen konten animasi pada plaftorm youtube sehingga seharusnya adanya perlindungan terhadap anak dapat dijadikan sebagai solusi untuk membatasi konten animasi youtube yang tidak sesuai dengan ketentuan yang berlaku. Dalam UU Perlindungan Anak pasal 1 angka 12 menyebutkan bahwa “Hak anak adalah bagian dari hak azasi manusia yang wajib dijamin dilindungi dan dipenuhi oleh orang tua, keluarga, masyarakat, pemerintah dan negara.” Berdasarkan hal tersebut maka perlindungan hukum terhadap konsumen anak perlu mendapat perhatian lebih karena perlindungan hukum yang diberikan saat ini masih sangat minim terhadap anak sebagai konsumen konten animasi youtube.

Abstract

This research, which aims to describe the legal protection of children as consumers of Korean films, is based on legal research with a doctrinal approach. The main data in this study is in the form of secondary data obtained through a literature study on Korean films broadcast via the Netflix platform. Based on the discussions that have been carried out, it is known that Korean films still do not provide legal protection for children as film consumers, this is evidenced by the many scenes that conflict with Article 6 of Law Number 33 of 2009 concerning Film, such as scenes containing violence, the use of narcotics, pornography and scenes that can degrade human dignity

Abstract

The study reviewed the development of the digital era in the legal field, especially The Electronic General Meeting of Shareholders (GMS), which is ruled by law. The problem formulation was how the electronic GMS, according to positive law in Indonesia, and how the impact on the notarial deed related to its implementation. The method used by the researcher was normative and library study based on the primary material (legislation), secondary material (scientific works, journals, books, documents, and other literature), and tertiary legal materials (legal dictionaries). The study results were that E-GMS is effective today, then regulated in Art 77 UUPT and PJOK Number 16/Pojk.04/2020, so that the Limited Liability Company members can carry out the GMS as usual without being physically present to break the chain of the Covid-19 pandemic. Although the e-GMS arrangements have been regulated in the legislation, the lex specialist derogat lex generalist principle cannot be ignored; article 16 paragraph (1) letter (m) and Article 18 UUJN are still prioritized so that the electronic deed of the GMS cannot be carried out or will resulting in the legal force of the proof being a private deed.

Abstract

THIS study aims to analyze the position of adopted children to the inheritance of their adoptive parents as well as to discuss how this position can be if there is a violation of law during the adoption which causes problems with the existing inheritance. The type of this research is descriptive research with a normative approach. Based on this research, the position of adopted children to the inheritance of their adoptive parents is strongly influenced by which type of law is used in the practice of adoption because Western law, Islamic law, and customary law that apply as the basis for adoption in Indonesia have different provisions. Then, if it is found that there has been a violation of law in the adoption of a child which causes problems with inheritance, the judge will identify the problem based on the facts and consider it based on the law used to adopt the adopted child so that the result decision can provide a sense of justice, benefits, as well as legal certainty or in other words an ideal decision.
