Abstract

The Baiturrohman al-Qur'an Education Park in Kramat Lamongan Village was established as a place for education to read the Koran and Islamic materials starting from kindergarten, elementary School/MI and higher education. However, the pandemic and the very strict emergency PPKM implementation policy caused face-to-face learning activities to be switched online (via WhatsApp groups). This has a significant effect on reducing student interest in learning. For this reason, through this KPM-DDR activity, researchers aim to find the best solution to increase interest in learning to read the Koran. In carrying out this community service, the ABCD approach is carried out by utilizing the potential/assets owned by the community by applying the five principles of discovery, dream, design, define  and destiny. The results showed that the combination of limited online and face-to-face methods (divided into 3 groups) succeeded in increasing student interest.

Abstract

This research aims to describe forms of unfair business competition practices that result in scarcity of 3kg LPG Gas and consumer protection, is based on legal research with a non-doctrinal approach. The data in this study are primary data collected through interviews with purposively selected informants, as well as supported secondary data collected by literature study. Based on the results of research and discussion conducted on business actors, it was found that there were business actors engaging in unfair business competition by practicing closed agreements; as well as business actors who carry out monopolistic practices, resulting in scarcity of 3 Kg LPG Gas and harming consumers.

Abstract

Protection of sexual violence is a human right guaranteed by the constitution. Non doctrinal research with qualitative descriptive. The aim is to find out and analyze the legal protection of women victims of sexual violence during the Covid 19 pandemic in the city of Surakarta according to statutory regulations. The results of the 2020 study totaled 40 cases with 26 cases of domestic violence, 6 cases of rape, 5 cases of sexual abuse, and 3 cases of dating violence. Legal protection for victims of rape sexual violence in Surakarta City began with the stages of investigation, prosecution and trial. However, the right to a new identity, reimbursement of transportation costs as needed, determining the form of protection and security support was almost never given. In addition, the government's policy of limiting the conditions of the Covid 19 pandemic has slowed down the handling of victim protection. The investigative phase is carried out face to face with health protocols, while the prosecution and examination courts and trials are conducted online by maintaining the confidentiality of the victim's identity but causing limited interaction between victims, prosecutors and judges. The right to legal protection for victims of female sexual violence during the Covid 19 pandemic has not been fully fulfilled in Surakarta City.

Abstract

The training on making online business contracts aims to help business actors in Gentan Market, Baki Sukoharjo, to make business contracts online as an effort to secure the rights and obligations of legal subjects included in business agreements. The initial process is material preparation, material presentation, agreement design, monitoring and evaluation. The community service method chosen is training. Scheduled, the activity will be held twice on Thursday 2 February 2023 and Thursday 9 February 2023. The first activity is to socialize the activity in the meeting room of the village hall of Gentan sub-district, Sukoharjo Regency. The second activity is in the Computer Lab of Duta Bangsa University Surakarta which is located on Jalan Pinang Raya Number 30 Grogol Cemani. As a result of this community service, business actors can make agreements online to secure their business.

Abstract

This paper aims to instigate the implementation of Article 68 of the Islamic Banking Act, which obliges Islamic divisions to be separated from their parent banks. This study attempted to reveal a legal solution so that the obligations can be turned into a corporate action. The argument presented by a critical review approach based on a literature review using secondary data. The solution still considers spin-offs a necessity, not a mandate. It is supposed to be considered a corporate action that its implemented based on readiness so the article needs to be amended. This paper proposes changes to the article on spin-offs for the development of Islamic Banking in Indonesia with practical benefits. Alternative changes can be completed in three ways: first, by issuing Financial Services Authority Regulation (FSAR), which makes the spin-off a corporate action. This method is unconstitutional because FSAR is structurally under the Constitution. The second alternative is done by submitting a judicial review of Article 68 to the Constitutional Court. Finally, the third is by enacting the omnibus law of Islamic economics. Those three options have both advantages and disadvantages. Thus, it is necessary to further find out which solution is most prospective for advancing Islamic banking.Artikel ini bertujuan untuk mendorong penerapan Pasal 68 Undang-Undang Perbankan Syariah yang mewajibkan divisi syariah dipisahkan dari bank induknya. Kajian ini mencoba mengungkap solusi hukum agar kewajiban tersebut dapat berubah menjadi aksi korporasi. Argumen yang disajikan menggunakan pendekatan Solusinya tetap menganggap spin off sebagai kebutuhan, bukan sebagai mandat. Hal ini seharusnya dianggap sebagai corporate action yang pelaksanaannya berdasarkan kesiapan sehingga pasal tersebut perlu diubah. Makalah ini mengusulkan perubahan pasal spin-off untuk perkembangan perbankan syariah di Indonesia dengan manfaat praktis. Alternatif perubahan bisa dilakukan dengan tiga cara, pertama dengan menerbitkan Peraturan Otoritas Jasa Keuangan (POJK) yang menjadikan spin off sebagai corporate action. Cara ini inkonstitusional karena POJK secara struktural berada di bawah konstitusi. Alternatif kedua dilakukan dengan mengajukan uji materi pasal 68 ke Mahkamah Konstitusi. Terakhir, yang ketiga adalah dengan pengundangan omnibus law ekonomi syariah. Ketiga pilihan tersebut memiliki kelebihan dan kekurangan. Untuk itu perlu dikaji lebih lanjut solusi mana yang paling prospektif untuk memajukan perbankan syariah.

Abstract

Terrorism has become a global phenomenon, affecting not only those hurt or killed by acts of terrorism but also involving women as significant contributors to indoctrination worldwide, including in Indonesia and Uzbekistan. This research aims to explain the evolving roles of women in terrorism in Indonesia and Uzbekistan and how terrorists use cyber indoctrination to target women in these countries. The research was conducted in Indonesia and Uzbekistan using the classical-normative dogmatic juridical method with a library-based approach. Cyber indoctrination has proven highly effective in persuading women to join and take initiative in acts of terror. Women who become involved in terrorism due to exposure to pseudo-religious ideologies through cyber indoctrination have human rights and should be legally protected as victims of cyber indoctrination by terror groups. This article contributes to the recognition of women's rights as victims of cyber indoctrination and sheds light on the changing role of women in terrorism. It aims to raise awareness among society, governments, law enforcement agencies, and religious leaders about the strategies of pseudo-religious cyber indoctrination employed by terrorists. It encourages them to take preventive and repressive actions to combat terrorism and safeguard women from its allure.

Abstract

Berangkat dari permasalahan perlu adanya perhatian serius dari pemerintah terkait jaminan perlindungan tenaga kerja Indonesia di luar negeri melalui penegakan hukum sehingga dapat menepis anggapan bahwa hukum dimanfaatkan oleh oknum tidak bertanggungjawab untuk membuat pola aktivitas perbudakan modern akibat lemahnya penegakan hukum. Pengabdian kepada masayarakat ini bertujuan untuk: 1). Mendeskripsikan perlindungan hukum pekerja migran Indonesia saat ini; dan 2). Mendeskripsikan upaya penyelesaian problem yang menimpa para pekerja migran Indonesia di luar negeri. Hasil pengabdian kepada masyarakat dengan mitra Pimpinan Cabang Istimewa ‘Aisyiyah Hong Kong menunjukan bahwa terdapat permasalahan hukum yang hingga saat ini tengah dihadapi oleh masyarakat antara lain permasalahan belum optimalnya penyelesaian konflik yang dialami oleh pekerja migran Indonesia di luar negeri. Sebagai upaya membantu masyarakat untuk menghadapi persoalan hukum tersebut, maka diselenggarakan pengabdian kepada Masyarakat yang dilakukan secara langsung sebagai wadah untuk menyiapkan pekerja migran Indonesia yang memiliki kesadaran diri dan kepedulian kepada isu-isu hukum dan keadilan sosial. Melalui Pengabdian hukum ini, para Pekerja Migran Indoensia menjadi paham terkait hak-hak dan metode penyelesaian hukumjika terjadi konflik.   Abstract Counseling on Problems and Legal Protection of Indonesian Migrant Workers in Hong Kong. Starting from the problem, there needs to be serious attention from the government regarding guaranteeing the protection of Indonesian workers abroad through law enforcement so that it can dispel the notion that the law is being used by unbalanced individuals to create a modern pattern of freezing activities due to weak law enforcement. This community service aims to: 1). Describe the current legal protection of Indonesian migrant workers; and 2). Describe efforts to resolve problems affecting Indonesian migrant workers abroad. The results of community service with partners from the Special Branch Leader of 'Aisyiyah Hong Kong show that there are legal problems that are currently being faced by the community, among other problems that have not yet optimally resolved the conflicts experienced by Indonesian migrant workers abroad. As an effort to help the community face these legal problems, community service is carried out directly as a forum for preparing Indonesian migrant workers who have self-awareness and concern for legal and social justice issues. Through this legal service, Indonesian migrant workers become aware of their rights and methods of legal resolution if a conflict occurs.

Abstract

A husband is obliged to take care of his family, including his wife and children. when they divorce, he doesn’t have to support his wife anymore, but he still has to support their children. With the compilation of Islamic Law, statute no 1 of 1974 and circular letter of Supreme Court, Courts decide how much the father needs to pay for child support after a divorce through judge’s consideration. But sometime, fathers don’t follow this decision.  In Indonesia, a 2021 circular letter from the Supreme Court allows the court to take the husband's property to ensure the children get the support they need after the divorce. This research aims to determine the concept of confiscation of husband's property as a guarantee for child support after divorce from a maqāṣid al-sharī'ah perspective.  The method used in this research is a normative juridical method which is descriptive. Data was collected through in-depth interviews and religious court studies. The research results show that the concept of including the ex-husband's assets as collateral for post-divorce child support is included in the execution submitted to the Religious Court for the father's husband's negligence in implementing the provisions regarding child consent in the divorce decision. This process can be submitted by the ex-wife or child's mother or child's guardian to the Religious Court. The concept of confiscating the husband's property as a guarantee for children's support after divorce can provide benefits for children in the form of hifdz nafs (protecting themselves) and hifdz aql(protecting reason), as well as benefits for fathers in the form of hifdz nafs (protecting offspring) and hifdz maal(protecting assets).

Abstract

Artificial Intelligence is categorized into the domain of computer science focused on creating intelligent machines that function like humans. Artificial Intelligence supports institutions including Islamic Financial Services in learning, making decisions, and providing useful predictive analytics. The progress and promise that artificial intelligence has made and presented in finance have so far been remarkable, allowing for cheaper, faster, closer, more accessible, more lucrative, and more efficient finance especially during the pandemic Covid-19 when people are required to stay at home yet still doing a banking transaction. Despite the incredible progress and promise made possible by advances in financial artificial intelligence, it nevertheless presents some serious perils and limitations. Three categories of risks and limitations involve the rise of virtual threats and cyber conflicts in the financial system, society's behavioral changes, and legal amendments that cannot respond to technological developments, especially in developing countries. The main objective of this article is to evaluate the operations of the potential risks that may arise in the use of Artificial Intelligence in Islamic finance services, especially dealing with the legal arrangement that is supposed to be in line with business development. Indonesia is a country that adheres to civil law system, in which every legal arrangement is supposed to be based on written law. The lack of this legal system is where the speed of legal changes cannot keep up with the pace of technological development, which is present as a hinder to the development of Artificial Intelligence in the financial system. This article concludes that Artificial Intelligence will have a huge impact in the future on the Islamic Finance industry, but in the Indonesian context, it still needs various efforts to reduce the potential risk that eventually has a big impact on the progress of Islamic banks.

Abstract

The Indonesian Islamic nomocracy paradigm has a long history and a cultural relationship with the national struggle that coincides with political and religious orientations. The Islamic nomocracy is inseparable from the relationship between Islam and the state rather than being linked to Islamic doctrine and power. This research employed the normative sociological method. It used a philosophical approach from Barbour’s paradigm of the relationship between religion and science and Habermas’ thought on religion in public spaces. This research strives to analyze the Islamic nomocratic paradigm pattern prior to Indonesian independence as a crucial stage that influences the following eras, namely the post-independence era, the Old Order Era, the New Order Era, and the Post-Reformation era up to now. This research aims to find the basics and the development of the Islamic nomocracy in the Indonesian legal system. The roots of the Islamic nomocracy legal thought in Indonesia can be traced to the pre-independence era. In the development of Islamic kingdoms, there was a dialog and integration process between the Islamic nomocracy and the kingdom government. After the War of Java, the conflict and independence pattern was formed. Before Indonesian independence, the Islamic nomocracy thought developed into Pan Islamism which tended to be conical to legal formalization through the caliphate system. After Indonesia’s independence, some of the Islamic nomocracy legal thought recognized the state as one of the legal systems in Indonesia besides customary law and positive law. Then, Indonesia became a partly-Islamic Legal State with a constant up-and-down relationship with the state. The authors also completed this paper with perspectives of Spain and Russia as both have been ruled under Muslim governance.
